1 CONTEST RULES (the Official Rules ) JACK Hours in Vegas with Elton John Contest (the Contest ) These Official Rules govern the Contest. By participating or attempting to participate in the Contest, you will be deemed to have received, understood, and agreed to these Official Rules. 1. WHO ARE THE SPONSORS? The Contest is sponsored and administered by Rogers Communications Inc. or one of its subsidiaries or their affiliates ( Rogers ) on behalf of JACK 96.9 Calgary (the Station ). Rogers and any co-sponsors of the Contest are referred to collectively or individually as the Sponsors. Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site (a Third Party Service ), the Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; any questions, comments or complaints regarding the Contest should be directed to Rogers and not to any Third Party Service. 2. WHO MAY ENTER THE CONTEST? This Contest is open only to entrants who are residents of the Province of Alberta and who are at least 21 years old as of the date of entry. The following individuals are not eligible to enter the Contest: (a) employees, officers, directors, agents, and representatives of: (i) the Sponsors, or any of their respective parents, subsidiaries or affiliates; (ii) any prize suppliers; (iii) any and all other companies associated with the Contest; (b) a household member of any of the individuals listed in (a), above, whether or not related; and (c) members of the immediate family (spouse, parent, child, sibling) of the individuals listed in (a), above. 3. WHEN DOES THE CONTEST START/END? You may enter the Contest between 5:30 a.m. March 5, 2018 and 7:00p.m. April 26, 2018 (the Entry Period ). All times referenced in these Official Rules are Eastern. 4. HOW DO I PARTICIPATE IN THE CONTEST? No purchase is necessary to enter the Contest. For a chance to win a prize in this Contest, you must first qualify as a Contest finalist. There are two (2) ways in which you may become a Contest finalist, as follows: 1) Cue to Text Method Listen to the Station between 5:30am and 7:00pm each weekday (Monday-Friday), excluding Good Friday on Friday March 30th, 2018, and between 9:00am and 12:00pm each Saturday during the Entry Period for a Cue to Text, which provides the Elvis does Elton John song title that you will be prompted to text, ( Text clue ); and text within ten (10) minutes of any such Cue to Text (the Entry Window ), send the Station a message that starts with the unique Text clue to (for clarity, the Text Clue could change for each contest qualifying occasion) along with your name. Such message may be sent via a cellular telephone that is capable of two-way messaging. Your carrier s standard text message or short code message and data rates may apply. By sending a message to the Station in accordance with these Official Rules, you agree to being put on-air by the Station. (b) Following the close of each Entry Window, the Station will conduct a random draw in Calgary, Alberta from among eligible messages received during the Entry Window. One (1) eligible

2 message will be selected at random at each draw and the individual associated with the selected eligible message will be deemed a potential finalist. Non-selected messages will not carry forward to any other draw. The Station will contact a selected entrant based on the Draw Schedule, using the information provided in the message that the entrant sent. (c) Notwithstanding the above, in the event of any technical issues relating to the Station s messaging platform (as determined by Rogers), a Cue to Text may be altered to a cue to call, such that the Station would prompt its listeners to call the Station, and the 9th eligible caller to reach the Station following any such cue to call would be deemed a Contest finalist. In the event of any such cue to call, the following additional terms and conditions apply: If the telephone line is dead when answered, or no audible response is heard, or no one responds after five seconds, the Station will answer the next call in sequence and the next call in sequence will replace that call, and so on and so forth. In the event a call is cut off before all personal data is collected, the Station will use reasonable efforts to make contact with the cut-off caller, provided enough personal information was gathered in order to correctly identify the cut-off caller. In the event two or more calls come through on the same line, all such callers will be advised to hang up and try again, and the next call in sequence will replace that call. In the event the Station answers a call and identifies the caller as an individual already qualified in this Contest or ineligible to participate in this Contest, the Station will answer the next call in sequence and the next call in sequence will replace that call, and so on and so forth. (d) The Station s stream on the JACK 96.9 app and the Station s online stream may be a delayed stream of the Station s radio signal and may vary depending on your computer s memory capacity and the speed of your Internet connection. For that reason, it is recommended that listeners listen to the Station in real time by turning on an actual radio. LIMIT: Maximum of one (1) qualifier/finalist per household. Whether or not an individual resides in the same household as another individual will be determined in the reasonable discretion of the Contest Sponsors. You may only text each Elvis does Elton (Text clue) song once. Text clues entered more than once will not be considered as potential winning entries. Any attempt or suspected attempt to enter this Contest in a fashion not authorized by these Official Rules shall be deemed to be tampering and will void all of your entries. Entries that contain false information and/or are late, lost, stolen, falsified, illegible, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or entries that have been submitted using robotic, automated, programmed, or through illicit means, or that do not conform with or satisfy any or all of these Official Rules, as determined in the Contest Sponsors absolute discretion, will be judged null and void and disqualified. Only entries received by Rogers will be considered. Proof of entry transmission shall not constitute proof of receipt. Rogers reserves the right to refuse any entry in its absolute discretion. The sole determinant of time for valid online entry in this Contest will be the Contest website s server machine(s). Although this Contest may be communicated, promoted, or administered by means of any third party social media or social networking service or site (each, a Third Party Service ), entrants acknowledge that: (i) this Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; (ii) if entry into this Contest is by means of a Third Party Service, entrants must have a valid account with the applicable Third Party Service (and may be required to have a public (i.e. non-private) account in order to participate) and must comply with the applicable Third Party Service s terms and policies; and (iii) any questions, comments or complaints regarding this Contest should be directed to the Contest Sponsors and not to any Third Party Service. By participating in this Contest, you completely release any Third Party Service of all liability in relation to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from your participation.

3 2) Mail-in Entry Method To enter this Contest by means of this entry mechanism, mail a letter during the applicable entry period with your name, address, day and evening telephone numbers, address, age, and time of day that you heard the Text clue and the Text clue to the attention of: JACK 96.9 Calgary and the 24 Hours in Vegas with Elton John Contest, Avenue SW, Calgary, Alberta, T2P 0Y4. Mail-in entries must be received within the applicable Entry Window period to be valid. Limit of one entry per postage-stamped envelope. 5. DRAWS (a) Random draws from all eligible qualifiers received will be made by a representative of JACK 96.9 based on the following Contest Entry Window Periods and Draw Dates schedule below at the JACK 96.9 offices located at th Avenue SW, Calgary, Alberta. The selected entrant will be contacted by telephone at the telephone number proved, (either by Text Entry or by mail-in entry) by the JACK 96.9 Morning Show as a potential winner. A selected entrant will be disqualified and required to forfeit any claim to the Contest prize if he or she cannot be reached within three (3) business days following the first attempt of contact or if the terms set forth in these Contest rules are not adhered to. One (1) Trip Prize Entrant will be selected for each Trip Prize draw. The selected Trip Prize Entrant s name will be announced on the Station the following morning during the JACK 96.9 Morning Show as the potential prize winner. (d) To be declared a winner, a potential winner must: (i) correctly answer (as determined in the absolute discretion of the Contest Sponsors) without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question; (ii) be in full compliance with these Official Rules; and, (iii) in the discretion of the Contest Sponsors, sign and return a release of liability and consent to publicity form (the Release Form ) within the time period specified in the Release Form, and any other documentation as may reasonably

4 be required by the Contest Sponsors in their absolute discretion. Any guest of the winner will also be required to sign and return a Release Form within the time period specified in the Release Form, and any other documentation as may reasonably be required by the Contest Sponsors in their absolute discretion. In the event any guest is a minor, the guest s parent or legal guardian will be required to sign and return such paperwork on behalf of such guest. (e) A potential winner may be required to provide proof of identification to the Contest Sponsors and/or prize supplier(s), as applicable, when claiming a prize or otherwise in connection with this Contest to facilitate the accurate identification of a Contest winner. Once confirmation of a Contest winner is complete in accordance with the terms of these Official Rules, the Contest Sponsors and/or any prize suppliers will promptly coordinate prize distribution. Except as otherwise determined in the absolute discretion of the Contest Sponsors and/or prize supplier(s), as applicable, upon notification, a winner must personally take delivery of his/her prize from the office or location of the Contest Sponsors and/or prize supplier(s) (as selected by the Contest Sponsors in their reasonable discretion) within thirty (30) days of being notified that such prize is available or within such other time period as may reasonably be advised by the Contest Sponsors. If a winner fails to comply with the requirements set forth in these Official Rules, he/she will be deemed to have forfeited his/her prize. 6. HOW MANY TIMES MAY I ENTER THE CONTEST? You may enter once per Contest Entry Window. Limit of one qualifier/finalist per household for this Contest. For greater certainty, you may only be a finalist once in this Contest. 7. COULD MY ENTRY BE REFUSED OR REJECTED? Your entry could be refused or rejected if: (a) you attempt to enter the Contest in a fashion not authorized by these Official Rules; (b) your entry contains false or misleading information, or is late, falsified, illegible, damaged or incomplete or otherwise irregular; (c) your entry is submitted using robotic, automated, programmed, or other illicit means; or (d) your entry is not in compliance with these Official Rules. In addition, the Sponsors reserve the right to refuse any entry for any other reason as they may determine. 8. WHAT ARE THE CONDITIONS OF ENTRY? By entering the Contest: (a) you agree to be bound by these Official Rules and by the decisions of the Sponsors, which decisions are final, binding and conclusive; (b) you represent and warrant that (i) your entry, including any material comprising your entry (e.g. name, user name, profile picture, etc., as applicable) and any material submitted with your entry (e.g. photograph, video, written submission, or other form of submission, as applicable) (all such material, collectively, the Entry Material ) is original to you, (ii) you have all necessary rights in and to your Entry Material to enter the Contest, including the consent of any third parties whose personal information is included in your Entry Material, and (iii) your Entry Material does not contain, depict, include or involve content that is, or could reasonably be considered to be, inappropriate, unsuitable or offensive, as determined by the Sponsors; (c) you understand and agree that your entry, including your Entry Material, will not be returned to you and may be moderated or edited by Rogers as it deems appropriate; (d) you grant to the Sponsors the irrevocable right to use your Entry Material in any media worldwide and for any purpose related to the Contest (or any similar contest), including the right to use, reproduce, modify, adapt, translate, or create derivative works from, your Entry Material without notification, compensation or additional consideration to you;

5 (e) you waive all claims of moral rights in any use of your Entry Material by Rogers pursuant to the rights granted in these Official Rules; (f) you agree that the Sponsors shall have the right at any time to require proof of identity or eligibility to enter the Contest; failure to provide any such proof upon request may result in disqualification; (g) you release and forever discharge the Sponsors, their respective parents, affiliates, and subsidiaries, any other companies associated with the Contest, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the Releasees ), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in the Contest, (ii) the awarding, receipt, possession, use or misuse of any prize, in whole or in part, or any travel or activity related to any prize, (iii) the use of any Entry Material or Publicity Material (defined below) in accordance with the rights granted in these Official Rules, or (iv) any breach of these Official Rules. 9. WHAT ARE THE CONTEST PRIZES? There are eight (8) prizes available to be won in this Contest (each, a Trip Prize ), consisting of a getaway trip for the winner and one (1) guest (collectively, the Travellers ) to Las Vegas, Nevada, United States of America, including: Return airfare Calgary to Las Vegas with WestJet (non-stop service) One (1) night accommodation at the New York New York Hotel & Casino Las Vegas Private meet & greet service at the airport upon arrival in Las Vegas Beer & wine on the transfer from the airport to the hotel One hour reception with cocktails for the JACK group 2pm at Tom's Urban at the hotel Tickets in the 1st Mezzanine Row F to see Elton John May 6, 2018 at The Colosseum at Caesar s Palace Transportation from the hotel to the airport on May 7th Airline & hotel taxes Total approximate retail value of Trip Prize is CDN $1, Actual retail value will vary based on flight schedule. A prize certificate outlining the terms of the prize and redemption procedures will be provided at the conclusion of the Contest. The following terms and conditions apply to any and all Trip Prize(s) awarded pursuant to these Official Rules: (i) Prize winner and guest must be at least 21 years of age. (ii) Prize winner and guest must be able to travel between May 6-7, 2018 and is not transferable or redeemable for cash. No extension will be given after the prize has expired. If the prize is not redeemed, the prize is void. (iii) Prize winner and guest must sign and return a release of liability and consent to publicity form prior to issuance of travel documents and participation in any prize activity. Travellers may be required to present a valid major credit card to hotel upon check-in. If a winner elects to travel with a fewer number of guests than the number of guests provided in the prize description above, no additional compensation will be awarded under any circumstances. (iv) Tickets are subject to certain terms and conditions as specified by issuers. Documentation that is reasonably necessary for the Contest Sponsors and/or prize supplier(s) to book the Trip Prize for the Travellers (e.g. passport number) must be supplied to the Contest Sponsors, as applicable, or their representatives or agents, upon request, and failure to do so may result in the forfeiture of the Trip Prize at the absolute discretion of the Contest Sponsors

6 and/or prize supplier(s). The Travellers must travel together on the same itinerary and are responsible for ensuring they have all necessary travel documents prior to travel (e.g., valid passport). (v) Travellers are responsible for any additional expenses not included in the prize as described herein. Without limiting the foregoing, all expenses and incidental travel costs not expressly stated in the prize description above are the responsibility of the Travellers, including but not limited to, ground transportation not specifically mentioned above; airport improvement fees, insurance (including, but not limited to, travel insurance, medical insurance and trip cancelation insurance), connecting flights (including to the departure gateway city), stop over hotel stays due to flight itinerary, sightseeing tours and other in-destination activities, taxes (including, but not limited to, departure taxes, air seat/airline taxes and applicable federal, provincial, municipal, state and/or local taxes), travel related fees/surcharges, excess baggage fees, costs associated with obtaining travel documents (including, but not limited to passports and visas), costs associated with obtaining necessary vaccinations, items of personal nature, additional meals, room upgrade, tips & gratuities, and in-room movies. (vi) No refund or compensation will be made in the event of the cancellation or delay of any flight. The Releasees (defined below) shall have no responsibility for trip cancellations, alterations, weather delays, weather cancellations or other changes to the trip itinerary (whether having the effect of lengthening or shortening the trip itinerary) and, by participating in the prize activity, each Traveller acknowledges and accepts such risks, and agrees that the Contest Sponsors and/or prize supplier(s), as applicable, are only responsible for the prize elements as listed in these Official Rules, subject to the terms and conditions herein contained, and are not responsible for any additional costs or expenses that may be incurred by any Traveller as a result of such changes in itinerary. (vii) All airline tickets are subject to flight variations, work stoppage, and schedule or route changes. The Releasees (defined below) are not responsible in the event any Traveller is denied the ability to fly out of or into any particular airport, whether due to airport restrictions or otherwise, nor are they responsible for any cancellations, delays, diversions or any other changes made by any transportation and/or travel companies, hotels, air carriers, or others providing or arranging any travel or prize-related services or accommodations, including, without limitation, any resulting changes in services or accommodations. Elements of the prize (including, without limitation, airfare and lodging) may not be used towards frequent flyer miles or other loyalty programs. Once reservations are made, they cannot be changed, save as otherwise determined in the absolute discretion of the Contest Sponsors and/or prize supplier(s). (viii) Travellers must comply with all applicable laws, including but not limited to, all local laws while in the destination. The Contest Sponsors and prize supplier(s) have the right, in their absolute discretion, to disqualify and/or remove any Traveller from any activity at any time if such individual is at any point uncooperative, disruptive, abusive, or unobservant of applicable rules, laws or regulations, or if such individual is likely to cause or has caused damage to person, property, or the reputation of the Contest Sponsors and/or prize supplier(s), as determined in the absolute discretion of the Contest Sponsors and/or prize supplier(s), as applicable. 10. ARE THERE ANY PRIZE CONDITIONS? In addition to any prize conditions provided elsewhere in these Official Rules, any prize awarded in the Contest is subject to the following conditions: (a) The prize may be substituted, in whole or in part, with a prize or prize component of equal or greater value if the prize or prize component cannot be awarded for any reason. (b) The prize must be accepted as awarded and may not be transferred, unless otherwise determined by the Sponsors. The prize may not be exactly as advertised. The prize is provided as is without representation or warranty of any kind by the Sponsors. (c) The prize may not be resold. (d) Any unused portion of the prize, once awarded, will be deemed forfeited. The prize will not be replaced if lost, destroyed, mutilated or stolen.

7 11. HOW WILL THE POTENTIAL WINNER(S) BE SELECTED? Please refer to Section 4 and Section 5, above. 12. HOW CAN A POTENTIAL WINNER BECOME A WINNER? Potential winners will be contacted by the Station, using the information provided by the finalist at the time of playing the Game, to confirm the potential winner s personal information for prize redemption purposes. At Rogers discretion, a potential winner may be disqualified and required to forfeit any claim to the Contest prize if the potential winner cannot be reached within three (3) business days following the first attempt of contact, or if the potential winner cannot confirm complete personal information with the Station, as required by the Station, within five (5) business days of having been reached by the Station. In addition, to be declared a winner, a potential winner: (a) must correctly answer, without assistance, a time-limited, mathematical skill-testing question to be administered by the Sponsors; (b) must be in compliance with these Official Rules; (c) must sign and return, within any designated time period, a release of liability and consent to publicity form and any other documentation as reasonably required; (d) may be required to provide proof of identification to confirm eligibility or to claim a prize, or provide proof that he or she is the authorized account holder of any account associated with the selected entry. 13. WHAT ARE THE ODDS OF WINNING A PRIZE? Odds of winning depend on the number of eligible Trip Prize Entrants determined in respect of each Trip Prize draw. 14. HOW DO I CLAIM A PRIZE? Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated. Except as otherwise indicated by the Sponsors, a winner must personally take delivery of the prize as instructed within thirty (30) days of being notified that such prize is available or within such other time period as may reasonably be advised. If a winner fails to take delivery of the prize as instructed, the prize will be deemed forfeited. 15. WILL I APPEAR IN ANY PUBLICITY IF I AM A WINNER? If you are a winner, the Sponsors may require you to appear in publicity related to the Contest or to any similar contest. By accepting a prize: (a) you grant to the Sponsors the irrevocable right to record, photograph or otherwise capture or document you, your likeness, your voice, or any statements you make regarding the Contest or the prize, by any available means; (b) you agree that any such captured material, together with your biographical information, such as name or place of residence, or your Entry Material (collectively, all such materials, the Publicity Material ) may be used by the Sponsors or their licensees, successors, or assigns (collectively, the Publicity Parties ) in any media, whether now known or later devised, worldwide and in perpetuity, for advertising or promotional purposes related to the Contest or any similar contest. Any such use of the Publicity Material may include the reproduction, modification, adaptation, translation or creation of derivative works from your Entry Material; (c) you acknowledge that the Publicity Parties shall not be required to compensate you, notify you, or request your permission in connection with their use of any Publicity Material, unless otherwise prohibited by law; and

8 (d) you waive any rights that you may have or that may otherwise exist in connection with any use of the Publicity Material by any of the Publicity Parties, including any moral rights in any such Publicity Material. 16. HOW WILL MY PERSONAL INFORMATION BE COLLECTED, USED AND DISCLOSED? By entering the Contest, you consent to Rogers collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at (the Rogers Privacy Policy ), for purposes of administering the Contest as described in these Official Rules. Over the course of participating in the Contest, you may be given the option to receive commercial s or other communications of a commercial nature (collectively, Commercial Communications ) from the Sponsors or other parties. Should you elect to receive Commercial Communications from Rogers, your personal information will be used by Rogers to that end, in accordance with the Rogers Privacy Policy. Your personal information may be disclosed to a third party in the following circumstances: (a) in accordance with these Official Rules, or with your consent, or as otherwise permitted or required by law. (b) if you elect to receive Commercial Communications from a party other than Rogers, Rogers will disclose your personal information to that other party for that purpose; (c) if you are a potential prize winner, Rogers may disclose your personal information to any prize supplier for purposes of prize fulfillment; and (d) if you have been asked to sign and return a release of liability and consent to publicity form or other documentation in accordance with the terms of these Official Rules, Rogers may disclose your personal information to any interested party, such as an entity who is released from liability. Rogers disclosure of your personal information to another party will cause your personal information to be subject to that party s privacy policy and practices. 17. HOW DO THE RELEASEES LIMIT THEIR LIABILITY? The Releases assume no liability for the following: (a) stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, jumbled, or garbled entries, transmissions, , mail, or other communications; (b) any error, omission, interruption, defect or delay in transmission, processing, or communication; (c) failures or malfunctions of, or difficulties with, computer hardware or software, telephones, telephone lines, telephone systems, or network, cable, satellite, server, or website connections; (d) printing, typographical, or other errors appearing within these Official Rules, in any Contest-related advertisements, or in Contest-related materials; (e) incorrect or inaccurate information, including where caused by website users, tampering, hacking, or by any equipment or programming associated or used in connection with the Contest; (f) injury or damage to any computer or other device resulting from or otherwise related to participation in the Contest, the use of any website, or the downloading or accessing of any materials; (g) anyone being incorrectly or mistakenly identified as a winner or potential winner; or (h) any other errors, problems or difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to the Contest, including those errors, problems or difficulties that may relate to the administration of the Contest, the processing of entries, the advertising of the Contest, the announcement of any prize or prize winner, or the cancellation or postponement of any event. 18. WHAT LAWS APPLY TO THE CONTEST? The laws of the province or territory in which you reside apply to the Contest. Any attempt to undermine the legitimate operation of the Contest may be a violation of criminal or civil laws. Should any such attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.

9 19. CAN THE SPONSORS CANCEL OR AMEND THE CONTEST? The Sponsors may cancel, modify, or suspend the Contest or amend these Official Rules for any reason whatsoever, subject to prior approval by the Régie des alcools, des courses et des jeux, if legally required. For example, if for any reason the Contest is not capable of running as originally planned, the Sponsors may adjust any of the dates, timeframes or other Contest mechanics, or suspend or cancel the Contest. You may not amend these Official Rules in any way. 20. WOULD THE SPONSORS EVER DISQUALIFY OR BAN SOMEONE FROM A CONTEST? The Sponsors may disqualify without notice or ban someone from the Contest or any future contest for any other reason, including if the Sponsors find that a person has: (a) resold or attempted to resell a prize, in whole or in part; (b) tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest; (c) provided false or misleading information; (d) acted in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person; or (e) otherwise violated these Official Rules. 21. WHAT HAPPENS IF THESE OFFICIAL RULES CONTRADICT OTHER CONTEST MATERIALS? In the event of any discrepancy or inconsistency between these Official Rules and disclosures or statements made by the Sponsors or appearing in other Contest-related materials, these Official Rules shall govern. 22. WHAT HAPPENS IF PART OF THESE OFFICIAL RULES BECOMES UNENFORCEABLE OR DOES NOT APPLY? If any part of these Official Rules is legally unenforceable or inapplicable, then that part will be deemed invalid; however, the remainder of these Official Rules will otherwise continue to be legally binding GENERAL PRIZE CONDITIONS. The terms and conditions contained in this Section apply to any and all Contest prize(s) awarded pursuant to these Official Rules: (a) No financial compensation will be made or required if actual prize value is lower than the total value quoted in these Official Rules. (b) Prize must be accepted as awarded, without substitution, transfer, exchange or assignment, unless otherwise determined in the absolute discretion of the Contest Sponsors and/or prize supplier(s). Prize may not be exactly as advertised. Except as expressly warranted herein, prize is provided as is without further warranty of any kind. (c) Any unused portion of the prize, once awarded, will be deemed forfeited by the applicable winner, and no financial compensation will be made or required in respect of such unused portion. Prize will not be replaced if lost, destroyed, mutilated or stolen. (d) The Contest Sponsors and/or the prize supplier(s) reserve the right, in their absolute discretion, to substitute a prize or a component of a prize with a prize or a component of a prize (as applicable) of equal or greater value, including, without limitation, a monetary award, if the prize or prize component cannot be awarded by the Contest Sponsors and/or the prize supplier(s) for any reason.

10 (e) Once awarded, prize may not be resold or commercially traded in any manner, directly or indirectly, and Rogers reserves the right to ban or disqualify any entrant from any contest, including future contests, should it reasonably believe such entrant to have acted or attempted to act in contravention of the foregoing restriction. I) RELEASE OF LIABILITY, INDEMNITY. By entering this Contest, you: (a) agree to remise, release and forever discharge the Contest Sponsors, their respective parent and affiliated companies, any and all other companies associated with the Contest (including prize suppliers and suppliers of materials or services related to the Contest), and all of their respective employees, directors, officers, shareholders, agents, representatives, successors and assigns (collectively, the Releasees ) from any and all actions, causes of action, suits, debts, dues, accounts, claims, damages or liability for any loss, harm, damages, costs or expenses, including, without limitation, costs or losses related to personal injuries, death, damage to, loss or destruction of property, and rights of publicity, personality, privacy and/or intellectual property (each, a Claim ) arising out of, or in any way related to, your participation in the Contest and/or the awarding, receipt, possession, use and/or misuse of any Contest prize (or any portion thereof), or any travel or activity that is related to the receipt or use of any Contest prize; and (b) agree to indemnify and hold harmless each of the Releasees from and against any and all Claims arising from (i) your breach of these Official Rules, including the breach of any representations or warranties contained herein, (ii) your participation in the Contest, (iii) your acceptance, possession, use and/or misuse of any Contest prize (or any portion thereof), if applicable, or (iv) the use of any Entry Material in accordance with the rights granted in these Official Rules. II) CONSENT TO PUBLICITY. By accepting a Contest prize, if applicable, you authorize the Contest Sponsors and each of their respective licensees, successors, assigns, agents, representatives and employees the right, licence and permission to record, photograph and/or otherwise capture or document you and/or your likeness, including without limitation your voice and any statements you may make regarding the Contest prize, by any available means, and to use any such recordings, photographs or documents, as well as your image and/or likeness appearing therein, and your biographical information, including your name, city and province/territory of residence, throughout the world and in perpetuity, in all manner and media, whether now known or hereafter devised, for advertising or promotional purposes relating to the Contest (or any substantially similar contest), without limitation and without compensation or additional consideration, notification, or permission of any kind, unless prohibited by law; and you waive any rights that you may have or that may otherwise exist in respect of any materials produced pursuant to the foregoing, including without limitation rights of inspection, approval, compensation, additional consideration or notification, and moral rights. III) LIMITATION OF LIABILITY. The Releasees are not responsible for: (a) stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postagedue or garbled entries, transmissions, or mail; (b) lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider, website, or other connections, including those through and/or by any website; (c) jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (d) failures or malfunctions of phones, phone lines or telephone systems, any error, omission, interruption, defect or delay in transmission, processing, or communication; (e) non-delivered, misdirected, blocked, or delayed notifications; (f) printing, typographical or other errors appearing within these Official Rules, in any Contest-related

11 advertisements or other materials; or (g) any other errors, problems or difficulties of any kind, whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with this Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials, or the cancellation or postponement of any event. The Releasees are also not responsible for any incorrect or inaccurate information, including without limitation where caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. The Releasees are not responsible for injury or damage to participants or to any other person s computer related to or resulting from participation in this Contest or downloading materials from or use of any website. IV) PRIVACY. By entering this Contest, you consent to Rogers collection and use of your personal information for purposes of administering this Contest in accordance with these Official Rules and selecting any Contest winner(s). You further acknowledge and agree that, where you enter a Contest by means of a Third Party Service, any personal information that you share with, or by means of, such Third Party Service may also be used by the applicable Third Party Service in accordance with its own privacy policy. V) GENERAL. (a) LAWS AND RULES. This Contest will be run in accordance with these Official Rules, which shall be subject to amendment by Rogers without notice or liability to you. You must comply with these Official Rules and will be deemed to have received and understood these Official Rules by participating or attempting to participate in this Contest. The terms of this Contest, as set out in these Official Rules, are not subject to amendment or counter-offer, except as set out herein. Rights and remedies may vary by province or territory. (b) CANCEL AND AMEND. Rogers reserves the right to cancel, modify, or suspend this Contest or to amend these Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, bug, corruption, security breach or other cause beyond the reasonable control of the Contest Sponsors, Rogers reserves the right to cancel or suspend the Contest and/or conduct a random draw from all previously received eligible entries. (c) CONDUCT. The Contest Sponsors reserve the right, in their absolute discretion, to disqualify without notice, and/or ban from this Contest and any future contests, any entrant that they find to be: violating these Official Rules; tampering or attempting to tamper with the entry process or the operation of the Contest or any Contest website; acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or attempting to undermine the legitimate operation of the Contest. Any attempt by an entrant or any other individual to undermine the legitimate operation of this Contest may be a violation of criminal and/or civil laws. Should any such attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. (d) IDENTITY OF ONLINE ENTRANT. If a dispute arises regarding the identity of any online entrant, the applicable entry will be deemed to have been submitted by the authorized account holder of the account provided at the time of entry. An entrant may be required to provide proof that he or she is the authorized account holder of the account associated with a particular entry. The individual assigned by an Internet access provider, online service provider, or other organization responsible for assigning the applicable type of account is considered the authorized account holder. Whether or not an individual constitutes the authorized account holder in question will be determined by Rogers in its sole discretion; and, if the name of the authorized account holder does not accord with the full name provided at the time of entry, the applicable entry may be disqualified in Rogers absolute discretion.
