2 WITH OPTIRCKET TECHNOLOGY LMT MERCER GROUP, INC. LIFETIME NON-PRORTED LIMITED WRRNTY WHT ND WHO IS COVERED FOR HOW LONG LMT (hereinafter Manufacturer ) warrants to the original homeowner/customer that its vinyl (PVC) products will be free from manufacturing defects - including peeling, flaking and corroding - when subject to normal and proper use. Should any defect occur the Manufacturer will repair or replace, at its option, the defective product. The Manufacturer also reserves the right to refund the amount paid by the original owner for the product (but not including the cost of its initial installation). In no event shall the Manufacturer be liable or responsible for labor charges or other expenses whatsoever in connection with removal or installation of either the original or replacement product. DESIGNER PRODUCTS Designer Products are warranted for 20 years and same limitations and coverage as other Manufacturer products. LIMITTIONS This warranty does not provide protection against any failure, defect or damage caused by situations and events beyond normal exposure conditions, including but not limited to: Misuse, abuse, neglect or improper handling or storage; improper installation or installation not in strict adherence to the Manufacturer s written instructions; Use of accessories which do not properly receive and/or secure the Manufacturer s products; Impact of foreign objects, fire, earthquake, flood, lightning, hail, hurricane, tornado or other casualty or act of God; Movement, distortion, collapse or settling of the ground or structure on which the product is installed; ny other cause not involving manufacturing defects in the material supplied by the Manufacturer; Normal weathering is defined as exposure to sunlight and extremes of weather and atmosphere which will cause any colored surface to gradually fade, chalk, or accumulate dirt or stains. The severity of any condition depends on the geographical location of the product, the cleanliness of the air in the area, and many other influences over which the Manufacturer has no control. This warranty does not apply to product which has been painted, varnished or coated over the manufacturer s original finish. If the Manufacturer replaces any material under this warranty, it may substitute products designated by the Manufacturer to be of comparable quality or price range in the event the product initially installed has been discontinued or modified. TRNSFERILITY This warranty is not transferable. OTHER CONDITIONS THIS WRRNTY REPLCES LL OTHER ORL OR WRITTEN WRRNTIES, LIILITIES, OR OLIGTIONS OF THE MNUFCTURER. THE MNUFCTURER DOES NOT UTHORIZE ITS DISTRIUTORS OR DELERS TO MKE NY CHNGE OR MODIFICTION TO THIS WRRNTY. 3 WITH OPTIRCKET TECHNOLOGY WHT THE CUSTOMER MUST DO The homeowner/customer upon identifying any manufacturing defect must promptly notify the Manufacturer in writing and provide proof of the date of purchase. ll notifications should be sent to: LMT Mercer Group, Inc. 690 Puritan venue Lawrenceville, NJ ttn: Consumer Services Department The consumer may be required to submit a sample of the defective material to the Manufacturer for analysis. The Manufacturer upon confirming that a defect exists and that said defect is covered by this warranty will within a reasonable amount of time repair or provide replacement for the defective material. The Manufacturer reserves the right to refund the amount paid by the original owner for the defective material, and accessories, per the terms of this warranty. 4 WITH OPTIRCKET TECHNOLOGY CHELSE UILDING PRODUCTS CELLULR PVC PROFILES WRRNTY WRRNTY COVERGE Chelsea uilding Products (hereinafter Manufacturer ) warrants that their cellular PVC profiles will be free from manufacturing defects that cause the product to splinter, blister, decay, rot, corrode or excessively swell from moisture for a period of 25 years. The Manufacturer s cellular PVC profiles are produced using the finest, exterior grade weatherable material. The product does not require painting. In the event that the product is painted, this warranty does not cover products painted in dark colors that fall within the lightness (L) value of 56 to 0, where 100 is white and 0 is black. This warranty does not cover the performance, nor application, of any coating. COVERGE EXCLUSIONS ND LIMITTIONS The Manufacturer shall not be liable for, and this warranty does not apply to, any failure, defects or damage resulting from or in connection with misuse, neglect or improper storage, improper application or application not in adherence to normal industry standards. In addition, the Manufacturer shall not be liable for damage incurred from impact of foreign objects, fire, hurricane, tornado or other violent storms or casualty or act of God, defects or failure to install property, shifting of product or structure after installed, exposure to harmful chemicals, airborne stains, mildew or pollutants. This warranty does not cover painted finishes or coating applied the product by the original purchaser or any third party. Failure to adhere to manufacturer s recommended guidelines for application or painted surfaces may void this warranty. REMEDIES This warranty applies to products produced by the Manufacturer and sold to its customer for its intended use. ny claim or remedies, if the product is believed to be defective under the terms of this warranty, are between the Manufacturer and its original customer. If the product is believed to be defective, the customer shall notify the Manufacturer promptly, in writing, including the date the product was produced, the location of the defective material and a description of the defect. If the material is determined to be defective due to the manufacturing of the product, the Manufacturer will, at its option, replace or issue credit for the defective material. (hereinafter Manufacturer ) warrants to the purchaser that its Westbury luminum Products (hereinafter Product ) are free of defects in workmanship and materials and that, in the course of normal and proper use, its Products will not crack, peel, blister, flake, rust, nor be subject to abnormal weathering per M 2604 Specifications. THE WRRNTY COVERS: ny defect in materials and workmanship. Nonliving entities shall include but not be limited to governments, municipalities, corporations, and commercial operations. ll nonliving entities shall receive a 30-year limited warranty from the date of purchase. WRRNTY CLIM PROCESS: Contact the dealer or distributor who sold or installed the Products, or write Digger Specialties, Inc., P.O. ox 241, remen, Indiana 46506, or call Digger Specialties, Inc. at within 30 days of discovering of the claimed defect. If the Products are found to be defective and covered by this warranty.
