1 Global Resource Center (GRC) Team Member Paid Time Off Policy Effective 05/01/2015 Paid Time Off Paid Time Off (PTO) is a program covering vacation, holidays and personal days. Vacation accrual for GRC Team Members is based on length of service and position (level); Holidays are fixed; and Personal days are based on length of service only. Vacation All regular, full- and part-time GRC Team Members are eligible to accrue vacation benefits as outlined in this policy. This policy and vacation accrual schedule applies to all GRC Team Members from May 1, 2015 forward. PTO Year: The PTO Year is the time period during which a team member receives Vacation and Personal days and runs concurrent with the Company s fiscal year. The Company s fiscal year calendar is posted on the Finance page of Company s intranet and generally runs from around February 1 through January 31. Please review the Company s fiscal year calendar annually to ensure you are following the correct fiscal year, as it may vary from year to year. (GRC hourly team members will continue to follow the February 1 to January 31 st Vacation Year.) (2) Team Members hired during a PTO Year are eligible for a pro-rated number of days during their first PTO Year based on the schedule outlined in TABLE I. (3) A day equals 8 hours based on a standard full-time 5-day work week. If your schedule differs, Vacation time will be prorated accordingly. Your anniversary is determined based on your Time Off Service Date which is your original date of hire, or the last rehire date following a break in service greater than 90 days. Vacation must be taken in the year in which it is accrued and may not be carried over to a subsequent PTO Year. Therefore, any time not used by the end of the PTO Year will be forfeited. (Excludes GRC hourly team members. GRC hourly team members may carryover up to a combined total of 5 Vacation and/or Personal days to the next Vacation Year. All carryover must be used by July 31 st of the following Vacation Year or it will be forfeited.) NOTE: You will receive your full Vacation accrual at the start of each PTO Year and you may use your full PTO Year allotment at any time during the PTO Year, subject to your manager s approval, and provided you have at least 90 days service. 1
2 Vacation Splash Days: In addition to the days you accrue in accordance with the above Vacation Accrual Schedule, you will be eligible for 5 additional vacation days if full-time, or a prorated amount based on your standard work week schedule if part-time, during the Vacation Year in which you celebrate your 15 th and every 5 th anniversary thereafter, based on your Time Off Service Date. This means that during each of these anniversary years, you would be eligible to accrue up to 25 days (5 weeks) vacation if full-time or a prorated amount if part-time. Max. Vacation Days accrued for In which you celebrate the following anniversary the PTO Year (4) 25 days (5 weeks) 15 th 20 th 25 th 30 th Every 5 th Anniversary (4) A day equals 8 hours based on a standard full-time 5-day work week. If your schedule differs, Vacation Splash Days will be prorated accordingly. If you are Hired during a PTO Year: Your accrual of vacation days will be prorated for the number of months you are active during the PTO Year. Table I outlines your vacation accrual based on your month of hire. You must complete 90 days of service before vacation days can be used. 3 Holidays and Personal Days Holidays Regular management GRC Team Members are eligible to receive holiday pay for regularly scheduled hours on days when the GRC is closed. A separate holiday schedule will be produced annually confirming the days on which the GRC will be closed. PT Team Members are eligible for holiday pay if the holiday falls on a regularly scheduled work day. Temporary Team Members are not eligible for holiday pay. In order for a Team Member to receive holiday pay, the Team Member must work the last scheduled day before the holiday and the first scheduled day after the holiday, unless it is pre-approved time off. Early Closings (Holidays) On occasion, the holiday schedule may include certain days, usually preceding a holiday, on which the office may close early an early closing holiday. Should a Team Member request and be granted the opportunity to take the entire day off, such time off will be recorded as a full PTO day (vacation or personal day). Personal Days The number of Personal Days a GRC Team Member is eligible for depends on their length of service, and is available to be taken during a PTO Year, provided you ve completed 90 days of service: (1) (2) Personal Beginning with the PTO Year in which you (1) 2 (2) are hired 3 Celebrate your 2 nd anniversary 4 Celebrate your 4 th anniversary A day equals 8 hours based on a standard full-time 5-day work week. All carryover must be used by July 31 st of the following Vacation Year or it will be forfeited.) PTO Provisions Promotions during a PTO Year: If you are promoted during a PTO Year and your new level provides a higher number of maximum accrual of vacation days per vacation year, you will be eligible to receive a prorated number of the additional vacation days based on the following schedule: 3
4 Month of Promotion Additional Vacation Days February or March 5 April or May 4 June or July 3 August or September 2 October or November 1 December or January 0 The additional vacation days are added to your pre-promotion current PTO Year accruals for use during the PTO Year. At the start of the next PTO Year, you will accrue vacation based on the Vacation Accrual Schedule for your respective position and years of service. Demotions during a PTO Year: If you are demoted during a PTO Year, you will retain your current PTO Year accrual level for the balance of that year only. At the start of the next PTO Year, you will accrue vacation days in accordance with the Vacation Accrual Schedule for your new position and years of service. Unpaid Vacation Time GRC Team Members may take up to one week of unpaid vacation (consecutive days only) during the PTO Year, with supervisor approval. See the separate GRC Unpaid Vacation Time Policy for additional information. PTO accrual while on Leave: PTO accrual continues while you are on a paid leave of absence, or on an approved FMLA leave. Your PTO accrual level will be prorated for any complete month in which you were on any other unpaid leave, except as may be required by law. PTO for Part-Time Team Members: Part Time (PT) Team Members are eligible for equivalent Vacation and Personal time based on their typical work week schedule. Pay in Lieu of Paid Time Off: Toys R Us will not pay Team Members for unused accrued PTO days. If You Terminate Employment: Toys R Us does not payout unused accrued PTO time (vacation, holiday or personal days) for GRC Team Members covered under this policy upon termination of employment. 4
5 Frequently Asked Questions I was hired on June 8, 2016 and Level 15, what is my vacation eligibility for the 2016 PTO Year, and when can I take it? Provided you remain employed through the end of the 2016 PTO Year, you will complete 7 full calendar months service during the 2016 PTO Year. Pursuant to TABLE I, you will be eligible to accrue up to 7 vacation days during the 2016 PTO Year. As a new hire, you must have at least 90 days service before you are eligible to take vacation. You would be eligible to take up to the full 7 days beginning September 5, I am a Level 14 Team Member and was hired May 19, I ll celebrate my 5 th anniversary on May 19, How much vacation will I be eligible for during the 2016 PTO Year? You are eligible to accrue up to 15 days during the PTO Year in which you celebrate your 5 th anniversary. That means you will have up to 15 days for the 2016 PTO Year. I wasn t able to use all my vacation during the PTO Year. Do I lose this time? This policy does not permit the carry-over of unused vacation and/or personal days from one PTO Year to the next. Any time not used by the end of a PTO Year will be forfeited. PTO days (vacation and personal days) are given to help you rest, relax and recharge away from the work environment. You are encouraged to take all your available time during the PTO Year so that you don t lose the time. If I am a Level 18 Team Member with 5 years of service and leave (terminate employment) Toys R Us how much vacation will I be entitled to get paid? Toys R Us does not payout unused PTO (vacation, holiday or personal) days upon separation from service for GRC Management Team Members covered under this policy, except where required by state law. Please refer to the Payment of Paid Time Off - GRC PTO Policy chart for state specific termination pay information. As a Level 15 Team Member with 3 years of service I am eligible to accrue to up to 10 days vacation. If I receive a promotion to a Level 16 Team Member in April, what is my vacation accrual level for that year? Based on this example, you would be eligible to accrue up to 14 days vacation during the current PTO Year. Here s why: As a Level 16, you will be eligible to accrue up to 15 days for a full PTO Year. Since your promotion occurred in April, you are eligible for a prorated amount of the additional 5 days. Based on your month of promotion (April), you would be eligible to accrue up to an additional 4 days vacation in addition to the 10 days you are already accruing as of the start of the current PTO Year. Beginning with the next PTO Year, you would be eligible to accrue up to the full 15 days. I will celebrate my 20 th anniversary with Toys R Us this year (during the 2016 PTO Year), how much vacation time will I have? First, Congratulations on achieving this career milestone. In recognition of this service dedication, Toys R Us will provide you up to an additional 5 vacation days for you to take during the PTO Year in which this anniversary (or your 15 th, 25 th, 30 th, 35 th, etc.) occurs. That means during the 2016 PTO Year you will be eligible to accrue and use up to 25 vacation days. GRC Paid Time Off Policy Revised 02/01/2016 Page 5
6 How do I determine how much Vacation and Personal time I am eligible for as a Part Time team member? As a Part Time (PT) Team Member, you re eligible to receive a prorated Vacation and Personal time allotment based on your typical work week schedule. For example, to calculate vacation time, if a Level 17 PT Team Member is scheduled to work 60% of a full-time (FT) schedule (i.e., 3 days per week), he/she would be eligible to accrue up to 6 days vacation (6 days x 8 hrs/day = 48 hours) during the first full PTO Year (10 days x 60% = 6 days). This same rule applies to a reduced-hour work schedule. Example: a Level 15 team member with 3 years of service working 4 hours/day, 5 days/week would be eligible to accrue 10 days at 4 hours/day, or a total of 40 hours. For personal time, if a PT Team Member with 5 years of service is scheduled to work 60% of a full-time (FT) schedule (i.e., 3 days per week), he/she would be eligible to accrue up to 2.4 personal days (4 days x 60% = 2.4 days), or 19.2 hours (2.4 days x 8 hrs/day = 19.2 hours) during the first full PTO Year. This same rule applies to a reduced-hour work schedule. Example: a team member with 3 years of service working 4 hours/day, 5 days/week would be eligible to accrue 3 days at 4 hours/day, or a total of 12 hours.
