The Committee will provide contestant with 5,000 1-½ oz. cups with lids and use of the freezer truck on site to store your ice cream the day of the event.! Contestant must supply own tent tables, chairs, signage, and freezer or cooler. For People s Choice: I will pre scoop our ice cream OR I will need the committee to pre-scoop the cups. VENDOR / CONTESTANT CONTRACT AND HOLD HARMLESS AGREEMENT 2014 The vendor/contestant agrees to maintain in full force a policy of comprehensive general liability insurance under which the Toms River business Development Corporation (dba Downtown Toms River) and the Township of Toms River named as additional insured, and under which the Insurer agrees to indemnify and hold Toms River business Development Corporation (dba Downtown Toms River), and the Township of Toms River harmless from and against all costs, expense, including reasonable attorney s fees, and/or liability arising out of or based upon any all claims, accidents, injuries and damages arising out of the Vendor s negligent or improper acts in the operation at the above mentioned event(s). The vendor/contestant agrees to indemnify and save harmless the Toms River Development Corporation (dba Downtown Toms River) and the Township of Toms River from and against all claims of whatever nature arising from, or claimed to have arisen from, any action omission or negligence of the Vendor/Contestant or arising from any accident, injury or damage whatsoever caused to any person or property arising out of the Vendor s operation at the following listed events. The Vendor/Contestant agrees to name the Toms River Business Development Corporation (dba Downtown Toms River), and the Township of Toms River as additional Insured, and to provide a valid certificate of Insurance with a liability limit of at least $500,000 per occurrence. 3 Contest Rules The Festival runs from 3:00 PM 8:30 PM. Tasting kits go on sale at 3:00 PM and tasting concludes at 8:00 PM. Winners will be announced at 8:15 PM at the stage. 1. The committee will provide 5,000 1¼ oz. cups with lids. 2. The committee will pre- scoop your ice cream the week before the festival OR you can pre- scoop your ice cream. 3. If we are pre- scooping your ice cream, 65 gallons must be delivered to Toms River High School South (TRHSS) the Monday, Tuesday, or Wednesday prior to the Festival. 4. One gallon of vanilla for the Special Judges Panel also needs to be delivered to TRHSS by the Wednesday before the Festival. 5. If you pre- scoop your 5,000 cups, you may deliver the product to TRHSS by the Friday before the Festival. 6. All ice cream stored at TRHSS will be brought to the Festival site Saturday morning and stored in a freezer truck. 7. All contestants need to setup a booth 10 x 10 tent, tables, chairs, signage, freezer and/or coolers with dry ice. 8. Electricity is available for your freezer. 9. Bring staff to promote your ice cream and to handout samples to the public. (We can provide volunteers to handout samples.) 10. The public will purchase a tasting kit that includes a spoon, a napkin and a voting ballot. 11. They will hand you a stub from the ballot to receive an ice cream sample. When they have tasted all of the contestants ice creams, they will vote for their favorite local and national flavors at the Voting Tent. 12. We will provide you with rack cards promoting the Festival to display in your store. 13. The public can purchase tasting kits in advance.

4 Ocean County Board of Health s Food Safety Requirements for Contestants 1. Proof of food sources required. a. Receipts for food purchased ready to cook at event. b. Copy of commissary inspection for any food prepared off site. 2. Protect all foods on display from contamination (i.e., dust, flies, consumer access). 3. Personal hygiene a. No bare hand contact; barrier between hand and food required; use of gloves, utensils encouraged. b. Effective hair restraints; use of clips/tie backs/bands encouraged. c. No smoking or eating allowed in booths; after doing both, hands must be washed. d. No aprons to be worn outside food stands; aprons needed for all food handling. 4. Temperatures in coolers need to be <41F maximum (with thermometers). a. Hot foods need to be kept at 135F minimum or better; stem typed or thin probe thermometer required. b. Bay sink is to be labeled wash, rinse, sanitize, air- dry. 5. Hand wash stations, i.e., urns or coolers with spouts, must be posted with hand wash sign provided with soap & paper towels; provide catch bucket below water container. 6. Stored food and clean kitchenware must be kept 6 above the ground, covered where needed to protect against insects and weather conditions. 7. Contain trash and dispose of appropriately at end of event.
