3 r I AGREEMENT BETWEEN: THE CORPORATION OF THE TOWN OF GANANOQUE, Hereinafter called "the Employer" of the First Part, -and- THE MEMBERS OF THE GANANOQUE PROFESSIONAL FIRE FIGHTERS ASSOCIATION AFFILIATED TO THE ONTARIO PROFESSIONAL FIRE FIGHTERS ASSOCIATION, Hereinafter called "the Employees" of the Second Part. ARTICLE 1 - GENERAL PURPOSE 1.1 The purpose of this Agreement is to establish mutually satisfactory relations between the employer and Employees concerned and to provide machinery for the prompt and equitable disposition of grievances, and to establish and maintain satisfactory working conditions, hours of work and wages for all Employees who are subject to the provisions of this Agreement so that there will not be any interference with the operation of the services rendered by the Gananoque Fire Department to the Public. ARTICLE 2- SCOPE OF AGREEMENT 2.1 The provisions of this Agreement shall apply to the full time Fire Fighters of the Gananoque Fire Department as defined by the Fire Protection and Prevention Act (Bill 84). 2.2 RESIDENCE CLAUSE- No restrictions shall be placed on any member of the Gananoque Professional Fire Fighters Association with regard to where they may choose to reside. ARTICLE 3- RECOGNITION 3.1 The Corporation recognizes the employees' committee, duly elected as the exclusive bargaining agent for all full time Fire Fighters of the Gananoque Fire Department, with the exception ofthe Fire Chief, Deputy Chief and Secretary (if applicable). 3

4 ARTICLE 4- HOURS OF WORK 4.1 The work week of a full time Fire Fighter shall be forty ( 40) hours, based on the Three Platoon System. 4.2 Nothing herein contained shall prevent the Chief or in the Chiefs absence the Officer in charge, from granting the request of any two Fire Fighters to change shifts or days off OVERTIME- if a Fire Fighter works in excess of their normal forty (40) hour week, the Fire Fighter shall choose to be paid at an hourly rate oftime and one half(11/2) oftheir normal pay or accumulate the hours. Such choice shall be made at the week of working the overtime and shall be final. The scheduling of time off shall be agreed upon by the Chief and the Association. Such overtime must be authorized by the Fire Chief or the Fire Chief's alternate and as defmed by The Fire Protection and Prevention Act (Bill 84). Time in lieu may be accumulated to a maximum of one hundred and twenty (120) hours. At no time shall a firefighters overtime banked hours exceed one hundred and twenty (120) hours. Any accumulated hours over one hundred and twenty (120) will be paid out automatically to the firefighter A Fire Fighter may be called back to work by the Fire Chief or the Fire Chief's alternate and the Fire Fighter shall be paid at the rate of time and one half(ll/2) of their normal pay for the hours worked or a minimum of three (3) hours pay Where a Fire Fighter attends at a fire voluntarily, outside of the policy provisions identified by the Chief for platoon calls, the Fire Fighter shall only be paid overtime on the basis noted in Article if the Fire Chief or the Fire Chiefs alternate determines there is a need for the Fire Fighter to remain at the fire scene Where a Fire Fighter is scheduled to work a shift on a Sunday the Fire Fighter shall be paid at the rate of time and one half (1 1/2) of their normal pay for the hours worked Where an employee, who would otherwise be on normal duty with the Town, is absent by reason of a summons to service as a juror, or of a subpoena as a witness he may at his option: Take leave-of-absence without pay and retain both the fee and the expense allowance paid by the Court; or Charge the absence against vacation credits and retain both the fees and expense allowance paid by the Court; or Treat the absence as leave with pay (but with no charge against their credits), but surrender the fee to the Town Treasurer when received. 4.5.MEAL ALLOWANCE- Any expenses a fire fighter incurs when on a course, Department business, or away from the workplace, which is sanctioned by the Fire Chief or the CAO, shall receive expenses as per the Town Policy covering such expenses. 4

5 4.6 The Town agrees that a shift change shall only occur after every possible option for coverage has been made, except for extenuating circumstances, so as not to interrupt the normal shift pattern of the employees where practical. The Town further agrees that notice of any change to a Fire Fighter's shift for any reason must be given to the Fire Fighter, both verbally and in writing, by noon on the seventh day prior to the proposed shift or shifts to be changed. Should proper notice not be given to the Fire Fighter, except that relating to extenuating circumstances, the Fire Fighter shall be paid at a rate of time and one half (11/2) of the Fire Fighter's normal pay for the first shift worked of the shift change. ARTICLE 5- VACATIONS 5.1 All employees who have one year or less of continuous service as of their anniversary date shall be entitled to a vacation with pay in the amount of one (1) day for every month worked up to a maximum often (10) days. 5.2 During the calendar year in which a Fire Fighter completes one (1) year's service and in each subsequent year in which a Fire Fighter is employed, he shall be entitled to two (2) weeks vacation. 5.3 During the calendar year in which a Fire Fighter completes five (5) continuous years service and in each subsequent year in which a Fire Fighter is employed, they shall be entitled to three (3) weeks vacation. 5.4 During the calendar year in which a Fire Fighter completes ten (1 0) continuous years service and in each subsequent year in which a Fire Fighter is employed, they shall be entitled to four ( 4) weeks vacation During the calendar year in which a Fire Fighter completes fifteen (15) continuous years service and in each subsequent year in which a Fire Fighter is employed, they shall be entitled to five ( 5) weeks vacation During the calendar year in which a Fire Fighter completes twenty-five (25) years continuous service and in each subsequent year thereafter the Fire Fighter shall be entitled to one (1) additional day per year of vacation to a maximum of five (5) days totaling six (6) weeks Vacations shall be arranged on a system agreed upon by the Fire Chief and the Association. 5.7 Holidays to be taken between January 1st and December 31st each year except as provided in Article Holidays to be posted according to seniority by March 31st each year and may be changed after March 31st each year by mutual agreement or the Fire Chief and the employee, subject to operational requirements as determined by the Chief. 5

6 5.9 Subject to the approval of the Fire Chief, two weeks of vacation may be carried over by each employee within the Department provided the normal operation of the Department will not be effected. The Fire Chief's approval shall not be unreasonably with held. In the case of more than one qualified request, the decision shall be made based on seniority Sick leave may be substituted for vacation leave where it can be established by the Employee that the illness or injury occurred while on vacation leave and impacted on their vacation leave. If requested by the Chief, the employee will provide verification of the illness or injury. The re-booking of any affected vacation leave will not impact on other Employees' annual vacation entitlement. ARTICLE 6- STATUTORY HOLIDAYS During each year in lieu of declared or Statutory Holidays, a Fire Fighter shall be entitled to one (1) working day off for each Statutory Holiday listed below: New Year's Day Victoria Day Labour Day Christmas Day Good Friday Dominion Day Thanksgiving Day Boxing Day Easter Monday Civic Holiday Float Day 1 FloatDay2 In addition to those set out above, any day proclaimed by the Governor General in Council or the Lieutenant Governor in Council for the Province of Ontario, shall be a Statutory or Declared Holiday. 6.2 A Fire Fighter who works a full shift on any Statutory or Declared Federal or Provincial Holiday shall be entitled to four ( 4) hours premium pay. ARTICLE 7 -GROUP INSURANCE 7.1 The Corporation agrees to pay 1 00% of the group Life & Accidental Death & Dismemberment insurance The basic Life Insurance coverage shall be 2x (two times) the annual salary ofthe fire fighter The AD&D coverage shall be an additional2x (two times) the annual salary ofthe fire fighter in accordance with the Manulife Financial Plan - Group Policy No. G Any changes to the Benefits as outlined in Manulife Benefit manual, Group Policy No , Class B, Firefighters will be agreed upon by both parties. ARTICLE 8-PENSION 8.1 The Corporation agrees to pay 50% ofo.m.e.r.s. 6

7 \,, ARTICLE 9- HEALTH PLAN The Parties agree to effect changes to the current health plan coverage for fire fighters that reflects those benefits that apply to non-union employees of the Town which will include but not limited to full "out of Country" coverage and vision coverage as described below. 9.1 The Corporation will contribute one hundred percent (1.00%) of the monthly premium cost of Ontario Health Tax, 'Manulife Financial' (or equivalent) Semi-private coverage for each Fire Fighter who is a subscriber, their spouse and all eligible dependants. 9.2 The Corporation will also contribute one hundred percent (1 00%) of the premium for 'Manulife Financial' (or equivalent) Extended Health Care Plan 9.3 The Employer agrees to pay one hundred percent (100%) ofthe 'Manulife' or equivalent Dental Plan No.9 with Riders 1, 2 and 3, using the current O.D.A. schedule of fees for each Fire Fighter, their spouse and all eligible dependants. 9.4 Upon providing a receipt, any employee and/or their eligible dependant shall receive three hundred and fifty (350) dollars towards the purchase of prescription eye glasses to a maximum of once every two (2) years. The cost of eye examinations, if a receipt is submitted, shall form part of the total coverage of three hundred and fifty (350) dollar coverage. 9.5 Should a fire fighter's death be in the line of duty, the Corporation agrees to pay 100% (one hundred per cent) of the cost for all of the above benefits for the surviving spouse and all eligible dependants. This coverage shall expire 24 (twenty four) months from the date of the fire fighters death. 9.6 Any Fire Fighter in the event of a temporary lay-off shall be deemed to be considered while laid off, an Employee of the Corporation for one (1) year and shall be covered by all the benefits of Articles 7, 8 and 9 of this Agreement for a period of three (3) months from the time of lay-off. Re-call of Fire Fighters from lay-off shall be in inverse order of lay-off, starting with the Fire Fighter with the most seniority. ARTICLE 10 - SICK LEAVE 10.1 Each Fire Fighter shall receive a credit of one and one half (1 1/2) days sick leave for each month of unbroken service When a full time Fire Fighter is absent owing to incapacity and an award has been made by the Workplace Safety Insurance Board, the Fire Fighter shall receive the difference between the Fire Fighter's salary or the rate of pay payable under such an award Full time Fire Fighters shall receive sick pay at full salary for time lost owing to illness or injury to the full extent of their sick pay credits, except when an award is made under the Workplace Safety Insurance Board. 7

8 10.4 The Fire Chief shall have the right at any time to require that a Fire Fighter who is absent from work on accolmt of sickness be examined and be reported upon by a physician to be designated by the Fire Chief This report shall reflect the sickness to which the fire fighter is claiming leave for. The Town shall pay for all costs associated with the examination Each Fire Fighter shall be entitled to receive on retirement or permanent disability, and subject to the completion of five ( 5) years service, upon termination of employmen~, full pay for one half (112) the number of days standing to their credit as accumulated sick leave, provided that no Fire Fighter shall receive pay for more than one half (1/2) year's earnings In the event of death, the beneficiary shall be paid one half (1/2) the number of days of accumulated sick leave, not to exceed one half (1/2) year's earnings In the event of a permanent Lay Off, a Mandatory Retirement, or thirty (30) years continuous service to the town, the Fire Fighter shall have their accumulated sick credits paid out to them to a maximum of one (1) years salary BEREAVEMENT LEAVE WITH PAY -For the purpose of this clause, immediate family is defined as father, mother (or alternately stepfather, stepmother or foster parents), brother, sister, spouse, child, stepchild, or ward of the employee, employee's household or with whom the employee permanently resides When a member of an employee's immediate family dies, the employee shall be entitled to bereavement leave with pay for a period of up to three (3) days for the purposes relating to the bereavement but not extending beyond the date following the day of the funeral and may, in addition, be granted up to three (3) days leave with pay for the purposes of travel related to the death In special circumstances and at the request ofthe Employee, bereavement leave with pay may be extended beyond the date following the day of the funeral but the total number of days granted which shall be consecutive, shall not exceed the number provided in Article above, and must include the day of the funeral An Employee is entitled to one (1) day's bereavement leave with pay for the purpose related to death of their grandparents, grandchildren, son-in-law, daughter-in-law, brother-in-law, sister-in-law, father-in-law and/or mother-in-law. ARTICLE 11 -RECLASSIFICATION 11.1 Based on their qualifications, an individual hired as a full time Fire Fighter shall be hired as either a First Class, Second Class, Third Class or Fourth Class Fire Fighter During the first three (3) months from their appointment a Fire Fighter shall deemed to be on probation, and not a permanent employee. At the Chiefs discretion the Probationary period may be extended another three months for further evaluation. 8

9 11.3 Prior to each change in classification, the Fire Chief shall assure himself that the Fire Fighter qualifies for the reclassification and the Council shall re-classify the Fire Fighter if it is satisfied that the Fire Fighter meets the requirements for the classification Subject to 11.3 above, a Fire Fighter shall be reclassified to Third Class Fire Fighter one (1) year from becoming a Fourth Class Fire Fighter Subject to 11.3 above, a Fire Fighter shall be reclassified to Second Class Fire Fighter one (1) year from becoming a Third Class Fire Fighter Subject to 11.3 above, a Fire Fighter shall be reclassified to First Class Fire Fighter one (1) year from becoming a Second Class Fire Fighter. ARTICLE12-SALAEaES 12.1 Effective January 1, 2004 the rank structure for the Gananoque Fire Service shall be as follows: Classification % of 1st Class Salary Prevention/Training Officer and Captain 1st Class Firefighter 2nd Class Firefighter 3rd Class Firefighter 4th Class Firefighter 102% 100% 90% 80% 70% 12.2 The salary for a first class fire fighter December 31, 2006 was$ 59,127. The salary for a first class fire fighter in contract year 2007 shall be as follows with all other ranks adjusted accordingly: EFFECTIVE PERCENTAGE SALARY 1sT CLASS DATE INCREASE FIRE FIGHTER January 1 /07 2% $60, July 1 /07 2% $61, December 31 /07 1% $ 62, >- There shall be a contract signing bonus of$ (six hundred dollars) paid to each full time fire fighter at the earliest possible date after ratification of this Minutes of Settlement. This bonus shall not form part of the regular salary no is it a part of any back pay monies owed to individual fire fighters as the case may be. 9

10 ARTICLE 13 -UNIFORMS AND EQUIPMENT 13.1 The receipt of any or all of the uniforms shall be at the discretion of the Fire Chief and relates to those items which require replacement. Uniforms shall consist of: Annual Work Clothes two (2) pairs of pants four ( 4) shirts one (1) pair shoes or boots one (1) belt one (1) pair winter gloves three (3) pair of socks one (1) pair coveralls one (1) baseball type cap one (1) work type jacket with zip out liner one (1) pair only per year toe rubbers or overshoes badges & hat badges Uniforms at Chiefs Discretion one (1) uniform tunic one ( 1) pair uniform pants one (1) uniform cap one (1) tie one ( 1) top coat one (1) parka 13.2 Requests for all of or any portion of uniform or duty clothes to be made prior to February 28ili each year and the approval or denial made by the Fire Chief prior to March 31st each year The Fire Fighter shall have their work type uniform (presently referred to as bunker gear) and protective boots replaced due to general wear and tear or work related damage that may jeopardize the Fire Fighter's safety or well being as soon as possible after the damage has been identified It is understood that all uniforms shall comply with the requirements ofcan/cgsb MSB, as noted in Ontario Regulation 125/83 as amended. The Employer will provide annual clothing items by June 30th, where practical. ARTICLE 14- SERVICE PAY 14.1 All Fire Fighters with more than five (5) years service and less than ten (10) years continuous service as of December shall be paid Sixty Dollars ($60.00) All Fire Fighters with more than ten (1 0) years service and less than fifteen (15) years continuous service shall receive One Hundred and Twenty Dollars ($120.00) All Fire Fighters with more than fifteen (15) years service and less than twenty (20) years continuous service shall receive One Hundred and Eighty Dollars ($180.00) All Fire Fighters with more than twenty (20) years continuous service shall receive Two Hundred and Forty Dollars ($240.00). 10

11 14.5 Fire Marshal's College- Each Fire Fighter attending courses at the Fire College and any other courses sponsored by the Fire Marshal's College and/or any recommended by the Fire Chief, will receive Fifty Dollars ($50.00) subsistence allowance for each five (5) day week. ARTICLE 15- CLEANING ALLOWANCE Each Fire Fighter shall receive two hundred dollars ($200.00) based on a credit system as agreed to by the Parties and arranged by the Town per annum for uniform cleaning.. ARTICLE 16- GRIEVANCE 16.1 Should any difference arise between the Employer and the Employee/ Association as to an alleged unjust discharge, discipline, suspension, discriminatory promotion, demotion, transfer or anything arising out of the duties, privileges or working conditions or remuneration believed contrary to this agreement, the employee shall present such grievance and/or complaint to the Fire Chief for consideration The Fire Chief shall hear, or receive the grievance and/or complaint within five (5) working days of being requested The Fire Chief shall provide a written response of his decision within two (2) working days of hearing the grievance and/or complaint The Employee may, if dissatisfied with the ruling of the Fire Chief, or if the Fire Chief fails or refuses to deal with the grievance and/or complaint within the specified time, the Employee may file with the CAO, the grievance and/or complaint within ten (1 0) working days of the date the grievance and/or complaint was submitted to the Fire Chief The CAO shall hear, or receive the grievance and/or complaint within five (5) working days of being requested The CAO shall provide a written response of his decision within two (2) working days of hearing the grievance and/or complaint The Employee may, if dissatisfied with the ruling of the CAO, or if the CAO fails or refuses to deal with the grievance and/or complaint within the specified time, the Employee may file with the Council, the grievance and/or complaint within ten ( 1 0) working days of that the grievance and/or complaint was submitted to the CAO The Council shall hear the grievance and/or complaint within ten (1 0) working days of submission of the grievance and/or complaint to Council, and communicate (in writing) their decision in the matter within five (5) working days of hearing the grievance and/or complaint. 11

12 16.9 Failing satisfactory settlement of said grievance the Employee or the Association may proceed to Arbitration under the provisions of the Fire Protection and Prevention Act, 1997 ofthe Province of Ontario. Time limits in this Article may be extended by mutual agreement of both parties. The Parties agree that a single Arbitrator under the power of the Fire Protection and Prevention Act,l997has the authority to alter any discipline measure(s) as they may see fit. ARTICLE 17-INTERPRETATION OF TIDS AGREEMENT 17.1 It is the intent of this Agreement that the Fire Fighters shall continue to receive any benefits of the present Fire Department By-law, for Employees generally, except where this Agreement shall apply. At least one (1) month prior to the passing of any amendments to the present Fire Department By-law which affects the members of the Fire Department, the Corporation will provide the Secretary of the Gananoque Professional Fire Fighters Association to make representations, if it so wishes, concerning the proposed amendments. ARTICLE 18- INDEMNIFICATION 18.1 The employer agrees to indemnify the full time firefighters and save them harmless from all lawsuits for damages, costs, charges, expenses or proceedings where they suffer any allegations as a result of anything they did or failed to do in the performance of their duties, excluding always, the negligence by the said full time firefighter. ARTICLE 19 - VACANCIES 19.1 The Town will notify the Employees of the action it proposes to take relative to replacement within forty-five ( 45) days of the vacancy of an existing full time permanent Employee position within the Fire Department. ARTICLE 20- TECHNOLOGICAL CHANGE 20.1 At least sixty ( 60) days prior to the introduction of major technological change affecting Employees, the Town will notify the Employees in writing of the proposed changes The Town shall also endeavour to, wherever possible and reasonable, include a representative of the Gananoque Professional Fire Fighters Association on any committees or study groups operating in any matters affecting the Fire Department or its operations. 12

13 ARTICLE21-LAY-OFF 21.1 Any Fire Fighter in the event of a temporary lay-off shall be deemed to be considered while laid off, an Employee of the Corporation for one (1) year and shall be covered by all the benefits of Articles 7, 8 and 9 of this Agreement for a period of three (3) months from the time of lay-off Re-call of Fire Fighters from lay-off shall be in inverse order of lay-off, starting with the Fire Fighter with the most seniority. ARTICLE 22- SENIORITY 22.1 For seniority purposes, an Employee's length of service shall be calculated from the date the Employee started work for the Fire Department as a full time Fire Fighter inclusive of the probationary period. A seniority list, which lists the Employees names in order of seniority, shall be posted once per year during the first month of each year with a copy provided to the Association. ARTICLE 23 - UNION SHOP 23.1 All present Employees are members of the Association and shall pay dues to the Association. All future Fire Fighters, except those exempted for religious reasons or under the provisions of legislation, shall become members within thirty (30) days of becoming Fire Fighters. All Fire Fighters, except those exempted, shall retain their membership so long as the Association is recognized as the collective bargaining agent for the Employees The Association will keep the Corporation advised of the names of the Officers, Executives and Negotiating Committee upon their election or any change therein. The Corporation will keep the Association advised of the names of the Negotiating Committee upon their appointment or any change therein The Employer will deduct any Employee's monthly Association dues on the authorization in writing from the Employee and will remit such money to the authorized officials of the Association. The Association will advise as to the exact cash amount of each deduction. ARTICLE 24- DURATION 24.1 This Agreement shall come into force on the 1st day of January, 2007 and shall remain in force until the 31st day of December, 2007 and from year to year thereafter unless within a period not greater than sixty (60) days and not less than thirty (30) days prior to the expiry date, either party give written notice for the termination of this Agreement. 13

14 24.2 In the event of either party desiring or proposing any change or alteration in this Agreement but not desiring to terminate the Agreement, such party may give the other party not less than thirty (30) days written notice before the renewal date and both parties shall within fifteen (15) days negotiate in good faith in respect to the matter which it is proposed to change or alter and the remaining provisions shall automatically renew themselves as aforesaid. ARTICLE 25- RETIREMENT 25.2 Upon completion of twenty-five (25) consecutive years with the Gananoque Fire Department, the Corporation agrees that upon the Fire Fighter's retirement, the Town will provide regular dental, semi-private, drugs, and optical from age fifty eight (58) to age sixty-five (65). ARTICLE 26- CONTRACTING OUT 26.1 No part~time (volunteer) Fire Fighter with the Gananoque Fire Department also employed by another Fire Department shall be permitted to perform any duties other than those related to emergency call out situation (Fire Call) with the Gananoque Fire Department Except to the extent and to the degree agreed upon by the parties, and except to the extent of the current practice as it relates to volunteer fire fighters, and except in the case of an emergency, no work customarily performed by an Employee covered by this agreement shall be performed by another Employee or by a person who is not an Employee of the Corporation. ARTICLE 27 UNION BUSINESS 27.1 The Corporation agrees to allow a total of 3 days paid leave, to be taken as a block or individual days, to the Gananoque Professional Fire Fighter's Association to attend union business or meetings. ARTICLE 28-JOB SECURITY 28.1 The Corporation agrees that there will be no downsizing of the department, as it relates to existing employees only, for the duration of this contract.
