DESCRIPTION - Types of Delivery - Tank Wagon and Truck Transport - A supplier awarded per county for each type of delivery. Some counties not covered. - Purpose is to fill customer owned storage tanks. Minimum deliver of 200 gal for tank wagon and 4000 gal for truck transport. - Fuel specification is latest issue of ASTM D Base price is for 87 octane; 10 cent add-on for 89 octane and 15 cent addon for 91 octane. PROCESS TO PURCHASE - View contract on COSTARS website. - Locate supplier and their bid differential price for your County based upon the quantity you want (tank wagon or truck transport). - Locate latest OPIS price via the latest change notice. - Add the differential and OPIS prices for total price. In some instances, suppliers may not have the capacity to accept several new accounts. The supplier should be contacted prior to placing your order. When ordering, include your COSTARS member number so DGS can track all spend data to get the best prices for all.
2 Department of General Services GSPUR-13B Rev. 2/20/01 SPECIAL CONTRACT TERMS AND CONDITIONS CONTRACT SCOPE/OVERVIEW: This Contract will cover the requirements of the Commonwealth of Pennsylvania for unleaded gasoline (87, 89, 91 Octanes) in the listed counties. ORDER OF PRECEDENCE: These Special Contract Terms and Conditions supplement the Standard Contract Terms and Conditions For Statewide Contracts for Supplies. To the extent that these Special Contract Terms and Conditions conflict with the Standard Contract Terms and Conditions For Statewide Contracts for Supplies, these Special Contract Terms and Conditions shall prevail. TERM OF CONTRACT: The Contract shall commence on the Effective Date no earlier than October 1, 2004 and expire on September 30, OPTION TO EXTEND: The Department of General Services reserves the right, upon notice to the Contractor, to extend the Contract or any part of the Contract for up to three (3) months upon the same terms and conditions. This will be utilized to prevent a lapse in Contract coverage and only for the time necessary, up to three (3) months, to enter into a new contract. OPTION FOR SEPARATE COMPETITIVE BIDDING PROCEDURE: The Department of General Services reserves the right to purchase supplies covered under this Contract through a separate competitive bidding procedure, whenever the department deems it to be in the best interest of the Commonwealth. The right will generally be exercised only when a specific need for a large quantity of the supply exists or the price offered is significantly lower than the Contract price. SPECIFICATIONS: Unleaded gasoline in accordance with ASTM D4814 (Latest Issue); The gasoline shall have an Antiknock Index of 87 adjusted for season and locality in accordance with recommendations in ASTM D4814. Antiknock Index of 89 applies to the Mid-Grade; Antiknock Index of 91 applies to the Premium. In addition, fuel shall contain an effective Port Fuel Injector Detergent-Dispersant Package and at the concentration being supplied, shall, MAINTAIN volume flow of fuel through fuel injectors. Contractor shall certify that each delivery contains the MAINTAIN level of detergent-dispersant additive. This certification shall accompany each delivery. The purchase of Mid-Grade Unleaded Gasoline (89 Octane) and Premium Unleaded Gasoline (91 Octane) is allowed from this contract. The pricing as follows: Mid-Grade Unleaded Gasoline ten (10) cents per gallon add-on to the current unleaded gasoline price. Premium Unleaded Gasoline fifteen (15) cents per gallon add-on to the current unleaded gasoline price. DELIVERIES: Deliver fuel within 48 hours after receipt of the Field Purchase Order (reserved for emergency use only), or as otherwise, agreed to, by the using agency and the contractor. Normal use requirements order at least five (5) days in advance of specified delivery date. Transportation terms are F.O.B. DESTINATION for all deliveries. Bid prices should include all transportation, delivery, handling charges, overhead, profit, etc. Requirements that are not anticipated or scheduled in advance such as emergencies will require 24 to 48 hour delivery. DELIVERY NOTES: Contractor is responsible for deliveries of awarded items; however, contractor may arrange to have another company make the actual delivery subject to the same terms and conditions of the contract. 3 Department of General Services GSPUR-13B Rev. 2/20/01 The number of above ground, concrete vaulted, fuel storage tanks owned by Commonwealth agencies has increased dramatically. State agencies such as DCNR (Parks and Forestry), Public Welfare and the Game Commission have purchased above ground tanks and will continue this trend. Political sub divisions, authorities, and school districts are also purchasing above ground tanks in substantial numbers. Product enters a vaulted tank through a 4 port equipped with a 2 grooved male adapter. The existing adapter and overfill protection equipment does not permit full infusion of a standard delivery nozzle into the tank. Delivery vehicles are required to carry a cam-and-groove, or quick disconnect fitting adapter, (if not already equipped), to insure the proper connection to the tank. It is not permissible to remove the overfill protection to gain access to the tank, nor is it permissible to deliver product through any other existing port on the tank. This procedure is strictly enforced to insure the integrity of the overfill mechanism, and the tank system in general. It is the contractor s responsibility to determine the delivery requirements before making the delivery. DELIVERY DOCUMENTS: Computerized bills of lading, metered slips from terminal loadings, sealed compartments and/or metered delivery tickets are acceptable deliveries. Using agency may require sealed compartments. Present delivery documents to the receiving agency PRIOR to unloading, if not metered. Signing of documents will occur after unloading and verification of quantities received. The Commonwealth will pay for gallons received - METERED OR otherwise; no adjustment is made for temperature, etc. For each T.T. location, deliveries started with metered equipment, must continue for the entire contract period. PRICE CHANGE: The Commonwealth will adjust prices under this contract based upon this clause. The BASIS FOR CHANGE IS OIL PRICE INFORMATION SERVICE, PAD 1 REPORT published weekly except last weeks in June and December by United Communications Group, Bethesda, MD. Telephone (301) CHANGE IS DETERMINED ON EACH THURSDAY OF THE MONTH AND BECOMES EFFECTIVE THE FOLLOWING TUESDAY. If a holiday falls on the applicable Thursday and the price information is not published, the last published price information before the applicable Thursday is used. Computations for BASE FIGURE (AVERAGE) OR APPLICABLE THURSDAY FIGURE (AVERAGE) is as follows: cts/gal (87 oct UL) = Harrisburg Avg + Philadelphia Avg + Pittsburgh Avg The fuel price is calculated using the calculated Thursday figure plus or minus the quoted price differential. The price differential shall include all delivery charges, markup, and miscellaneous charges. A change notice to the contract is issued to incorporate the price change and changes all contract prices for deliveries on or after the effective date of the price change. During unusual market conditions, the Department of General Services shall adjust prices on a daily basis. "Unusual market conditions" is defined as dramatic or unforeseen daily changes in the market prices such that the average OPIS figure changes from day to day by more than 10%. When unusual market conditions occur, the Department of General Services shall issue change notices daily until such time that the market has stabilized. The daily adjustment will use the same approach as above but with daily OPIS data. Page 2 of 3
