1 ALPINE SCHOOL DISTRICT 490 North State Street, Lindon, Utah Office (801) Fax Number (801) July 12, 2011 Notice to Contractors: Alpine School District is requesting Bids for Construction Manager/General Contractors (CM/GC) from qualified firms, licensed and certified as applicable in the State of Utah, for the remodel of the ATEC Building, Lindon, Utah. This CM/GC proposal and supplemental information must be received at Alpine School District Purchasing Department located at 490 North State Street, Lindon, Utah 84042, by 11:00 AM., July 27, 2011as a sealed bid. Delivery means and methods for CM/GC proposals are the sole responsibility of the contractor. Bids received after this time will not be considered. The CM/GC shall provide three copies of the statement of qualifications, management plan (for each project), termination and debarment statement, and contractor s license. Statement of qualification needs only to be submitted once for multiple projects. The statement of qualification should be a short document that indicates the experience and qualifications of the CM/GC and the project team key individuals as identified in the management plan. It should include information on similar projects that have been completed by the CM/GC and the project team. When listing similar projects, include information to indicate the dates, size, firm worked for at the time and what the responsibility of each individual was on the project. Include the experience and special qualifications of the team that are applicable to this project(s) and/or are part of the project specific selection criteria. Questions, interpretations, clarifications or communication regarding this project should be directed to Chuck Bearce, Kraig Sweat or Frank Pulley. Contact made with any other Alpine School District personnel may be considered grounds for disqualification. The selection process will be a two step selection process. Step one will be an evaluation and ranking of the proposals by representatives of the Physical Facilities and Purchasing Departments. Step two will be a submittal of the ranked proposals to the Alpine School District Building and Grounds Committee for evaluation and final decision. The CM/GC must be capable of and willing to work closely with Alpine School District representatives and the Architect, Sandstrom Associates with Gary Kirschbaum as project manager. Project Risk Factors Construction at a currently occupied and operating school. 1

2 General Information This project is being funded with ARRA monies and must comply with all ARRA requirements including paying Davis Bacon wages, and providing certified payrolls each week. Steel used must be US made. Estimated construction cost(s): $65,000 Projected Construction start date: July 28, Projected Construction completion date: August 20, Management Plan Licensure The Management Plan should contain the following: How the construction of each project, will be managed, including items such as security and safety controls, and coordination with Alpine School District. A proposed construction schedule. Project specific criteria; risks that have been identified from the bid additional risks that the team has identified for each project, and how those risks will be mitigated. Attendance at the pre-construction and design meetings. CM/GC firms and their employees shall comply with, and require all of their sub-contractor s employees to comply with, the licensure laws of the State of Utah. All bids must include proof of a valid Utah contractor s license at the time of submission. Termination or Debarment Certifications CM/GC firms must submit a certification that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from soliciting work by any governmental department or agency. The firm must also certify that neither the firm nor its principals have been terminated during the performance of a contract or have withdrawn from a contract to avoid termination. If the firm cannot certify these two statements, the firm shall submit a written explanation of the circumstances for review by the District. Firms are to submit these certifications with their RFP. CM/GC Firm s Experience/Qualifications Each CM/GC firm submitting an RFP must provide, but not be limited to, the following information: 1. All firms or individuals your company anticipates utilizing to provide surveying, engineering, and any other necessary professional services. 2. Present level of professional liability insurance coverage for the firm, including errors and omissions insurance. 3. Any litigation, arbitration, or other alternative dispute resolution proceedings your firm has been involved in with an owner within the past ten years. 2

3 4. Financial statements reflecting the firm s financial resources to adequately perform the work described herein. These financial statements should be submitted in a separate sealed envelope. Proprietary information will not be disclosed. 5. Ability to perform services as reflected by workload and the availability of adequate personnel, equipment, and facilities to perform the services expeditiously. 6. Other pertinent information regarding qualifications and performance data that may be requested by Alpine School District.. Guaranteed Maximum Price The Guaranteed Maximum Price (GMP) shall include all fees and percentages required by this Bid, as well as the costs for General Conditions and all work as required in the Contract Documents. Cost Proposal, Fees, and Markups Before submitting the bid, each CM/GC shall carefully examine the bid and shall include in the bid the cost of all items required by the bid. If the contractor observes that portions of the Contract Documents are at variance with applicable law, building codes, rules, regulations or contain obvious erroneous or uncoordinated information, the CM/GC shall promptly notify the specified Alpine School District Representative and the necessary changes shall be accomplished by addendum before the Bid opening. All contractors shall furnish the following fees and markups as part of the bid: Self-performed bid work: 1. If the CM/GC intends to self-perform any of the construction functions which will be bid by sub-contractors, the CM/GC will be required to submit a bid for each item the CM/GC intends to self-perform. 2. These bids will be due 24 hours prior to the bid opening of the subcontractors. 3. Submit these bids to the Purchasing Department at 490 North State Street, Lindon, Utah, The cost of any work that is self-performed will be part of the established GMP. 5. All bids will be compared to all other bids, and the highest ranking proposal that most closely meets the needs of Alpine School District will be contracted to provide the service(s). Change orders All overhead fees for construction change orders up to $50,000 will be limited to 10% for the subcontractor and 5% for the CM/GC. If the CM/GC is self-performing work, the overhead fee will be limited to 15%. 3

4 Contract For change orders exceeding $50,000, the sub-contractor will be limited to 7% and 3% for the CM/GC. If the CM/GC is self performing work, the overhead will be limited to 10%. These percentage fees represent the total fees to be paid for change orders. The contract(s) to be entered into between the successful CM/GC and Alpine School District will include the following forms and documents from the American Institute of Architects (AIA) which will govern the course of construction of the projects: AIA Document A AIA Document A AIA Document A AIA Document G AIA Document G AIA Document G AIA Document G AIA Document G AIA Document A AIA Document A Instructions to Bidders Bid Bond Performance Bond Application and Certificate for Payment Continuation Sheet Change Order Certificate of Substantial Completion Consent of Surety to Final Payment General Conditions of the Contract for Construction Standard Form of Agreement between Owner and Construction Manager as Constructor Insurance Alpine School District will provide Builder s Risk Insurance. CM/GC will be required to provide Liability and Workers Compensation insurance for their employees. Sub-contractors will be required to do the same. Selection criteria for CM/GC will include the following The following criteria will be used in ranking each of the contractors. The contractor that is ranked the highest will represent the best value for Alpine School District. The criteria are not listed in any priority order. The selection committee will consider all listed criteria in performing a comprehensive evaluation of the proposal. Responsible (5 points possible): How closely the contractor s RFP meets or exceeds administrative requirements, technical specifications, and contractual terms and conditions. Responsive (5 points possible): The contractor s ability in all respects to successfully perform the contract requirements. General Conditions and Fee (30 points possible for lowest bid): The contractor s cost proposal will be considered with all other criteria to determine the ranking of the firm. Submit in separate, sealed envelope. Strength of contractor s Team (25 points possible): Based on the statements of qualifications, and management plan, the selection team shall evaluate the expertise and experience of the construction firm, the project manager, and the superintendent as it relates to this project in size, complexity, quality and duration. Key personnel assignments and their commitment to each phase of the work 4

5 will be evaluated. Based on the information provided in the construction and management plan, the selection team shall evaluate how each team has planned and determined how to construct the project in the location and in the time frames presented. The contractor shall discuss what portions of the project they plan to self-perform. The selection team will also evaluate the degree to which risks to the success of the project have been identified and a reasonable solution has been presented. Past performance (25 points possible): Each contractor will be given a past performance rating. The rating will be based first on how well the firm did on past projects with Alpine School District. If a minimum of five years of Alpine past performance ratings are not available, a rating will be established using any Alpine School District past performance ratings that are available, supplemented by references supplied by the contractor at the time the proposals are submitted. DFCM s performance ratings may also be used by Alpine School District for references. Experience with projects of similar scope (10 points possible): Each contractor will be rated on experience performed on similar projects. 100 total points possible. Pre-bid conference A pre-bid meeting and site visits will be held on Wednesday July 19, 2011 at 9:00 AM beginning at the ATEC School at 350 North State St, Lindon Additional legal information Alpine School District Board of Education reserves the right to reject any or all proposals or to waive any formality or technicality in any proposal in the interest of the District. It will be required of all contractors and sub-contractors to comply with State of Utah Code 63G concerning identity documents and verification and compliance with status verification. This code can be found on the web at: It will be required of all contractors and sub-contractors to comply with controlled substance rules found in State of Utah Rule R33-10 which can be found on the web at: Smoking is prohibited on and around all Alpine School District properties. Alpine School District School Board Policy 4457 states: 1.1 School Authorities are charged with protecting the health and safety of all students. As a means of helping to fulfill this charge, Alpine School District requires prospective employees to have a criminal background check. 1.5 Applicants who have been CONVICTED of any felony shall not be hired by Alpine School District. Applicants who have been convicted of any job related misdemeanor shall be reviewed and may not be hired by Alpine School District. It will be required of all contractors and sub-contractors to comply with this policy by submitting necessary information on all employees working on the project. District representatives will perform a Name Check through the Bureau of Criminal Identification, a division of the Utah 5

6 Bid bond Department of Public Safety, for all employees. The employees must pass the background check to be eligible to work on projects on any Alpine District Property occupied by students. Background checks may not be older than three years to be considered current and valid. A fee of $25.00 per employee name submitted for Name Check must be submitted at the time names are submitted to be checked. Pursuant to State of Utah Code 63G bid security requirements, bid security in the amount equal to at least 5% of the amount of the bid shall be required for all competitive sealed bidding for construction contracts. Bid security shall be a bond provided by a surety company authorized to do business in this state, the equivalent in cash, or any other form satisfactory to the state. Per Alpine School District Policy a bond is the only form of bid bond that will be accepted no cash or cashier s checks will be accepted. Bonds Successful vendor will be required to provide 100% performance and payment bonds. Bid deadline To be considered your sealed bid must be received at the Purchasing Department at 490 North State Street, Lindon, Utah by July 27, 2011 at 11:00 AM. Pursuant to Alpine School District Policy and State of Utah Rule , late bids will not be accepted. 6
