3 Foreword Wilks is proud to be one of the world s leading companies in the manufacture and supply of impact protection and synthetic teak decking systems. Since 1973 we have supplied many leading boat builders with their profiles and our customer base spans the globe. We manufacture a wide range of fendering profiles for boat and pontoon applications as well as accessories for other marine uses including Dek-King, a superb alternative to teak decking. At our premises we hold a vast stock of profiles in flexible PVC, rigid PVC, PVR, stainless steel, aluminium and rubber; but as manufacturers we can also supply to meet your individual trade requirements. 4 Warranty Dek-King 5 Year Material Warranty At Wilks we strongly believe in the quality and performance of our Dek-King range and offer a 5 year material guarantee on our profiles to reflect this confidence. Limited Warranty for Dek-King Profile Range This warranty applies only to Dek-King profiles ( Product ) produced by Wilks (Rubber Plastics) Mfgs Co Ltd that are sold, installed and used globally. This warranty is extended to the first end-user purchaser only ( Purchaser ). The warranty period shall commence on the date of the original purchase by the Purchaser (the Commencement Date ). 1. Limited Product Warranty Five-Year Repair or Replacement. Wilks (Rubber Plastics) Mfgs Co Ltd warrants the Product(s) to be free from defects in material and workmanship under normal application, installation, use, storage, transportation, handling and service conditions. If the Product(s) fails to conform to this warranty, Wilks (Rubber Plastics) Mfgs Co Ltd will, at its sole option, either repair or replace the Product(s). This warranty shall extend for a period of sixty (60) months from the Commencement Date (the original product warranty period ). This repair or replacement remedy shall be the sole and exclusive remedy provided under this warranty and the original product warranty period remains in effect and will not be extended, nor will any new warranty period begin, upon repair or replacement of defective Product(s) or parts. This Limited Product Warranty is subject to provisions and limitations in sections 2,3,4,5,6,7 and Limited Warranty Exclusions. 5 Warranty c) Lack of compliance to Wilks (Rubber Plastics) Mfgs Co Ltd installation instructions, and/or instructions contained in the Data Sheet. d) Alteration or improper application. e) Damage from abuse, alteration, installation or improper repair. f) Improper storage, handling, packaging or transportation. g) Damage from external stress, such as falling items. h) Damage from environmental pollution such as acid rain. i) Damage from non-compatibility of Product(s) with unapproved components. j) Damage from extreme natural conditions or fire. k) Damage that is the result of normal wear and tear, aging or continuous use. l) Expiration of warranty period, no evidence of purchase, no proof of purchase date, no proof of purchase from official Dek-King distributor. Note: in order to satisfy proof of purchase, proof of purchase date, proof of purchase from an official Dek-King distributor the Purchaser must retain throughout the warranty period and provide to Wilks (Rubber Plastics) Mfgs Co Ltd at the time of the claim the original invoice provided to the Purchaser at the time of the Product s purchase. 3. Limitation of Warranty. The express warranties set forth herein shall constitute the only warranties applicable to the Product(s). Wilks (Rubber Plastics) Mfgs Co Ltd hereby expressly disclaims any and all other warranties, expressed or implied, including without limitation the warranties of merchantability or fitness for particular purpose, use, or application, and all other obligations or liabilities on Wilks (Rubber Plastics) Mfgs Co Ltd part, unless such other warranties, obligations or liabilities are expressly agreed in writing by Wilks (Rubber Plastics) Mfgs Co Ltd. Wilks (Rubber Plastics) Mfgs Co Ltd shall not be responsible or liable in any way for damage or injury to persons or property, or for other loss or injury resulting from any cause whatsoever arising out of or related to the Product(s), including without limitation, any defects in the Product(s), or from use or installation. In no event shall Wilks (Rubber Plastics) Mfgs Co Ltd be liable for incidental, consequential or special damages, loss of use, loss of profits, loss of production, or loss of revenues for any reason whatsoever. Wilks (Rubber Plastics) Mfgs Co Ltd total liability, if any, in damages or otherwise, shall not exceed the invoice value paid by the customer for the product or service furnished, which is the subject of the claim or dispute. The above limitations or exclusions may not apply in some countries that do not allow limitations on implied warranties or the exclusion of damage. Page 5

6 Warranty 4. Obtaining Warranty Performance. Purchasers who believe they have a justified claim covered by these Limited Warranties must immediately notify the distributor who sold the Product(s) to the Purchaser or Wilks (Rubber Plastics) Mfgs Co Ltd directly at the following address: Wilks (Rubber Plastics) Mfgs Co Ltd Woodrolfe Road, Tollesbury, Essex, CM9 8RY, ENGLAND Telephone: +44(0) Fax: +44(0) sales@wilks.co.uk Together with the notice, the Purchaser must also provide evidence of proof of ownership, date of purchase, traceability reference code (found either directly on Product or on Product packaging) and detailed description of the nature of the defect claimed. The distributor who sold the Product(s) to the Purchaser should be able to assist in this regard. The Purchaser should also provide such other evidence as may be requested by the distributor or Wilks (Rubber Plastics) Mfgs Co Ltd at the time of the claim. Note that the return of any Product(s) in relation to any claim under the Limited Product Warranty will not be accepted by Wilks (Rubber Plastics) Mfgs Co Ltd unless accompanied by a valid return material authorisation and prior issued written authorisation issued by Wilks (Rubber Plastics) Mfgs Co Ltd. Warranty claims will be investigated and laboratory tests will be undertaken if deemed necessary. 5. Severability. If a part, provision or clause of this Limited Warranty, or its application to any person or circumstance is held invalid, void or unenforceable, such holding shall not affect this Limited Warranty and all other parts, provisions, clauses or applications shall remain, and, to this end, such other parts, provisions, clauses or applications of this Limited Warranty shall be treated as severable. 6. Disputes. The Purchaser may bring no action, regardless of form, arising out of or in any way connected with this Limited Warranty, more than six (6) months after the cause of action has occurred. THIS LIMITED WARRANTY GIVES THE CUSTOMER SPECIFIC LEGAL RIGHTS: CUSTOMERS MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM COUNTRY TO COUNTRY. 7. Replacements. Product(s) that is replaced by Wilks (Rubber Plastics) Mfgs Co Ltd shall become the property of Wilks (Rubber Plastics) Mfgs Co Ltd. Wilks (Rubber Plastics) Mfgs Co Ltd reserves the right, at its sole option, to deliver another type of new or refurbished Product(s) that may differ in size, colour, shape or reference number. Force Majeure Wilks (Rubber Plastics) Mfgs Co Ltd shall not be held responsible or liable to the Purchaser or any third-party arising out of non-performance or delay in performance of any terms or conditions of sale, including this Limited Warranty, due to acts of God, war, riots, strikes, unavailability of suitable and sufficient labour, material, die or capacity or technical or yield failures and any unforeseen event beyond its control, including, without limitations, any technological or physical event or conditions which is not reasonable know or understood at the time of the sale of the Product(s) or the claim. 8 Maintenance and Care Whilst Dek-King greatly reduces the level of maintenance required in comparison to teak deck, it does not eliminate the need to maintain it entirely once installed. As with all flooring products, any spillages should be attended to as soon as possible. We are unable to offer our 5 year warranty on a deck where lack of care or maintenance is apparent, or damage caused to the material through contact with chemicals or solvents. The following information is provided to assist in the care of Dek-King. Your local Dek-King installer will also be happy to answer any questions that you may have with regard the upkeep of your deck. Maintenance A simple wash using soap and water should be sufficient to remove everyday dirt, grime and general spillages. A nylon brush can also be used to help release debris from the surface. Unlike teak decks, pressure washers can be used upon Dek-King to give a thorough clean over larger areas. Liquids such as fish blood, oil, suntan lotion or red wine should be cleaned as soon as possible. Allowing the liquid to dry could result in a stain which is more difficult to remove. Should any surface staining occur we recommend using a piece of 40 grit sandpaper rubbed along the grain using short strokes. This will remove most marks and return the area to it s original colour. This may be lighter than the surrounding area but should blend over a short period of time. Power sanders are not recommended as they can easily create an uneven surface or cause damage to the profiles and joins. It is the customer s responsibility to regularly clean and maintain their Dek-King deck. Dek-King will naturally darken over time, a light sanding may restore the surface to its original colour if desired. By keeping your Dek-King in a clean and maintained state you will not only keep your deck looking good but will also ensure that it lasts for years to come. Care As with all boat decks, the use of deck shoes will reduce the likelihood of marking or damage caused to your deck. Black soles should be avoided as they may leave marks upon the surface. High heeled shoes should not be used upon the deck as dent could be caused upon the surface. Care should be taken with furniture or heavy objects as it may be possible to dent the surface of Dek-King, especially through dropped items. The force of such actions may cause permanent damage to the product surface. Do not place hot objects on synthetic teak decking as this can cause heat marks or burns upon the surface which may prove difficult to remove. Leaving metal objects and other such conductors upon the surface under direct sunlight may also lead to such issues especially in hot climates. Page 8

9 Maintenance and Care Chemicals or Solvents Damage caused by chemicals or solvents such as bleach or acetone will void our warranty. Any spills of such liquids should be rinsed with water as soon as possible to prevent staining. Failure to clear such spillages may result in damage which could ruin the material. Dek-King is a non-slip product and the application of any liquid surface covering may result in a loss of these properties. The use of these liquids (i.e. paint, varnish, oil, sealant) will void the warranty upon the product. Citrus based cleaning products must not be used to prepare the deck prior to installation or to clean around areas of exposed adhesive such as panel edges. Citrus acids are harmful to the adhesives used with Dek-King and using them will void any warranty offered by the installer, fabricator, distributor or manufacturer. Further advise on areas of exposed adhesive: Clean with clean water; Never scrub the adhesive/sealant with a hard bristle/brush; Do not use (strong) alkalis, such as ammonia, bleach, chlorine, caustic soda or sodium hydroxide; Do not use (strong) acids, such as oxalic acid, phosphoric acid, sulphuric acid, hydrochloric acid, acetic acid or citric acid; Do not use natural solvents such as lemon- or pinene-based cleaners; Do not use household detergents or other neutral cleaners such as lemon- or pinenebased cleaners, ammonia, bleach, green soap or the like; Do not use 2-component cleaners and or brighteners of any kind; Do not use oils or grease on the adhesive/sealant; Do not spill fuels or motor oils. Templates and Fitting Dek-King panels that are fabricated to templates are produced as accurately as possible. It is only natural that any errors or inaccuracies created during templating will be reflected in the mats that are supplied. The provision of accurate templates is the responsibility of the template manufacturer. All quotations made are subject to change should it be discovered that inaccuracies are present in the details that were originally supplied. Dek-King is designed to be fitted to an even and level surface. It should not be used to cover any deficiencies present upon a surface. Wilks 5 Year Material Warranty on our Dek-King profiles covers defects created during the manufacturing process or in the structural performance of the base compound. Page 9

10 Maintenance and Care If a person other than a certified Dek-King distributor or installer tries to fit the product this will void the warranty. Notes Dek-King has been designed and manufactured to replicate the graining found on natural timber, therefore the graining effect we provide will differ between planks. This non-uniformity is intentional and an inherent feature of the product. Due to the colouring, Dek-King may become hot under direct sunlight. In such cases we recommend the wearing of deck shoes in order to walk comfortably upon it. Any burn marks upon the surface will void the Dek-King warranty. Page 10
