Establishes the carbon pollution tax and investment act. Imposes a carbon pollution tax on: (1) The sale or use of fossil fuels, including fossil fuels used in generating electricity; or (2) The sale or consumption of electricity generated through the combustion of fossil fuels. Requires the state health care authority to provide health coverage to individuals who: (1) Are at least nineteen years old and no older than twenty-six; (2) Have an income that is at or below one hundred thirty-three percent of the federal poverty level; (3) Are not incarcerated; and (4) Are not eligible for categorically needy medical assistance as defined in the social security Title XIX state plan. HB 1619 Health care costs H HC/Wellness Farrell Addressing health care cost transparency. Requires the office of the insurance commissioner to: (1) Adopt rules to ensure that an enrollee may obtain an estimate of his or her out-of-pocket costs for a covered health care service before the service being provided; and (2) Convene a work group of interested parties and relevant state agencies to develop the content of the rules. HB 1640 (SB 5478) Advance directives H Rules R Graves Allowing notaries and proof of identity for advance directives. Requires a directive to withhold or withdraw from life-sustaining treatment in a terminal condition or permanent unconscious condition to be: (1) Signed by the declarer, who has provided proof of identity; and (2) Acknowledged before a notary public or other individual authorized by law to take acknowledgments. HB 1776 Digoxin & KCl/med procedures H HC/Wellness Van Werven Addressing the use of potassium chloride or digoxin in medical procedures. Requires a hospital or health care facility, in which an abortion is performed, to report to the department of health whether an intrafetal injection was used in an attempt to induce fetal demise, such as intrafetal potassium chloride or digoxin. Requires a mental health professional or an individual health care provider providing mental health services to a patient to warn or to take reasonable precautions to provide protection from a patient's violent behavior only if the patient has communicated to the mental health professional or individual health care provider an actual threat of physical violence against a reasonably identifiable victim or victims. Health provider changes H Judiciary Jinkins Concerning notice of material changes to the operations or governance structure of a health care provider or provider organization. HB 1811 Requires each party to a transaction that results in a material change to the operations or governance structure of a provider or provider organization to submit written notice to the attorney general of the material change. Requires a provider or provider organization that conducts business in this state, and files a premerger notification with the federal trade commission or the United States department of justice, to provide written notification to the attorney general of the filing and, upon request of the attorney general, provide a copy of the merger, acquisition, or other information. HB 1870 (SB 5654) Out-of-network health care H HC/Wellness Harris Protecting consumers from charges for out-of-network health care services. Modifies health care service provisions regarding the protection of consumers from charges for out-ofnetwork services. Noncompetition agreements H Rules R Stanford Concerning noncompetition agreements. HB 1967 Requires an employer, in order for a noncompetition agreement to be enforceable, to: (1) Disclose the terms of the agreement in writing to the prospective employee no later than the time of the offer of employment; or (2) If the agreement is entered into after the commencement of employment, provide independent consideration for the agreement. Sugar beverages tax H Finance Jinkins Concerning a tax on sugar-sweetened beverages. HB 1975 Imposes a tax on: (1) The first sale of prepackaged sugar-sweetened beverages made by a distributor in this state; (2) Syrup or powder sold or offered for sale to a retailer for sale to a consumer; (3) The first sale of prepackaged diet beverages made by a distributor in this state; and (4) Diet syrup or diet powder sold or offered for sale to a retailer for sale to a consumer. Requires the joint legislative audit and review committee to evaluate the impact of the sugar-sweetened beverage tax on the consumption of the beverages by residents. Requires the department of health and the department of revenue to provide the committee with access to data necessary to conduct the evaluation. Repeals chapter RCW (syrup tax). SB 5112 (HB 1549) Invests in education and other vital public services by: (1) Narrowing the use tax exemption for extracted fuel; (2) Modifying the nonresident sales and use tax exemption; (3) Eliminating the sales and use tax exemption for bottled water; and (4) Addressing the real estate excise tax on foreclosures; the limit tradein exclusion; the business license fee; the interest rate on assessments and refunds; trust fund accountability; the economic nexus for retailing business and occupation tax; and the public works assistance account. SB 5355 Requires the director of the department of labor and industries to: (1) Develop access to telemedicine and reimburse providers for services in a manner that is similar to the policies developed for commercial health insurance plans and medicaid managed care plans; and (2) Reimburse a provider for a health care service provided to a covered person through telemedicine or store and forward technology for a health care service that is medically necessary. SB 5400 (SHB 1477) Health info. disclosure S HumSer/MenHlth Zeiger Concerning disclosure of health-related information with persons with a close relationship with a patient. Authorizes certain health care providers and facilities to disclose, under certain circumstances, healthrelated information to persons with a close relationship with a patient. SB 5401 (SHB 1541) Rx drug cost transparency S Health Care Rivers Addressing prescription drug cost transparency. Requires the office of financial management to use a competitive procurement process to select a data organization to collect, verify, and summarize the prescription drug pricing data provided by issuers and manufacturers. Requires an issuer to submit certain prescription drug cost and utilization data to the data organization for the previous calendar year. Requires a covered manufacturer to report certain data for each covered drug to the data organization. Requires the data organization to compile the data submitted Page 6 of 10

7 by issuers and manufacturers and: (1) Prepare an annual report for the public and the legislature summarizing the data; and (2) Provide the report to the office of financial management and the joint select committee on health care oversight. SB 5413 (HB 1356) Physician limited licenses S Rules 2 Cleveland Concerning physician limited licenses. Addresses the medical quality assurance commission's issuance of limited licenses for physicians. SB 5416 Property tx exemp/intangible S Ways & Means Chase Repealing the tax exemption on intangible property to provide funding for essential government services. Provides funding for essential government services by repealing the tax exemption on intangible property. SB 5433 Death with dignity decisions S Rules 2 Miloscia Concerning informed decision making for death with dignity decisions. Revises the state death with dignity act to require an attending physician to inform the patient of feasible alternatives, including the treatment for the purpose of cure and the treatment for the purpose of extending the patient's life, to ensure that the patient is making an informed decision. SSB 5435 (SHB 1413) Mental health record discl. S Rules 2 Rivers Specifying to whom information and records related to mental health services may be disclosed for the purposes of care coordination and treatment. SB 5436 Telemedicine locations S Rules 2 Becker Expanding patient access to health services through telemedicine by further defining where a patient may receive the service. Provides that an originating site for a telemedicine health care service includes any location determined by the individual receiving the service. SB 5457 Telemedicine payment parity S Rules 2 Becker Expanding patient access to health services through telemedicine and store and forward technology by requiring parity in payment for services. Requires parity in payment for services to expand patient access to health services through telemedicine and store and forward technology. SB 5574 Health care declarations S Ways & Means Keiser Concerning the maintenance and disclosure of health care declarations. Requires the department of health to contract with an entity, which may be a private organization or another state that operates a similar registry, to coordinate and manage the statewide health care declarations registry in compliance with certain standards. Balance billing S Health Care Rivers Concerning balance billing. SB 5579 Establishes the cost transparency and balance billing protection act. Requires a governing body of a hospital to require that providers who are granted professional privileges must be an employee, part of its medical staff, or have a contract with the hospital to perform services in the hospital. Requires a hospital to provide notice on its web site that lists the names and hyperlinks for direct access to the web sites for each health carrier for which the facility contracts. Requires the department of health to make or cause to be made a survey of a postsurgical care center where an ambulatory surgical facility provides postsurgical care services in coordination with a survey conducted of the ambulatory surgical facility. SB 5619 (HB 1117) Health care balance billing S Health Care Rivers Addressing health care services balance billing. Exempts commercial health benefit plans, offered in the individual and small group markets, from all state-mandated benefits beyond those required by the federal government.
