1 Dear Owner: Here is some important information regarding the ARB Application process for proposed exterior work on a unit: ARB Application Form 1. Fill-in owner name, unit address, Area and telephone number. Include a description of proposed work to be done with specifications and a plan or drawing. 2. Provide contractor information, including contractor license and certificate of insurance. 3. Owner/Applicant s signature required. 4. Area President s approval & signature Waiver of Liability Owner to complete, date and sign. $500 Deposit for Major Architectural Exterior Renovations on Villas and Apartments Remit a $500 deposit payable to Quail Ridge POA (Deposit will be returned after the work has been inspected, is in compliance with ARB Guidelines and all permits finalized). Dumpster Authorization Request Form If your project requires the use of a waste dumpster, a Dumpster Request should be completed and returned to the ARB Compliance Coordinator as soon as possible for authorization. ARB APPLICATION PROCESS When the application is submitted in its entirety, it will be presented to the ARB Committee for approval. Upon approval, you will be notified and can proceed with the proposed work. Any changes to the original application will require approval (Area and ARB Committee) and possibly a new application. Please note that Quail Ridge requires all contractors performing work on the property be licensed and insured. If work is being performed inside the unit, it is the Owner s responsibility to hire licensed and insured contractors and that all required construction permits are obtained by Palm Beach County. 4 WAIVER OF LIABILITY Name (hereinafter Owner ) (Print) Address, seeks approval for said addition, change, or alteration to the above-mentioned Unit. Owner shall be responsible for all costs and expenses in the addition, change or alteration of said Unit. All such work shall be completed in good workmanship manner in accordance with all applicable laws, ordinances, rules, regulations and requirements of all governmental bodies or officers having jurisdiction over such work. Before such work is commenced, owner shall obtain all required permits, insurance, and authorization (ARB approval). Owner shall pay all costs, expenses and damages to repair any portion of the common areas damaged by subcontractors, material, men, mechanics or other third parties rendering goods, services to said Unit. Owner expressly understands that Association approval and disapproval will be based on any ground including without limitation, aesthetic reasons, to maintain and protect the value of property within Quail Ridge. If requested, owner shall seek and pay for architectural and engineering opinions on said plans from respective professionals in the field. Owner shall indemnify and hold the Association free and harmless from and against all liability caused by or arising from any acts, which may increase the susceptibility to loss on the described property or common areas, and any loss, claim or damage by reason of any injury, accident or damage to any person or property, including common areas of the Association arising out of or in any way relating to the addition, change or alteration to the Unit, occasioned wholly or in part by any act or omission of the Owner, contractor, or other third party rendering services or goods, In the event that the Association shall be made a party to any litigation commenced against Owner concerning addition, change or alteration to the Unit, then the Owner shall defend, protect and hold the Association harmless and pay all attorneys fees, costs and expenses incurred by them in connection with such litigation. In connection with any dispute, litigation, enforcement, or interpretation of the Waiver of Liability, Association shall be entitled to recover reasonable attorney s fees, including appellate and post judgement proceedings, costs and expenses. APPROVES $500 DEPOSIT FOR MAJOR ARCHITECTURAL EXTERIOR RENOVATIONS ON VILLAS AND APARTMENTS NOT TO WORRY, YOUR MONEY WILL BE REFUNDED TO YOU WHEN THE WORK HAS PASSED INSPECTION & ALL PERMITS ARE FINALIZED. At the December 11, 2007 P.O.A. Board Meeting, a recommendation by the Architectural Review Board was unanimously approved that requires a $500 deposit on all major material changes for exterior architectural renovations. This is not a fee. It s a temporary deposit that will be refunded approximately 14 days after the ARB Compliance Coordinator inspects the completed project to verify that it is in compliance with the ARB Application and all permits have been finalized with Palm Beach County. However, if there is damage to the common area, and the contractor has not repaired it, all or part of the deposit will be used for the necessary repairs. It is the unit owners responsibility to make sure the contractor repairs any damage to the property. Q & A What jobs are considered major changes? Screen enclosures, pavers, roofs, garage enclosures, window replacements, hurricane shutters, plus other unspecified renovations. Who do I call to arrange for an inspection? The inspection is required on all exterior projects. Contact the ARB Coordinator, Barbarann Larrabee at extension When is the $500 deposit due? When you submit the ARB application. What is the reason for the deposit? Three reasons: (1) To ensure that residents notify the ARB for an inspection when their project is completed (2) To make sure the project is in compliance with their ARB Application (3) To correct all damage done to common property. The Area President and Security must be notified and permission granted to allow the dumpster on property. Dumpster location must be approved by the Area President and Security. Dumpster must be emptied when debris is visible to the eye. When there is a hurricane watch the dumpster must be emptied and covered with a tarp. Dumpsters are allowed for 30 days. If you have a construction project that requires the need for a dumpster, Quail Ridge will only allow access to Waste Management ( ) or Solid Waste Services (SWS) at Dumpsters for apartment areas are not allowed during the season (November to May).
