The number of Eligible Workweeks applicable to your claim is set forth below. If you believe that the number of workweeks stated below is correct, you do not have to do anything else. It is your responsibility to keep a current address on file with the Settlement Administrator to ensure receipt of your Settlement Award. YOUR ELIGIBLE WORKWEEKS Park N Fly s records indicate that you worked 49 Eligible Workweeks from December 12, 2012 to November 18, YOUR ESTIMATED SETTLEMENT AWARD Under the terms of the Class Action Settlement, you are entitled to receive a settlement payment in the approximate estimated amount of $256.95, minus all applicable payroll and tax deductions, after the Court approves the Settlement and it goes into effect. This process may take six months or more. You will receive a Form W-2 and/or 1099 reflecting the payment to you. Your Individual Settlement Payment reflected on this Notice is only an estimate. The exact amount of your settlement payment could vary, up or down. If you wish to dispute the number of workweeks credited to you, you must return this form and follow the procedure described in the Notice of Class Action Settlement. If you believe that the number of workweeks with which you have been credited is incorrect, you must complete this Dispute Form by indicating what you believe is incorrect on the blank lines below and return it on or before March 11, 2019 to the Settlement Administrator at James v. Park N Fly, c/o CPT Group, Inc., 50 Corporate Park, Irvine, CA 92606, via U.S. Mail with proof of the submission date (such as a postmark or delivery service date stamp). You must also send any documents or other information that you contend supports your belief that the information set forth above is incorrect. The Settlement Administrator will resolve any dispute based upon Park N Fly s records and any information you provide. 3 NOTICE OF PROPOSED CLASS ACTION SETTLEMENT AND HEARING DATE FOR COURT APPROVAL James v. Park N Fly Service, LLC et al., Case No. 17CIV05465 As a current or former non-exempt employee of Park N Fly Service, LLC and/or Park Holding (PHI) Service, LLC in California, you may be entitled to receive money from a class action settlement. The San Mateo County Superior Court has authorized this Class Notice. This is not a solicitation from a lawyer. YOU MAY BE ENTITLED TO RECEIVE MONEY FROM A CLASS ACTION SETTLEMENT IF YOU ARE A CURRENT OR FORMER HOURLY EMPLOYEE WHO WORKED FOR PARK N FLY SERVICE, LLC AND/OR PARK HOLDING (PHI) SERVICE, LLC, IN CALIFORNIA FROM DECEMBER 12, 2012 TO NOVEMBER 18, A proposed settlement of $700, (the Gross Settlement Amount ) will be used to pay claims to: current and former hourly-paid employees of Park N Fly Service, LLC and/or Park Holding (PHI) Service, LLC (collectively Park N Fly ) who worked at any time from December 12, 2012 to November 18, 2017 in California (such periods of time, the Class Period and such employees, the Class Members ). The settlement resolves a lawsuit entitled James v. Park N Fly Service, LLC et al., Case No. 17CIV05465 (the Lawsuit ) over whether Park N Fly properly paid employees for all wages earned, including overtime, provided compliant meal periods and rest breaks, maintained accurate records, provided accurate itemized wage statements, timely paid final wages, and other legal consequences that would follow from the aforementioned violations. This settlement avoids the costs and risks of continuing the Lawsuit, pays money to persons like you, and releases Park N Fly from alleged liability. The Court has not made a determination of the validity of the claims in the Lawsuit. Park N Fly denies any and all liability arising from any of the claims and contends that at all relevant times they properly paid all employees, provided accurate itemized wage statements, and fully complied with all applicable laws. Class Members will be eligible to receive a payment based on the number of workweeks worked, rounded up to the nearest full workweek, during the Class Period. 4 HOW MUCH WILL I GET? You worked a total number of 49 during the Class Period. It is expected that you will receive approximately $ YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT DO NOTHING Receive a payment and give up your legal rights to pursue claims released by the settlement of the Lawsuit. If you timely submit a written objection, you may speak about your objection at the hearing. IMPORTANT INFORMATION ABOUT THE PROPOSED SETTLEMENT 1. Why did I get this Class Notice? You were sent this Class Notice because you have a right to know about the proposed settlement in the Lawsuit and about all of your options before the Court rules on whether to finally approve the settlement. If the Court approves the settlement, and after any objections and appeals are resolved, a Settlement Administrator appointed by the Court will make the payments that the settlement allows. This Class Notice explains the Lawsuit, the proposed settlement, your legal rights, and what benefits are available and how to receive them. The Court in charge of this case is the San Mateo County Superior Court. The persons who sued are called Plaintiffs and the organization they sued is called Defendant. 2. What is the Lawsuit about? In the Lawsuit, Brittany James, the Representative Plaintiff, alleged multiple violations of the California Labor Code, the California Business & Professions Code, and the California Private Attorneys General Act ( PAGA ) on behalf of herself and other non-exempt employees of Park N Fly, including causes of action for: (1) failure to pay for all hours worked, including overtime; (2) failure to provide meal and rest breaks; (3) failure to maintain accurate records; (4) failure to furnish accurate wage statements; (5) failure to pay final wages timely; (6) violations of PAGA and related claims for penalties; (7) failure to reimburse business expenses, and (8) unfair competition. 3. Why is there a settlement? The parties disagree on the probable outcome of the case with respect to liability, damages, and how much money could be recovered if the Representative Plaintiff won at trial. Park N Fly believes the Representative Plaintiff would not prevail if this case went to trial. The Court has not decided in favor of the Representative Plaintiff or Park N Fly. There has been no trial in this case. Instead, both sides recognize the risks, expenses, and disruption associated with continued litigation and they have therefore chosen to resolve their differences by entering into a settlement. By doing so, the parties can avoid the cost of a trial, yet Class Members are still entitled to receive payments if they comply with the instructions in this Class Notice. The parties entered into this settlement after arms-length negotiations while using the services of an experienced and neutral mediator. The Representative Plaintiff and Class Counsel believe that the proposed settlement is fair and reasonable and is in the best interest of the Class Members. CLASS NOTICE - PAGE 2 OF 5

5 4. What is a class action settlement? CPT ID: «ID» The Court must approve the terms of the proposed settlement as fair and reasonable. Once approved, the settlement will affect all Class Members, except those who have properly opted out. This Class Notice explains your legal rights, the terms of the settlement, what you must do to participate, and the amount of money you may receive. Please read this entire Class Notice carefully. 5. How do I get a payment? If you wish to remain a settlement class member and obtain any share of the settlement that you may be entitled to receive, then you do not need to take any action. You are never required to go to court or pay anything to the lawyers in this case. If the court approves the proposed settlement, you will be mailed your share of the settlement amount. BE MINDFUL, HOWEVER, THAT IF THIS CLASS NOTICE REACHES YOU AND THE ADDRESS WHERE YOU NOW LIVE IS DIFFERENT, YOU NEED TO CONTACT THE SETTLEMENT ADMINISTRATOR AND PROVIDE UPDATED INFORMATION SO THAT ANY FUTURE CORRESPONDENCE OR THE SETTLEMENT CHECK ITSELF REACHES YOU AND IS NOT RETURNED AS AN ADDRESS UNKNOWN. 6. How much will my payment be? Your potential payment would be proportional to how long you worked during the relevant time period. After all fees, costs, and offsets are taken as set forth in the parties Joint Stipulation of Settlement and Release (which is available for review), the remainder will be used to calculate Class Members relative portions which are based on the number of workweeks each Class Member worked during the Class Period. Your estimated payment is listed on page 2 of this document. The Net Settlement Amount will equal the net amount available for payment to Class Members after deducting the costs from the Gross Settlement Amount. For example, if the Court approves the maximum amounts requested the Net Settlement Amount will be $401, The maximum amounts requested are $233, in attorney fees, $20,000 in legal costs, $25,500 in settlement administration costs, $5,000 in incentive awards, and $20,000 allocation for PAGA penalties (of which $15,000 is submitted to the LWDA). The NSA is calculated as follows: $700,000 - $233, $20,000 - $25,500 - $5,000 - $15,000 = $401, If the Court approves a lesser amount of any of the above-referenced costs, the Net Settlement Amount will increase proportionately. 7. When would I get my payment? The Court will hold a hearing on April 5, 2019 to decide whether to approve the proposed settlement. If the Court approves the settlement and anyone objects, there may be appeals. It is always uncertain when these objections and appeals can be resolved, and resolving them can take time. Payments will be completed in three equal payments over three years. The first payment is anticipated to be sent by May The second payment is anticipated to be sent by May 2020 with the third and final payment anticipated to be sent by May What am I releasing? Upon the Court s final approval of the settlement, and except as to such rights or claims as may be created by the settlement, Plaintiffs and Class Members who have not effectively opted-out of the settlement as described below, fully release and discharge Park N Fly, Inc., Park Holding (PHI) Service, LLC, and Park N Fly Service, LLC, and all of their past and present owners, officers, directors, shareholders, employees, agents, assigns, attorneys, insurers, parent companies, subsidiaries, and affiliates, and their respective predecessors, CLASS NOTICE - PAGE 3 OF 5

6 successors, and assigns, without limitation ( Released Parties) of and from any and all claims for alleged unpaid wages including minimum wage and overtime, meal period premiums, rest period premiums, unreimbursed expenses, damages, unpaid costs, penalties including but not limited to wage statement and waiting time penalties, expenses, liquidated damages, benefits, fringes, interest, attorney fees, litigation costs, liabilities, restitution, or equitable relief, which Plaintiffs, the Class, and/or any Class Member had, or may claim to have, against any of the Released Parties, known or unknown, arising out of the facts, circumstances, and primary rights during the Class Period, which are alleged or could have been alleged based on the facts as set forth in the operative Complaint in this action ( Released Claims ). These claims include but are not limited to (1) all claims for failure to pay wages, including overtime wages; (2) all claims for failure to provide meal and/or rest periods (3) all claims for failing to maintain accurate records; (4) all claims for failing to furnish timely accurate itemized wage statements; (5) all claims for failing to timely pay final wages; (6) all claims for violation of California Business and Professions Code 17200, et seq.; (7) failure to reimburse business expenses; (8) all claims for violation of PAGA and all related claims for penalties, to the extent such claims are predicated on the other claims released herein. This release covers all claims pled, or that could have been pled, arising out of the facts, circumstances, and primary rights in the operative Complaint. The time period covered by this release is from December 12, 2012 to November 18, How can I opt out of this settlement? You can opt out of this settlement and retain your rights. To do so, you must prepare and submit a letter expressing your intent to be excluded. To be valid, the Opt-Out Request must (a) state that you request to be excluded from the Settlement in James v. Park N Fly Service, LLC et al., Case No. 17CIV05465, (b) be signed and dated, (c) include your name (and former names, if any), (d) include your address, and (e) include last four digits of your social security number. You will have 60 days from the date of mailing of this Class Notice to do so. Your Opt-Out Request must be mailed to the Settlement Administrator, James v. Park N Fly Settlement, c/o CPT Group, Inc., located at 50 Corporate Park, Irvine, CA and be postmarked no later than March 11, 2019, or it will not be considered and you will be bound by the settlement. 10. Do I have a lawyer in this case? The Court has appointed Leonard Emma and Stephen Noel Ilg of HOFFMAN EMPLOYMENT LAWYERS, PC, 1999 Harrison Street, 18th Floor, Oakland, California 94612, telephone to represent you and other Class Members in the Lawsuit. These lawyers are called Class Counsel. They will be compensated from the Total Settlement Amount as discussed in this Class Notice. If you want to be represented by your own lawyer, you may hire one at your own expense. 11. How will the lawyers be paid? Class Counsel will ask the Court to award them fees of approximately 33.3% (one-third) of the Gross Settlement Amount. Class Counsel will also ask the Court to award them costs incurred in connection with the Lawsuit in an amount not to exceed $20,000. The Court may choose to award less than the amount requested by Class Counsel. 12. How do I tell the Court if I do not like the settlement? You can ask the Court to deny approval by filing an objection. You cannot ask the Court to order a larger settlement; the Court can only approve or deny the settlement. If the Court denies the settlement, no settlement payments will be sent out and the Lawsuit will continue. If that is what you want to happen, you must object. You may object to the proposed settlement in writing. You may also appear at the Final Approval Hearing, either in person or through your own attorney if you submitted a written objection. If you appear through your own attorney, you are responsible for paying that attorney. All written objections and supporting papers must (a) clearly identify the case name and number (James v. 7 17CIV05465), (b) be submitted to the Settlement Administrator, CPT Group, Inc. at the address listed above, and (c) be postmarked on or before March 11, When and where will the Court decide whether to approve the settlement? The Court will hold a fairness hearing on April 5, 2019 at 2:00 p.m. in Department 2 at the San Mateo County Superior Court 400 County Center, Redwood City, CA At this hearing, the Court will consider whether the settlement is fair, reasonable, and adequate. If there are objections and they have been properly submitted, the Court will consider them. The Court will listen to people who submitted an objection. The Court may also decide how much to pay to Class Counsel. At or after the hearing, the Court will decide whether to approve the settlement. We do not know how long this decision will take. 14. Do I have to come to the hearing? No. Class Counsel will answer any questions that the Court may have. But you are welcome to come at your own expense. If you sent an objection, you do not have to come to Court to talk about it. As long as you mailed your written objection on time, the Court will consider it. You may also pay your own lawyer to attend, but it is not required. 15. May I speak at the hearing? You may speak at the fairness hearing if you submit a written objection according to the instructions set forth herein. 16. What happens if I do nothing at all?
