1 OFFICIAL RULES AND REGULATIONS MAC S Online Lottery DAILY GRAND Contest 1. CONTEST PERIOD The MAC S Online Lottery DAILY GRAND Contest (the Contest ) begins on Monday, October 10, 2016 at 12:00:01 a.m. Eastern Time ( ET ) and ends on Sunday, December 4, 2016 at 11:59:59 p.m. ET (the Contest Period ). 2. ELIGIBILITY: To be eligible to enter the Contest participants must: a) Be residents of Ontario; b) Be eighteen (18) years of age at the time of entry; and c) Have purchased an eligible lottery product at a participating Mac s or Circle K Convenience Store. The Contest is not open to: a) Employees (including full-time, part-time and student employees; persons who are directly on payroll; and employees who are on paid or unpaid leave), officers, directors, representatives or agents (and those with whom any of the foregoing persons are domiciled, whether related or not) of: i. Mac s Convenience Stores Inc. (the Sponsor ); ii. The Ontario Lottery and Gaming Corporation ( OLG ); iii. The Alcohol and Gaming Commission of Ontario (the AGCO ) iv. The Sponsor s authorized retailers, distributors or franchisees (including both corporate and independent Mac's and Circle K stores as well as Winks, Daisy Mart, and Becker s); v. The respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies of any of the foregoing parties mentioned in (i) through (iii); and vi. Any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the Contest Parties ). The Contest is in no way, sponsored, administered or managed by OLG. You understand that any information provided by you is provided to the Sponsor and not to OLG. The information you provide will only be used for the administration of this Contest and in accordance with these Official Rules and Regulations (the Rules ) and the Sponsor s privacy policy (available at 3. HOW TO ENTER: There are two (2) ways to enter the Contest: 1

2 a) With Purchase: Purchase any of the following OLG lottery tickets at a participating Mac s or Circle K Convenience Store in Ontario, Canada during the Contest Period: i. DAILY GRAND, LOTTO MAX, LOTTO 6/49, POKER LOTTO, MEGADICE LOTTO, WHEEL OF FORTUNE LOTTO, DAILY KENO, PICK 2, PICK 3, PICK 4, ONTARIO 49, LOTTARIO, PRO LINE, PRO PICKS, POINT SPREAD, PROPS and POOLS (each an Eligible Ticket ). OR After purchasing an Eligible Ticket, enter the Contest online at anytime during the Contest Period. Simply follow the instructions and fully complete the registration by submitting your contact information including your name, address, address, phone number and enter your Eligible Ticket numbers. Each Eligible Ticket number entered will automatically receive one (1) entry into the applicable Prize Draw. Limit: Each Eligible Ticket number is unique and can only be entered one (1) time during the Contest Period. No Purchase Necessary: To be entered, by mail, into the contest for the Prize Draws, without purchasing an Eligible Ticket, please print by hand your first name, last name, day and evening phone numbers, address, date of birth, complete mailing address (including postal code) and include a minimum 50 word hand written essay about the first thing you would buy if you won the lottery on a plain piece of white 8 ½ x 11 paper and mail it (in an envelope with sufficient postage) to Mac s Online Lottery MORE WINNERS Contest, 612 Creative, # Columbia Street, New Westminster, British Columbia V3M 1B4 (the Request ). Upon receipt of your Request, in accordance with these Rules, you will automatically be entered into the applicable Prize Draw as post-marked on the envelope. One entry per unique and original Request must: (i) be received separately in an envelope bearing sufficient postage (i.e. mass mail-in Requests in the same envelope will be void); and (ii) be post-marked during the Contest Period and received by the Sponsor or their designated representative no later than five (5) business days after the Prize Draw Period ends (defined below) at 5:00 p.m. ET. The Released Parties (defined below) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Requests (all of which are void). 4. ENTRY LIMIT AND SPONSOR S RIGHT TO VERIFY: During the Contest Period, each eligible person may enter the Contest a maximum of twenty-five (25) times per day, regardless of the method of entry. Contest participants may be disqualified from the Contest in the sole and absolute discretion of the 2

3 Sponsor if it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by it) that any person has attempted to: a) Obtain more than the stated maximum number of entries; and/or b) Use multiple names, identities and/or any automated, macro, script, robotic, or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest. All entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity in a form acceptable to the Sponsor including, without limitation government issued photo identification: a) For the purposes of verifying an individual s eligibility to participate in this Contest; b) For the purposes of verifying the eligibility and/or legitimacy of an entry/request entered (or purportedly entered) for the purposes of this Contest; c) For the purposes of verifying an individual s age prior to awarding any prize; and/or d) For any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid entry/request in this Contest will be the Sponsor s official clock(s). 5. DISPUTES REGARDING ENTRIES: In the event of a dispute regarding who submitted an online entry, entries will be deemed to have been submitted by the authorized account holder of the address associated with the entry in question (as determined by the Sponsor, in its sole and absolute discretion, in accordance with its official records). A participant may be required to provide proof in a form acceptable to the Sponsor (including without limitation, government issued photo identification), that he/she is the authorized account holder of the address associated with the online entry in question. All decisions of the Sponsor regarding who qualifies as the authorized account holder will be final and binding without right for appeal. 6. THE PRIZES AND APPROXIMATE RETAIL VALUES: There will be fifty six (56) prizes (each, a Prize and collectively, the Prizes ) consisting of a $100 lottery gift card. Limit of one (1) Prize per household during the Contest Period. Each Prize must be accepted as awarded without substitution and is not transferable, not assignable, not for resale. The Sponsors, in their sole discretion, reserve the right to substitute all or 3

4 any portion of the Prizes with another prize or portion thereof of equal or greater value. 7. RANDOM PRIZE DRAWS AND WINNER SELECTIONS: In all cases the draws will be initiated by a Contest administrator (human) and processed by an algorithm (computer program) that simulates a random draw (the Random Draw ). Any attempt to manipulate or tamper with the winner selection system or the database of entries will result in disqualification and possible criminal prosecution. For the purposes of this Contest, a Day shall mean a calendar day that begins at 12:00:00 AM (EST) and ends at 11:59:59 PM (EST). A Week shall begin on Monday and end on Sunday. For each Week during the Contest Period a Random Draw for that Week s prizes will be conducted in Vancouver, BC, by an independent contest judging organization, from all eligible entries received during that Week. Weekly winners will be selected within five (5) business days of the corresponding prize Week. Odds of being selected depend upon the total number of eligible entries received during a given Week. Unselected entries will not roll over into subsequent weekly draws. The odds of winning a Prize depend on the number of eligible entries received. The Sponsor or its designated representative will within fifteen (15) business days of Draw Date make a minimum of three (3) attempts to contact each selected entrant using the personal information submitted. TO BE DECLARED A CONFIRMED PRIZE WINNER, each selected entrant will be required to: a) Correctly answer a mathematical skill-testing question without mechanical or other aid; i. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or comply with applicable law; b) Sign and return within fifteen (15) business days of notification the Sponsor s declaration and release form, which (among other things): ii. Confirms compliance with these Rules; iii. Acknowledges acceptance of the Prize as awarded; iv. Releases the Contest Parties, OLG, the AGCO and each of their respective officers, directors, agents, representatives, affiliates, successors and assigns (collectively, the Released Parties ) from any and all liability in connection with this Contest, his/her participation therein, and/or use of his/her name, address, voice, statements about the Contest, photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or internet. 4

5 A selected entrant may be disqualified by the Sponsor in its sole and absolute discretion if he/she: a) Fails to correctly answer the skill-testing question; b) Fails to return the properly executed Contest documents within the specified time; c) Cannot be contacted within fifteen (15) business days of the Draw Date, or there is a return of any notification as undeliverable; d) Cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or e) Is determined to be in violation of these Rules as determined by the Sponsor in its sole and absolute discretion. If disqualified a selected entrant will forfeit all rights to the Prize and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate entrant from among the remaining eligible entries submitted and received in accordance with these Rules. In such cases the foregoing provisions of this section shall apply to such newly selected entrants. 8. LIABILITY The Released Parties (as defined above) will not be liable for any loss or damage howsoever caused, including but not limited to loss or damage arising from: a) Any failure of any entry, request or other information to be received, captured or recorded howsoever caused; b) Any late, lost, misdirected, delayed, illegible, damaged, destroyed, incomplete or incompatible requests (all of which are void); c) Any late, lost, misdirected, delayed, illegible, damaged, destroyed, incomplete or incompatible entries, regardless of how such entries are submitted (all of which are void); d) Any error, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated in these Rules; e) Any attempt to undermine the legitimate operation of this Contest in any way (as determined by the Sponsor in its sole and absolute discretion); By entering into this Contest, all entrants agree to release OLG of any and all liability in connection with this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not OLG. 9. GENERAL CONDITIONS: The Contest is only available at participating Mac s and Circle K Convenience Stores in Ontario. All entries become the property of the Sponsor. This Contest is subject to all applicable laws of Ontario. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants. 5

6 By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted or associated with his/her entry only for the purpose of administering the Contest and in accordance with the Sponsor s privacy policy (available at ), unless the entrant otherwise agrees. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by an entrant, entry or request with these Rules, or as a result of any technical or other problems, or in the light of any other circumstances which, in the opinion of the Sponsor, in its sole discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contestrelated materials, the terms and conditions on these English Rules shall prevail, govern and control to the fullest extent permitted by law. Any attempt to undermine the legitimate operation of this Contest in any way (as determined by the Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. BY PARTICIPATING IN THIS CONTEST YOU ARE AGREEING TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS OF THESE RULES. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 6
