1 BT N 8623 (Draft Resolution BT C51/2011) Issue date : Target Date : BT - TECHNICAL BOARD 1 T O D E C I D E 2 S U B J E C T : Creation of a new Project Committee on "Indoor sun exposure services" 3 B A C K G R O U N D On 30 March 2011 ASI submitted a Form A (see Annex 1) to CEN proposing the creation of a new CEN Project Committee in order to develop European Standards on indoor sun exposure services. Over the years, the quality and safety of sun beds and other artificial sunlight devices - without which an indoor sun exposure facility cannot operate have improved substantially. Nevertheless, the safe use of sun beds is also dependent on the way the service is provided. Particularly important are the hygienic aspects and the way in which consumers are informed about the proper use, including advice on indoor sun exposure schemes for their skin type. The development of European Standards on the service provision of sun exposure services will therefore contribute to consumer protection. The Form A envisages the development of two European Standards on tanning facilities (for an outline of the proposed standards see Annexes 2 and 3). A first standard dealing with the assessment of the indoor sun exposure consultant, which provides information and advice to the consumers using these services, and a second one establishing requirements for the provision of services of tanning facilities. Priority will be given to the development of the standard dealing with the training of the consultants. There are already two national standards in Austria dealing with tanning facilities and the training and qualification of indoor sun exposure consultants. Moreover, the European Sunlight Association (ESA) has published a training manual for indoor sun exposure facility operators.
2 By Resolution BT C75/2009, BT approved that both of following criteria are to be met for acceptance of such proposal for new work (in new area): A two-thirds majority of the votes cast (abstentions not counted) are in favour of the proposal (or more); Members express commitment to participate. As a consequence, BT Members are requested to state explicitly, by means of the commenting field provided in the BT-balloting tool, whether or not they are committed to participate in the work. 4 D R A F T R E S O L U T I O N BT, having considered the proposal for new work (Form A) submitted by ASI as included in BT N 8623; considering that the following members have expressed commitment to participate: o members decides, - to create a new Project Committee, CEN/TC xxx "Project Committee Indoor sun exposure services" in order to work on the European Standards on indoor sun exposure services according to the specifications provided in BT N 8623; - to ask the new CEN/TC xxx to submit its programme of work for BT approval by December 2011; - to allocate the Secretariat to ASI. NOTE Requirements for appliances for skin exposure to ultraviolet are excluded from the scope. 3 Justification and purpose Over the years, the quality and safety of the sun beds and other artificial sunlight devices - without which an indoor sun exposure facility cannot operate have improved substantially. This is especially the case since the publication of EN :2010 Household and similar electrical appliances - Safety -- Part 2-27: Particular requirements for appliances for skin exposure to ultraviolet and infrared radiation, which limits the radiation to 0,3 W/m². Consumer protection Bringing newly marketed sunbeds in compliance with the Low Voltage Directive 2006/95/EC does not protect the public, making use of already installed sunbeds in professional indoor sun exposure facilities. The safety of sunbed use for indoor sun exposure offered as a public service needs to be addressed too. Safe use of sunbeds, including for example hygienic aspects, is critically dependent on the way the service is provided. Particularly important is the way in which consumers are informed about the proper use, involving advice on indoor sun exposure schemes for their skin type. A European standard on the service provision of sun exposure services will therefore contribute to the consumer protection. Legal framework and providing a benchmark for market enforcement authorities Market surveillance of indoor sun exposure facilities differs among the different Member States. This was particularly highlighted during the market surveillance authorities Joint Action on Sunbeds (see: ). This Joint Action takes place in the framework of the General Product Safety Directive 2001/95/EC, in which context the provision of indoor sun exposure services fall. A European standard on the service provision of indoor sun exposure facilities will effectively help the market surveillance authorities to benchmark sun exposure facilities. In addition, the standard
4 can support the practical operation of the GPSD. Note: A new Joint Action on sunbeds, with 12 member states authorities, is going on until December Qualification of indoor sun exposure facility staff Providing an optimal service to clients, including the way in which consumers are informed about the proper use, require education and training of staff. Qualified staff which supervises an indoor sun exposure facility, is a way to raise consumer protection. The Austrian standard ÖNORM S 1131:2000 Requirements for the training of qualified consultants for the exposure to sun lays down these requirements and is an ideal step-stone towards a European standard for qualification of indoor sun exposure facility staff. In addition, the European Sunlight Association (ESA) has published a training manual for indoor sun exposure facility operators (see It is therefore envisaged to elaborate two European standards on tanning facilities: EN xxxx with as provisional title Indoor sun exposure facilities Requirements for and assessment of indoor sun exposure consultants EN xxxx with as provisional title Indoor sun exposure facilities Requirements for the provision of services of these facilities In the course of this Project Committee, a clear focus will be given to the development of first the training standard. The second standard with regard to the requirements for the tanning facilities will only be addressed within this project if the development of the first standards can be finalized on time. National provisions Specific legislation on indoor sun exposure facilities is in force in Belgium, Denmark, Finland, France, Hungary, Italy, Norway, Spain, Sweden and the Netherlands. Legislation in Germany will likely come into force in the course of this year. This national legislation will be taken into account during the standardisation activities. Full examination of other national situations will be examined. These national legislations cover different aspects of indoor sun exposure services or of the artificial sunlight appliances themselves and therefore do not hinder the elaboration of these European standards. This standard lays down the training provision, so that sun exposure consultants are knowledgeable on sun exposure and can be qualified as a competent consultant. 1. Scope This European standard provides a set of minimum requirements, which are essential for the training of sun exposure facilities consultants.
