1 October 10, 2007 Mr. Berne Mosley Director, Division of Pipeline Certificates Federal Energy Regulatory Commission Facsimile number: (202) RE: Cheyenne Plains Gas Pipeline Company, LLC Fifth Report of Service Interruption and/or Damage to Facilities Pursuant to Section Dear Mr. Mosley: On September 18, 2007, CPG notified the Federal Energy Regulatory Commission ("Commission") of an interruption of service and damage occurring on its system on September 16 th ("System Outage"). 1 While Cheyenne Plains Gas Pipeline Company, LLC ( CPG ) works to repair damage to its Cheyenne Plains Compressor Station and amine treating facility, it continues to free flow as much gas as possible until the facilities are fully returned to service. As information becomes available, status updates to the System Outage are provided to customers. 2 CPG continues to seek ways to increase its operationally available system capacity until its facilities can be restored to full service. As a result, CPG has contracted for an interruptible transportation service from Colorado Interstate Gas Company ( CIG ). This service will essentially act to partially replace the disabled compression by allowing CPG to raise the pressure on the west end of its pipeline and increase the operationally available system capacity from approximately 465 MMcf/day to approximately 590 MMcf/day. Using this service, CPG can provide transportation to shippers whose gas is delivered from CIG, Wyoming Interstate Company, Ltd. and Rockies Express Pipeline, LLC. Under the service agreement, CPG will pay a transportation rate and a fuel charge. CPG will recover this replacement fuel through its fuel mechanism consistent with the compression for which the service is substituting. Service under this agreement is expected to begin in mid-october after the completion of necessary pipeline modifications on the CIG and CPG systems. Included in Tab A is Notice No. 318 Cheyenne Plains Force Majeure Update # 17 posted today informing shippers of CPG s contracting for interruptible transportation service from CIG. Request for Waivers, if Necessary CPG is informing the Commission of its emergency responses to the System Outage. CPG does not believe that any further FERC authorization is needed for the activities described in this letter. However, to the extent that the Commission determines that further authority is necessary to implement these activities, CPG respectfully requests that the Commission grant all necessary waivers to authorize these activities. 5 Cheyenne Plains Gas Pipeline Company - Critical Notices Page 1 of 1 Cheyenne Plains Gas Pipeline Company - Critical Notices Notice ID: 311 Notice to Shippers Thursday, September 27, 2007 Cheyenne Plains Force Majeure Update # 14 Seasonal Primary Entitlement Change In Cheyenne Plains' conference call with its customers on September 25, 2007, Cheyenne Plains reminded its customers that the total firm contract capacity on its system changes effective October 1 and November 1, Cheyenne Plains committed to posting the total firm contract capacity with path rights through the Cheyenne Plains West (CPW) constraint point that is currently in effect for the months of September, October and November 2007 for shippers' ease of use in understanding how their pro rata share of capacity through CPW will change during the extent of the force majeure event on the system. As you will recall from Critical Notice #291, shippers' allocated firm capacity at the CPW constraint point is a function of operationally available capacity at Cheyenne Plains East (CPE) minus primary firm scheduled through the Yuma Lateral Constraint (YLC). The primary firm rights that are allocated through the CPW constraint point are REX Crazy Bear (CZB), WIC Curley (CUR), WIC Thunder Chief (TDC), and CIG Red Cloud (RDC). Operationally available capacity for shippers with firm path rights through the CPW constraint point is allocated based on the following denominator, and that percentage is then multiplied times each Shipper's firm contract path rights through CPW: September - 836,297 Mcf/d October - 861,452 Mcf/d November - 871,529 Mcf/d Please refer to Non-Critical Notice #283 for details on the scheduling process. 8 Cheyenne Plains Gas Pipeline Company - Critical Notices Page 1 of 1 Cheyenne Plains Gas Pipeline Company - Critical Notices Notice ID: 318 Notice to Shippers Cheyenne Plains Force Majeure - Update # 17 Wednesday, October 10, 2007 Cheyenne Plains ("CP") has contracted for an interruptible transportation service from Colorado Interstate Gas Company ("CIG") that will allow CP to raise the pressure on the west end of its pipeline, increasing operationally available system capacity, effectively serving as a partial short term replacement for our disabled compression. The replacement fuel for this service will be recovered through the CP fuel mechanism as is consistent with our currently disabled compression. CP will pay CIG's interruptible transportation rate for the services. CP's service agreement with CIG will provide transportation service for shippers delivering to CP from those pipelines flowing into CP, i.e., CIG, Wyoming Interstate Company, Ltd. ("WIC") and the Rockies Express ("REX"). Service under this agreement is expected to commence mid-october subject to completion of necessary piping modifications on the CIG and CP systems. A notice will be posted to inform shippers of the date of the commencement of the service under agreement when it becomes known. There will be no additional nomination procedures required for shippers desiring to deliver gas to CP. Depending on the downstream pressures on the CP system, this transportation service should allow an increase in the Cheyenne Plains West (CPW) operationally available capacity to approximately 540 MMcf/d and the Cheyenne Plains East (CPE) operationally available capacity to approximately 590 MMcf/d. This effectively increases our post incident CP operationally available capacity from 465 MMcf/d to 590 MMcf/d.
