1 Samsung Smart Utsav Offer - Terms & Conditions 1. The Smart Utsav Offer ( Offer ) is provided by Samsung India Electronics Private Limited. 2. The Offer is valid in pan India except where prohibited by law. The Consumer Electronics offers are not valid for the State of Kerala during the Offer Period. 3. The Offer is valid from 15th September to 5th November 2016 (both days inclusive) ( Offer Period ). 4. The Offer is applicable on select models of Consumer Electronic products, as detailed in this document including the Annexure (collectively called as Products ). 5. The offers shall be applicable only on genuine Products of Samsung purchased from Samsung Shop only i.e. Samsung estore. The Offers shall not be applicable on purchases made from third party ecommerce portals. 6. Under this offer the customer will place an order on Samsung Shop and receive his product from the nearest Samsung Plaza or Samsung Authorized store under its Delight Delivery Program. Samsung reserves the right to extend or annul the offers at any point to time without giving any prior notice at its sole discretion. 8. The respective offers on select Products are as under and may vary depending on the models/ products purchased as detailed below: (I) TELEVISION & HOME THEATRE SYSTEM: (A) Free Home Theater/Sound Bar/DVD Offer i. Free DVD-E370 worth Rs 2,990/- would be given on purchase of select models of LED TV, as detailed in Annexure below. ii. iii. Free Sound bar model HW-K360 worth Rs 14,990/- would be given on purchase of select models of LED TV, as detailed in Annexure below. Free Samsung Sound Bar model HW-K450 worth Rs. 19,990/- would be given on purchase of select models of LED TV, as detailed in Annexure below.

2 iv. Free Home Theatre model HT-E350 worth Rs 10,490/- would be given on purchase of select models of LED TV, as detailed in Annexure below. v. Free Sound bar model HW-J7501R worth Rs 48,990/- would be given on purchase of select models of LED TV, as detailed in Annexure below. vi. vii. Free Speaker model HW-K20 worth Rs 5,690/- would be given on purchase of select models of LED TV, as detailed in Annexure below. Free 2600 mah Powerbank model RMP0322 (Powered by Samsung SDI cell) worth Rs. 1199/- would be given on purchase of select models of LED TV, as detailed in Annexure below. (B) 2 years Warranty (1+1) i. The extended warranty (1+1) will be valid for the specific models purchased between the promo period. 1st Year of warranty is the standard warranty which is applicable from date of invoice. The 2nd year warranty which is applicable from the date of expiry of the standard warranty is applicable only on Panel failure. The list of applicable models is detailed in Annexure below. Process to avail Extended Warranty: i. Installation call for the TV purchased during the offer period i.e. till 5th November 2016 shall be registered latest by 20th November 2016 and installation must complete by 30 th November ii. iii. iv. Customer has to handover one copy of invoice to the engineer during installation/demo. In case of non availability of Invoice, Warranty extension will not be applicable. One Year extended warranty is applicable from the date of expiry of 1st year warranty i.e. 1+1 year. The 1 year extended warranty is applicable only on Panel failure. Terms & Conditions for Extended Warranty: i. The terms and conditions of this Extended Warranty are supplement and in addition to the terms and conditions provided on the Standard Warranty Card supplied with the Product. ii. Under this offer the extended warranty will be valid for the specific models purchased between the promotion period.

3 iii. iv. 1st Year of warranty is the Standard Manufacturer's warranty as detailed in the warranty card which is applicable from date of invoice. The 2nd year warranty which is applicable from the date of expiry of the standard warranty is applicable only on Panel failure. This Extended Warranty is confined to the first purchaser ("Purchaser") of the Product only and is non-transferrable. Extended Warranty applicable only on Panel failure. v. Repair or replacement will be carried out through the Company's Service Centres or its Authorized Service Centres or it's Dealer's Service Centres. vi. vii. viii. ix. For the Products installed beyond the municipal limits of the jurisdiction of the Authorized Service Centre/Company's Service Centre/Authorized Dealer's Service Centre, all the expenses including but not limited to collection of the Product or part/s from the Company's Service Centre/Authorized Service Centre/Authorized Dealer's Service Centre, expenses incurred in connection with deputing of service personnel/ technicians, travel expenses (to and fro) incidentals expenses etc. shall be borne by the Purchaser. In the event of repairs/replacement of any part/s of the Product, this Extended Warranty will thereafter continue and remain in force only for the unexpired period of the Extended Warranty. Moreover, the time taken for repair/replacement and in transit whether under the warranty or otherwise shall not be excluded from the Extended Warranty period. During the period of the Extended Warranty the Company's obligation under shall be limited to repair or providing replacement of part/s only. The maximum claim /s if entertained by the Company will be subject to the maximum listed price of the Panel of the Product or the purchase price of the Panel part of the Product, whichever is lower. In the event of any unforeseen circumstance, and spares not being available, the Company's prevailing depreciation rules will be binding on the Purchaser to accept as a commercial solution in lieu of repairs. x. The Extended Warranty does not cover any accessories external to the Product. xi. xii. Customer has to handover one copy of invoice to the engineer during installation/demo. In case of non-availability of Invoice, extended warranty will not be applicable. Extended warranty is subject to verification of the documents and/or information provided by the customer and Samsung reserves the right to seek such additional documents and/or information from the customer as it may deem appropriate.

In case the customer wants to cancel the extended warranty before completion of the extended warranty period, there shall be no refund of the charges for the unexpired period of the extended warranty. The warranty does not apply to normal wear & tear of the parts or defects caused by household pets, rats, cockroaches or any other animals or insects. The warranty does not cover the damage or loss caused by accident, lighting, water, fire or other acts of God, improper ventilation, dropping or excessive shock or any external cause beyond Samsung's control. In case services are required as a result of the causes stated above, such services shall be at extra charges. This Extended Warranty will not be applicable in any of the following cases: a. The Product is not purchased from an authorized dealer of the Company in India. b. The Product is not used according to instructions given in the instruction manual. c. Defects caused by improper usage as determined by the Company's personnel. d. Modification or alteration of any nature is made in the electrical circuitry/ or physical construction of the Product. e. Installation/ repair work is carried out by persons/agencies other than authorized by the Company. f. The product is used for commercial purpose. g. The conditions of the premises do not confirm to the recommended operating conditions of the Product. h. The original serial number is removed, obliterated or altered from the Product or its cabinet. i. This Extended Warranty does not cover the damages to the Product while in transit to service centre or Purchaser's residence. This Extended Warranty shall cover only the Panel part of the Product. Any additional part(s) that may be required to restore the Product to the working condition shall be on chargeable basis at a price prevailing at the time of repair. (II) REFRIGERATORS (A) Free Samsung LED TV i. Free LED TV model 32FH4003 worth Rs 23,900/- would be given on purchase of select models of Side by Side Refrigerators. The models on which the Free LED TV is applicable are RF28K9380SG/TL, RF60J9090SL/TL, RH62K60177P/TL, RH77J90407H/TL, RH80J81323M/TL, RS58K6417SL/TL, RS51K56H02A/TL.

5 (B) Free Samsung J2 mobile i. Free J2 mobile model (J210FZDDINS, J210FZKDINS, J210FZSDINS) worth Rs 10,200/- would be given on purchase of select models of Side by Side Refrigerators. The models on which the Free J2 is applicable are RS21HSTPN1/XTL, RS21HUTPN1/XTL, RS21HZLMR1/XTL, RS552NRUA7E/TL, RS554NRUA1J/TL, RS554NRUA9M/TL, RSA1SHMG1/TL, RS55K50107S/TL, RS55K5010S9/TL. RS51K5460SL/TL, RS51K54F01J/TL. (III) MCROWAVE OVEN: (A) Free Borosil 10 pc Dinner Set i. Free 10 pc Borosil Dinner set worth Rs. 1,499/- would be given on purchase of all 28L & above Convection Microwave Oven models. (B) Extended Warranty: 5 Years (i.e. 1+4 years) Warranty on Magnetron on all models of Convection Microwave Ovens i. The Extended warranty on Magnetron will be applicable on all models of Convection Microwave Ovens purchased during the Offer period by the first purchaser only and is nontransferable. ii. iii. iv. Under the Extended Warranty on Magnetron Samsung will free of charge repair or replace the Magnetron only during the term of warranty and its labour charges will be free of cost. For any other repairs the same shall be chargeable as per the rates as decided by the company from time to time. The offer is applicable on Pan India basis. The terms and conditions of this extended warranty ("Extended Warranty") are supplemental to the terms and conditions provided on the Standard Warranty Card supplied with the Product. This extended warranty is applicable only for the repair or replacement of the Magnetron of the Product. The repair or replacement of the Magnetron of the Product will be carried out through the Company's Service Centres or its Authorized Service Centres or its Dealer's Service Centres. v. In the event of any unforeseen circumstance(s), and spares not being available, the liability of the company during the extended warranty is limited to the cost of the Magnetron only. xi. xii. xiii. The Extended Warranty does not cover any accessories external to the Product. The Courts at New Delhi shall have exclusive jurisdiction over matters covered or flowing from this Extended Warranty. This Extended Warranty will not be applicable in any of the following cases: a. The Product is not purchased during the Term specified above. b. The Product does not match the description as provided above. c. The Product is not purchased from an authorized dealer of the Company in India. d. The Product is not used according to instructions given in the instruction manual. e. Defects caused by improper usage as determined by the Company s personnel. f. Modification or alteration of any nature is made in the electrical circuitry or physical construction of the Product. g. Installation/repair work is carried out by persons/agencies other than authorized by the Company. h. The conditions of the premises do not confirm to the recommended operating conditions of the Product.

7 i. The original serial number is removed, obliterated or altered from the Product or its cabinet. j. Defects due to causes beyond control of the Company like abnormal voltage, acts of God or while in transit to service center or to the Customer s place. k. Defects caused by household pets, rats, cockroaches or any other animal or insects. l. Wastage of material, wearing out of any part of the Product caused by rust, or any other deposits, corrosion or deterioration due to chemical or atmospheric conditions or otherwise, scratching or painting or polishing of the surface. 9. Samsung reserves the right to change/alter & modify the terms & conditions of this Offer at any given point at its sole discretion without giving any reason whatsoever. 10. Samsung shall also not be responsible for non-availability of Stock(s) due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies or operational & technical issues. 13. In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Offer, these Terms shall prevail over all such other instructions, rules and conditions. 14. All the above offers shall be with a Standard Manufacturer s warranty as detailed in the warranty cards for each of the respective products. 15. All offers are subject to change without prior notice. Samsung disclaims any and all claims and liabilities with respect to this offer. Under no circumstances shall Samsung and/or its affiliates and/or their directors, officers, agents or employees be held liable for any part of these offers. 16. All disputes shall be governed by the laws of India. These Terms shall be governed by exclusive laws of India and the courts located at New Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Offer.
