12 Valuation and damages Important for at least two reasons: 1. How much will the State have to pay in case of expropriation? 2. Did an indirect expropriation occur? Three main questions: 1. Date of valuation when? 2. Measure of damages how much? 3. Method how will this be calculated? Training course for economies in transition - Sarajevo 12

14 The fundamental challenge Balance between: (a) attracting foreign investors and protecting their interests; and (b) preserving the regulatory autonomy of the State. Will general, non-discriminatory State regulation in good faith for a public purpose be considered an indirect expropriation? social legislation? tax legislation? environmental legislation? (a) The determination of whether an action or series of actions by a Party constitutes an indirect expropriation, requires a case-by-case, fact-based inquiry that considers, among other factors: (i) the economic impact of the government action, although the fact that an action or series of actions by a Party has an adverse effect on the economic value of an investment, standing alone, does not establish that an indirect expropriation has occurred; (ii) the extent to which the government action interferes with distinct, reasonable investmentbacked expectations; and (iii) the character of the government action."
