3 Section One Insuring Agreement Policy Number: Intermediary Group Policyholder: Group Policyholder Address: /Truro School Aon UK Limited, 103 Waterloo Street, Glasgow, G2 7BW Truro School & Truro Preparatory Schools Trennick Lane, Truro, Cornwall, TR1 1TH is hereby insured by Chubb Insurance Company of Europe SE (referred to herein as the Company) in consideration of payment of the required premium and in accordance with the attached Policy Specification Policy Period: From: 1 st September 2017 To: 31 st August 2018 (both dates inclusive) and any subsequent period for which payment is made and the Company agrees to accept the premium. Premium: Category A Personal Accident per pupil/employee Category B Personal Accident for Governors and Volunteers Insured Insured All Premiums are Inclusive of Insurance Premium Tax or other applicable tax. This Policy, Specification and any Endorsements together with this Insuring Agreement and the Definitions, General Exclusions and General Insurance Conditions shall read as one document. Wherever a word or series of words appear in bold, they are defined to be given the specific meaning set out in the Section 4 Definitions or in the Endorsement(s) to this Policy. They will carry the same meaning throughout wherever they appear within this Policy. The terms of this Policy shall not be waived or changed, except by Endorsement(s) issued to form part of this Policy. This Policy shall not be valid unless signed by an authorised employee of the Company or Aon UK Limited as applicable. 4 Section Two Personal Accident Specification Insured Persons Category A: Any Pupil or Nursery Child attending the School or any Employee of the School as declared to the Company. Category B: Any Governor or Volunteer engaged in the business of the Group Policyholder Operative Time Category A: In respect of Pupils and/or Nursery Children: 24 hours a day anywhere in the world and will cease when the child permanently leaves the school or nursery. In the event of an Insured Person not returning to the School following the completion of his/her Education after the end of a term, cover will cease immediately upon the Insured Person s uninterrupted return home direct from the School or to another destination. Cover will be effective for Journeys which take place after the end of the Insured Person s final term at School, provided that: a) The trips are organised by the School; b) The Insured Person booked their place of the trip before the end of their final term at the School. In the event of an Insured Person transferring to another school within the United Kingdom cover continues until an Insured Person starts his/her uninterrupted travel to the new school. In respect of Employees. 24 hours a day anywhere in the world. Category B: Whilst in pursuit of normal business duties on behalf of the Group Policyholder, or whilst travelling directly between the Group Policyholder s premises and the Insured Person s residence (permanent or temporary). 4

7 Section Three Personal Accident Coverage In the event an Insured Person sustains Bodily Injury during the Operative Time, the Company shall pay the Insured Person in accordance with the Scale of Benefits stated in the Personal Accident Specification. If compensation is payable in respect of one Insured Person under more than one benefit included under the Personal Accident Specification as a result of one Event the total payable shall not exceed the Maximum Benefit any one Insured Person noted in the Personal Accident Specification. Coverage Extensions Burns and Scalds If within the Operative Time an Insured Person sustains permanent scarring caused by full thickness burns (third degree burns or burns of greater severity) or scalding to the body surface area (excluding any part in the area from the hairline to and including the lower jaws and ears) the Company will pay the following percentages of the amount stated in the Personal Accident Specification: a to at least 4% but to less than 15% of the body surface 30% b to at least 15% but to less than 25% of the body surface 60% c to 25% or more of the body surface 100% Dental Injury and Emergency Dental Treatment (Benefit 27 provided to Category A Insured Persons only) If within the Operative Time a Category A Insured Person suffers dental injury or requires emergency dental treatment following Bodily Injury the Company will pay the amounts shown below: a b c d e Treatment for Dental Injury following Bodily Injury: In each period of insurance for reasonable fees for the treatment and services provided to the Insured Person for the purpose of treatment for dental injury. Up to 10,000. Emergency Dental Treatment following Bodily Injury: In each period of insurance for reasonable fees incurred for emergency dental treatment Up to 2,000 Surgical Extraction of wisdom teeth following Bodily Injury: Provided it is diagnosed for the first time and being necessary during the operative time 125 per tooth In-Patient Hospital cash benefit following Bodily Injury: For each night the Insured Person spends in hospital during the effective time for the primary purpose of receiving in-treatment dental treatment up to a maximum of 365 nights, provided that the condition for which the treatment or surgery is required is diagnosed during the period of insurance 125 per night Travel to Hospital Expenses For reasonable expenses necessarily incurred for the services of a chauffeur or taxi or other additional travel costs to convey or accompany an Insured Person to and from a Dentist Up to 125 7

8 Disappearance If an Insured Person disappears and it is reasonable to believe that such Insured Person has died as a result of Bodily Injury occurring during the Operative Time, the Company shall pay the Accidental Death Benefit shown in the Personal Accident Specification. If the Insured Person is aged 17 years or less the Company will pay the Benefit Amount to the Parent or Legal Guardian of the Insured Person. If the Insured Person is aged 18 years or over the Company will pay the Benefit Amount to the estate of the Insured Person. The Parent or Legal Guardian or the Insured Person s legal representatives shall provide a signed undertaking that if the death is subsequently found to be incorrect the Accidental Death Benefit paid shall be refunded to the Company. Disability Assistance Expenses If within the Operative Time an Insured Person sustains Bodily Injury resulting in Benefit per Insured Person per Event 2, 3, 4, 5, 6, 7, 8, 10 or 11 as shown in the Personal Accident Specification the Company shall indemnify the Group Policyholder for the benefit of the Insured Person for reasonable expenses necessarily incurred with the Company s prior written consent for alterations that have to be made to the Residence and/or vehicle and/or usual place of employment of the Insured Person in accordance with the Sum Insured shown in the Personal Accident Specification. Domestic Assistance Expenses If within the Operative Time an Insured Person sustains Bodily Injury resulting in Benefit per Insured Person per Event 2, 3, 4, 5, 6, 7, 8, 10 or 11 as shown in the Personal Accident Specification the Company shall indemnify the Group Policyholder for the benefit of the Insured Person for reasonable expenses necessarily incurred in employing a bona fide domestic services company for domestic assistance provided to the Insured Person at their Residence up to a maximum period of 104 weeks in accordance with the Sum Insured shown in the Personal Accident Specification. Exposure Death and/or injury to an Insured Person as a direct result of unavoidable Exposure to the Elements shall be deemed to have been caused by Bodily Injury. Extension of Policy Period If the Insured Person is traveling directly to the School to commence forthwith his/her Education before the start of a School term, cover will commence upon the Insured Person s leaving home, even if such travelling commences before the start of the Policy Period, provided that the School term falls wholly within the Policy Period. Independent Financial Advice If within the Operative Time an Insured Person sustains Bodily Injury resulting in Benefit per Insured Person per Event 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23 and 24 as shown in the Personal Accident Specification the Company shall indemnify the Group Policyholder for the benefit of the Insured Person for fees charged by an Independent Financial Adviser authorised and regulated by the Financial Conduct Authority or equivalent regulatory authority in the Insured Person s Country of Permanent Residence and who is not the Insured Person the Partner of the Insured Person a member of the immediate family of the Insured Person or an Employee of the Group Policyholder to provide the Insured Person with one session of professional financial advice in accordance with the Sum Insured shown in the Personal Accident Specification. 8

9 Loss of or Loss of Vitality of Permanent Natural Teeth (Benefit 26 provided to Category A Insured Persons only) If within the Operative Time an Insured Person sustains Bodily Injury that directly results in loss of, or Loss of Vitality of, permanent natural teeth, the Company will pay compensation up to a total overall maximum each period of insurance of 7,500 subject to the following inner limits: a Total Loss of anterior tooth (canine or incisor) 2,000 per tooth b Total Loss of posterior tooth (molar to pre-molar) 1,250 per tooth c i partial loss of anterior and/or posterior tooth Up to 600 per tooth ii the total Loss of Vitality of a permanent natural tooth 600 per tooth but not exceeding 2,400 in total for all teeth partially lost and/or teeth suffering total Loss of Vitality. Special Conditions: 1 Total loss of tooth must occur within three years from the date of the Accident resulting in dental injury and involve the complete permanent physical loss of tooth from the mouth. 2 Claims for partial loss of tooth or teeth shall be calculated by assessing the percentage of tooth lost in relation to the maximum benefit payable for partial loss of a single tooth. Where more than 90% of a tooth has been lost the Company will deem it to be Total Loss of anterior tooth (canine or incisor) or Total Loss of posterior tooth (molar to pre-molar) for the purposes of a claim under this section. 3. Where an Insured Person subsequently loses the remaining part of a tooth for which a partial loss of tooth or total Loss of Vitality of a permanent natural tooth claim has been paid by the Company, the Company shall be entitled to deduct such amount paid from any subsequent claim for the total loss of such tooth. Special Exclusions: The Company shall not be liable to pay compensation for: 1 Total or partial loss of any a) deciduous (milk) tooth b) dental implant c) crown, veneer, denture or bridge 2 Loss of Vitality of any a) deciduous (milk) tooth b) tooth caused intra orally by wear and tear Loss of or damage to sound and natural teeth (Benefit 28 provided to Category B Insured Persons only) If within the Operative Time an Insured Person sustains Bodily Injury that directly results in the total loss of, or damage to sound and natural teeth, the Company will pay a benefit of 500 per tooth (excluding milk teeth) lost or damaged and requiring emergency treatment within 30 days of the Bodily Injury subject to a maximum benefit of 2,000 in all in any one Accident. 9

10 Section Four Definitions This Policy uses words in their plain English meaning. Words with special meanings are defined here or in the part of the Policy where they are used. Throughout the Policy, defined terms will be capitalised and bolded when used. Accident shall mean a sudden unforeseen fortuitous identifiable event and the word accidental shall be construed accordingly. Annual Salary shall mean the total annual basic salary including overtime, but excluding bonus or commission payments payable to the Insured Person at the date Bodily Injury is sustained. Overtime payments shall be based on the average payments made during the 12 months immediately prior to the date of Bodily Injury. Bodily Injury shall mean injury which is caused solely by accidental means which solely and independently of any other cause results directly in the death, disablement, dental injury or Facial Disfigurement within twenty four months from the date of the Accident. Education shall mean a programme of learning or caring provided by a recognised educational body, which may lead to qualification by examination or assessment which is either full time study or a mixture of study and work experience. Any Nursery or Pre- Preparatory School is deemed to be included within this definition Event shall mean one occurrence or a series of occurrences, consequent upon or attributable to, one source or original cause. Exposure to the elements shall mean death or Bodily Injury of an Insured Person as a direct result of unavoidable exposure to extreme heat or cold. Facial Disfigurement shall mean permanent facial disfigurement to the extent of not less than one (1) square centimetres of scar tissue, or a scar of not less than two (2) centimetres in length in each case in the area from the hairline to and including the lower jaw and ears. Funeral Expenses shall mean reasonable expenses necessarily incurred in the burial or cremation of the Insured Person if within the Operative Time an Insured Person sustains Bodily Injury resulting in Accidental Death in accordance with the sum insured shown in the Personal Accident Specification. Loss of Jaw shall mean the surgical removal of the lower jaw or the jaw (or remaining part) being fixed in position with permanent and total loss of movement in the temporomandibular joint (the joint between the jaw and the skull). Loss of Vitality shall mean death of nerve of tooth. Parent or Legal Guardian shall mean a person with parental responsibility, or a legal guardian, both being in accordance with Children Act 1989 and any statutory amendment modification or re-enactment of it. Permanent Disability shall mean disability which has lasted for at least 12 months and from which in the opinion of a Qualified Medical Practitioner an Insured Person will not recover for the remainder of his or her life. Qualified Medical Practitioner shall mean a doctor or specialist who is registered or licensed to practice medicine or dentistry under the laws of the country in which they practice and who is not the Insured Person or a member of the immediate family of the Insured Person or an employee of the Group Policyholder Residence shall mean the place where the Insured Person permanently resides. 10

11 School shall mean the Group Policyholder noted in Section 1 Insuring Agreement and includes any Nursery or Pre- Preparatory School. Total Loss of Hearing shall mean total and irrecoverable loss of hearing. Total Loss of Sight shall be deemed to have occurred: a) in both eyes once the name of the Insured Person has been added to the Register of Blind Persons on the authority of a fully qualified ophthalmic specialist and the Company is satisfied that the condition is permanent and without expectation of recovery; or b) in one eye when the degree of sight remaining after correction is 3/60 or less on the Snellen Scale (meaning seeing at three feet that which the Insured Person should see at sixty feet) and the Company is satisfied that the condition is permanent and without expectation of recovery. Total Loss of Speech shall mean the total and irrecoverable loss of use of the power of audible and intelligent speech. United Kingdom shall mean England, Scotland, Wales and Northern Ireland, the Isle of Man and the Channel Islands. War shall mean armed conflict between nations including forces acting for any international authority whether War be declared or not, invasion, civil war, any attempt to usurp power, or any activity arising out of an attempt to participate in military force between nations. 11

12 Section Five General Exclusions The following General Exclusions apply. The Company shall not be liable for any Bodily Injury, loss or expense suffered as a result of: a) an Insured Person sustaining Bodily Injury once he or she has attained the age of eighty years unless such Bodily Injury occurs during the Policy Period in which the Insured Person attains the age of eighty years; b) War in the United Kingdom; c) an Insured Person engaging in active service in any of the Armed Forces of any nation; d) an Insured Person participating in any sport as a professional where earnings therefrom exceed 50% of Annual Salary. e) an Insured Person committing or attempting to commit suicide or intentionally inflicting self injury; f) sickness, disease, any naturally occurring condition, any gradually operating cause or post traumatic stress disorder other than as a direct result of Bodily Injury; g) an Insured Person engaging in aviation as a pilot of a fixed wing or rotary propelled aircraft; The Company shall not be liable to provide cover or benefit or pay any sums if that would directly or indirectly put it or any of its group companies in breach of any applicable economic or trade sanctions. 12

13 Section Six General Insurance Conditions These conditions apply to the Policy as a whole and to each Coverage Part in it. 1. ADJUSTMENT INFORMATION The Group Policyholder shall provide details of the numbers of Insured Persons within 30 days of the commencement of the Period of Insurance and thereafter every subsequent School term to the Intermediary for onward transmission to the Company. 2. CANCELLATION The Policy may be cancelled by the Group Policyholder by giving the Company sixty days written notice by recorded delivery. The Company shall return any unearned portion of the Premium paid by the Group Policyholder to the company for the Policy Period provided that no claim has been paid or is payable and no incident has occurred which could give rise to a claim under the Policy. The Policy may be cancelled by the Company by giving the Group Policyholder sixty days prior written notice to the last known address of the Group Policyholder. The Company shall return any unearned portion of the Premium paid by the Group Policyholder to the company for the Policy Period. The calculation of the unearned portion of the Premium shall be made as soon as practicable after written notice of cancellation has been given to the Group Policyholder but the failure of the Company to provide details to the Group Policyholder of the unearned portion of the Premium in the notice of cancellation shall not affect the validity of such notice. The Policy may be cancelled by the Company for non payment of Premium by giving the Group Policyholder five days written notice by recorded delivery to the last known address of the Group Policyholder. The Company may cancel any cover provided under the Policy in respect of War by giving the Group Policyholder seven days written notice by recorded delivery to the last known address of the Group Policyholder 3. DUE DILIGENCE The Group Policyholder and Insured Persons shall exercise all due diligence and care to avoid or diminish any loss or any circumstances likely to give rise to a claim under this Policy. 4 MISREPRESENTATION AND NON-DISCLOSURE In the event of misrepresentation or non-disclosure by deliberate or reckless act or omission by the Group Policyholder of any circumstances material to the risk insured, the Company may avoid this Policy from the date of that act or omission and need not return any of the premium paid. In addition, any benefit that has been paid under this Policy that resulted from or after any such deliberate or reckless act or omission shall immediately be repaid to the Company. It is for the Company to demonstrate that such act or omission is deliberate or reckless. The rights of the Company in the event of misrepresentation or non-disclosure which is neither deliberate nor reckless are limited to the right to (i) charge an additional premium; and/or (ii) apply additional terms from the date of such act or omission, which could reasonably have been demanded had such misrepresentation or non-disclosure not occurred; or (iii) cancel the Policy in accordance with the Cancellation condition. 5. FRAUDULENT CLAIMS In the event of a fraudulent claim by the Group Policyholder, an Insured Person or any other person or party entitled to benefit under this Policy, the Company a) is not liable to pay the claim; b) may recover any sums paid in respect of the claim; c) may cancel this Policy from the date of the fraudulent act and need not return any of the premium paid; 13

14 d) is not liable for any losses occurring, or provision of other benefit under this Policy, after the date of cancellation; and e) may, in respect of d) above, recover any sums paid in respect of such losses or benefit. Provided that 1. where any claim is for indemnity or benefit to more than one person or party, the rights of the Company under a) and b) above are exercisable only in relation to the person or party who committed the act; 2. where a fraudulent act is committed by any person or party who is not the Group Policyholder the rights of the Company under c) and d) above are exercisable only in relation to the cover provided for such person or party who committed the fraudulent act. It shall be for the Company to demonstrate that a claim has been made fraudulently and/or that a fraudulent act has taken place. 6. INFORMATION PROVIDED TO THE COMPANY The Group Policyholder must tell the Company, as soon as possible, if there are any changes to the information that has previously been provided to the Company. 14

15 7. INTEREST No sum payable under this Policy shall carry interest. 8. JURISDICTION AND GOVERNING LAW This Policy shall be governed by and construed in accordance with the Law of England and Wales. Each of the parties submits to the exclusive jurisdiction of the courts of England and Wales. 9. SPECIAL CLAIMS CONDITIONS It is a condition precedent to the liability of the Company under this Policy that in the event of any circumstances which could give rise to a claim, a) the Group Policyholder or Insured Person shall give notice to the Company as soon as reasonably possible by writing to the following address: Chubb Insurance Company of Europe SE, 100 Leadenhall Street, London, EC3A 3BP, or by contacting Chubb as below; Telephone: +44 (0) Facsimile: +44 (0) cahukclaims@chubb.com b) the Group Policyholder and/or Insured Person shall i) make no admission of liability without the prior written consent of the Company; ii) provide the Company or their appointed representatives with: a) all necessary assistance in a timely manner, b) all information reasonably required, c) all documentation and records necessary to establish and assess indemnity hereunder, d) copies or extracts as may be reasonably required, iii) prove the loss to the reasonable satisfaction of the Company; iv) forward immediately to the Company or their representatives any letter, writ, notice of claim or other document received in connection with any claim made under this Policy; v) assist and concur with all reasonable arrangements for medical and other advisers of the Company to examine any Insured Person in respect of which a claim has arisen. vi) As often as may be reasonably required provide a statutory declaration sworn before a solicitor, justice of the peace or notary public named by the Company, on all matters connected with a claim, at such reasonable time and place as may be designated by the Company. No act of the Company or their representatives in connection with any investigation hereunder, shall be deemed a waiver of any defence which the Company might otherwise have. All acts shall be deemed to have been made without prejudice to the Company's liability. The Company reserves the right to:- a) take such steps as they deem necessary to prevent, mitigate or minimise a loss; b) take over and conduct the defence or settlement of claims made against an Insured Person that are covered by this Policy; c) pursue all rights or remedies available to the Insured Person whether or not payment has been made hereunder; d) require independent medical examination of any Insured Person who gives rise to a claim hereunder. 15

16 c) The Company will pay claims as follows; a) If the Insured Person is aged 17 years or less the Company will pay the Benefit Amount for Accidental Death to the Parent or Legal Guardian of the Insured Person and for all other claims to the Parent or Legal Guardian for the benefit of the Insured Person whose receipt shall be a full discharge of the Company s liability for such Benefit Amount. b) If the Insured person is aged 18 years or over the Company will pay the Benefit Amount for Accidental Death to the estate of the deceased Insured Person and the receipt given to the Company by the Insured Person s personal representatives shall be a full discharge of the Company s liability for such Benefit Amount. c) If the Insured Person is aged 18 years or over the Company will pay the Benefit Amount for all other claims to the Insured Person whose receipt shall be shall be a full discharge of the Company s liability for such Benefit Amount 10. THIRD PARTY RIGHTS A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Policy except where such rights exist apart from the operation of such Act. 11. NON ASSIGNMENT This Policy cannot be assigned without the prior written consent of the Company. 12. DATA PROTECTION NOTICE The Company collects and processes personal information about individuals who may receive cover under the Policy from the Group Policyholder and/or Insured Person, such as their name, address, and any other personal details which are provided to us in order to provide the insurance and claims services. The Company will treat this information in accordance with applicable data protection law. For policy administration purposes the Company will use and store any such personal information on an electronic database, which may also be available to selected authorised representatives of member insurers of the Chubb Group of Insurance Companies operating outside Europe. Chubb has taken reasonable measures to protect such personal information once it is transferred outside Europe in accordance with their normal data security policies. The Company may also disclose such personal information to outside parties, such as premium collection agencies, reinsurers, outside counsel and claims administrators, to provide the insurance and claims services, or as allowed by law. Please ensure that the Insured Persons are aware of the same. 13. COMPLAINTS The Company aims to provide a first class service.
