6 WAIVER RELEASE AND INDEMNITY AGREEMENT In consideration of using Crestview Country Club (hereinafter CCC ) and Elmcrest Country Club through CrestLinks TM (hereinafter ECC ), and as a condition of my membership, I, (hereinafter Member ) hereby agree as follows: (PRINT NAME) PERSONAL PROPERTY CCC and/or ECC is not responsible for the loss or theft of, or damage to, personal property on CCC s and/or ECC s premises, whether held in storage or not. This includes, but is not limited to, golf clubs, golf bags, push carts, golf accessories, money, clothing, automobiles, or other property. Member will take all precautions to avoid loss or theft of, or damage to, personal property. In the event of such loss, or damage, Member and their heirs shall hold CCC and/or ECC harmless from and against any and all claims, actions, costs, expenses, and demands in respect to such theft, loss or damage, however caused, arising out of or in connection with the use of CCC and/or ECC. As a condition of bringing a guest or family member onto the premises of CCC and/or ECC, Member agrees to assume all risk of loss or damage to personal property belonging to that person. The Member agrees to indemnify CCC and/or ECC for any liability, costs, or expenses imposed by law upon CCC and/or ECC for any and all such losses. GOLF CARTS Member agrees to assume all risk of loss or damage to golf carts rented or borrowed from CCC and/or ECC, as well as the risk of injury to Member or other persons and damage to other property arising from the use of the golf cart. Member agrees to take all precautions to avoid loss or damage to the golf carts, damage to other property, and injury to persons, including to the Member and their guests, arising from the use of golf carts. In the event of any loss, damage, or injury, the Member and their heirs shall hold CCC and/or ECC harmless from and against any and all claims, costs, expenses, and demands in respect of such loss, damage or injury, howsoever caused. Member agrees to indemnify and reimburse CCC and/or ECC for any liability, costs, or expenses imposed by law for any and all such losses. GENERAL WAIVER Member is aware of, and accepts, the risks inherent with participating in, or attending, any events or activities at CCC and/or ECC (such as golfing, walking, swimming, diving, exercising, etc.), including but not limited to, trips and falls, being hit by golf balls, drowning, incidents involving owned or rented equipment, negligence of the Member and of other persons, etc. Member agrees to release CCC and/or ECC from any liability from personal injury, property damage, or loss sustained by the Member, their guests, their family members, and their heirs, including but not limited to, injury resulting in death or any financial loss or damage, directly or indirectly resulting from the Member s activities or participation in any events or activities at CCC and/or ECC. Member further waives, as against CCC and/or ECC, all claims, recourses, and rights of action that the Member, their guests, their family members, or their heirs may have against CCC and/or ECC as a result of such personal injury, property damage, or loss. Member accepts the risk from lightning strikes. Member agrees that if the Lightning Detection System activates at CCC, the course MUST be evacuated. Member also agrees to evacuate the golf course if advised by the staff of CCC or ECC. Member agrees that this WAIVER RELEASE AND INDEMNITY AGREEMENT shall not be affected by any negligence, gross negligence, breach of contract, or any other conduct on the part of CCC and/or ECC. Member acknowledges that he or she has read this Waiver Release and Indemnity Agreement and understands and accepts the contents. In the event that any provision is deemed to be unenforceable and/or invalid, such provision shall be severable from the whole of the document and shall not affect the validity and enforceability of the other provisions or the agreement as a whole. Member further consents to provide CCC and ECC with electronic photos of each member listed on their application and to allow CCC and ECC to publish their name and picture on the website, bulletin board, newsletters, or other media. 7 MEMBER CREDIT ACCOUNT APPLICATION AND AGREEMENT I,, and all other Authorized Users listed below (collectively Member ), hereby applies for credit (hereinafter Credit Account ) from Crestview Country Club (hereinafter CCC ) under the following terms and conditions: 1. Promise to Pay: Member promises to pay CCC for any and all charges applied to the Credit Account. Member, including other Authorized Users of the Credit Account, is required to sign for ALL charges. The failure to sign for charges does not relieve the Member s obligation to pay CCC for such charges. Any disputed charges shall be in writing and directed to Crestview Country Club, PO Box 305, Agawam, MA 01001, within 60 days of billing. 2. Billing & Payment Terms: Member will be billed for all charges applied to the Credit Account during a calendar month (hereinafter Billing Period ). The full outstanding balance is due and payable in the form of cash or check on the 20 th day of each month following the end of said Billing Period (hereinafter Due Date ). If payment in full is not received by the Due Date, the Member agrees to pay a nonrefundable 3% Closeout Fee of the outstanding balance and also authorizes CCC to automatically charge the following credit card for the outstanding balance: [ ] Visa [ ] MasterCard [ ] Discover [ ] AMEX Credit Card Number Expiration Date Security Code (CVV) (3 or 4 Digit Code) Provide the Billing Zip Code used on Credit Card : The Member shall maintain a valid, approved credit card on file with CCC at all times and must inform CCC in writing of any changes to such card. The failure to maintain a valid, approved credit card on file with CCC will result in the denial, suspension, or cancellation of Member s Credit Account. Payments in the form of cash and check that are received after an automatic credit card payment has been processed will be applied to the Credit Account to offset current and future charges, unless Member requests a refund of an existing credit balance in writing from CCC. 3. Past Due Amounts & Finance Charges: If payment in full is not received by the Due Date and the Member s credit card on file is declined or otherwise not accepted, the Member agrees to pay a 1.5% per month finance charge on any past due balances and outstanding invoices, which is in addition to the Closeout Fees described in Section 2. Member understands that the failure to make any payment by the Due Date may result in the suspension of the Credit Account and the cancellation of their membership privileges without refund. Member agrees to reimburse CCC for all costs, including administrative and legal fees, associated with the collection of past due balances. 4. Service Charge & Returned Check Fee: Member agrees to pay a $5.00 monthly service charge to administer the Credit Account. The monthly service charge will be waived if there are no charges or outstanding balances on the Credit Account during the Billing Period. A $35.00 fee will be assessed to the Credit Account for returned checks. 5. Authorized Users: Member authorizes the following persons to apply charges to the Credit Account and assumes full responsibility for all charges applied to the Credit Account by these Authorized Users: The undersigned hereby understands and agrees to the terms and conditions of the Credit Account contained herein.
