1 Purpose and Scope At ServiceMaster we want our employees to make it to work and home safely each and every day, and we want to ensure that the public is safer as a result of our actions. The Vehicle Safety Policy is established by the Executive Committee to define the minimum vehicle safety requirements for all employees who drive on behalf of the company. A Business Unit President may impose standards that are more stringent than this policy. Each Business Unit may also supplement this policy with Business Unit specific standard operating procedures, but such procedures must meet or exceed the minimum requirements of this policy. (If an employee works in a business unit with an addendum, the stricter policy will apply.) This policy applies to ServiceMaster Global Holdings, Inc. ( SERV ), each of its subsidiaries, and any ventures that are controlled by the company. The policy applies enterprise-wide, to any employee who works on behalf of any of the businesses, as outlined in the following two (2) sections. Violations of this policy may result in corrective action, up to and including termination of employment and/or suspension of company driving privileges. Distracted Driving This section (Distracted Driving) of the policy applies to all employees, no matter how frequently or infrequently they drive for company business purposes. (For example, driving from one work location to another for a meeting may constitute driving for company business purposes.) While operating any vehicle for company business purposes, the following rules apply to electronic devices: 1. Cell phones (company-issued or personal) a. Only hands-free conversation is permitted while operating a vehicle (devices may include ear-pieces, speaker phones, Bluetooth applications, etc.). b. Other functionality, such as text, , or other applications is prohibited. 2. Use of Global Positioning System (GPS) Devices a. GPS devices (stand-alone or cell phone) may be used, provided the vehicle is stopped and parked while data entries are being made. b. Under no circumstances may the driver enter data unless the vehicle is in park. c. No other features of the device may be used while the vehicle is in motion. The device must be secured from movement or shifting and should not obstruct the field of view of the driver and be positioned in a manner that minimizes the driver s distraction from the road, or connected via Bluetooth technology. e. If additional map review or directions are needed while operating the vehicle, it is required that the operator pull the vehicle over to a safe location, engage the hazard lights, stop the vehicle, engage park, and reconfirm. 3. Use of other electronic devices (i.e. any tablet, computer, hand-held device, etc. company-issued or personal) is prohibited while operating a vehicle. The remainder of this policy applies only to those employees that Drive on Behalf of the Company, as defined in the following section. Who Drives on Behalf of the Company? Human Resources (HR) determines if an employee is subject to this policy by job code. For any employee who drives on behalf of the company, this policy applies to any vehicle if driven in the course of employment, including personal vehicles, as well as to any company vehicle used at any time. In general, a job code will be assigned as an employee who drives on behalf of the company, if the employee meets any of the following criteria: 1. Has been given the use of a company vehicle or 2. Receives a vehicle allowance for a vehicle to be used on behalf of the company or 3. Works in a position where driving is an essential function of the job (i.e. cannot perform the work associated with the position without driving, such as an outside sales position, for example). Those individuals that meet the criteria above will be referred to as driver(s) for the remainder of this policy. Requirements of Drivers Driver Criteria: 1. Must be at least 21 years of age 2. Must have in his or her possession a current, valid driver s license from the state or territory of residence a. The license type must also be appropriate for the type of vehicle being driven. For example, some vehicles may require a Commercial Driver License (CDL) or a Chauffeur s License. 3. Must adhere to all restrictions on the driver s license (i.e., use of corrective lenses) Policy Owner: Executive Committee Page 2 of 5

Must maintain acceptable ServiceMaster driving score (see Acceptable Driving Record, below) Acceptable Driving Record ServiceMaster uses an internal company process to determine acceptable levels of risk for each driver. The decision-making process includes the use of tools, with scoring matrices 1 based on motor vehicle offenses, citations, and preventable collisions. Certain disqualifying motor vehicle offenses are considered as well, as outlined in the next section of this policy. A motor vehicle record (MVR) will be obtained and subject to internal scoring review/risk assessment, at a minimum, annually. Based on the current matrices in place, an applicant may be deemed ineligible if he or she has been convicted, charged with, or given a deferred adjudication program within the timeframe identified in the applicable matrix. Associates may receive corrective action, up to and including termination of employment, if the risk assessment score reaches an unacceptable threshold. Any employees transferred or reassigned from a non-driving position to a driving position will be held to the same standards. Expectations for Drivers: Substance Abuse & Drug-Free Workplace Policy: all employees are held accountable to the Substance Abuse & Drug-Free Workplace Policy. Drivers should review this policy to ensure understanding of expectations related to substances (such as alcohol, prescription and non-prescription medications). Insurance: If operating a personal vehicle, the driver must maintain vehicle insurance in accordance with the laws and regulations of the state or territory of residence. Disqualifying Motor Vehicle Offense: Any driver, who is convicted of a violation, or receives a deferment of adjudication for any offense listed below will have his or her company driving privileges suspended and be subject to corrective action, up to and including termination of employment. The same applies for any driver who is charged or cited with any offense listed below, and the company concludes that the driver likely engaged in the alleged conduct. 1 The company reserves the right to change the matrices at any time. 4 o Driving while under the influence of an intoxicating substance, (including, but not limited to D.U.I., D.W.I., O.W.I., D.W.A.I., etc.) o Leaving the scene of an accident o Refusing to submit to a drug or alcohol test o Committing a felony involving the use of a motor vehicle Disqualification under Department of Transportation Regulations: The Federal Department of Transportation (DOT) requires that drivers using a CDL will be subject to disqualification for certain offenses. Therefore, ServiceMaster CDL drivers will be subject to disqualification in accordance with DOT regulation part , table 1 through 4. If there are situations that are addressed by both part and ServiceMaster policy, the more stringent of the two will be applied. Commercial drivers should review the ServiceMaster Commercial Drivers Drug and Alcohol Testing Policy as well. Preventable Collision: Any driver that is involved in a collision will be subject to an internal review to determine if the collision was preventable. If the review determines that the risk assessment level of the driver has increased to an unacceptable level, the driver will be subject to corrective action, up to and including termination. In addition, any driver that has been employed for six (6) months or less will be subject to revocation of driving privileges for six (6) months. If a non-driving position is unavailable, the employee s employment may be terminated. Provisional Driving Status: If an internal review determines that a driver has reached a threshold that requires more frequent review, the driver will be placed on provisional driving status, and the MVR will be obtained at a minimum, every quarter, unless/until the driver reaches an acceptable risk threshold assessment, when he or she will return to annual review. If the driver escalates to an unacceptable risk threshold, he or she will have company driving privileges revoked and be subject to corrective action, up to and including termination of employment. Driver Reporting Requirements: The following events require immediate reporting to the driver s supervisor: o Involvement in any collision or alleged collision, regardless of damage o Cited for a moving violation o Having the state driver s license suspended, revoked, or restricted If a driver loses driving privileges, permission to utilize a company vehicle is immediately revoked. In addition, any collision or alleged collision must be reported as follows: Policy Owner: Executive Committee Page 4 of 5
5 o The driver must contact local police and report any injuries. o The driver s manager must report a collision to the following groups: o Accident management vendor as soon as possible, and no later than twenty-four (24) hours following the incident o Applicable business unit safety staff (or if there is no safety staff, to the applicable HR Manager) Drive Defensively and Professionally All drivers are expected to: 1. Successfully complete the SERV Defensive Driver Training Program within the required time-frame. (Refer to your business unit guidelines for further information.) 2. Obey all state and local traffic laws and company policies. 3. Wear seat belts at all times and ensure that passengers wear seat belts. 4. Drive with courtesy and respect, and refrain from any type of road rage behavior. 5. Refrain from engaging in activities that distract the operator s attention while driving. 6. Refrain from transporting non-approved DOT regulated hazardous materials or other illegal materials/substances. Use of a Company Vehicle Only approved company drivers may operate a company vehicle. Company vehicles may not be utilized to tow personal items, such as trailers, boats, campers, etc. Each business unit may further define the personal use of a company vehicle for its entity, provided the changes meet or exceed the minimum requirements of this policy.
