2 ADVERTISEMENT INVITATION FOR BIDS SHA Job No. P-MOV The Somerville Housing Authority invites sealed bids from contractors to relocate tenant apartments contents in Somerville, Massachusetts in accordance with the documents prepared by the Somerville Housing Authority Purchasing Department Job No. P-MOV Description of Work: Relocate tenant apartments contents Term of contract is 2 years Bids are subject to provisions of M.G.L. c.30b, and to the minimum wage rates required by M.G.L.c H inclusive. Sealed Bids will be received until 11:00 A.M., February 28, 2019 and opened forthwith. Bids should be brought or mailed to Somerville Housing Authority, Bryant Relocation Bid, Attn. Anthony Crespo, 30 Memorial Road, Somerville, MA no later than the time specified. Bid Forms and Specification Documents will be available for pick-up at the Somerville Housing Authority, Administration Offices, 30 Memorial Road, Somerville, MA after 11:00 A.M., on February 13,2019 or you may download them from our web site under our opportunities tab. There will be no charge for these documents. If downloaded, you must register with Anthony Crespo at Tonyc@sha-web.org and leave a contact to receive changes, or updates. You will receive confirmation of reception via reply to your . A site visit is scheduled for February 20, 2019 at 9:00 a.m. You are not required to attend. All interested parties will meet at Somerville Housing Authority, Modernization Building, 30-R Memorial Road, Somerville, MA Prior notification that you will be attending is required. INVITATION FOR BID 1 of 1

3 The SHA invites you to quote on the relocation of approximately 80 elderly occupied one-bedroom apartments at our Bryant Manor Development located at 75 Myrtle Street in Somerville, MA. The moves will be internal moves. Contents will be relocated to another apartment within the same building. The contract will be awarded to the lowest and eligible bidder that can meet all requirements on this specification. SCOPE OF WORK Prior to execution of a move, the mover shall provide a certificate of insurance naming Somerville Housing Authority as the certificate holder. Coordinate with SHA on moving schedule on a week-to-week bases. The SHA will set a schedule as per their needs. The SHA will schedule move at minimum 3 days in advance. Contractor will make sure to have ample workers on site as per scheduled. Price for moving one, two, and three apartments per day. Relocate all contents of current apartment to another apartment in the same building. Disassembly and re-assembly of bed and bureau and mirror required. Items will be relocated to the same room in the new apartment or as indicated by label or requested by SHA. Example set kitchen supplies in kitchen, couch in living room, etc. The Mover shall exercise all appropriate care and caution in the performance of the moves. The Mover shall bear all responsibility for damage to the building due to negligence. The Mover shall respond to any such report of damage or loss within five business days of notification by SHA. SHA reserves the right to withhold payment for a completed move to cover the cost of damage by mover. Approximately 80 one-bedroom apartments shall be relocated. Building has multiple floors and elevators. Provide an option for the tenants to be able to buy insurance for either depreciated and/or replacement value with bid. No washing machine, dryers, stoves or refrigerators need to be relocated SHA will provide a Tenant Coordinator that will pack the tenants and work with the Contractors lead worker. The contractor will work directly with the tenant coordinator to remedy any concerns that they may have. Contractors shall not contact the tenants unless requested to do so by the SHA. Work will be performed between the hours of 8:00 A.M. and 5:00 P.M., unless otherwise approved by SHA. SHA will not pay for other supplies used. Travel time from and to the base will be at a set price. Three workers per move is the minimum number of workers considered sufficient. The Mover s employees shall at all times exhibit a professional and courteous attitude toward the residents and staff. SHA reserves the right to have any worker removed from the property immediately with or without cause. Such said person/s will not be able to occupy/visit any SHA site. If the SHA has someone removed, it will be the contractor s responsibility to have the person replaced to complete moves and comply with this contract. Bids shall only be considered from firms that regularly engage in relocating Apartments, Homes and Businesses using employees performing the work on its own payroll.

4 MOVE PROCEDURES REQUIRED BY SHA Coordinate dates, time and apartment\s being moved with the SHA staff Protect carpeting or flooring, Protect upholstered and wood furniture, walls, elevators, hallways Protect and transport Televisions, computers, cable box Provide and use blankets when needed. RULE FOR AWARD The contract will be awarded to the lowest responsible and eligible bidder. As used herein, the term "lowest responsible and eligible bidder" shall mean the General Bidder whose bid demonstrably possessing the skill, ability, and integrity necessary for the faithful performance of the work, and who not debarred from bidding and who shall certify that they are able to furnish labor that can work in harmony with other elements of labor employed or to be employed on the work. INSURANCE REQUIREMENTS The Contractor shall takeout and maintain insurance coverage as listed below with respect to the operations as well as the completed operations of this Contract. This insurance shall be provided at the Contractor's expense and shall be in full force and effect for the full term of the Contract. All policies shall be issued by Companies authorized to write that type of insurance under the laws of this Commonwealth of Massachusetts CONTRACTORS COMMERCIAL GENERAL LIABILITY 1. Provide the following minimum coverage with respect to the operations performed by any employee or supplier: Bodily Injury & $1,000,000 each occurrence Property Damage $1,000,000 general aggregate Products & Completed Operations $1,000,000 aggregate Personal & Advertising Injury $1,000,000 each occurrence This policy shall include contractual liability coverage. The Contractor shall provide a separate Owner's and contractor's Protective Liability policy in the name of the owner at the same limits listed above. VEHICLE LIABILITY Provide the following minimum coverage with respect to the operations of any employee, including coverage for owned, non-owned, and hired vehicles. Bodily Injury $1,000,000 each person Property Damage $1,000,000 each accident WORKER'S COMPENSATION 1. Provide the following coverage in accordance with M.G.L.c. 149 ss34a and c. 152 as amended. Worker's Compensation Provide Statutory Minimum

5 Coverage A Employer's Liability Coverage B $500,000 each accident $500,000 disease per employee $500,000 disease policy OWNER AS ADDITIONAL INSURED The Owner and Department shall be named as additional insured on the Contractors Commercial Liability Policies. WORKER DOCUMENTATION CERTIFICATION: In accordance with Executive Order 481 the contractor certifies under the penalties of perjury that the Contractor shall not knowingly use undocumented workers in connection with the performance of this contract; that pursuant to federal requirements, the Contractor shall verify the immigration status of all workers assigned to such contractor without engaging in unlawful discrimination; and that it shall not knowingly or recklessly alter, falsify, or accept altered or falsified documents from any such worker(s). The Contractor understands and agrees that breach of any of these terms during the contract period may be regarded as a material breach, subjecting the Contractor to sanctions, including but limited to monetary penalties, withholding of payments, contract suspension, or termination. PAYMENTS The Contractor will bill for the completed work once a month. The SHA will only pay for the apartments relocated, minus additions or deductions as indicated herein. At no time may the Contractor invoice in advance for any payments. SHA RIGHT TO AWARD CONTRACT The SHA reserves the right to award part of this contract to the second and third lowest bidder. This clause will not be used unless the contractor defaults or cannot meet the SHA s need to move multiple units at one time do to time constraints or if the SHA feels it is in its best interest to do so. The SHA reserves the right to waive any informality in or to reject any or all bids if it is in the public interest to do so. TERMINATION The Somerville Housing Authority may terminate this contract with or without cause, without penalty if the Somerville Housing Authority deems that it is in the best interest to do so.

6 SHA INSTRUCTIONS AND TERMS TO BIDDERS Section A 1. Bids must remain firm throughout the contract term. No increase in the price bid once accepted and awarded will be permitted. 2. The bidder agrees, if this bid is awarded that, within ten (10) days from the date of bid award, they will furnish work as per prices herein quoted, in compliance with all terms, conditions and requirements specified in this bid solicitation. The undersigned certifies under penalties of perjury that this bid or proposal is in all respect bona fide, fair and without collusion or fraud with any other person. 3. By executing this Contract, the Contractor under the pains and penalties of perjury, makes all certifications required by law and certifies that it shall comply with the following requirements: that the Contractor is qualified and shall at all times remain qualified to perform this Contract; that performance shall be timely and meet or exceed industry standards, including obtaining requisite licenses, permits and resources for performance; that the Contractor and its subcontractors are not currently debarred; that the Contractor has reviewed the General Conditions for Procurement Contracts (including hyperlinks), Special Conditions for Term Contracts, Bid Form and Technical Specifications, and Instructions to Bidders; that the terms of this Contract shall survive its termination for the purpose of resolving any claim, dispute or other Contract action, or for effectuating any and all representations, warranties and guarantees made or supplied by the Contractor or its subcontractors.; The Contractor further agrees that all terms governing performance of this Contract and doing business in Massachusetts are attached to this Contract or incorporated by reference herein, including the following requirements: all relevant Massachusetts State and Federal laws, regulations, Executive Orders, treaties, the General Conditions for Procurement Contracts, Special Conditions for Term Contracts, Bid Form and Technical Specifications, and Instructions to Bidders, the Request for Proposals (RFP) or solicitation/invitation for Bids, (IFB) the Contractor s response to the RFP or solicitation (IFB) (if applicable), and any additional stipulated provisions. As used in this certification, the word "person" shall mean any natural person, joint venture, partnership, corporation, or other business or legal entity.

Failure to examine any specifications, instructions or conditions will be at bidder's risk and will not relieve successful bidder of his /her obligation to fully carry out and implement all provisions of the contract at the price stated on the bid form. 5. Bids must be submitted on the bid forms provided. Forms may be reproduced as necessary. Bids will not be accepted electronically. 6. Bidders are cautioned to insure that their bids are complete, correct and accurate. Clerical errors or irregularities discovered after bid opening is subject to correction only with the concurrence of the Authority and in compliance with applicable State or Federal regulation. Negligence on the part of the bidder in preparing a bid confers no right of withdrawal or modification of said bid after it has been opened. 7. In the case of discrepancy between the unit price and extension, unit price shall prevail. In case of discrepancy between the total price shown on the bid form and the actual sum of the item totals, the actual sum of the item totals shall prevail. 8. The Somerville Housing Authority is exempt from Federal and State Sales and Excise Taxes and prices invoiced must not include those taxes. Exemption certificates will be provided on request. 9. If Bidder is a Corporation, the Corporate Certificate included herein shall be signed, sealed, and returned with the bid. All bidders shall sign and return the W-9 Form, Verification of Taxation Reporting Information also included herein. Failure to submit all required documents may result in rejection of the bid.

9 SERVICE CONTRACT This Agreement, made this day of 2019, by and between the Somerville Housing Authority hereinafter called the "Owner", and hereinafter called the "Contractor". Witnesseth, that the Owner and the Contractor, for the consideration hereinunder named, agree as follows: Article 1. Scope of Work. The Contractor shall perform all the Work required by the Contract Documents for the relocation of apartment contents according to contract documents prepared by the Somerville Housing Authority. Article 2. Term of Contract. The Contractor shall commence work under this Contract on the date specified in the written Notice to Proceed and shall perform the specified Work for a minimum of 2-years of said date. Article 3. Suspension and Termination. The awarding authority may terminate this Contract by giving written notice to the other party, with or without cause without penalty if it deems that it is in the best interest to do so. Article 4. Contract Sum. The Owner shall pay in current funds the Contractor for the performance of the Work the Contract Sum $ in words Payments will be made in accordance with the terms set forth in these Contract Documents and may be different then the above amount. No contract amendments shall be made except in writing upon the express agreement of the parties, approved by SHA and in accordance with the provisions of M.G.L. c.30b. Article 5. The Contract Documents. The following, together with this Agreement form the Contract and all are as fully a part of the Contract as if attached to this Agreement or repeated herein: Invitation to Bid, the Bidding Documents, the Conditions of the Contract, the Contractor's Bid Submission, and, any amendments or addenda issued prior to award and any modification agreed to after the award. Article 6. Conflict of Interest. The Contractor covenants, that (1) presently, there is no financial interest and shall not acquire any such interest, direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed under this Agreement or which would violate M.G.L. c.268a, as amended; (2) in the performance of this Contract, no person having any such interest shall be employed by the Contractor; and (3) no partner or employee of the firm is related by blood or marriage to any Board Member or employee of the Awarding Authority. Article 7. REAP Certification. Pursuant to M.G.L. c.62(c), sec.49 (a), the individual signing this Contract on behalf of the Contractor, hereby certifies, under the penalties of perjury, that to the best of their knowledge and belief the Contractor has complied with all laws of the Commonwealth relating to taxes, reporting of employees and contractors, and withholding and remitting child support. Article 8. Validation. This Contract will not be valid until signed by the Executive Director of the Somerville Housing Authority or his/her designee.
