1 D E C I S I O N establishing the requirements with regard to energy labelling and efficiency for placing on the market of household electric ovens On the basis of art. 108 of Romanian Constitution, republished, The Government of Romania has adopted this decision. Art. 1. (1) This decision establishes the requirements relating to energy labelling and efficiency for placing on the market of independent household electric ovens, as well as those being part of larger appliances, called ovens hereafter. (2) This decision shall apply to ovens, including the situation when they are marketed for uses other than household ones. Art. 2. (1) This decision shall not apply to: a) ovens that can also use other energy sources; b) ovens which do not fall within the scope of the harmonized standards referred to in art. 5 par. (2); c) portable ovens having a mass of less than 18 kg, provided they are not designed for built-in installations. (2) The energy consumption of the steam functions, other than the hot steam function, are not covered by this decision. Art. 3. (1) Where ovens which are subject to distance selling contract, signed in accordance with the law, respectively those offered for sale, hire or hire purchase by way of a printed or written communication or by other means whereby the potential customer cannot be expected to see the appliance displayed, such as a written offer, a mail order catalogue, advertisements on the Internet or other electronic media, that communication shall include all the information specified in annex no 1. (2) The requirements / provisions of par. (1) shall also apply in respect of offers for built-in ovens for integrated kitchens. (3) The information provided for in par. (1) shall be made available to the potential buyer prior to the oven s purchase. Art. 4. For the purpose of this decision, the terms and expressions below have the following meanings: a) supplier means the manufacturer or his authorized representative established in Romania or in a member state of the European Union or the person who places the oven on the market; b) dealer means a retailer who sells en détail or other person who sells, hires, offers for hirepurchase or displays ovens to end users; c) fiche / information sheet is a standard table of technical information relating to the oven in question; d) other essential resources means water, chemicals or any other substance consumed by an oven in normal use; e) supplementary information means other information concerning the operation / performance of an oven, which relates to, or is helpful in evaluating, its use of energy or other essential resources. Art. 5. (1) Only ovens conforming to / complying with the following requirements collectively shall be admitted for the placing on the market: a) have attached to oven s door, in a visible position, without the possibility of obscuring it, a label covering information relating to the consumption of (electrical) energy and other essential resources, as well as supplementary information in accordance with the provisions

2 specified in annex no 2; for multi-cavity ovens, each cavity shall have its own label, except a cavity which does not fall within the scope of the standards referred to in par. (2); b) The content and format of the fiche shall be as specified in annex no 3. (2) The information required by this decision shall be obtained by means of measurements made in accordance with harmonized European standards, the reference numbers of which have been published in the Official Journal of the European Communities, adopted as Romanian standards or as national standards of the European Union for which the reference numbers are published. (3) The Romanian standards which adopt the harmonized European standards listed in par. (2) shall be approved and updated periodically by an order of the minister of economy and commerce and shall be published in the Official Journal of Romania, Part I. (4) Information relating to the noise level provided for in annexes 1-3 shall be made public in accordance with the provisions of art. 3 of Government Decision no 482/2004 establishing the conditions for the placing on the market of electrical household appliances in respect of the airborne noise level. The noise level is measured in accordance with the provisions of Government Decision no 482/2004. (5) The energy efficiency class of each cavity of an oven shall be determined in accordance with the provisions of annex no 4. (6) The provisions of par. (1) shall not apply to small indication / directions / index / instruction / mark / signal plates or their equivalent, fixed on the ovens for user s safety purposes. (7) Equivalents in Community languages of the terms to be used on the label and on the fiche are set out in annex no 5. Art. 6. The following are exempted from the provisions of art. 5 par. (1): a) ovens whose production ended before the date of entry into force of this decision; b) second-hand ovens. Art. 7. (1) The supplier is responsible for supplying the label and fiche and for the accuracy of the information written on them. (2) The supplier s consent for the information written on the label or in the fiche to be published is presumed / presupposed / anticipated / foreseen. (3) The obligation of applying the label lies with the dealer. The supplier has the obligation to send the dealer, free of charge, the necessary labels. For this, the choice of the delivery system of the labels belongs to the supplier. However, in case the dealer requires the labels to be sent to him, the suppliers must ensure their immediate delivery. (4) The information written on the label are in Romanian, with the possibility of supplying them in an international public / widely spoken language too. (5) The application of other labels, marks, symbols, letters / inscriptions relating to energy consumption, which do not correspond to the requirements of this decision, if it has the potential to cause an error to arise / occur or confusion, with the exception of Community or national ecological labels. Art. 8. (1) The supplier shall draw out the technical documentation establishing the ovens conformity with the requirements of this decision and enabling the accuracy of the information contained in the label and the fiche to be assessed. (2) The documentation referred to in par. (1) shall include: a) the name and address of the supplier; b) a general description of the model, sufficient for it to be unequivocally and easily identified; c) information, including drawings as relevant, on the main design features of the model and in particular items which appreciably affect its energy consumption; d) reports of relevant measurement tests carried out under the test procedures of the harmonised standards referred to in art. 2 par. (2); e) operating instructions.

3 (3) The supplier shall keep the documentation referred to in par. (1) for 5 years from the date of manufacturing of the last oven in that specific manufacturing series. (4) The supplier shall present the specially authorized control bodies the documentation provided for in par. (1) for examination. Art. 9. Placing on the market ovens which are not in conformity with this decision may not be prohibited or restricted. Art. 10. (1) The control bodies especially authorized shall deem the labels to fall in conformity with the provisions of this decision where no elements to prove the contrary are available. (2) Especially authorized control bodies may require the suppliers to furnish them the documents relating to the exact information included in the label or in the fiche only if there are reasons to think they are inaccurate / incorrect. Art. 11. (1) The following deeds are deemed to be contraventions: a) non-compliance with the provisions of art. 5 par. (1) and of art. 7 par. (1); b) non-compliance with the provisions of art. 5 par. (2); c) non-compliance with the provisions of art. 7 par. (3) and (5); d) non-compliance with the provisions of art. 8. (2) The contraventions referred to in par. (1) shall be sanctioned as follows: a) with a fine of 200 lei (RON) to 2,000 lei (RON), those provided for in a); b) with a fine of 300 lei (RON) to 1,000 lei (RON), those provided for in b); c) with a fine of 500 lei (RON) to 3,000 lei (RON), those provided for in c); d) with a fine of 800 lei (RON) to lei (RON), those provided for in d). (3) Establishing contraventions and applying sanctions shall be done by especially designated staff within the Romanian Agency for Energy Conservation. Art. 12. Dispositions relating to the contraventions provided for in art. 11 shall be completed by the provisions of Government Ordinance no 2/2001 relating to the legal regimen of contraventions, approved as amended and completed by Law no 180/2002, as amended and completed. Art. 13. Annexes no 1-5 are part of this decision. Art. 14. This decision shall enter into force on the 30th day following its publication in the Official Journal of Romania, Part I. Art. 15. On the date of entry into force of this decision, Government Decision no 1,117/2002 establishing the requirements relating to energy labelling of electrical household appliances for their placing on the market, published in the Official Journal of Romania, Part I, no 785 of 29 October 2002, shall be repealed. Art. 16. This decision transposes European Commission Directive 2002/40/EC implementing European Union Council Directive 1992/75/EEC on energy labeling of electrical household ovens, published in the Official Journal of the European Communities (OJec) no L 128 of 15 May 2002 (pages ). 4 ANNEX No 1 I N F O R M A T I O N covered by the distance selling contract Mail order catalogues, communications, written offers, advertisements on the Internet or on other electronic media referred to in art. 3 par. (1) of the decision, including offers for built-in ovens for integrated kitchens, shall contain the following information, given in the order specified: 1. supplier's trade mark and model identifier (annex no 3 to the decision, points 1 and 2) 2. energy efficiency class (annex no 3 to this decision, point 3) 3. energy consumption (annex no 3 to this decision, point 5) 4. usable volume (annex no 3 to this decision, point 6) 5. size (annex no 3 to this decision, point 7) 6. noise (annex no 3 to this decision, point 9). Where other information contained in the fiche is provided, it shall be in the form defined in annex no 3 to this decision and shall be included in the above table in the order required for the fiche. NB: The equivalent terms in other languages to those given above are set out in annex 5 to this decision.

6 Notes on the label / Label notes The following notes define the information to be included: I. supplier's name or trade mark; II. supplier's manufacturing model identifier; III. the energy efficiency class of the cavity(ies) of the model determined in accordance with annex no 4 to this decision. The head of the arrow containing the indicator letter shall be placed at the same level as the head of the relevant class arrow. The height of the arrow containing the indicator letter shall not be less than, and not more than twice, the height of the classes arrows. IV. Without prejudice to any requirements under the Community eco-label scheme, where a model has been granted a European Union eco-label under European Union Council Regulation No 1980/2000 of the European Parliament and of the Council on a revised Community eco-label award scheme, a copy of the eco-label may be added here; V. Energy consumption in kwh for the heating function(s) (conventional and/or the forced air convection) (of appliances) based on standard load determined in accordance with the test procedures of the harmonized standards referred to in art. 5 par. (2) of this decision; VI. Usable volume of the cavity in litres, determined in accordance with the harmonised standards referred to in art. 5 par. (2) of this decision. VII. The size of appliance determined as follows: - small: 12 l volume < 35 l - medium: 35 l volume < 65 l - large: 65 l volume. This indicator arrow shall be placed at the same level as the relevant size. VIII. Where applicable, noise measured during the function determining the energy efficiency, determined in accordance with the provisions of Government Decision no 482/2004, where necessary. NB: The equivalent terms in other languages to those given above are set out in annex no 5 to this decision. Printing The following defines certain aspects of the label: Colours used: CMYK cyan, magenta, yellow, black. Ex. 07X0: 0 % cyan, 70 % magenta, 100 % yellow, 0 % black. The background is white.

7 ANNEX No 3 FICHE The fiche shall contain the following information. The information may be given in the form of a table covering a number of models supplied by the same supplier, in which case it shall be given in the order specified, or given close to the description of the appliance: 1. supplier's trade mark; 2. supplier's manufacturing model identifier; 3. the energy efficiency class of the cavity(ies) of the model determined in accordance with annex no 4 to this decision. Expressed as Energy efficiency class on a scale of A (more efficient) to G (less efficient). Where this information is provided in a table this may be expressed by other means provided it is clear that the scale is from A (more efficient) to G (less efficient). The indication of the heating function in which the energy efficiency class is determined; 4. where the information is provided in a table, and where some of the appliances listed in the table have been granted a European Union eco-label under Regulation (EC) No 1980/2000 on a revised Community eco-label award scheme, this information may be included here. In this case the row heading shall state European Union eco-label, and the entry shall consist of a copy of the eco-label mark. This provision is without prejudice to any requirements under the Community eco-label scheme; 5. energy consumption in kwh for the heating function(s), (conventional and/or forced air convection and/or hot steam) (of appliances) based on standard load determined in accordance with the test procedures of the harmonized standards referred to in art. 5 par. (2) of this decision; 6. usable volume of the cavity in litres, determined in accordance with the harmonised standards referred to in art. 5 par. (2); 7. the type of oven / oven type determined as follows: - small volume: 12 l volume < 35 l; - medium volume: 35 l volume < 65 l; - large volume: 65 l volume. This indicator arrow shall be placed at the same level as the relevant size; 8. time taken to cook standard load determined in accordance with the test procedures of the harmonised standards referred to in art. 5 par. (2) of this decision; 9. where applicable, noise measured during the function determining the energy efficiency, determined in accordance with the provisions of Government Decision no 482/2004, where necessary 1) ; 10. the declaration of the power consumption when no heating function is performed and the oven is in the lowest power consuming mode as soon as a suitable harmonised standard for stand-by-losses becomes available; 11. the area of the largest baking sheet expressed in cm 2 and determined as surface area according to the harmonized standard referred to in art. 5 par. (2) of this decision. If a copy of the label, either in colour or black and white is included in the fiche, then only the further information needs to be added. NB: The equivalent terms in other languages to those given above are set out in annex no 5. (1) The relevant standards are EN (noise measurement) and EN (verification).
