1 Eligible Occupancies Businessowners Program Eligibility Guidelines The following are eligible occupancy groups for the Businessowners program subject to the criteria listed below. Unless otherwise noted: Eligible risks with a total of 35,000 square feet in total floor area or less, or $6,000,000 in annual gross sales at each location Apartments (Including Residential Condominium Associates) Incidental occupancies are permitted: 1. Offices 2. Eligible Wholesaler 3. Mercantile 4. Processing and Service Occupancies 5. Contractors can occupy up to 7,500 square feet or up to 15% of building area (If these limitations are exceeded, classify as a contractor office) Business owners business personal property in eligible apartment buildings Five to twelve units per building Must meet Indiana Farmers Habitation Guidelines More than twelve (12) living units per building More than six (6) buildings per complex Converted dwellings Condominium Commercial Unit-Owners Business personal property of owners of condominium units that are used for eligible mercantile, wholesaler, processing, service, office, or contractor occupancies. Contractors Up to $300,000 of annual payroll Work at heights up to and including three (3) stories The total cost of subcontracted work up to 10% of the contractor s total annual gross sales Sales unrelated to installation, service, or repair up to 25% of annual gross sales 10/10/ 1 6 P r o p r i e t a r y I n f o r m a t i o n, n o t f o r d i s t r i b u t i o n P a g e 1 5
2 Renting or leasing equipment to others General Contractors, described as a contractor who is responsible for managing an entire project on behalf of the client, rather than just a portion of the project and hires and coordinates the efforts of subcontractors Contractors who use cranes in their operations Contractors who repair, install or service or previously repaired, installed or serviced boilers, burglar alarm systems, automatic fire extinguishing systems, elevators, escalators, or computers Contractors with products manufactured or sold under the insured s name Contractors who engage in or previously engaged in any of the following: 1. Demolition, blasting, wrecking, high pressure boiler work, liquid petroleum gas (LPG) work 2. Insulation work 3. Lawn chemical spraying operations, except with respect to the operations of a landscape gardener, provided that such landscape gardener operations meet all standards of any statute, ordinance, regulation or license requirement of any federal, state or local government that apply to such operations 4. Hazardous material or pollution abatement operations, including but not limited to: o Asbestos o Lead o Radon mitigation and testing Contractors that currently engage in any of the following: 1. Sales, service, or installation of any kind of automatic opening doors or garage doors (residential or commercial) 2. Heavy construction, including but not limited to: o Bridge, caisson, cofferdam, dam, dike, dry dock, jetty, levee or pier construction o Cable laying and cable installation o Crane or derrick installation or rigging o Dredging o Drilling o Excavation o Grading of land o Iron or steel erection o Pipeline construction o Sandblasting o Scaffolding, hoists, tower erection o Tunneling 3. Installing, repairing or servicing hot tubs 4. Ship repair or painting work 5. Sheet metal work 6. Installing and repairing swimming pools 7. Tree service or removal work 8. Waterproofing contracting operations 9. Installing wood and coal stoves 10. 3 Convenience Food Stores, Grocery Store and Supermarkets The following definitions are provided: A convenience food store is an establishment where the primary activity is the retail sale in limited amounts of canned goods, dairy products, prepackaged meats and other incidental grocery items. A grocery store or supermarket is a retailer that primarily sales food. If there are limited cooking or fast food restaurants on premise, the restaurants requirements below must be met. Minimum of 3,000 square feet in total floor area when there is the sale of gasoline Those with gasoline sales must also meet all of the following petroleum requirements: 1. Risks must have a separate pollution policy in force with a minimum of $1 million limit; 2. If the operation is more than 15 years old, we will require proof that the underground gasoline tanks have been replaced; 3. Documentation must be provided to show what release detection equipment has been installed and the frequency of the testing of this equipment; and 4. Documentation must be provided to demonstrate that there is a policy of regular inspection of tanks, piping, fittings and related equipment. Sale of beer, wine and/or liquor Twenty- four hour operations Automobile service or repair operations Car wash operations Propane or kerosene tank filling operations Mercantile Risks Building and business personal property for mercantile risks are eligible for coverage under the Businessowners Program as listed in the Businessowners Classification Table. Motels Motel buildings up to three stories in height No limitation applies to floor area Motels with eligible restaurant occupancies are permitted (refer to Restaurant guidelines) Sale of beer, wine and/or liquor 10/10/ 1 6 P r o p r i e t a r y I n f o r m a t i o n, n o t f o r d i s t r i b u t i o n P a g e 3 5
4 Seasonal operations (risks that are closed for more than 30 consecutive days) Bar or cocktail lounge Offices (Including Office and Commercial Condominium Associations) Buildings occupied principally for office purposes each of which does not exceed 6 stories in height or 100,000 square feet in total floor area are eligible for coverage. The following incidental occupancies are permitted: 1. Apartments; 2. Eligible wholesaler, mercantile, processing and service occupancies and contractors, which in total do not exceed 35,000 square feet; and 3. Contractors that do no occupy more than 7,500 square feet or more than 15% of the total area; otherwise classify as a contractor office Business personal property in offices that do not occupy more than 35,000 square feet in one building are eligible for coverage Processing and Service Risks Building and business personal property for processing and service risks listed in the Businessowners Classification Table Up to 25% of annual gross sales can be derived from off-premises operations Restaurants The following types of restaurants are eligible: Limited Cooking: Prepare cold food or use appliances that do not emit smoke or grease-laden vapors that require an exhaust system. Sale beer or wine only. Fast Food: May include limited cooking type appliances and perform cooking processes capable of producing grease-laden vapors. They do not offer table service and may sale beer and wine only. Casual Dining: Serve moderately priced food in a casual atmosphere. Patrons generally order and are served while seated and pay after eating. They may offer take-out service, use a buffet, and sale beer, wine or alcoholic beverages. Fine Dining: provide quality food and alcoholic beverages prepared by highly trained chefs and served with a great deal of attention to customers by wait staff. A maître provides supervision of wait staff and customer turnover and the food preparation and kitchen operations are supervised. These restaurants typically have valuable business personal property consisting of furniture, tableware, lighting, art and other items of décor. Up to 7,500 square feet in total floor area Seating capacity no greater than 150 Catering operations are limited to 15% of total sales Has a UL-300 Extinguishing System installed and properly maintained (excluding Limited Cooking) 10/10/ 1 6 P r o p r i e t a r y I n f o r m a t i o n, n o t f o r d i s t r i b u t i o n P a g e 4 5
5 Sale of beer, wine and/or liquor Twenty- four hour operations Offers delivery service Seasonal operations (risks that are closed for more than 30 consecutive days) bars or cocktail lounge Dancing Live entertainment (including karaoke) other than incidental music, such as piano playing, provided by the establishment Happy hours or similar promotions Bar operations for the sole purpose of consuming alcoholic beverages. (Bar service is only available for customers who are seated or waiting to be seated in the restaurant.) Self-Storage Facilities Self-storage facilities are not to exceed two stories in height. No limitation applies to floor area Wholesale Risks Outdoor storage of any type of motorized vehicles, including campers and recreational vehicles Cold storage or storage of industrial materials, chemicals, pollutants, or waste Building and business personal property for wholesale businesses listed in the Businessowners Classification Table Up to 25% of annual gross sales may be derived from retail operations, and Up to 25% of the total floor area may be open to the public Operations of manufacturers representatives or contractors 10/10/ 1 6 P r o p r i e t a r y I n f o r m a t i o n, n o t f o r d i s t r i b u t i o n P a g e 5 5
