2 1. Introduction The Privacy Act, which took effect on July 1, 1983, extends to individuals the right of access to information about themselves held by the government, subject to specific and limited exceptions. This Act also protects individuals' privacy by preventing others from having access to their personal information and gives individuals substantial control over its collection, use and disclosure. Section 72 of the Privacy Act requires that the head of every government institution prepare for submission to Parliament an annual report on the administration of the Act within the institution during each financial year. This report describes how PPP Canada administered its responsibilities under the Privacy Act in fiscal year and is to be referred to the Standing Committee on Access to Information, Privacy and Ethics. 2. Structure a.) About PPP Canada Inc. On February 28, 2008, PPP Canada was incorporated pursuant to the Canada Business Corporations Act. On May 8, 2008, the Governor-in-Council declared PPP Canada as a Parent Crown corporation for the purposes of Part X, (except section 90) of the Financial Administration Act, reporting to Parliament through the Minister of Finance. PPP Canada is the federal government s Public-Private Partnerships (P3) office. As a Crown corporation, PPP Canada will work with the public and the private sectors to encourage and to enhance the depth of knowledge throughout all jurisdictions regarding Canada s P3 market and the opportunities therein. PPP Canada became operational in February 2009 with the appointments of a Chair of the Board of Directors and a Chief Executive Officer. PPP Canada will manage and invest the Government of Canada s $1.25 billion P3 Canada Fund, a unique infrastructure program designed to invest in P3s using a range of innovative financing arrangements, will advise the Government of Canada on the execution of P3 projects, and will assess P3 options for major projects seeking funding from federal infrastructure programs. Our Mandate PPP Canada s mandate is to improve the delivery of public infrastructure by achieving better value, timeliness and accountability to taxpayers, through P3s. Most recently, in the Budget Implementation Act 2012, PPP Canada was endowed with Partial Agent Status, relevant to the Federal Business Line. PPP Canada has six corporate objects, as outlined in its Articles of Incorporation: 1. Assess Public-Private Partnerships opportunities at the federal level in accordance with criteria established by the Treasury Board; 2

Assess the suitability of Public-Private Partnership projects seeking funding from federal infrastructure programs in accordance with criteria established by or pursuant to Treasury Board authorities; 3. Advise on the execution of Public-Private Partnership projects at the federal level; 4. Manage the Public-Private Partnerships Funds (P3 Canada Fund) in accordance with the policies and authorities established by the Treasury Board; 5. Negotiate, sign and administer agreements to be funded through the P3 Canada Fund in accordance with the policies and authorities established by the Treasury Board; and, 6. Act as a source of expertise and advice on Public-Private Partnership matters. PPP Canada acts as a leading source on P3 matters through knowledge development and sharing. In addition, the Corporation provides expertise and advice in assessing and executing P3 opportunities at the federal level as well as leveraging greater value for money from federal investments in provincial, territorial, municipal and First Nations infrastructure through the P3 Canada Fund. In its fifth year of operation, PPP Canada will continue to grow its P3 market development program and service offerings. The Corporation will support the Government of Canada on the implementation of the P3 Program Screen announced in Budget 2013 as well as continuing to support the Federal P3 Screen announced in Budget Round Five of the P3 Canada Fund was launched on April 15, 2013 and will build on the successes of previous Rounds. b.) Organizational Structure The administration of the Access to Information Act and the Privacy Act is the responsibility of the Access to Information and Privacy Coordinator, which, due to the size of the Corporation (under 50 employees), is a function assumed by the Chief Executive Officer (CEO), coordinated by the Vice President of Strategy and Organizational Development, who is a member of the Corporation s executive committee. One administrative person supports the CEO and Vice President in this function. The CEO, on the advice of the Vice President of Strategy and Organizational Development, ensures compliance by the Corporation with the legislative obligations under these Acts by processing requests for information and coordinating all activities relating to the legislation and the relevant regulations, directives and guidelines. The CEO ensures that PPP Canada meets its legislative obligations in replying to requests with support from a network of executives from each of the Corporation s five business units. 3
4 3. Delegation Order Pursuant to Section 2 of the Access to Information Act, the Chief Executive Officer of the Corporation is designated as Head of the institution. Presently there has been no Delegation Order in accordance with Section 3 of the Access to Information Act; as such the Chief Executive Officer is responsible for administering the Access to Information Act. 4. Statistical Report In fiscal year , PPP Canada did not process any requests under the Privacy Act. The statistical report is attached for your information and has been forwarded to the Treasury Board of Canada. 5. Education and Training No formal training activities were undertaken during the reporting period. 6. Policy, Guidelines and Procedures Our institution did not implement any new and/or revised Privacy Act policies, guidelines or procedures during the reporting period. 7. Complaints and Investigations No complaints and/or investigations were received by our institution during the reporting period. 8. PIA (Privacy Impact Assessment) Our institution did not complete any PIAs during the reporting period. 9. Disclosure of Personal Information pursuant to paragraph 8(2) (m). During the reporting period, PPP Canada did not disclose any personal information pursuant to subsections 8(2) (m) of the Privacy Act. APPENDIX A 4
5 Additional Reporting Requirements Privacy Act Treasury Board Secretariat is monitoring compliance with the Privacy Impact Assessment (PIA) Policy (which came into effect on May 2, 2002) and the Directive on Privacy Impact Assessment (which takes effect April 1, 2010) through a variety of means. Institutions are therefore required to report the following information for this reporting period. Note that because some institutions are using the Core PIA as outlined in the Directive in advance of the implementation deadline, they will not have Preliminary PIAs to report.
