American Society of Safety Engineers (ASSE) Solving the Mysteries of US-Safety and Health Standards A+A 2017 Program Dusseldorf, Germany October, 2017
Focus of Our Presentation Today n Standardization What does this mean? n Compliance and Enforcement n OSHA Standards Consensus Standards n American Standards Developing Organizations n Role of ANSI (American National Standards Institute) n U.S. Market n The role of the United States Government n ASSE An example of a standards developer n Standards you should know n Touch points for the American safety and health market n Where to go for information and contacts
Compliance and Enforcement: Factors Influencing Standardization Examples from a U.S. perspective... n Public opinion u Example: Publicity about faulty or dangerous products will negatively impact the market n n Legal system u Example: Laws allow consumers to return faulty products u Consumers can sue producers of faulty or dangerous products F Penalties include requiring companies to recall and withdraw products from the market Government agencies (federal, state or local) u Example: The import of unsafe products can be denied u Faulty or dangerous products can be recalled or removed from the market
OSHA Regulations & Compliance Guidelines HEALTH STANDARDS Focus on preventing illness SAFETY STANDARDS Focus on preventing injury Performance Standards Dictate how not what Specification Standards Dictate how and what Horizontal Standards Across General Industry Vertical Standards Within Specific Industry Temporary Variances Permanent
National Voluntary Consensus Standards Organizations - Examples ANSI Coordinating Body ASME (American Society of Mechanical Engineers) ASSE (American Society of Safety Engineers) ASTM (American Society of Testing and Materials) ISEA (International Safety Equipment Association) NFPA (National Fire Protection Association) How they Work (Amplify/Clarify, specifics where law is general, and accepted/best practices) Philosophy Relation to Compliance
The Role of Government Understand This Important Point!!! n In the U.S., no single federal government agency has control over national voluntary consensus standards. u Each government agency determines which standards meet its needs. (NIST National Institute of Standards and Technology overall coordinator). u An agency is responsible for determining whether a private sector standard already exists that is appropriate for its needs. F If so, they will use the private sector standard. F If not, the agency is expected to work with the private sector to develop the needed standard.
Role of a Standards Developing Organization - ASSE n ASSE manages the process accredited by ANSI and operates under ANSI requirements n Committee representatives many times are not ASSE members or SH&E Professionals n ASSE works to show the ANSI Essential Requirements (procedures) are met and consensus is reached n Raise awareness of use/implementation of standards
ASSE Standards Secretariats (Administator) n A10 - Construction and Demolition Operations n A1264 Floors and Walkways (Slips and Trips) n Z9 - Ventilation n Z15 - Motor Vehicle Operations n Z88 Respirators (PPE related protective equipment) n Z117 Confined Spaces n Z244 Lockout/Tagout (protective equipment) n Z359 Fall Arrest/Fall Protection
Secretariats Continued n Z10 OSHMS (Safety Management Standard) n Z490 (Safety and Health Training) n Z390 Hydrogen Sulfide Training (H2S) n Z590 The Safety Professional n Z690 Risk Management (Management ISO 31000) n ISO TC94/SC4 TAG International Fall Protection n ISO TMB/WRG Risk Management (Management) n ISO PC 283 Occupational Health & Safety Management (Proposed ISO 45001)
ANSI Standards The Impact??? n How are these standards used? n Are these standards used only for litigants? n How are such standards used by OSHA and other regulatory agencies? u U.S. General Duty Clause (Section 5A1) u Settlement Proceedings u Citation by Reference n More on law versus consumer demand
ANSI Standards The Impact??? The following language is in almost all ANSI Standards: The use of American National Standards is completely voluntary; their existence does not in any respect preclude anyone, whether he/she has approved the standards or not, from manufacturing, marketing, purchasing, or using products, processes, or procedures not conforming to the standards.
ANSI Standards Know the Market n It is critical to KNOW the version (Year) n Understand the differences in requirements of different versions n Claiming to meet OSHA Standards is an automatic turnoff for knowledgeable U.S. buyers n Claiming Products are certified by ANSI an automatic turnoff for knowledgeable U.S. buyers n Meets European Standards No mention of meeting American National Standards Also a turnoff n More on law versus consumer demand - Difference
