1 DEMOLITION 535 Fraser Street Request for Quotations Quotations are invited for the demolition and removal of a house and site remediation located at 535 Fraser Street, Esquimalt. The Township of Esquimalt has undertaken sampling within the house to determine whether any environmental abatement is required prior to demolition. The successful bidder will be responsible for completing abatement works required and for arranging appropriate disposal of contaminated materials considering all environmental and regulatory requirements. 2 REQUIREMENTS INSURANCE The Company shall obtain, and maintain at all times, insurance in the following manner and amounts: a) Comprehensive general liability providing coverage for a minimum of $5,000,000 per occurrence, against liability for bodily injury or death and/or damage to property on an all?risk basis. The Township of Esquimalt shall be listed as an Additional Insured under this Policy; b) Motor vehicle insurance for public liability providing for a minimum of $2,000,000 covering use or operation of all motor vehicles and trailers owned, leased, hired or controlled by the Company and used or operated in the performance of the contract; If the Contractor hires a sub?contractor to perform any work related to the Services, the Contractor shall, in turn, cause such sub?contractor to obtain Commercial General Liability insurance on the same terms as outlined above. Such insurance shall name the Township as an additional insured and shall include coverage for all operations required for the Contractor s work under this Agreement, including, but not limited to, excavation, blasting, shoring, underpinning and pile driving. COMPLIANCE WITH LAWS AND RESOLUTION OF DISPUTES The Contractor shall comply with all applicable federal, provincial, municipal and regulatory laws, statutes, regulations, or bylaws. This Agreement and all disputes arising out of or in connection with this Agreement or in respect of any defined legal relationship associated with it or derived from it shall be governed by the laws of the Province of British Columbia. ESQUIMALT BUSINESS LICENSE The Contractor shall conform to the Township of Esquimalt License Bylaw and, where required under the Bylaw, obtain and maintain a valid Esquimalt business license throughout the duration of the work. WORKERS COMPENSATION BOARD The Contractor shall be deemed to be the Prime Contractor within the meaning of the Part 3 Division 3, Section 118 (1) of the Workers Compensation Act [RSBC 1996] Chapter 492. The Contractor shall have a written safety program in place that meets the requirements of Part 3 of the Workers Compensation Act and Part 3 of the WCB OHS Regulation. 2

3 The Contractor s attention is drawn to Part 20 of the WCB OHS Regulation. Prior to commencing construction work, the Contractor shall furnish the Workers Compensation Board with the written notice of project as required by the above?mentioned regulations with a copy to the Township. The notice shall state that the Contractor is the Prime Contractor. The Contractor shall ensure that all Workers Compensation Board safety rules and regulations are observed during the performance of this contract, not only by the Contractor but also by all sub?contractors, workers, material suppliers and others engaged in performance of this contract. In addition, the Contractor is to complete a copy of the Form 30M33, issued by the Workers Compensation Board relating to the operation of equipment or work being done in proximity to overhead power lines. Photocopies of the notice and the completed 30M33 form are to be delivered to the Township. The Contractor shall indemnify the Township and hold the Township harmless from all manner of claims, demands, costs, losses, penalties and proceedings arising out of or in any way related to unpaid Workers Compensation Board assessments owing from any person employed on the work by the Contractor, by its sub?contractors or by any other person doing or contracting to do all or any part of the work of this contract or arising out of or in any way related to a failure to observe safety rules, regulation and practices of the Workers Compensation Board, including any penalties levied by the Workers Compensation Board. 3

6 Specifications 1. General Specifications for Demolition To provide all materials, labour, and equipment to deconstruct and demolish the building and fencing specified in the scope of work, including removal and legal disposal of all materials, in accordance with the Municipal Master Specifications and the following: 1.1 Install construction fencing around the entire site. Demolish the building, asphalt, some bushes, fencing, and other outdoor wooden structures and remove all materials in accordance with the National Building Code and the CSA Standard S350?M1980 Code of Practice for Safety in Demolition of Structures and all applicable laws, codes, bylaws and regulations. The vacant lot immediately North of the site can be utilized for access and storage of equipment and bins. 1.2 Site restoration: Site must be restored to as good or better on level ground. 1.3 The Contractor shall provide erosion and sediment control as required to ensure no discharge into watercourses of materials or sediment. 1.4 The Contractor shall conduct his operations so as to cause the minimum obstruction and inconvenience to traffic and to people in the park. No greater quantity of work shall be undertaken at any one time than can be properly conducted with due regard for the right and interest of the public as may be determined by the Township of Esquimalt. 1.5 The Contractor must comply with all Work Safe BC rules and regulations. 1.6 The Contractor shall keep the work under his personal control. The Contractor shall not, without the consent, in writing, of the Township of Esquimalt, assign or transfer this contract, or any sum or sums, or any part thereof, due or to become due to the Contractor under this contract. 1.7 The Contractor shall not begin demolition or removal of salvage without prior written consent of the Township of Esquimalt. Approval shall not be granted until receipt of all required documents and permits have been obtained by the Contractor. 1.8 Drawings or descriptions, verbal or otherwise of existing structures or their locations that are given to the Contractor are intended only as an aid to this location of these structures and are not guaranteed to be accurate, and must be verified by the Contractor prior to proceeding. 1.9 Remove and disposal of all contaminated and hazardous materials such as but not limited to: asbestos, paint, Freon, P.C.B s, etc. shall be in accordance with all levels of Government rules and regulations. 2. General Requirements for Hazardous Material Removal 2.1 This scope of work includes the removal of asbestos containing, contaminated, and hazardous materials and demolition and deconstruction of buildings within Esquimalt. 2.2 Asbestos removal for this project will be conducted under appropriate work conditions as defined by Work Safe BC and the Ministry of Environment. 6

7 2.3 All buildings are to be deconstructed or demolished in accordance with specifications and the scope of work, following the removal of all hazardous materials. 2.4 The areas identified as asbestos containing are listed in the Hazardous Materials Report. 2.6 All quantities in this specification are approximate, and it is the responsibility of the Contractor to verify actual amounts. Any discrepancies greater than 10% of the specified amount are to be brought to the Township of Esquimalt s attention prior to the submission of tenders. Any discrepancies identified after the close of the Invitation to Tender will not be considered. 2.7 All services to the property will be disconnected and capped by the Contractor 2.8 The Contractor will be responsible to supply all power and water during the demolition. 3. Asbestos Abatement 3.1 The removal of all known asbestos containing materials must be performed by competent persons trained, knowledgeable and qualified in the handling and disposal of asbestos materials. 3.2 Any worker deemed by the Township of Esquimalt to be inadequately trained to perform these duties will be removed from the project. The Contractor will provide the necessary documentation to demonstrate that the site superintendent has attended Work Safe BC recognized asbestos training courses. 3.3 Any platforms used to access the asbestos materials will be constructed in accordance with OH&S regulations. 3.4 All necessary documentation will be the responsibility of the Contractor. 3.5 The health and safety of all employees and subcontractors is the sole responsibility of the Contractor. 3.6 All work is to be carried out between the hours of 7:00 am and 7:00 pm Monday to Friday unless otherwise directed by the Township of Esquimalt. 3.7 The Contractor shall provide all necessary labour, materials, insurance, permits and equipment necessary to carry out the work in accordance with all applicable regulations. 3.8 All electrical connections necessary to the Owner s supply system will be the responsibility of the Contractor. 3.9 If required, air monitoring and inspection of all areas of work prior to completion will be completed by the Contractor. 4. Disposal Requirements 4.1 All material shall be removed from the work area and shall not be left on the work site following completion of the demolition. Waste material shall be transported to an approved landfill for disposal. The Contractor shall obtain all necessary permits prior to commencing work. 4.2 Disposal of all asbestos waste will be conducted in accordance with the Ministry of Environment and all WorkSafe BC regulations pertaining to hazardous waste. 4.3 In the event of accidental release of asbestos debris during transportation the Contractor shall be fully responsible for all costs associated with the clean?up. 4.4 The Contractor shall supply waste receptors clearly marked as being asbestos containing which shall be stored on site in a locked bin until such time as the bin is full and ready for transportation by the Contractor. 7

8 5. Management Service Air Monitoring 5.1 If required, all air monitoring will be the responsibility of the Contractor. 5.2 All barriers will remain in place until air clearance (if required) has been confirmed. Once the clearance is confirmed, the Contractor shall remove all barriers and signs. 6. Project Management 6.1 The Contractor shall work under the direction of the Township of Esquimalt for all matters and demolition issues not related to hazardous materials. 6.2 The Contractor shall coordinate all work scheduling with the Township of Esquimalt. 6.3 Inspections not related to hazardous materials will be conducted by the Township of Esquimalt. 6.4 The Township of Esquimalt shall have full access to all documentation. 6.5 No unscheduled work shall be undertaken without the expressed permission of the Township of Esquimalt. 6.6 Results of hazardous materials sampling are included in the Environmental Report. 6.7 While not mandatory, the Township of Esquimalt would prefer bidders submit a copy of their intended work procedures and schedule for review with their quotation. 6.8 Should conflict arise between Federal, Provincial, or the Corporation s requirements, in the general the most stringent ruling will apply. 7. Road Closures and Traffic Control 7.1 If required, the Contractor shall provide all flag people, cones, barricades, lights, signs, etc., required to maintain safe and adequate traffic flow at the work site. Every effort shall be made to maintain a movement of traffic at all times, with minimum delay at all times, and provision shall all times be made for emergency vehicles. 7.2 All traffic control signs and barricades must be at least to the standard as given in the latest edition of the Traffic Control Manual for Work on Roadways published by the BC Ministry of Transportation. If requested by the Township of Esquimalt construction advisory signs, to the Township of Esquimalt requirements, shall be posted at each end of the construction site. 7.3 Should a lane closure become necessary, a traffic management plan of the proposed signing to be used, shall be approved by the Township of Esquimalt before the detour is put into effect. Road closures will not be allowed. 7.4 The Contractor shall be fully responsible to ensure debris does not interfere with vehicle or pedestrian thoroughfares, as the case may be. 8
