1 Group Prepaid Legal Insurance Services Project Specific Vendor Questionnaire Matrix Page 1 of 6 Proposer is being asked to provide the following services. Proposers are asked to specify their ability to provide these services. If Proposer cannot provide any of the following services, the Proposer must so indicate with a NO and brief explanation. Proposals shall be based on the Plan designs requested. With the exception of the minimum qualifications requirements, items that the Proposer deviates from will not exclude the Proposal from consideration for evaluation. Such deviations must be clearly identified and noted Broward County will award a contract under this RFP directly to the carriers or companies that provide the requested services and will require a signature from an authorized representative with the authority to commit the carrier or company to all requirements of the RFP. Awardee may contract with independent agents or brokers separately from its contract with Broward County. Nothing in this RFP will be construed to restrict compensation, contractual or employment arrangements that an Awardee may grant to a licensed insurance agent or to otherwise violate Section or Section , Florida Statutes. Proposer agrees that no minimum participation requirements will apply to any proposed plan. Proposer must have a comprehensive network in Dade, Broward and Palm Beach Counties and provide adequate access to services. Comply: /No Comply: /No Comply: /No

Proposer agrees that it will not pre-assign attorneys to County members. Members will have the ability to select a NETWORK Attorney of their choice. Proposer agrees to provide vendor-billed continuation of coverage through the same or similar plan to retired/terminated employees. Hyatt Legal Plans encourages employees to use the plan to resolve as many legal issues as possible even if there are preexisting matters. The only preexisting matters that are not covered are those for which the employee retains an attorney before becoming eligible for plan benefits. This is necessary to protect the existing attorney-client relationship. ELIGIBILITY 7. Proposer agrees employees shall be eligible to add or delete existing dependents during the Plan Year (January-December) if the employee experiences a valid family status change (qualifying event). Employees who do not enroll within their initial eligibility period, and do not have a valid family status change (qualifying event), cannot enroll until the following annual open enrollment period with coverage starting on January 1 st of the new Plan Year.

Proposer agrees to cover Domestic Partners and eligible dependents of a domestic partner, based on the Broward County Domestic Partner Ordinance. EMPLOYEE COMMUNICATIONS Proposer agrees to cover child dependents including: natural child, stepchild, foster child, adopted child (including a child who is required to be eligible for coverage as an adopted child in conformity to applicable law) or a child for whom the employee has been appointed a legal guardian, pursuant to a valid court order. Proposer agrees to cover child dependents to the limiting age for Young Adult Coverage under the Affordable Care Act (currently age 26) and to adjust if changes are made to Affordable Care Act. (Student status not required past age 18). Proposer agrees coverage for a covered child dependent may be continued through the end of the calendar year in which the child turns age 26 (subject to change based on Health Care Reform guidelines). Proposer agrees the County will collect, verify and maintain dependent documentation and eligibility. ELIGIBILITY FILES/ELECTRONIC DATA EXCHANGES Proposer agrees to accept County enrollment processes, including enrollment form and weekly electronic eligibility file transfers. Proposer agrees to exchange all data (file transmission, , media, etc.) between Proposer and County should be encrypted and only de-encrypted by the specified recipient. In addition, Proposer is required to use a secure venue to exchange files to and from third party vendors outside of the organization. All electronic files will be in a HIPAA compliant format. N/A the legal plan is not governed by HIPAA regulations EMPLOYEE COMMUNICATIONS Proposer agrees to obtain County approval any member communication materials prior to distribution. Proposer is responsible for all costs of printing, producing and mailing/distributing adequate quantities of member information. Proposer agrees to provide a toll-free number for members to contact Member Services. Proposer agrees to host an ADA compliant (Section 508 of the Rehabilitation Act of 1973) web portal/micro site designed specifically for County members to include general plan information, Attorney Finder by location and specialty, Certificate of Coverage, Benefit Summary and the ability for the member to sign on to their own secure account. Vendor must be able to provide statistical reports on use of the website. Proposer agrees to provide documents for posting on the County s website or distribution through electronic media in an ADA compliant format. Proposer agrees to provide assistance, technically and creatively, in the on-going development and preparation of various employee communication materials. Proposer will provide a minimum of one representative to attend annual Countysponsored Financial Fairs and annual Open Enrollment vendor fairs. Financial Fairs typically held in June over a one week period at various County locations and Open Enrollment typically held in mid-october over a one week period. Agreed, except our rate does not include the cost of home mailings.

The speaker will be an expert on the topic selected. Proposer agrees to provide a County-approved Welcome Kit at vendor s expense to include ID cards, Summary Plan Description and other member information to newly enrolled members within ten (10) business days after receipt of the enrollment. Proposer agrees to review and update applicable sections of the County s annual benefit summary book, (currently titled We ve Got You Covered) to ensure information is compliant with the plan documents. ACCOUNT MANAGEMENT, REPORTING AND AUDITING 25. Proposer agrees to establish an account management and servicing relationship with the County that emphasizes proactive, regular contact, timely responses to administrative issues and employee complaints. 26. Proposer agrees to accept the County s remittance for active employees on a biweekly basis, in arrears, after each payroll is run. The County will remit premium payments based on its records. 27. Proposer agrees to provide quarterly and annualized utilization reports as follows: (a) Customer Call log detailing types of call, type of complaint and resolution.
