1 CITY OF WILMINGTON TREE COMMISSION AND MAYOR S OFFICE REQUEST FOR PROPOSALS FOR TREE AND STUMP REMOVAL BID SUBMISSION DEADLINE: WED., OCTOBER 26 at 12:00 Noon The Wilmington Tree Commission (the WTC), with assistance from ODNR, Division of Forestry, has conducted an inventory of public street trees and public park trees in the City of Wilmington. The WTC has determined the condition of the trees listed in Exhibit A to be in decline and recommends their removal. Trees listed in Group 1 are standing dead or considered high priority for removal; trees listed in Group 2 are considered medium priority. The City of Wilmington is hereby requesting proposals from qualifed businesses for bids for 1) labor and materials for the removal and stump grinding for trees in Group 1 and for 2) labor and materials for the removal and stump grinding for trees in both Group 1 and Group 2. For identification purposes, the Wilmington Tree Commission will visibly mark Group 1 trees listed in Exhibit A with a dot of red paint at the root collar, and Group 2 trees listed in Exhibit A with a dot of blue paint at the root collar. The marking of the trees will occur by 8 a.m. on Monday, October 3, Contractor will provide all labor, supervision, equipment, materials and expertise required to perform tree removal in the City of Wilmington as specified. The work shall be performed by a company which derives the majority of its annual income from arboricultural work, and whose employees are highly trained and skilled in all phases of tree removal. Work performance history and references may be required. Project Address: VARIOUS SEE EXHIBIT A FOR LOCATION OF TREES TO BE REMOVED. Work to be performed on trees in Exhibit A: 1. Cut tree down, 2. Remove tree trunk, branches and debris from the public rights-of-way and city park land, 3. Grind stump to a minimum depth of twelve inches beneath the soil surface and holes refilled with existing soil and wood chips, 4. All ash trees included in this contract must be inspected by crew foreman for Emerald Ash Borer (EAB) prior to chipping, grinding, slabbing, or moving any wood from said tree off-site. Crown of all ash trees must be inspected for D-shaped exit holes and bark splitting. Bark must also be removed with hammer and chisel, sharp knife, or drawknife to inspect for EAB galleries. If, in the event that exit holes, larvae, pupae, adults, or 1
2 galleries are found, crew foreman must contact the Chair of the Wilmington Tree Commission (Chris Hodgson at ) immediately. If tree appears to be positive for EAB, WTC Chair will then proceed by contacting the Ohio Department of Agriculture s EAB Division immediately. All work on ash species must cease until City Service Director authorizes that work continues. 5. Once removed from the work site, trees and debris become the sole property of the contractor and the City of Wilmington relinquishes any financial claim to the wood products derived from the sale or deposal of the public trees. The salvage value of said wood and tree debris should be considered in making any bid pursuant to this RFP. Clean-Up: The work site shall be left as clean as or cleaner than its pre-work condition. Tree limbs and other parts dropped or lowered from the tree shall be kept off private property. Cleanup shall be completed within twenty-four (24) hours after debris has been placed around the site of each tree requiring removal. All lawn areas shall be raked, and all paved areas shall be swept. Work period: The NOTICE TO PROCEED will be issued by approximately November 1, 2011 and be completed by March 31, 2012, exclusive of inclement weather. Working hours shall be between 7:00 a.m. and 6:00 p.m. Monday through Saturday, excluding state and federal holidays. Licenses and Permits; OSHA compliance: Bidder shall comply with all applicable federal, state, and local ordinances, regulations, licenses and permits necessary to perform work under this contract. All work shall conform to all components of OSHA , Logging Operations: Occupational Safety and Health Standards and the latest revision of the latest revision of the ANSI Z133.1, Pruning, Repairing, Maintaining, and Removing Trees and Cutting Brush Safety Requirements. Damage to residual trees and property: Contractor shall use care in tree removal to avoid damaging trunks, roots and large branches of residual trees. If major damage occurs to residual trees, it will be the financial responsibility of the contractor to hire or consult with a certified arborist to remedy the damage by following the ANSI A-300 Part 6, Tree Care Standards. Any and all damages done by the contractor to any person or property, public or private, shall be the total responsibility of the Contractor, and shall be repaired or compensated for by the Contractor at no cost to the City, and to the satisfaction of the injured party and the City. All damages and injuries shall be reported to the City within twenty-four (24) hours of occurrence. Damage to utility lines: The successful bidder/contractor is responsible for contacting utility agencies any time assistance is needed to work safely around overhead or underground installations. It is the Contractor s responsibility to contact the Ohio Utility Protection Service (OUPS) for their assistance in locating all underground or non-visible utilities prior to beginning work. Price: Proposals should include the total cost for the proposed work, including labor and 2
3 materials. Any taxes charged should be indicated as a separate item. The City of Wilmington is a tax-exempt entity. The City can provide its tax-exempt ID number. Subcontractors: Subcontracting of work under this contract shall not be allowed without prior consent of the City. All subcontractors permitted to perform any work under this contract shall be bound by all conditions and specifications contained herein. GENERAL CONDITIONS MINIMUM WAGE DETERMINATION The work requested pursuant to this RFP is not subject to Ohio s Prevailing Wage laws unless bids come in over the threshold. Michelle Horner is the Prevailing Wage Coordinator for this job and questions should be directed to her at INSURANCE. FOR THE DURATION OF THE CONTRACT, THE CONTRACTOR IS REQUIRED TO PROCURE AND MAINTAIN INSURANCE AGAINST CLAIMS FOR INJURIES TO PERSONS OR DAMAGES TO PROPERTY WHICH MAY ARISE. INSURANCE IS RECOMMENDED TO BE PLACED WITH INSURERS WHO HAVE AN AM BEST RATING OF A- OR BETTER. INCLUDE A CERTIFICATE OF COVERAGE OR INSURANCE SHOWING COMMERCIAL GENERAL LIABILITY COVERAGE FOR THE WORK TO BE PERFORMED AND THE POLICY LIMIT AMOUNTS. $1,000,000 PER OCCURRENCE FOR BODILY INJURY, PERSONAL INJURY AND PROPERTY DAMAGE. THE MINIMUM GENERAL AGGREGATE AMOUNT SHALL BE 1,000,000. CONTRACTOR SHALL INCLUDE ALL SUBCONTRACTORS AS INSURED UNDER ITS POLICIES OR SHALL FURNISH SEPARATE CERTIFICATES AND ENDORSEMENTS FOR EACH SUBCONTRACTOR. ALL COVERAGES FOR SUBCONTRACTORS SHALL BE SUBJECT TO ALL REQUIREMENTS STATED HEREIN. CONTRACTOR SHALL AT ALL TIMES DURING THE DURATION OF THE CONTRACT MAINTAIN AUTOMOBILE LIABILITY INSURANCE WITH A LIABILITY LIMITS OF AT LEAST $500,000 PER ACCIDENT FOR BODILY INJURY AND PROPERTY DAMAGE. THE CONTRACT FOR THIS PROJECT SHALL CONTAIN AN ACCEPTABLE HOLD HARMLESS AGREEMENT THAT TO THE FULLEST EXTENT PERMITTED BY LAW, THE CONTRACTOR AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE CITY, ITS OFFICIALS, AGENTS, EMPLOYEES AND VOLUNTEERS. THE CITY OF WILMINGTON WILL PROVIDE ADDITIONAL INSURED LANGUAGE TO BE INCLUDED ON THE CERTIFICATE OF COVERAGE. COVERAGES DESCRIBED ABOVE SHALL CONTAIN A 30 DAY WRITTEN NOTICE OF CANCELLATION, NON-RENEWABLE AND/OR MATERIAL CHANGES ADDRESSED TO THE CITY. 3
4 WORKER S COMPENSATION CERTIFICATE. THE BIDDER SHALL INCLUDE A COPY OF ITS WORKER S COMPENSATION CERTIFICATE PRIOR TO THE WORK COMMENCING. A CURRENT CERTIFICATE SHALL BE KEPT ON FILE DURING THE DURATION OF THE CONTRACT. Ignorance of legislation as described will in no way excuse the Contractor from full compliance with all statues and regulations. Attention is directed to Section through of the Ohio Revised Code, State of Ohio, which provides for retention by the City of additional payments due the Contractor in the event the Contractor fails to pay legal labor, materials and equipment bills out of moneys previously received from the City, Claims against the Contractor must be properly authenticated and supported by the claimant before the City can take action. INSPECTION The City reserves the right to perform inspection upon all levels of work performed by the Contractor. The Service Director or his designated representative will inspect all work on a continuing daily basis, and shall not be restricted from any area of work. Should differences of opinion occur between the Service Director or designated representative and the Contractor, the City reserves the right to stop progress until a satisfactory solution has been reached. The Contractor shall upon request of the City and/or their designated representative make available any and all information pertinent to the job. SAFETY COMPLIANCE It shall be the sole responsibility of the Contractor to keep and maintain the work site and public right of way areas impacted by the work in a safe and orderly manner. The Contractor shall at his expense provide for such safety equipment as is needed for compliance with existing Occupational Safety and Health Act (OSHA). Penalties for violations of the safety act shall be the full responsibility of the Contractor. The City Streets Department will assist with maintaining public safety on impacted public areas and right-of-ways. Contractor is responsible for notifying the City when public areas and right-of-ways will be obstructed or otherwise impacted by the work. Traffic Control: Traffic control shall be the total responsibility of the Contractor, and shall be coordinated with the Mayor/agent. The Contractor shall be solely responsible for pedestrian and vehicular safety and control within the worksite, and shall provide all necessary warning devices, barricades, and ground personnel needed to give safety, protection, and warning to all persons and vehicles in the work area. Blocking of public streets shall not be permitted without 4
5 consent of the Mayor/agent. Traffic control shall be accomplished in conformance with applicable state, county and City codes. LAWS TO BE OBSERVED Contract provisions required in public contracts by applicable Federal, State and Local Laws, Ordinances, Orders or Regulations, are adopted herein by reference and shall be as fully effective as if rewritten herein. NON-DISCRIMINATION. The Contractor agrees that in hiring of employees for the performance of work under this Contract or any subcontract hereunder, no Contractor or subcontractor shall, be reason of race, creed or color, discriminate against Citizens of the United States in the employment of labor or workers, who are qualified and available to perform the work to which the employment relates. INDEMNIFICATION AND HOLD HARMLESS Bidders must agree to the following indemnification and hold harmless clause: Contractor agrees to indemnify and hold harmless the City of Wilmington, Ohio, its officials, employees and agents, from any and all liability or obligation caused by or resulting by reason of the performance or non-performance of any of the obligations, responsibilities, or duties on the part of the Contractor to be performed or assumed pursuant to this agreement except as is caused or results by reason of the intentional acts of neglect of said City, its officials, employees or agents. It is the contractor s responsibility to inspect public trees for embedded metal and concrete and not hold the City responsible for equipment damage from such foreign objects. CITY INCOME TAX: The City of Wilmington levies an income tax. It is suggested that all bidders contact the Income Tax Personnel, at the Municipal Building, 69 N. South Street, Wilmington, Ohio for information. THE CITY RESERVES THE RIGHT to reject any and all bids if the City is not able to move forward due to funding issues, administrative constraints or other legal reason. *************** PROPOSALS SHOULD BE SUBMITTED BY WEDNESDAY, OCTOBER 26, at 12:00 Noon in the Mayor s Office, 2 nd Floor, 69 N. South Street, City of Wilmington, Ohio. The Bids shall be good for at least 30 days. The successful bidder should expect to enter into a contract for the work between October 28 and Nov. 1, DEADLINE FOR WORK TO BE PERFORMED. Work performed under the contract must be finished by March 31,
