1 Application Information The Fair Sunday is an international art fair held annually in since The fair is dedicated to the discovery of young and contemporary galleries and artists. Sunday hosts approximately 23 galleries and 4 institutions and takes place concurrently with Frieze Art Fair. It offers visitors a focused selection of exciting young galleries in an open and laid back environment. Location The fair is held at Ambika P3, Marylebone Road,, NW1 5LS. A 14,000 sq ft subterranean exhibition space, close to Baker Street Underground Station and a ten-minute walk from Frieze Art Fair. Important Dates and Times Application deadline: 31st May 2018 Acceptance notification: early June 2018 VIP preview: Thursday 4th October from 12 6 pm Public preview: Thursday 4th October from 6 10 pm Open hours: Friday 5th & Saturday 6th October from 12 8 pm and Sunday 7th October from 12 6 pm. General Details The cost of participation at the fair is 3,500 plus UK VAT. International galleries are not required to pay VAT. Booths at Sunday can be solo or curated group presentations. Shared booths are allowed and should be submitted as one application. Tours and Patron Groups This year we will again organise tours of patron groups from leading international museums and institutions, and extend invitations to patrons and staff from leading museums and institutions to attend the VIP Preview.

2 Application Details Please complete the Application Form PDF. Please include images and illustrations of your booth proposal along with supporting images of the artist(s) work. Please submit your completed applications as a PDF (under 15mb) to: applications@sundayartfair.com You will be notified of the result of your application in early June Application Fee Application Fee is plus VAT. Upon receipt of your application we will issue you with an invoice for the application fee, this must be paid before we process your application. 3 Terms and Conditions Definitions For the purposes of the Terms and Conditions the following words and phrases will have the following meanings: Applicant means an applicant for participation in the Fair as an Exhibitor. Application means the official Application Form for admission to the Fair. Contract means the contract between Sunday Art Fair and the Exhibitor. Exhibitor means the Applicant participating in the Fair following written acceptance of such Applicant s Application by Sunday Art Fair. Exhibitor s Booth means the space allocated by Sunday Art Fair for display of the Exhibitor s art as part of the Fair. Exhibitor s Manual means the manual containing information for Exhibitors issued by Sunday Art Fair prior to the Fair Fair means the Sunday Art Fair scheduled to take place 1 8 October, Fair Premises means the area designated for the location of the Fair at Ambika P3, University of Westminster,. Sunday Art Fair means Sunday Art Fair Ltd, a company registered in the UK. General These Terms and Conditions govern the Exhibitor's participation in the Fair. Sunday Art Fair reserves the right to, at any time, issue other rules and regulations of participation in the Fair. Show Dates The Fair will take place from 1 8 October, Public opening days will be 4 7 October, Location The Fair will be held at Ambika P3, University of Westminster, 35 Marylebone Rd, NW1 5LS. Price and Conditions of Payment The Application must be accompanied by a processing fee of 75. This fee is non-refundable including upon withdrawal of an Application by an Applicant. Upon acceptance by Sunday Art Fair of an Application, the relevant Exhibitor will be invoiced for the rental fee for an Exhibitor s Booth. This invoice must be paid within 30 days. The method of payment is by electronic funds transfer denominated in GBP. The Exhibitor is liable for any costs or fees incurred by the transfer.

4 The Exhibitor shall be liable to pay interest on any overdue amount, accruing at a daily rate of 1% of the total amount of the unpaid invoice on the date on which the payment becomes overdue. The Exhibitor shall be liable for Sunday Art Fair s reasonable costs of collection and recovery of amounts due, including but not limited to full reimbursement of reasonable legal fees. Failure to Participate The Exhibitor must inform Sunday Art Fair immediately if they are unable to participate in the Fair. Any money paid towards the exhibitor s fee will not be refunded. Space Allocation The placement of the Exhibitor s Booth at the Fair will be designated solely at Sunday Art Fair's discretion. Sunday Art Fair does not guarantee the location of the Exhibitor s Booth. Requests concerning location and space requirements will be considered by Sunday Art Fair but participation in the Fair will not be contingent upon these requests and the allocation of an Exhibitor s Booth contrary to these requests does not give the Exhibitor a right to terminate the Contract. Sunday Art Fair may change the location of any space allocated to an Exhibitor s Booth in its sole and absolute discretion. Sunday Art Fair reserves the right to alter the allocation of common space and to relocate the aisles, entrances and exits of the Fair Premises at any time. The Exhibitor will not sublet or subdivide the Exhibitor s Booth or any part of it. The Exhibitor will not permit any other party to use Exhibitor s Booth for any purpose whatsoever. An Exhibitor who fails to occupy their Exhibitor Booth by 6pm on the 4 th of October will forfeit its right to occupy their booth. In that event, Sunday Art Fair will use the Exhibitor s Booth as they see fit and the Exhibitor shall remain liable for the full rental fee. Services and Amenities Provided Sunday Art Fair will provide Wi-Fi access at the Fair free of charge. The Wi-Fi service is provided on an as is basis and as available basis. Sunday Art Fair does not make any guarantee that the service will be uninterrupted, timely, secure, or error free. Sunday Art Fair will provide access to electrical sockets for each Exhibitor free of charge as well as general lighting. Sunday Art Fair will use all reasonable efforts to provide common area lighting but shall not be liable for any loss or damage due to failure or interruption of any service. Maintenance Exhibitors are responsible for the maintenance of their own Exhibitor s Booth and will leave the spaces as found upon arrival. Exhibitors are responsible for the removal of all wall fixings at the end of the Fair. Sunday Art Fair reserves the right to charge the Exhibitor for any damage to Exhibitor s Booth or the Fair Premises. The Exhibitor shall keep their Exhibitor s Booth sufficiently manned during the time the Fair is open to the public.

5 Works exhibited Sunday Art Fair requires complete details of any works of art proposed for exhibition at the Fair. Sunday Art Fair reserves the right to prohibit exhibition of any object at the Fair at their sole discretion. Insurance and Exception From Liability Sunday Art Fair accepts no responsibility for the loss or damage of the Exhibitor s artworks and property by any cause, including but not limited to: theft, breakage, leakage and water damage or fire. It is recommended that the Exhibitor has their own insurance policy in place. Sale of Goods The Exhibitor shall comply at all times with all applicable laws, rules and regulations regarding sales. This includes the collection and payment of all appropriate sales and excise taxes. Postponement, Cancellation or Force Majeure Sunday Art Fair maintains the right to change dates and opening hours of the Fair. Sunday Art Fair will not be responsible for any loss, damage, claims, costs or expenses of any kind if the event is cancelled, postponed or altered due to a Force Majeure. Force Majeure is defined as any unforeseen occurrence that renders performance of the event impossible, inadvisable, illegal or impracticable. Force Majeure includes, but is not limited to: casualty, fire, explosion, flood, earthquake or other natural disasters, an act of God, governmental restrictions or regulations, war or apparent acts of war, terrorism or apparent acts of terrorism, civil disturbances or riots, strikes, curtailment, suspension or restriction on transportation facilities and means of transportation or any other emergency. Jurisdiction and Applicable Law These Terms and Conditions are governed by the laws of England and Wales and will be interpreted in accordance with the English courts. The English courts shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these terms and conditions.
