1 Terms & Conditions of the Access Plan: 1. Each service included in the Plans is subject to the General Terms and Conditions of HKBN (please visit: hkbn.net/tnc/en/general.html), Special Terms and Conditions of Broadband Service (please visit hkbn.net/tnc/en/broadband.html), Special Terms and Conditions of HKBN Wi-Fi Service (please visit hkbn.net/tnc/en/hkbn_wi-fi.html) other Terms and Conditions stated in this registration form. Subscriber understands and agrees that HKBN has the absolute right to revise all the terms and conditions from time to time, while HKBN will endeavour to give 30 days' prior notice to Subscriber before such revision takes effect. 2. Access Plan will only be applicable to Subscriber whose service installation address is at designated residential area with no provision of HKBN broadband service within 120 days prior to registration. 3. Subscriber must commit to a designated Access Plan with a 30-month Minimum Commitment Period and have the broadband service successfully installed. 4. Subscriber must pay an installation fee of $380 for Access Plan. If the Plan(s) is/are terminated within the Minimum Commitment Period after the cooling-off period of installation of residential fixed telecommunication network services for whatever reasons, HKBN shall have the right to charge the Subscriber $300 of the standard installation charge for Access Plan and $680 for each of the other Plan(s) subscribed. 5. Should Subscriber requires re-installation of the service(s) of the Plan(s) due to any change of service installation address, installation fee for service relocation or any amount as HKBN shall stipulate from time to time will be charged. For details, please refer to hkbn.net/charge/en. 6. If any service of the Plan is terminated, other service(s) included in the same plan will also be terminated. 7. If the Plan(s) is/are terminated within the Minimum Commitment Period for whatever reasons, Subscriber shall pay the total amount of the special monthly fees payable for the remaining Minimum Commitment Period to HKBN as liquidated damages. If Subscriber terminates the Plan(s) as a result of moving to area without HKBN's service coverage, liquidated damages payable shall then be the sum of the following amounts : (i) any installation charge previously waived or any difference between the standard installation fee and installation fee paid; and (ii) if applicable, pro-rata listed price of premium calculated by remaining contract months to fixed Minimum Commitment Period (e.g. if listed price of premium is $2,400, Minimum Commitment Period is 24 months, Subscriber terminates the contract 6 months prior to expiration of Minimum Commitment Period - pro-rata calculation will be : $2,400 / 24 X 6 = $600). The listed price of premium shall be the amount as set out by HKBN. Subscriber agrees that HKBN can set off the liquidated damages with prepayment (or any part thereof) of related service and Subscriber shall pay the remaining balance of liquidated damages after set off, if applicable. The above liquidated damages are genuine pre-estimate of loss and not penalty. All offers in the Plan(s) will also be terminated. 8. Any payment made to HKBN will be non-transferable and/or non-refundable. 9. If the Subscriber terminates any of the Plan(s), Subscriber is required to give at least 30 days' prior notice to HKBN. All equipment (if applicable) provided by HKBN must be returned to HKBN shops (For shop locations, please refer to hkbn.net/shop/en) within 30 days after termination date of the Plan(s). If Subscriber fails to return the equipment within the said period or in case of any loss of or damage to the equipment or any part thereof, HKBN will charge the Subscriber with rates specified by HKBN from time to time. For details, please refer to hkbn.net/charge/en 10. If the Subscriber continues to use the Plan and/or Value-added Plan(s) after the Minimum Commitment Period, Subscriber will be charged at the after Minimum Commitment Period (i.e. Standard monthly fee: $433).
2 11. Other charges for the individual service(s) of the Plan are stated in the Terms and Conditions of the specified service. 12. Subscriber may select "Service Commencement Date" for the Access Plan provided that this date must be within 180 days after service installation date. Services included in the same Plan(s) will become effective on the "Service Commencement Date". Subscriber must confirm the "Service Commencement Date" before service installation and the contract will commence on the "Service Commencement Date" once confirmed. Subscriber understands that service will be temporarily suspended from service installation date to the "Service Commencement Date". If Subscriber terminates the subscribed Plan(s) after service installation date and before the "Service Commencement Date" for whatever reasons, Subscriber shall pay a total amount of remaining special monthly fee within Minimum Commitment Period to HKBN as liquidated damages, and all the offers will also be terminated at once. Terms & Conditions of the Communication Plan (If applicable) : 1. Each service included in the Plans is subject to the General Terms and Conditions of HKBN (please visit: Special Terms and Conditions of Home Telephone Service (please visit Special Terms and Conditions of Number Porting (Number Switch Over) Service (please visit Special Terms and Conditions of IDD 0030 Service (please visit other Terms and Conditions stated in this webpage. Subscriber understands and agrees that HKBN has the absolute right to revise all the terms and conditions from time to time, while HKBN will endeavour to give 30 days prior notice to subscriber before such revision takes effect. 2. The service installation address of Communication Plan must be the same as Access Plan. 3. The Value-added Plans of the Communication Plan will only be applicable to subscriber who subscribes to Access Plan at the same time and have the broadband service successfully installed. If the broadband service of Access Plan cannot be installed successfully for whatever reasons, Communication Plan subscribed will be cancelled at once. 4. Subscriber who has successfully registered the Plan is entitled to calling time of 100 minutes per month ( Prescribed Calling Time ) for calling from registered Home Telephone number(s) and/or mobile number(s) to the landline numbers and the mobile numbers in Mainland China, United States of America, Canada, Singapore, and the landline numbers in the United Kingdom, Australia, France, New Zealand, Germany, South Korea, Japan, Taiwan, Malaysia, Austria, Belgium, Denmark, Ireland, Italy, Norway, Spain, Sweden, Switzerland, and Netherlands ("Specified Destinations"). The Prescribed Calling Time is not applicable to calls made to special telephone numbers in United Kingdom with prefix 4456, 447, 448 or 449 and telephone numbers in Japan with prefix Subscriber shall be entitled to enjoy a special rate at $0.38 per minute for calling from Specific Landline of HKBN Home Telephone service plan to the aforementioned Specified Destinations ("Special Rate") after the Prescribed Calling Time for each month has been used up. Calls made to destinations other than the Specified Destinations shall be charged at the respective Standard Rate Plan for the IDD 0030 Service subscribed by subscriber. HKBN reserves the rights to amend, vary the rates from time to time without notice. For details of Standard Rate Plan, please contact: If the Plan(s) is/are terminated within the contract period for whatever reasons, subscriber shall pay the total amount of the special monthly fees payable for the remaining contract period to HKBN as liquidated damages. If subscriber terminates the Plan(s) as a result of moving to area without HKBN's service coverage, liquidated damages payable shall then be the sum of the following amounts : (i) any installation charge previously waived or any difference between the standard installation fee and installation fee paid; and (ii) if applicable, pro-rata listed price of premium
3 calculated by remaining contract months to fixed contract period (e.g. if listed price of premium is $2400, contract period is 24 months, subscriber terminates the contract 6 months prior to contract expiry - pro-rata calculation will be : $2400 / 24 X 6 = $600). If subscriber fails to return the equipment within the said period or in case of any loss of or damage to the equipment or any part thereof, HKBN will charge the subscriber with rates specified by HKBN from time to time, details please refer to 7. If the subscriber continues to use the Plan and/or Value-added Plan(s) after the contract period, subscriber will be charged at the after contract period (i.e. Standard monthly fee). 8. Subscriber may select "Service Commencement Date" for the Communication Plan provided that this date must be within 180 days after service installation date. Services included in the same Plan(s) will become effective on the "Service Commencement Date". Subscriber must confirm the "Service Commencement Date" before service installation and the contract will commence on the "Service Commencement Date" once confirmed. Subscriber understands that service will be temporarily suspended from service installation date to the "Service Commencement Date". If subscriber terminates the subscribed Plan(s) after service installation date and before the "Service Commencement Date" for whatever reasons, subscriber shall pay a total amount of remaining special monthly fee within contract to HKBN as liquidated damages, and all the offers will also be terminated at once. 9. For subscribers who choose to use the existing fixed line phone number at HKBN, subscribers shall not terminate the telephone service with original telephone service operator before the number porting service activates. 10. HKBN will provide a temporary number to subscriber who selects to Retain and Port In the Existing Telephone Number and the temporary number will automatically be deleted 10 days after the successful ported-in of the above Existing Telephone number. For Subscriber selecting Retain and Port In the Existing Telephone Number, if the information submitted by the subscriber is incomplete or incorrect or if, due to reasons which are not controlled by HKBN, the application for Retain and Port In of Existing Telephone number is not successful within 180 days after installation of Home Telephone service, the application of porting in existing telephone number will not be processed under this circumstance. 11. Home Telephone service Value-added Combo includes Caller Display, Call Waiting, Conference Call and Block-the-blocker. 12. Home Telephone service cannot run properly in case of power failure and hence not suitable for connecting to Personal Emergency Link Service or for users relying on Personal Emergency Link Service. 13. If Home Telephone service is not successfully installed at/not applicable to subscribers service installation address, HKBN will substitute the service with Broadband Phone (if applicable). 14. IDD 0030 services will become effective on the date the Communication Plan commences.
4 15. If the commencement date of the IDD 0030 service is not on the first day of a calendar month, the Prescribed Calling Time of the first calendar month will be calculated on a pro rata basis. 16. If subscriber is entitled to calling time other than the IDD 0030 monthly plan registered under subscriber s account, such calling time should be used up before the Prescribed Calling Time will start to be deducted from the relevant account. 17. The Specific Calling Time and Special Rates will be calculated on a per-minute basis according to HKBN's call records. Each individual call charge will be rounded up to the nearest 10 cents. 18. The Specific Calling Time and Special Rates are not applicable to calls received and/or answered in Hong Kong, the People's Republic of China or overseas via IDD 0030 International Call Forwarding Service, and not applicable to calls made to Immarsat or Intelsat. 19. The Subscriber makes calls to destinations other than the Specified Destinations shall be charged at the respective Standard Rate Plan for the IDD 0030 Service subscribed. HKBN reserves the right to amend and vary the rates from time to time without prior notice. For details of Standard Rate Plan, please contact: Unused Specific Calling Time of the respective billing cycle shall be forfeited and cannot be carried forward to the next billing cycle, redeemed for cash or transferred to other subscribers. The Specific Calling Time and Special Rates shall be forfeited immediately in the following circumstances: (i) if the Subscriber fails to settle any outstanding payment with HKBN; (ii) if subscriber's HKBN IDD account has been terminated. In these circumstances, HKBN shall charge the Subscriber for all calls made (if any) whereby such calls shall be charged at the respective Standard Rate Plan for the IDD 0030 Service subscribed. IDD 0030 Service will remain available to the registered telephone number(s) of the IDD 0030 Service, and that any calls shall be charged at the respective Standard Rate Plan for the IDD 0030 Service subscribed. 21. The delivery of International Calling Line Identification (CLI) is not guaranteed, it may subject to the calling party, the remote end carrier and other environmental factors. Terms and Conditions of Cooling-off Period after Registration: 1. Subscriber is entitled to a 14-day cooling-off period commencing from the date following the registration of designated service plan of residential fixed telecommunications network services (which includes Home Broadband and/or Home Telephone) ("FTN Services"). Subscriber may cancel the service plan(s) registered within the cooling-off period without any charges by sending to HKBNbroadband@hkbn.net. However, the cooling-off period will immediately cease to apply if (i) subscriber has collected any premium; or (ii) completion of installation whereby the cooling-off period after installation commences. For details, please refer to the "Terms and Conditions of Cooling-off Period after Installation" below. 2. If any service of a service plan is cancelled during cooling-off period, other service(s) included in the same plan and any other service plan(s) or value-added service(s) subscribed together on the same application will also be cancelled. Terms and Conditions of Cooling-off Period after Installation: 1. Subscriber is entitled to a 14-day cooling-off period commencing from the date following the installation date ( Installation Date ) of designated service plan of residential fixed telecommunications network services (which includes Home Broadband and/or Home Telephone) ( FTN Services ). Installation Date refers to the date as set out
5 in the acknowledgment of installation form and if installation of services are completed on separate dates for the Plan(s) subscribed, cooling-off period shall commence on the date following the earliest Installation Date. Subscriber may cancel the service plan(s) within the cooling-off period by sending to However, the cooling-off period will immediately cease to apply upon the occurrence of any of the following events: (i) the successful number porting to HKBN of home telephone service; or (ii) subscriber has collected any premium. 2. If any service of a service plan is cancelled during cooling-off period, other service(s) included in the same plan and any other service plan(s) or value-added service(s) subscribed together on the same application will also be cancelled. The amounts set out in clause 3 below shall become immediately payable by subscriber. 3. If subscriber cancels the service(s)/service plan(s) within the cooling-off period, subscriber shall pay the following amounts: (i) special monthly fee calculated on a pro rata basis according to the number of days of the service(s)/service plan(s) used; (ii) charges of any value added service based on actual usage before termination; and (iii) Standard installation fee for each Plan subscribed (except subscriber who had already paid the installation fee). Subscriber agrees that HKBN can set off the above amounts with prepayment made (or any part thereof) and subscriber shall pay any remaining balance after set off, if applicable. Terms on payment: 1. If the Subscriber selects credit card payment as the designated payment method, he/she shall agree that HKBN will reserve part of the credit limit of the credit card upon registration of the service plan until the day after broadband service has been successfully installed at the service address. HKBN will debit the reserved amount from the credit card account the day after successful installation of the broadband service as prepayment of the service fees. If broadband service installation is unsuccessful, the reserved amount will be cancelled and no amount will be debited from the credit card account by HKBN. 2. If the Subscriber elects credit card payment as the designated payment method, HKBN will charge those Subscribers for the related monthly service fee via the relevant subscriber's registered credit card account. For whatever reasons, if any Subscriber fails to settle the monthly service fees via his designated registered credit card account. HKBN will charge the relevant subscriber $30 per month as administration fee. 3. The Subscriber agrees and authorizes HKBN to set up his/her personal accounts according to the information provided in this registration form. If Subscriber has the personal accounts set up already, The Subscriber agrees HKBN to update the information of his/her personal accounts according to the information provided herein, if applicable. The Subscriber agrees and authorizes HKBN to include the service registered herein, together with all HKBN services as may from time to time registered by the Subscriber (including but not limited to broadband service/ IDD service/ telephone service/ TV service/ all telecom services/ and value added service of all aforementioned services), under his/her personal accounts, and adopt the related selected payment method to settle all service fees registered in such personal accounts. The Subscriber understands HKBN has the absolute right to decide whether to include any particular HKBN service subscribed by the Subscriber in his/her personal accounts, and allow to settle the respective service fees with the same payment method. The Subscriber agrees to settle the service fees by the specified payment method as informed by HKBN from time to time accordingly. 4. The Subscriber agrees and authorizes HKBN under the circumstances as deem appropriate from time to time to
6 update the related credit card information to settle any amount payable in the Subscriber s personal accounts. 5. The Subscriber agrees and authorizes HKBN to continue to keep the information of my existing credit card ("Existing Credit Card") and/ or autopay account ("Autopay Account") (if applicable) which is used to settle the bills in subscriber s personal accounts for credit check, and when the new credit card (for whatever reasons) cannot be used to settle the bills in the Subscriber s personal accounts, HKBN can use "Existing Credit Card" and/ or "Autopay Account" (if applicable) to settle the bills in such accounts until further written notice. 6. The Subscriber clearly understands and agrees that if payment is settled by cash through 7-Eleven/ OK/ VanGO Convenience Store/CR Vanguard, an administrative charge of not more than $10 will be levied by HKBN. 7. If the Subscriber chooses to pay by autopay, the Subscribers agrees HKBN to settle the bill by cash/ crossed cheque prior to the successful application of autopay. 8. If no address is provided, all statements and correspondence will be sent to the Subscriber according to the statement delivery instruction previously registered with HKBN (if applicable) or by post. Statement will be sent by post to the Subscriber in case any payment is overdue of which a handling charge of $25 or any other amount as HKBN shall stipulate from time to time will be charged. Note: Above "Contract period", "Special monthly fee within contract", "After contract period monthly fee" and "Plan effective date" listed on plan details means "Minimum commitment period", "Special monthly fee within minimum commitment period", "Monthly fee after minimum commitment period" and "Service commencement date" respectively.
