3 The Alberta Utilities Commission Calgary, Alberta Decision Application No MW Condensing Steam Turbine Generator Proceeding ID No Introduction 1. (DMI) filed an application with the Alberta Utilities Commission (AUC or the Commission) pursuant to sections 11 and 18 of the Hydro and Electric Energy Act for approval to construct and operate a 25-megawatt (MW) condensing steam turbine generator (the project) within the existing Peace River Pulp Division mill site, in the Peace River area. The application was registered on November 15, 2010 as Application No The proposed generator would be located within the fenced boundary of the existing Peace River Pulp Division mill site, located in LSD 12 of Section 13, Township 85, Range 21, west of the Fifth Meridian. The proposed project will contain a new building to house the steam turbine generator and a two-cell cooling tower. 3. The Commission issued information requests to DMI on December 1, DMI responded to the information requests on December 20, 2010 and April 26, The Commission issued a second set of information requests to DMI on May 3, DMI responded to the second set of information requests on May 20, On June 1, 2011, the Commission issued a notice of application to occupants, residents and landowners located within 2,000 metres of the proposed project. A submission was received from the County of Northern Lights in support of the project. No objections or concerns to the application were received by the June 17, 2011 deadline for intervener submissions. 2 Discussion 5. DMI applied to construct and operate the proposed generator within its existing Peace River Pulp Division mill site, located approximately 16 kilometres northeast of the town of Peace River, Alberta. 6. The proposed generator would be connected to a new switchgear cell in the existing DMI owned and operated 13.8-kilovolt (kv) switchgear. The DMI 13.8-kV switchgear is currently connected to ATCO Electric Ltd. s (ATCO) Daishowa 839S substation. ATCO confirmed that it does not have any outstanding concerns with the proposed generator and its connection. 7. DMI prepared an environmental impact statement for the application. In letters to DMI dated March 1, 2010 and March 8, 2010, Alberta Environment (AENV) indicated that no further assessment from AENV was required for the project. 8. In a letter dated May 17, 2010, from Alberta Culture and Community Spirit (ACCS), DMI was granted a Historical Resources Act clearance from ACCS for the proposed generator. AUC Decision (July 8, 2011) 1

DMI prepared and filed a noise impact assessment indicating that the noise levels will be within the permissible sound levels as specified in AUC Rule 012: Noise Control (AUC Rule 012). 10. DMI conducted a participant involvement program in accordance with AUC Rule 007: Rules Respecting Applications for Power Plants, Substations, Transmission Lines, and Industrial System Designations (AUC Rule 007). DMI stated that there are no residences within 2,000 metres of the proposed project. DMI s participant involvement program included a title and interest holder search within 2,500 metres of the proposed project and contact with all interested parties and relevant government agencies. DMI advertised the proposed project in local newspapers between December 2009 and January DMI stated that one concern was raised by a landowner located approximately two kilometres away from the proposed generator regarding the noise level of the proposed generator. After providing additional information to the landowner, DMI submitted that the landowner confirmed by telephone that he did not have any outstanding concerns with respect to the noise level of the proposed project. 3 Findings 12. The Commission notes that DMI undertook a participant involvement program and finds that there are no outstanding public or industry objections or concerns. The Commission notes that no interested party responded to the notice of application issued by the Commission with concerns or objections. The Commission also notes that the only submission received in response to the notice of application was a submission from the County of Northern Lights in support of the application. The Commission finds that the participant involvement program complies with the requirements of AUC Rule The Commission finds that the noise impact assessment submitted by DMI fulfills the requirements of AUC Rule The Commission notes that AENV has not requested further assessment of the proposed project and that ACCS has provided a clearance for the proposed project. 15. The Commission considers that the technical, siting, environmental and noise aspects of AUC Rule 007 have been met. 16. Based on the foregoing, the Commission considers the project to be in the public interest in accordance with Section 17 of the Alberta Utilities Commission Act. 4 Decision 17. Pursuant to sections 11 and 18 of the Hydro and Electric Energy Act, the Commission approves the application and grants the approvals set out in Appendix 1 Power Plant Approval No. U July 8, 2011, and in Appendix 2 Connection Order Order No. U July 8, 2011 (the appendices will be distributed separately). 2 AUC Decision (July 8, 2011)
