If the replacement has already put in their scheduled shift, the replacement would be entit1ed to time and one-half (l Yz ). The Superintendent will have the final say in how many hours a replacement will be needed over their regular work shift. For the purpose of regular rotation, but for such purpose only, work shall be equally distributed among qualified employees. If prior to or during the exchange period, a problem develops, it is still the responsibility of the original scheduled employee to cover this period. Working weekends and holidays will be on a rotating basis for the Treatment Facility. An employee who is required to work in an emergency in excess of sixteen (16) hours shall be allowed eight (8) hours off for a rest period. If any of the above eight (8) hours of rest period falls within an employee s regular work day, he/she shall be paid for all hours in which it occurs. Overtime: Overtime work shall be equally distributed among qualified employees on the basis of seniority in job classifications covered by this Agreement. A list of eligible employees shall be posted and maintained in current status. For the purpose of regular rotation of overtime work but for such purpose only, overtime work refused shall be considered as overtime worked.. The Union representative shall have access to pertinent records to distribution of overtime and holiday work. Overtime records shall be available for review every thirty (30) days. Time and one-half the regular rate shall be paid for all unscheduled work, performed in excess of forty (40) hours in any week or eight (8) hours in a day. An employee shall also be paid double time the regular rate of pay for work performed on Sunday. CompensatorY Time: Superintendent/Clerk/Treasurer to receive compensatory time at time and one-half for hours worked over regular schedule, due to circumstances not allowing hours to be worked during the normal workweek. Maximum accrual of compensatory time is forty (40) hours. Coffee Break: All employees work schedule shall provide for a fifteen (15) minute coffee break in the a.m. and fifteen(15) minute coffee break in the p.m. ARTICLE XV HOLIDAYS Regular full-time and part-time employees who are not on authorized leave of absence, will be eligible for one (1) days pay for the following holidays: New Year's Day Martin Luther King Day Washington's Birthday Patriot's Day Memorial Day Independence Day Labor Day Columbus Day Veteran s Day Thanksgiving Day Day after Thanksgiving Christmas Day 6/16/11 8

2 Christmas Eve and New Year's Eve shall be a one-half (~) day of work. An employee who has to stay to maintain the efficient operation of the Treatment Facility or for an emergency, will be entitled to the time off at another date and time. The Superintendent must approve the requested, time off. The above-recognized holidays shall be holidays with pay when they occur from Monday through Friday, provided that any such holiday that occurs on Saturday or Sunday will be observed on the previous Friday or the following Monday respectively and shall be a holiday with pay. Holiday Callback: Employees will receive double time for hours worked. ARTICLE XVI LEAVE OF ABSENCE Attendance at Union Conventions: Any employee elected a delegate to a Union Convention may be given a reasonable time and leave of absence with pay. Maternity Leave: Full-time, female employees are eligible for an unpaid maternity leave upon completion of their introductory period. Eligible employees will be granted an unpaid leave of absence of at least eight (8) weeks for giving birth or adopting a child. The taking of such a leave will not affect their right to receive vacation time, sick leave, bonuses, advancement, seniority, benefits or other advantages incident to their employment. They must provide two (2) weeks notice that they intend to return to their job. Upon termination of such leave, they are entitled to return to their previous or similar position, unless other employees of equal seniority and status in the same or similar position have been laid off due to economic conditions or other changes in the operating conditions affecting employment during the period of such leave. Military Leave: Employees who are required to serve in any branch of the Armed Forces of the United States will be given the necessary time off. Full-time employees will be paid the difference between their normal rate of pay and their military pay for a duration of sixteen (16) days. Bereavement Leave: Bereavement leave without loss of pay during the regular work week excluding Saturday and Sunday shall be granted for death in the immediate family up to three (3) consecutive days: Mother-in-Law Daughter-in-Law Brother-in-Law Grandparents Father-in-Law Son-in-Law Sister-in-Law 6/16/1 J 9

3 and, up to five (5) consecutive Father Mother Sister Brother Child Spouse Stepparents Grandchildren Significant other days: Stepchildren Long time live in companion and, one (1) day (Funeral Day): Aunt Niece Cousin Uncle Nephew Vacations: The vacation year shall be the period July first (1st) to June thirtieth (30th), inclusive. Employees may carry over fifteen (15) days maximum of vacation leave to the following year. Employees shall accrue vacation with pay and it shall be granted according to the following schedule: Length of continuous service Six (6) months to One (1) year One (1) year to Four (4) years Five (5) years to Nine (9) years Ten (10) years to fourteen (14) years Fifteen (15) to twenty (20) years or more Vacation Five (5) days Ten (10) days Fifteen (15) days Twenty (20) days Twenty-five (25) days An employee has the option of being compensated for vacation days. Helshe shall be compensated by the end of the fiscal year. For the purpose of scheduling and for this purpose only, Treatment Operators and Distribution/Supply shall submit vacation days preferably one (1) month in advance, no later than two (2) weeks in advance. Request for vacations shall be submitted in writing and the response approval or denial of the request will be presented in writing within five (5) working days after receipt of the request. Distribution/Supply shall not be called in on sick, personal or vacation days. In the event of the death of an employee, the District agrees to pay one hundred percent (100%) buyback to the spouse or the estate. When employment is terminated, the employee shall be paid for the portion of vacation allowance earned in the vacation year and any carried over vacation time during which the termination occurred, up to the time of the employee s separation date. This would not apply to anyone during their probation period or if the termination is due to gross misconduct of the employee. 6116/11 10

4 Sick Leave: Sick Leave shall consist of one and one-half (1 Y2) days per month, not to exceed eighteen (18) days per year, accumulative to two hundred (200) days. A retiring employee shall be entitled to buyback of all unused accumulated sick days or in the case of death of an employee, the estate or executor of the will, wili receive the buyback. Employees will be entitled to buyback of accumulated sick days with the exception that the employee resigns (unless the resignation is found to be caused by an unhealthy, unsafe, harassing work environment or unless an employee is resigning because they have been offered better employment). In the case of termination of an employees employment for just cause, the employee would not be entitled to buyback of any unused accumulated sick days. Should an employee resign due to illness, the employee would be entitled to buyback of accumulated sick days. An employee who plans to retire shall provide, except in unusual circumstances, at least 6 months notice prior to the effective date of his or her retirement. Upon receipt of such notice the District will be allowed a time between 6 and 12 months in which to payout the accrued sick leave that would be due to the employee upon retirement. Said payout would be completed within 6-12 months after the effective date of retirement. Employees shall be credited with sick leave after serving their probation period, retroactive to the first day of actual full-time employment. Employees using sick time during their probation period may be compensated for that time at the discretion of the board. A bonus will be paid after the employee has accumulated not less than one hundred twenty (120) sick days. Employees will receive the bonus the first week of July based on their sick leave record of the previous year. The bonus shall be as follows: Sick Leave Bonus: absent 0 days from July thru June absent 1 day from July thru June absent 2 days from July thru June absent 3 days from July thru June absent 4 days from July thru June absent more than 4 days $ $ $ $ $ $ 0.00 A doctor's certificate may be requested if sick days are abused by the employee. A doctor s certificate will be required for absences of more than three (3) consecutive days. Note should include when the condition began and an estimate of how long the condition should last. In the event of the death of an employee, the District agrees to pay buyback to spouse or estate. The District agrees to pay an employee the net difference between workman s compensation payments and their regular weekly pay which shall be charged to accumulated sick leave for any employee injured on the job. An employee is entitled at the rate of one hundred percent (100%) buyback of accumulated sick time in excess of two hundred (200) days. Payment will be made to the employee at the end of the fiscal year

5 Compensation time: The District will pay the employees entitled to compensation time for all accumulated compensation time prior to the end of the fiscal year Therefore, effective July 1,2011 all employees will have a "clean slate" with no accumulated comp time. From July 1, 2011 forward compensation time shall be taken by the eligible employee within 60 days of the date of its accrual and in no case will compensation time accumulate to more than 20 hours. Because of the unusual circumstances that could effect compensation time between May and June of each fiscal year, the parties agree that to pay up to 20 hours of accrued compensation time at the end of the fiscal year. Anything over 20 hours that has not been used by the end of the fiscal year shall be forfeited. Quarterly reports shall be given to the Board of Water Commissioners as to the status of compensation time for each employee who is eligible for compensation time. In addition, all compensation time will be listed on the weekly time sheets submitted. Inclement weather. In the case of inclement weather which could result in the closing of operations, the Board of Water Commissioners or its designee (the Superintendent), will make a decision as to when only "essential people" will be required to work. Whenever the office closed for such reasons the employees involved will not lose pay for the work time that is cancelled because of inclement weather. ARTICLE XVII JURY DUTY Employees who are summoned for jury duty and are regularly employed will receive their regular wages for the first three (3) days. Thereafter, full-time employees who are summoned for jury duty will be paid the difference between their normal rate of pay and monies received by the court for said duty. An employee must provide the District with a copy of the payment records from the court in order to be compensated. The employee should make arrangements with his/her supervisor as soon as the summons is received. In fairness to the District, the employee is expected to return to work if excused from jury duty during regular working hours. ARTICLE PERSONAL XVIII DAYS Employee is entitled to six (6) days personal leave. ARTICLE XIX INSURANCE Employer contribution of current health care plan to continue for the life of the Agreement. The Administration will contact any committees addressing the group insurance plans and request that a member of this bargaining unit be invited to attend

6 ARTICLE XX MISCELLANEOUS Licenses: The District shall pay for any job required licenses renewals, with the exception of a driver's license. The District shall pay for all necessary Tuition and/or Books to maintain required licenses. Clothing allowance shall be $ per year. The Board of Water Commissioners shall provide to the union a standard for the clothing to be worn and require that all clothing have a stenciled ID of the Dighton Water District. This applies to Group A and Group B employees. The District will reimburse an employee 100% ofthe cost of tuition for any job required licenses if passed by the employee. The District will not pay for any failed exams. Employees must pay for the exam upfront. l'~probationary employee will not be reimbursed until they have served six (6) months of employment and are hired as a permanent full time employee. This shall not apply to courses mandated as part of the job requirements when the employee was hired. No employee shall be forced to take further education classes unless when hired, there was a licensing requirement mandated in the advertisement or job application. Licensed Operators Incentive: ID $ IT $ IC $ D $ T $ C $ D $ T $ C $ D $ T $ C $ Payment shall be made in a lump sum for one (1) grade only at the end of the fiscal year. Payment will be based on the highest grade which is in effect at the time of payment. Possession of both Distribution and Treatment licenses of the same grade shall constitute combined status. GIl

7 ARTICLE SUCCESSOR XXI CLAUSE This Agreement shall be binding upon the successors and assigns of the parties hereto and no provisions, terms or obligations herein contained shall be affected, modified, altered, or changed in any respect whatsoever by the takeover, assumption or contracting out of any plant, operation, function, or part thereof. It is agreed that a successor employer shall continue the employment of present employees who seek such employment. However, the Union shall have the right to renegotiate this Agreement or portions thereof with any successor or assign, and the Union shall also have the right to terminate the Agreement with the successor upon written notice to said successor or assign. ARTICLE XXII DURATION This Agreement shall be in effect from July 1,2010, to June 30, This Agreement may be extended or modified by written notice and mutual consent of both parties giving one hundred eighty (180) days notice prior to the expiration date of this Agreement. ARTICLE XXIII EFFECT OF AGREEMENT The District has bargained collectively with the Union and set forth the agreements reached in this Agreement with respect to wages, hours and all other conditions of employment for all of the employees in the bargaining unit set forth herein. Prior to the execution of this Agreement, each of the parties made proposals or had the opportunity to make proposals concerning every subject which is legally the subject of collective bargaining. The discussions which ensued resulted in certain agreements, all of which are incorporated in writing in their entirety in this Agreement. There are no other agreements between the parties, verbal or written, express or implied. It is further agreed that this Agreement may not and shall not be added to, subtracted from, altered, amended or modified in any respect except by a document in writing signed on behalf of the parties hereto by their duly authorized officers and representatives. No provisions of this Agreement shall be retroactive prior to the effective date unless otherwise specifically stated herein. Where this Agreement requires the appropriation of funds on the part of the Employer to effect carrying out of any provision hereof, this Agreement is subject to such action as may be taken at a District meeting pertaining to the required appropriation or appropriations. 6/
