Hold a protest hearing to accept testimony and written protests against the increased fees. Ask the City Clerk to tabulate the protests. If the number of written protests received is not sufficient to constitute a majority protest, make a finding that there is no majority protest by property owners within the assessment area. 2. Approve Resolution No. 17-, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOMITA INCREASING SOLID WASTE COLLECTION RATES PER THE ATTACHED EXHIBITS FOR RESIDENTIAL, COMMERCIAL AND MULTI-FAMILY COLLECTION BACKGROUND Solid Waste collection and recycling services are provided under an exclusive franchise agreement for the entire City. The City contracts with the franchise hauler, CalMet Services, for household trash and curbside recycling service for residential properties (parcels with five units or less), commercial and multi-family residential properties (six units or more). Solid Waste and Recyclable Material Collection provisions are contained in the Lomita Municipal Code, Title 5, Chapter 3 (Integrated Waste Management). Proposition 218 requires that the fees and charges imposed on a parcel may not exceed the proportional special benefit conferred on that parcel. During the public notice period (June 14, 2017 to August 1, 2017), the City received a total of 7 phone calls and/or s. The inquires from the customers indicated that they were not opposed to the fee increase but had questions regarding the proposed rate increase. On October 1, 2009, the City entered into a franchise Agreement with CalMet Services for citywide solid waste collection and recycling services for commercial, multi-family residential and residential properties. The current agreement expires on June 30, The City contracts with CalMet Services for household trash and curbside recycling

2 services for residential parcels, commercial parcels and multi-family unit residential parcels. Each customer is billed directly by the contract hauler based on the number/type of bins and frequency of collection services for the parcel. Summary of Proposed Rate Changes (1) Adopting CPI-related pass-through adjustments to all rates and charges for solid waste collection and disposal applicable to each property/customer within the City for the period July 1, 2014 to June 30, 2019 pursuant to Government Code Section 53756; (2) Authorizing a 3.41% increase (above the 1.59% CPI increase) for the disposal component from the July 1, 2016 rate due to extraordinary disposal cost increases during the prior year and; (3) Adoption of a new rate for the state-mandated organic waste collection applicable to businesses and multi-family developments of five or more units. If approved, these rates, charges and adjustments will be effective September 1, The CPI-related rate increases covering the time period June 30, 2014 to August 30, 2017 have already been implemented and the proposed action this evening would affirm those rates, consistent with the terms of the City s franchise agreement with CalMet Services Methodology for Annual CPI-Related Increases Annual CPI-related rate increases will be calculated based on CalMet s actual costs for labor, vehicle replacement, vehicle and equipment maintenance, disposal, fuel, and other miscellaneous items. CalMet s actual costs for these cost categories would be adjusted for inflation based on the annual average percentage change as published by the U.S. Bureau of Labor Statistics and the U.S. Department of Energy. Under the franchise agreement, if inflation is negative for a given year, there will be no CPI increase the following year. If this fee increase is approved, State law still requires that customers receive notice of subsequent annual CPI increases. Therefore, if the rates are approved, the City will notify customers of any CPI-related increases as required by law. Any increases proposed after June 30, 2019 would require a new Prop 218 hearing and notice. For the typical residential customer (4,410 customers out of 4,872 total customers), the rate would increase by 54 cents to 63 cents per month depending upon the solid waste container size as shown in the table below: Bin Size 32 Gallon 64 Gallon 96 Gallon Proposed Rate $20.38 $20.96 $23.16 Current Rate $19.84 $20.38 $22.53 Difference $0.54 $0.58 $0.63 Rate increases for commercial and multi-family residential customers vary depending upon size of container, frequency of pick-up and special services provided (see of the attached draft resolution).

Proposition 218 has the following limits on property related fees, including solid waste collection rates: 1. Revenues derived from the fee or charge must not exceed the funds required to provide the property-related service; 2. Revenues derived from the fee or charge must not be used for any purpose other than that for which the fee is imposed; 3. The amount of a fee or charge imposed upon any parcel or person as an incident of property ownership must not exceed the proportional cost of the service attributable to the parcel; 4. The fee or charge may not be imposed for a service unless the service is actually used by, or immediately available to, the owner of the property subject to the fee or charge; fees or charges based on potential or future use of a service are not permitted, and stand-by charges must be classified as assessments subject to the ballot protest and proportionality requirements for assessments; and 5. No fee or charge may be imposed for general governmental services, such as police, fire, ambulance, or libraries, where the service is available to the public in substantially the same manner as it is to property owners. Revenues derived from the charge will be used to provide solid waste and recycling collection, the service will be provided to the parcel/customer receiving the service and will not exceed the proportional cost to the subject parcel. This charge will not be utilized for general governmental services as listed in #5 above. Organic Food Waste Collection AB 1826 adopted by the State Legislature in October 2014 mandates the recycling of organic waste by businesses and multi-family dwellings of five units or more. Organic waste (also referred to as organics) means food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food waste. The State regulation also requires implementation of an organic waste

4 recycling program. Exhibit B provides rate detail for the commencement of organic waste collection effective September 1, If the Council does not receive written protests from a majority of the affected parcels (a total of 2,437 protest letters would need to be received to reach a majority), the Council may approve the rate changes as summarized in Exhibits A and B of the resolution. Only one protest per parcel will be accepted. The time period for the proposed action coincides with the ending of the current agreement with CalMet Services which expires on June 30, OPTIONS: 1) Do not adopt the resolution. 2) Give staff alternative direction. FISCAL IMPACT If approved, the proposed increase would take effect on September 1, The fiscal impact to the City would be negligible and the City would see a nominal increase in the City s franchise fee. 5 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOMITA, CALIFORNIA, INCREASING SOLID WASTE COLLECTION FEES THE CITY COUNCIL OF THE CITY OF LOMITA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. On Tuesday, August 1, 2017, the City Council held a duly noticed protest hearing with respect to the solid waste collection fees. All affected property owners and customers were given notice of the hearing on June 15, 2017, and given an opportunity to protest. 4,872 total parcels were affected. The City received written protests for properties prior to the protest hearing and an additional written protests were received at the public hearing. A total of written protests were received before the close of the hearing. For purposes of determining whether a majority protest exists for each type of parcel/customer, the protests were also tabulated for commercial, multi-family residential and single-family residential. The number of written protests received was not sufficient to constitute a majority protest. The City Clerk has certified the tabulation of written protests. Section 2. Section of the California Government Code authorizes the City to adopt a schedule of fees or charges authorizing automatic adjustments for inflation provided that the City Council adopts such schedule of fees or charges for a period not to exceed five years. The City Council hereby accepts the City Clerk s certification of the results of the protest hearing and adopts the increase in solid waste collection fees for CPI increases as follows: a), the Solid Waste Collection fees shall be adjusted per and Exhibit B. b) Effective July 1, 2014 and each July 1 through June 30, 2019, the Collection Charge component of the annual City Solid Waste Collection and Recycling Service Fee is adjusted by the percentage change between the 12 month average value of the Consumer Price Index for All Urban Consumers (CPI-U), including all items as published by the US Bureau of Labor Statistics, for the most recently completed calendar year and the 12 month average value CPI-U per the applicable CalMet agreement. c) Effective July 1, 2014 and each July 1 through June 30, 2019, the Disposal Charge component of the annual City Solid Waste Collection and Recycling Service Fee is adjusted by either the percentage change between the 12 month average value Consumer Price Index for All Urban Consumers in the Los Angeles-Anaheim-Riverside, CA Area (CPI-LA), including all items as published by the US Bureau of Labor Statistics, for the most recently completed calendar year and the 12 month average value CPI-U for the prior most recently completed calendar year or the rate per ton on December 1 st of the preceding year and on December 1 st of the current year for the Los Angeles County Landfill System whichever is lower per the applicable CalMet agreement.

6 d) A potential CPI-related increase will be calculated in early 2018 which would take effect in July 2018 based on the criteria in b) and c) above. Section 3. The Disposal Component Increase for the period September 1, 2017 to June 30, 2018 shall be an additional 3.41% as shown in. Section 4. Organic Food Waste Collection Rate. Pursuant to AB 1826 adopted by the State Legislature in 2014, a new organic waste food collection rate currently applicable to certain commercial and larger multi-family residential developments is hereby adopted (Exhibit B). Section 5. The City Clerk is directed to fill in the protest counts in Section 1 above, certify to the passage and adoption of this resolution and enter it into the book of original resolutions. 11 June 14, 2017 CITY OF LOMITA - NOTICE OF PUBLIC HEARING TO CONSIDER A PROPOSED INCREASE IN RATES FOR SOLID WASTE SERVICE CHARGES NOTICE IS HEREBY GIVEN that the City Council of the City of Lomita (the City ) will conduct a Public Hearing on August 1, 2017 at 6:30 p.m., in the Council Chambers at Narbonne Avenue, or as soon thereafter as the matter may be heard, to consider: (1) adopting CPI-related pass-through adjustments to all rates and charges for solid waste collection and disposal applicable to the Assessor Parcel Number for which you are shown as the property owner and/or tenant for the period July 1, 2014 to June 30, 2019 pursuant to Government Code Section 53756; (2) authorizing a 3.41% increase (above the 1.59% CPI increase) for the disposal component from the July 1, 2016 rate and; 3) adoption of a new rate for the state- mandated organic waste collection applicable to businesses and multi-family developments of five or more units. If approved, these rates, charges and adjustments will be effective September 1,2017. PROPOSED SOLID WASTE RATES AND CHARGES (INFLATION PASS-THROUGH AND OTHER RATE ADJUSTMENTS FOR THE PERIOD JULY 1, 2014 to JUNE 30, EFFECTIVE SEPTEMBER 1, 2017) All current solid waste service rates include a collection and a disposal component. The City s Franchise Agreement with the waste hauler (CALMET) allows the rates for solid waste collection services to be adjusted on an annual basis to reflect changes in the Consumer Price Index ( CPI ) and other increases may be authorized upon request. The Franchise Agreement specifies use of the CPI for Los Angeles- Anaheim- Riverside Metropolitan Area from year-to-year. In accordance with the franchise agreement, the proposed rate adjustments would cover the period from July 1, 2014 through June 30, 2019 as follows: 1. For the period (July 1, 2014 to June 30, 2015) the collection element CPI increase was 1.56% with no increase in the disposal element. 2. For the period (July 1, 2015 to June 30, 2016), there was no increase. 3. For the period (July 1, 2016 to August 30, 2017), the collection element increased by 0.74% and the disposal element increased by2.03%. 4. For the period (September 1, 2017 to June 30, 2018), the overall rate increase including both the collection and disposal components will be 2.8%. This includes a 1.46% rate increase for collection and a 5% rate increase in the disposal component. The average single family residential bill is expected to increase by 58 cents per month. 5. For the period (July 1, 2018 to June 30, 2019), the City is also proposing to authorize, for one additional year, an automatic annual inflationary adjustment in all current and new solid waste service fees, rates & charges. Customers would receive a notice of the increase before it went into effect. These adjustments are reflected in further detail in to this Notice. If approved, these increased rates, included in Exhibit A, will be effective September 1, For 2016, the actual cost of the disposal rate has seen an extraordinary increase of 12.90%. This is a result of significantly higher disposal costs during 2016, and is the basis for the increase in the disposal component listed in item (4) above. The automatic inflationary adjustments noted above are authorized pursuant to Government Code Section and are based upon the categories listed below. Annual CPI-related rate increases will be calculated based on CalMet s actual costs for Labor, Vehicle Replacement, Vehicle and Equipment Maintenance, Disposal, Fuel, and All Other. CalMet s actual costs for these cost categories will be adjusted for inflation based on the annual average percentage change as published by the U.S. Bureau of Labor Statistics and the U.S. Department of Energy. The U.S. Bureau of Labor Statistics and the U.S. Department of Energy indices to be used for inflation adjustments of the cost categories are as follows: Labor: Employment, hours, and earnings from current employment, waste collection Vehicle and Equipment Replacement: Truck, bus, car and other vehicles bodies, for sale separately Vehicle and Equipment Maintenance: Parts and attachments for Industrial work trucks and tractors Disposal: Consumer Price Index, All Urban Consumers, All Items, Los Angeles-Anaheim-Riverside, CA Fuel: Energy Information Administration, California #2 Diesel Fuel, Retail sales by all sellers. PUBLIC HEARING AND PROTESTS Any property owner or any tenant (i.e., a customer of record) directly responsible for the payment of solid waste service fees may submit a written protest to the proposed rate changes to the City s solid waste service rates; provided, however, only one protest will be counted per identified parcel. Any written protest must: (1) state that the identified property owner or customer of record is in opposition to the proposed solid waste rate changes; (2) provide the location of the identified parcel (by assessor s parcel number or street address); and (3) include the name and signature of the property owner or customer of record submitting the protest. Written protests may be submitted by mail or in person to the City Clerk at Narbonne Avenue, Lomita, CA 90717, or at the Public Hearing (date and time noted above), provided they are received prior to the conclusion of the public comment portion of the Public Hearing. Any protest submitted via or other electronic means will not be accepted. Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the City Clerk, Attn: Public Hearing on Solid Waste Rate Changes. IF YOU DO NOT OBJECT TO THE ADJUSTMENTS, NO ACTION IS REQUIRED. The City Council will hear and consider all written and oral protests to the proposed rate changes at the Public Hearing. Oral comments at the Public Hearing will not qualify as formal protests unless accompanied by a written protest. Upon the conclusion of the Public Hearing, the City Council will consider adoption of a resolution authorizing the rate changes to the City s solid waste service rates as described herein. If written protests against the proposed rate changes as outlined above are not presented by a majority of property owners or customers of record of the identified parcels upon which the rates are proposed to be imposed, the City Council will be authorized to impose the rate changes. If adopted, the proposed rate changes to the solid waste service fees will be in effect on September 1, A separate notice reflecting the approved rate increases will be sent to all customers. This protest hearing is being conducted in accordance with Article XIIID of the California Constitution (also referred to as Proposition 218). Please note that a rate protest proceeding is not an election. To ensure transparency and accountability in the rate protest tabulation, protests shall constitute a disclosable public record from and after the time they are received.
