1 Question 1 The maximum amount of disposable income (where not over the capital limit): Question 2 For a HC2 = an amount equivalent to the person/s personal allowance plus any applicable premiums and eligible housing costs plus 50% of a prescription charge. For a HC3 = There is not actually an upper limit of disposable for a HC3 certificate, however we would not send a certificate if the disposable income was in excess of unless specifically requested to do so. Please note that eligible housing costs may be reduced due to non dependants and amenities. The following list is not exhaustive. (1) Any payment from (and certain payments derived from) the following: (b) Macfarlane Trust; Macfarlane (Special Payments) Trust; Macfarlane (Special Payments) (No.2) Trust; (d) ILF; (e) (f) (g) (h) The Fund ; The Eileen Trust; Skipton Fund; Caxton Foundation. (2) Any payment for a reduction of Council Tax; (3) Any payment under the Personal Reader Service administered by the Royal National Institute for the Blind on behalf of the Employment Services; (4) Attendance Allowance (AA) (including Constant Attendance Allowance (CAA) paid as an addition to Industrial Injuries Disablement Benefit or War Disablement Benefit (WDP));

2 (5) Certain payments due before the date of claim (e.g. an occupational pension due but not paid because the trustees of the scheme have suspended or ceased payment due to insufficient funds, or unpaid CSA maintenance payments); (6) Christmas Bonus; (7) Compensation for the loss of entitlement to Housing Allowance (HA) (8) Direct Payments to the claimant from a Local Authority in lieu of community care payments or health care. The payments enable these people to purchase the help they need, rather than this be provided directly by the Authorities. This includes any payment from: a Local Authority made under: (i) section 17, 23B, 23C or 24A of the Childrens Act 1989; (ii) section 21(1) of the Child Care Act 1980; (iii) section 12 of the Social Work (Scotland) Act 1968 or sections 22, 29 or 30 of the Children (Scotland) Act 1995; (iv) section 23B(8) of the Children (Leaving Care) Act 2000; (v) section 2(6)(b), 3 or 4 of the Adoption and Children Act (b) a Care Authority made under regulation 9 of the Boarding Out and Fostering of Children (Scotland) Regulations 1985 or under Section 13 of the Children (Scotland) Act 1995; a Local Authority or the Welsh Assembly to a claimant, relating to a service which is provided to develop or sustain the capacity of the claimant to live independently in his accommodation; (9) Concessionary payments made by the Secretary of State in place of AA or DLA; (10) Council Tax Reduction; (11) Dependant s or non-dependant s contribution to accommodation and living costs; (12) Disability Living Allowance (DLA - Both Care and Mobility components); (13) 16 to 19 Bursary Fund payment - a discretionary payment made to people continuing secondary education beyond the upper age limit of compulsory schools; (14) Exceptionally Severe Disablement Allowance (ESDA);

3 (15) Foreign currency, cost of conversion (any banking charge or commission payable in converting to sterling any payment of income made in another currency); (16) A gallantry award (e.g. a Victoria Cross Annuity, a George Cross Annuity or any similar annuities); (17) Housing Allowance or Local Housing Allowance; (18) Income frozen abroad (income payable in a country outside the UK, but is prohibited from being transferred to the UK); (19) Income in kind (e.g. food vouchers); (20) Jurors or witnesses court attendance allowance (any payment to a juror or court witness, other than compensation for loss of earnings or benefits); (21) Mobility Component / Supplement paid as part of a War Disability Pension (WDP) or Armed Forces Compensation Scheme; (22) Payments to a claimant by a Health Authority, Health Board, Local Authority or other organisation for a person who is not normally a member of the claimant s household but is temporarily in the claimant s care; (23) Personal Independence Payment; (24) Community Care Grant payments made under Income Support legislation (note that the disregard does not apply to payments made from the European Social Fund); (25) Supporting People Payments (a special housing-related benefit); (26) Training Premiums; (27) Travel allowances and reimbursed travelling expenses of a claimant on a training scheme; (28) Vouchers (child care cheques, luncheon vouchers, department store gift vouchers); (29) Any Special War Widow's Allowance / Pension granted where the partner's death occurred following injury or illness as a result of service which ended before 31 March The special payment is a weekly sum paid in addition to War Widows Pension (WWP) (current rate is noted on the CAM Desk Aid). [NB: The War Widows Pension will include the special payment if the amount exceeds 100 per week]; (30) Welfare foods, NHS supplies, travelling expenses and APVU payments / refunds;

4 (31) Most forms of income from capital (e.g. interest payments); (32) Regular voluntary payments paid to nonstudents. (b) Regular charitable payments. Regular payments as a consequence of a personal injury. (d) Regular payments, or regular payments derived from a trust fund, in consequence of a personal injury to the claimant or partner. (e) Compensation payments for death of one or both parents (where claimant is under 18). (33) Guardians Allowance. (34) Income paid to or in respect of a dependant child or young person, including: Child Benefit; (b) Child Tax Credit ; (d) Maintenance in respect of a child or CSA payments; Adoption or Custodianship Allowance; (e) Dependants Allowances in student loans and grants in respect of dependant children; (f) Childcare costs from tax credits; (35) Pension Credit Savings Credit; (36) Any payment from the London Bombings Relief Charitable Fund (37) Work Based Learning for Adult payments (38) Payments made for after-care under section 117 of the Mental Health Act. (39) Any local welfare provision. (40) Armed forces independence payment. Question 3 There are no maximum housing costs. Rent, mortgage/endowment premiums (where linked to a mortgage), council tax and allowable service charges are taken into consideration. Where applicable, deductions may be made for amenities and nondependants.
