1 EXHIBIT A SCOPE OF SERVICES EMERGENCY ROADSIDE ASSISTANCE PATROL SERVICES (EMA) 1.0 GENERAL This scope of services describes and defines the Emergency Roadside Assistance services to be provided by the Contractor for the Florida Department of Transportation District Four (Department) for Emergency Events, such as roadway evacuations or motorist assistance during a pre-hurricane or other catastrophic occurrences. All services performed under this Contract shall be in accordance with all applicable federal and state laws, and environmental regulations. The specific limited access and non-limited access highway facilities to be covered by these services will be designated by the Department. The geographic area for this work will encompass Broward, Palm Beach, Martin, St. Lucie, and Indian River Counties. Bids will be accepted on an individual county basis and may vary in price per county. It is not necessary for the Contractor to bid all five counties. The Department reserves the right to award more than one contract per county. The Department will initiate work with the lowest bidder for each county first and may award additional contract(s) in a county based on order of remaining bid price(s) received from other responders. The contract time shall be three (3) years (1,095 days) starting from the date of execution. The Department may extend time sufficient for the Contractor to complete the scope of work for each event or hurricane season. The service provider will begin activating the service two (2) hours after the issuance of notice to proceed by the Department. The vehicles of the service provider may be inspected by the Department prior to their use. If, after inspection, the Department in its sole discretion determines any of these vehicles to be unsafe or unfit for service, the Department will pull these vehicles from service and the service provider will not receive compensation for use of those vehicles. The Contractor must be authorized in the State of Florida to engage in the type of business required under this contract. All vehicles operated or caused to be operated by the contractor must be registered in the State of Florida in accordance with Florida Statutes, Chapter 320. Page 1 of 12
2 EXHIBIT A SCOPE OF SERVICES EMERGENCY ROADSIDE ASSISTANCE PATROL SERVICES (EMA) 2.0 SERVICES TO BE PROVIDED BY THE CONTRACTOR Emergency Motorist Assistance (EMA) Patrol Operations The Contractor shall supply the following EMA patrol operations: The EMA patrols will provide basic motorist services as necessary, such as providing gasoline or removing disabled vehicles to the shoulder of the roadway. After, the motorist vehicle has been moved out of the travel way the EMA patrol must contact the emergency assistance transportation provider that will be identified by the Department to pick up the stranded motorist (and passengers). The emergency assistance transportation provider services will be provided under a separate Department contract. Each EMA Patrol/Tow Vehicle shall meet the following requirements: Cell Phone-with car battery charger Vehicle that can push 6,000 pounds. Vehicle must be equipped with seat belts. Two (2) towing straps rated at 3,000 pounds minimum. Rubber face push bumper. Spot light (hand-held is acceptable) Suitable cab lighting A trailer hitch capable of handling a 1 7/8 inch ball and or a 2 inch ball. A roof mounted amber warning/strobe light bar with front to rear directional flashing capability, equipped with removable senses and in-cab on/off switch. Roof mounted, amber warning/strobe light Minimum Gross Vehicle Weight Rating (GVWR) chassis of 10,000 pounds Dual wheel chassis and four-ton recovery equipment rating Wheel lift towing equipment, with a minimum lift rating of 3,000 pounds. All tow equipment shall include proper safety straps. Boom with a minimum static rating of 5,000 pounds Winch Cable: 8,000 pound rating on the first layer of cable Winch Cable: one hundred feet of 3/8 inch diameter, with a working limit of 3,500 pounds Page 2 of 12
3 EXHIBIT A SCOPE OF SERVICES EMERGENCY ROADSIDE ASSISTANCE PATROL SERVICES (EMA) Each EMA Patrol shall carry the following supplies: A minimum of 40 gallons of gas. The EMA patrol shall dispense enough gas to allow a disabled motorist to reach the nearest exit (if on a limited access facility, or no more than two gallons if on a non-limited access facility). The Department of Transportation will provide the fuel to the EMA Service provider but the provider will not need to pay at this time, but will be charged in accordance with Section 3 herein. The EMA Patrol will need to complete the fuel log noted on Exhibit D. Other Contractor services and/or requirements include the following: Maintenance of all EMA patrol vehicles in good working order and properly licensed When initiating services, EMA patrol vehicles will have a full tank of gas; Contractor will be responsible for refueling patrol vehicles with exception as noted in Section 3.0. All patrol operators must possess a valid Class E Florida Driver License and have a safe driving record Proof of insurance for EMA patrol vehicles Completion of Department supplied log sheet for each EMA patrol vehicle; patrol vehicle log sheets(see Appendix A) are to be returned to the Department after completion of contract services Coordination with other EMA service providers as may be required Coordination with the Department as may be required 3.0 SERVICES TO BE PROVIDED BY DEPARTMENT OR IT S DESIGNATED REPRESENTATIVE The Department shall provide the following services: Identification of limited access and non-limited access highway facilities and the desired coverage areas by County and length Oversight for the Contractor s operations Under Emergency Conditions the Department may provide fuel for the Contractor s EMA Patrol Vehicles use in performing services under this Contract. Cost of fuel provided to the Contractor for the Contractor s use in performing these contract services shall be reimbursed to the Department at the cost which the Department purchases the fuel. A written fuel log will be provided by the Contractor with each invoice submittal. The Contractor shall make a line item adjustment to each invoice submitted reflecting a deduction for the cost of Department provided fuel Page 3 of 12
4 EXHIBIT A SCOPE OF SERVICES EMERGENCY ROADSIDE ASSISTANCE PATROL SERVICES (EMA) Department will provide a Roadside Assistance Services patrol log sheet for each EMA patrol vehicle-see Exhibit C Coordination with the Contractor as may be required 4.0 INSURANCE The CONTRACTOR shall maintain the following insurance policies according to the minimum limits set forth below. Each policy shall be in the name of the CONTRACTOR and shall include coverage for towing and storage. The policy shall be effective throughout the period that the CONTRACTOR is under contract to the DEPARTMENT. It is not the intent of this contract to limit the CONTRACTOR to the types of insurance required herein. Worker s compensation and employer s liability insurance as required by State statute. The following minimum levels of combined bodily injury liability insurance and property damage liability insurance required by section , Florida Statutes, in addition to any other insurance coverage as required by this contract. $50,000 per occurrence for a wrecker (Service Patrol Vehicle as described herein) with a gross vehicle weight of less than 35,000 pounds $100,000 per occurrence for a wrecker (Service Patrol Vehicle as described herein) with a gross vehicle weight of 35,000 pounds or more, but less than 44,000 pounds $300,000 per occurrence for a wrecker (Service Patrol Vehicle as described herein) with a gross vehicle weight of 44,000 pounds or more The insurance coverage required shall include those classifications listed in standard liability manuals, which most nearly reflect the operation of wrecker operators. All insurance policies required above shall be issued by companies authorized to do business in the State of Florida. The CONTRACTOR shall furnish certificates of insurance to the DEPARTMENT prior to the contract execution, and after that, 30 days prior to the expiration dates of the policies. The certificates shall clearly indicate that the wrecker operator (Service Patrol Vehicle Operator as described herein) has obtained insurance of the type, amounts and classifications required for compliance with this section and that no material change or cancellation of the insurances shall be effective without 30 days prior written notice to the DEPARTMENT. 5 EXHIBIT B METHOD OF COMPENSATION EMERGENCY ROADSIDE ASSISTANCE PATROL SERVICES (EMA) 1. PURPOSE This Exhibit defines the limits and method of Compensation to be made to the Contractor for services set forth in Exhibit A, Scope of Services and Exhibit E, Fee Rates, and the method by which payments shall be made. 2. ASSIGNMENT OF WORK The service provider will begin activating the service two (2) hours after the issuance of Notice to Proceed by the Department. 3. COMPENSATION There is no Budgetary Ceiling. Funds will be encumbered prior to each Notice to Proceed. This is a Term Contract for an Indefinite Quantity whereby the Contractor agrees to furnish services during a prescribed period of time. The Department will authorize services based on need and availability of budget. Execution of this Agreement does not guarantee that the work will be authorized. The work will begin upon issuance of Notice to Proceed and an approved encumbrance of funds. 3. PAYMENT Payment will be made in accordance with the bid items shown in Exhibit E. The items listed in Exhibit E, Fee Rates, include compensation for all work and services required in Exhibit A, Scope of Services Page 5 of 12
