1 Terms and Conditions of Mirchi Vinnundhi Helicopter Ekkundhi Vodafone Essar South Limited (VESL) is not the organizer, coordinator or controller of the activity, rather only a sponsor and does not make any representation or warranty, in any form, what so ever, with regard to the activity (Helicopter ride to watch Ganesh Visarjan on 22 nd September 2010). Further is neither owner of the Promotion, contest, activity, nor responsible, for any of it, in any way. By reading this terms and conditions and participating in "Mirchi Vinnundhi Helicopter Ekkundhi" (herein after referred to as Activity) the participant irrevocably and unconditionally accept the same and represent, undertake to be bound, abide by, all the conditions contained therein without any kind of contestation and/or demur. Besides these terms and conditions contained herein you shall also be bound by the terms and conditions set out by Entertainment Network (India) Ltd (ENIL). Please also check out web site of ENIL. i.e. and carefully read their applicable terms and conditions. The Contest shall be known as "Mirchi Vinnundhi Helicopter Ekkundhi" same shall commence at ENIL s radio station at 98.3 FM Radio Mirchi from 10 th September 10 for 12 days, only (both days inclusive), and is subject to the terms and conditions herein. Participant s Eligibility a. Entry is strictly open only to Adults Indian citizens (residing in Hyderabad) above the age of 18 years, ( Participant /You/Your ) are eligible for participating in the Contest. Further, for participating in caller tune contest you also need to be a Registered Vodafone user. b. The Contest is not open to (i) persons who have an agreement or contract with any third parties that would prohibit such persons from participating in the Contest; (ii) the employees (permanent or contract) and directors, including each of their immediate family members of VESL (sponsors) their parent, subsidiary and affiliated companies, unless specifically nominated and approved by ENIL; and (iii) advertising and promotion agencies, suppliers of prizes, and persons or entities connected with the promotion of the Contest. c. The Contest is also not open to employees/officers of ENIL/Radio Mirchi and its group companies. d. ENIL reserves the right to verify the eligibility of all participants. The Sponsors reserves the right to verify the validity of all entry/registration forms and to disqualify participants who tamper with the entry process. e. You represent that you are legally competent to enter into and form binding contracts under applicable laws. A Vodafone Essar Company

If and when required you agree without any demur to provide complete and correct information in respect of your identity, contact details, id, PAN No. telephone number, age, and complete postal address / correspondence. g. You agree that mere participation in any or all of the activities / aspects i.e. download / calling RJ / answering questions / attending conference, flying in chopper, is good enough compensation for the Activity. h. No electronic, surveillance, device, item, equipment including cameras, mobile phones, I Pods, shall be allowed during the contest, within the airport or while flying in the chopper. i. Participants, contestants need to exactly follow instructions as provided by people from /representatives of, ENIL / Sponsors. j. Participants, contestants, need to complete formalities, documentation and verification process, including but not limiting to providing declaration / undertaking in format provided prior to participation, actual flying in chopper. k. Promotion, Activity, can and shall not be clubbed with any other promotion, activity either by ENIL or the sponsor. 2. Mode of Participation and Entries. a. Only one entry per Participant is permitted. Multiple entries will result in disqualification of the Participant. b. You can participate in the Activity by downloading caller tunes, followed by short listing, answering questions put to you in the quiz on Ganesh, Mythology etc. The first lot of person answering all questions correctly will be the winners. c. In no case shall the Sponsors, ENIL, RJ, or Radio Mirchi will be held responsible for any dispute between yourself and ENIL / service provider (Airlines) regarding any thing. d. Your participating by downloading caller tunes, answering questions asked, participating in quiz, following instructions given, shall be construed to be acknowledgment and acceptance of the terms and conditions of the activity. 3. Winners and Prizes a. Radio Mirchi / ENIL would announce the Winners on Radio Mirchi 98.3F.M. at ENIL s radio station across Hyderabad. b. The special prize shall a opportunity to take a ride in helicopter, on 22 nd September may range any where between 10 to 25 minutes, including take off, hovering, flying, landing (all from Begumpeth Airport). c. Only the Activity (i.e. ride in helicopter) is being sponsored by VESL via ENIL. It is given solely as an act of gratification and not for any consideration. d. Activity is non-transferable and non substitutable and subject to Taxes, if applicable. e. In case the Activity (ride in helicopter) is unclaimed by the winner within the stipulated period, the winner shall be deemed to have automatically surrenders his/ her right to the Activity and shall not have any claim, thereafter and in such an event, the Sponsors reserves its right to transfer the prize to the next winner chosen in the same contest/draw. f. VESL is sponsoring the activity on as is basis and without any warranty or guarantee concerning the execution, factual flight, flying, quality, suitability,

3 sustainability or merchantability of the Activity and VESL or its, officers, agents, representatives, shall not be responsible for or liable for Activity not happening and/or it not happening as publicized and/or any incident relating to the Activity or any kind of consequential damages/loss, in any manner whatsoever. g. The Participant/You acknowledge, agree and understand that this is a promotion activity and no consideration/monies shall be payable to Participant/you. The Prize can not be exchanged/ redeemed for cash or any other non-monetary consideration. h. The decision of the ENIL /Sponsors viz-a-viz the Activity, shall be final and binding upon you and the same is non-contestable by you in any manner whatsoever. i. You/Participant agree that you shall be solely responsible for participating in the Activity (ride in helicopter) at your own risk, consequences. You have your own insurance, and consent to take part in the Activity (ride in helicopter). You agree and undertake not to hold the Sponsors or Radio Mirchi responsible or liable for any mishap, allergic reaction, adverse reaction, injury, physical impairment on usage of such prize or product, relating to the Activity. j. In the event you are chosen as the winner, you agree to complete all formalities, submit all documents, provide required, undertaking, indemnity (as required) to avail the Activity (ride in helichopter). Other Terms and conditions 1. Each Participant/Contestant represent that he/she is legally competent to enter into and form binding contracts under applicable laws. By taking part and/or entering into the Contest you hereby warrant that all information submitted by you regarding your Name, Address, Phone number, age, husbands consent etc is true, correct, accurate and complete. 2. Only one entry per Participant, per contest is permitted. Multiple entries will result in disqualification of the Participant for the Contest. 3. The Winner/s shall also be intimated at the permanent address, contact no (provided) of the Winner as available with the Sponsors/ENIL. 4. The decision of the Management of Sponsors/ENIL with regard to the promotion, quiz, activity (prize) its terms, manner, result, is final and no appeal, correspondence or any other claims whatsoever, in this regard will be entertained. 5. The Prize cannot be exchanged and is not transferable. 6. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all entries received shall vest solely and exclusively with the Sponsors at all times. The Sponsors and ENIL/Radio Mirchi if permitted by the sponsors in this regard shall be entitled to use the entries received, sound bytes, quotes or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant. 7. The Sponsors/ ENIL reserves the right to withdraw, change, defer, alter or cancel this Contest or concept of contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Decision of Sponsors/ ENIL in this regard and in general with respect to this Contest and the Terms & Conditions thereto shall be final, binding and noncontestable. 8. None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between the Participant and ENIL/sponsor and the Participant shall have no authority to bind ENIL/sponsor in any manner whatsoever. 9. The Sponsors/ENIL or any of its officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible entries.

The responce must not, in the discretion and judgment of ENIL, (1) contain words, images or statements considered offensive to individuals of any age, race, ethnicity, national origin, religion, sexual orientation or other protected class, or who are disabled, (2) contain any threats to any person, place, business, group or entity, or contain material that is unlawful, (3) contain materials that promote bigotry, racisms, hatred or harm against any group or individual or promotes discrimination based on age, race, ethnicity, national origin, religion, sexual orientation or other protected class, or disability; (4) contain any materials that depict illegal acts, are sexually explicit, libelous, obscene, violent, hateful, slanderous; (5) contain other inappropriate content which includes, but not limited to, any display of smoking, alcohol, illegal drugs, firearms, harming of animals, nudity, provocative/suggestive outfits or poses, or (6) contain content not in keeping with Radio Mirchi s reputation and image. 11. Radio Mirchi /Sponsors of Prize (Activity) shall under no circumstances be liable for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of accepting the prize, participating in the chopper ride. 12. Any Participant/Contestant who enters the contest releases from and indemnifies Radio Mirchi/the Sponsors and/or any of its officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or usage or intake of prize, participation in the contest including but not limited to personal injury, damage to person, property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. 13. The contest entries and material submitted in connection with the contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors are licensed to the Sponsors and upon submission the Sponsors may use the material in any medium in any reasonable manner it sees fit. ENIL/Sponsors accepts no liability for any errors or omissions, whether on behalf of itself or third parties. 14. ENIL /Sponsors shall not be liable to perform any of its obligations under the contest or in respect of the prize (activity) where it is unable to do so as a result of circumstances beyond its control in the nature of fire, explosions, natural calamities, State Emergency, riots, or any Force majeure condition etc. and shall not be liable to compensate you in any such circumstances. ENIL / sponsor cannot and shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the contest due to any government restrictions/ Force Majure / Act of God/ beyond control of sponsor/ ENIL. 15. ENIL /Sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for any late, misrouted, rerouted, activity (flight) of any mistake/ errors in radio broadcast/jock talks/producer talks associated with the Activity. 16. You shall be solely responsible for any consequences which may arise due to your taking part in the contest (flying in chopper) conducting an illegal act and also undertake to indemnify ENIL/Radio Mirchi/Sponsors and its officers, directors, employees etc on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis. 17. The failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies. 18. Travel to collect prize and all other expenses, costs or taxes relating there to shall be the sole responsibility of the Participants. 19. Each Participant must take all reasonable steps to ensure their own health and safety and the health and safety of their parents and relatives, during participation, contest, flight in chopper.

You undertake not at any time to disclose, reveal, communicate or otherwise make public any information relating to ENIL /sponsor, its business, personnel, servants, agents or officers to anyone. 21. Participants must enter the Contest on their own behalf, entry by proxy is not allowed 22. Radio Mirchi/Sponsors accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Radio Mirchi is a mere broadcaster has no control over communications networks or lines and none of them accepts any responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Radio Mirchi shall not liable for any consequences of user error including (without limitation) costs incurred. 23. If you are dissatisfied with the Web Site, the contest or the contest rules and/or any content or any requirements of the contest, the materials available on it, or with these Terms of Use, your sole and exclusive remedy is to discontinue using the Web Site or not to participate in the contest. 24. In consideration of Radio Mirchi /Sponsors allowing you to take part in the Contest you waive and release each and every right or claim, all actions, causes of actions (present or future) what so ever, you have or may have against Radio Mirchi/Sponsors, its agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Contest or related to the Contest or Activity (ride in helicopter). 25. You undertake and irrevocable and unconditionally permit Radio Mirchi to cover the contest through various media including newspapers, radio television news channels, internet, mediums etc and shall not raise and objection, protest or demur to such coverage or in this regards To the fullest extent permitted by law, in no event will Radio Mirchi/ENIL/Sponsors or any of its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that ENIL/Radio Mirchi may engage for purposes of the Contest), be liable for any loss or damages(including without limitation loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Contest and/or the prize, even if ENIL/Radio Mirchi/Sponsors has been advised of the possibility of such damages in advance, and all such damages are expressly excluded. Each Participant/you shall indemnify, defend, and hold Sponsors/ENIL/Radio Mirchi, harmless from any third party/entity/organization claims arising from or related to his/her participation in the Contest. In no event shall Sponsors/ ENIL/Radio Mirchi be liable to the participant for acts or omissions arising out of or related to the Contest or participation in the Contest. 26. The General terms and conditions, privacy policy of the website shall be applicable in addition to any other document, indemnity, undertaking which may be given by participant, to the Activity. 27. You unconditionally agree that ENIL/sponsor is also not responsible in case the flight does not take place or is with drawn or post poned, withdrawn for any other reason whatsoever. 28. If the operation of the Competition (including without limitation the operation of the telephone/sms system or internet; the recording; broadcast etc.) of any/all the shows is prevented by an event of force majeure, the ENIL may cancel all or any part of the Competition and shall not be liable to anyone for the same. Further, in the event that the

6 flight is cancelled on the date/s of the Ganpati Vasarjan due to situation beyond control viz. Grounding of Chopper due to technical reasons, act of God, non-operation due weather conditions, act of terrorism, Government orders etc., in such eventualities the ride may completely stand cancelled and no compensation shall be given to the Winners. 29. Once the winners of Chopper ride are declared as such, thereafter neither ENIL nor the sponsors shall be responsible for execution of Chopper ride. The winners shall be directed to charter service provider, who shall be responsible for execution of the prizes won. Further, any action or claim arising in relation to the charter service provider and Chopper ride can be sustained against the charter service provider only. In no case Vodafone Essar Ltd., The Company or ENIL shall be liable in any manner to the winner in relation thereto. 30. You agree, understand, accept and undertake to strictly adhere to the terms and conditions of the Sponsors over and above the aforesaid terms and conditions. 31. If you choose to access this Site from outside India, you shall do so on your own initiative and are responsible for compliance with applicable local laws of the Country of use. 32. By clicking on the aforesaid URL you are unconditionally accepting and agreeing to the terms and conditions set out herein and also agree to the terms and conditions of the Sponsors. 33. Link to ENIL terms and conditions or to other websites sites are provided for your convenience and sponsors are neither responsible nor under obligations for their or any Third Party Content, the terms and conditions, therein. 34. The Courts of competent jurisdiction at Hyderabad / Secundrabad shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Contest. Use of this Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. 35. By taking part in this Contest each Participant agrees to accept all the terms and conditions stated herein and any other provisions /conditions imposed by the Sponsors or ENIL. Disclaimer : Vodafone Essar South Ltd (VESL) explicitly disowns any responsibility whatsoever and disclaims all liabilities in respect of any accident, neglect and/or force majeure (wholly or in part) that may arise in relation to, and / or participation in, activity "Mirchi Vinnundhi Helicopter Ekkundhi" or the helicopter ride on 22 nd Sept The Participants agree that VESL s role is clearly limited to that of a sponsor and VESL is not organizing, managing, controlling either the activity "Mirchi Vinnundhi Helicopter Ekkundhi" or the helicopter ride on 22 nd Sept 2010 and is independent organization.
