Entry into this Promotion is deemed to be an acceptance of these Terms and Conditions. 2. To enter, consumers will need to click the Participate and win button in the Philips newsletter received from Philips. To enter for the Philips newsletter consumers must subscribe on or create an account on and agree to receive promotional communications. 3. You will be required to click through from the Philips newsletter to the landing page and answer the survey question to participate. 4. Entry is only open to permanent residents of Australia. Where an entrant is under the age of 18, a parent or guardian must provide written permission for the entrant to participate. 5. An entrant can enter the Promotion more than once. 6. Each entry shall be individually judged by a panel including representatives of Philips. Winning entries will be chosen based on the originality and creativity of their content. The decision of the judges is final and binding and no correspondence will be entered into with entrants, including in the event of a dispute. Prizes cannot be transferred or redeemed for cash.7. The entries will be chosen on 16/11/17 at 09:00 am (AEST) at Philips Australia, 65 Epping Rd, North Ryde NSW 2113.

2 If a winner is under the age of 18 years the prize will be awarded to their parent or legal guardian. 8. The winners will be notified via by Tuesday 17/11/17 and the prize will be delivered to the address supplied by the winner. Each entrant consents for their name to be announced in the Philips newsletter and on a promotion page, in the event they are the winner. 9. In the event that there are any unclaimed prizes three months after the judging date, the judges may nominate an alternative winner who will be notified in accordance with these terms and conditions. 10. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated postal address. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter will not be held liable for any late, lost or misdirected mail due to the fault of the entrant. 11. Employees and their immediate families of the Promoter and their agencies and companies associated with the Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or first cousin. 12. Prize values are the recommended retail value as provided by Philips and are correct at time of printing. The prize value is in Australian dollars. The Promoter accepts no responsibility for any variation in the value of the prize after that date. 13. Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001(Cth) or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non Excludable Guarantees, the Promoter (including their respective officers, affiliated companies, employees and agents) excludes all liability for any personal injury,

3 illness or death of any person; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including to the fullest extent permitted by law, due to Promoter s negligence. 14. In consideration of the acceptance of the entrant s entry, to the fullest extent permitted by law, the entrant releases and forever discharges the Promoter from all claims that the entrant may have or may have had but for this release arising from or in connection with any entrant s participation in this Promotion and a winner s acceptance and use of the prize. 15. Any tax liability arising as a result of accepting any prize is the responsibility of the winner. 16. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Terms and Conditions, subject to approval of the gaming authorities in each State and Territory where relevant. 17. If any act or omission, event or circumstances occurs which is beyond the reasonable control of the Promoter which prevents the Promoter from complying with these conditions of entry, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion. 18. The Promotion commences on 12/10/17 at 01:00pm AEST and entries close 26/11/17 at 5:00pm AEST. All entries are deemed to be received at the time of receipt into Philips data base and not at the time of transmission by an entrant. 19. All entries become the property of Philips. 20. By submitting an entry into this Promotion via the Philips Newsletter, the entrant hereby acknowledges and agrees that any intellectual property rights (Including, without limitation, copyrights, image rights), and any other proprietary rights in connection with works generated or developed in the course of his/her submissions (the "Works"), shall vest in Koninklijke Philips N.V and/or its affiliate companies ( Philips Group ). The entrant here by irrevocably and unconditionally assigns to Philips Group all right, title and

4 interest in and to any and all Works and to do everything necessary to perfect such rights and to protect Philips Group interests therein. Philips Group, its affiliates, nominees and/or assignees shall be entitled to use the Works (including works derived thereof) on a world-wide basis for all forms of use, including use in connection with advertising and marketing of Philips products and all other commercial and non-commercial exploitation of the Works. Philips Group shall be entitled to modify, adapt or edit the Works in any form and in any way it deems fit. The entrant hereby expressly, irrevocably and unconditionally waives, to the maximum extent possible, all moral rights (including rights of authorship) to which the entrant or any third person engaged by it in the creation of the entries or any other submissions may now or at any time be entitled in respect of any of the submissions, including the Works. The entrant shall not assert any claim against Philips Group or any of its affiliates, assignees, licensees or customers for violation or infringement of moral rights in respect of any of the submissions, including the Works or any modification or adaptation carried out by Philips Group. 22. Entrant warrants that each entry submitted is their original work that does not infringe the rights of any third party, living or deceased, including but not limited to, privacy, publicity or intellectual property rights, or legal or moral rights, or violate applicable laws, and regulations. A breach of the warranty set out in this condition will result in the entrant s entry being deemed invalid. In addition, each entrant indemnifies Philips against all loss, damages and costs incurred by Philips and/or arising from that entrant s breach of the warranty set out in this condition. 23. By entering this Promotion, each entrant is taken to consent to Philips using the entrant s personal information to administer the Promotion, announce the winner and disclose the entrant s personal information to organisations that assist Philips, with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). Philips is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth) and by entering into this Promotion, each entrant also consents to Philips using their personal information for future marketing purposes.

5 24. By entering this Promotion, each entrant is taken to consent to Philips collecting the entrant s personal information ( PI ). Philips collects personal information in order to conduct the Promotion and for other purposes set out in Philips privacy policy. Philips may disclose your PI, entry submissions and feedback forms to contractors and agents to assist in conducting this Promotion and to provide Philips with marketing research, to third party prize suppliers, State and Territory lottery and gaming authorities (as required) and to communicate with entrants. In addition to any use that may be outlined in Philips Privacy Policy, if the entrant opts-in by ticking the opt-in box at the time of submitting an entry, entrants consent to the information they submit with their entry being entered into a database of Koninklijke Philips N.V and/or its affiliate companies and this information maybe used by Koninklijke Philips N.V and/or its affiliate companies in any media, for an indefinite period, for future promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the entrant, without any further reference or payment or other compensation to the entrant. If any provision of these Terms and Conditions are held to be illegal, void, invalid or unenforceable under the applicable laws of any jurisdiction, the legality, validity and enforceability of the remainder of these Terms and Conditions in that jurisdiction is not affected. If any invalid, unenforceable or

6 illegal provision would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the intention of the parties. 26. These Terms and Conditions will be interpreted in accordance with the laws of New South Wales, Australia.
