3 I. Introduction A. The Annual Report Period 1. This is the eighth Annual Report 1 of the Board Compliance Review Committee (BCRC), a committee of the Board of Directors (Board) of the Asian Development Bank (ADB). It covers the period from 1 January 2011 to 31 December B. Compliance Review Phase of the ADB Accountability Mechanism 2. On 29 May 2003, the Board approved the ADB Accountability Mechanism 2 (the Mechanism) and it became effective on 12 December Under the Compliance Review Phase of the Mechanism, the BCRC has the following specific functions: (i) to clear the proposed terms of reference (TOR) and the time frame for the Compliance Review Panel (CRP) to conduct a compliance review authorized by the Board; and (ii) to review the draft reports prepared by the CRP to monitor the implementation of any remedial actions approved by the Board as a result of a compliance review. The BCRC conducts business pursuant to the Operational Procedures of the Board Compliance Review Committee dated 29 March The Secretary of the CRP also performs the functions as the Secretary of the BCRC and the Office of the Compliance Review Panel (OCRP) provides secretariat support to the BCRC, including (i) assisting the BCRC in carrying out its activities; and (ii) administering the yearly operating expenses of the BCRC, if any. C. Members 4. The BCRC consists of six Board members comprising four regional and two nonregional members. The President appoints the BCRC members, in consultation with the Board, and designates the BCRC Chair. 4 2 II. Activities of the Board Compliance Review Committee A. Meetings 5. The BCRC met on one occasion during the period covered by this report. A meeting on 22 February 2011 discussed the forthcoming fifth and final monitoring mission for the Southern Transport Development Project and the proposal to focus on identified lessons in a separate study. It was agreed that such a study should not duplicate the work of IED or that of the Accountability Mechanism Review. B. SRI: Southern Transport Development Project 6. The BCRC cleared the fifth and final annual monitoring report on 3 August 2011 and it was circulated to the Board on 4 August C. PHI: Visayas Base-Load Power Development Project 7. Following the BCRC s approval of the terms of reference for conducting a compliance review of this project on 28 July 2011, the CRP initiated the investigation for this project and is expected to circulate the final draft report to Management in early The investigation is examining ADB s compliance with relevant policies and procedures including those for environment and energy. D. KGZ: CAREC Transport Corridor 1 (Bishkek-Torugart Road) Project 1 8. Following the BCRC s approval of the terms of reference for conducting a compliance review of this project on 22 August 2011, the CRP initiated the investigation for this project with anticipated circulation to Management of the final draft report in early The investigation is examining ADB s compliance with relevant policies and procedures including those for resettlement. III. Budget 9. The Board did not allocate any budget to cover BCRC's operating expenses in the period covered by this report. The BCRC did not incur any expenses in the period covered by this report. IV. Looking Forward A. Terms of Reference 10. 5 3 B. Review of the Accountability Mechanism 11. The Chair, BCRC, also serves as the Chair of the joint Board/Management working group on the review of the Accountability Mechanism. With the expected conclusion of the review and the production of an R-Paper in early 2012, it is possible that the roles and responsibilities of the BCRC will change. As such, the BCRC may need to meet in 2012 to discuss specifically any final recommendations approved by the Board following that review, to the extent that they may affect the BCRC.
