1 Legislation Passed July, 0 The Transportation Benefit District Governing Board, at its special meeting of July, 0, adopted the following resolutions /or ordinances. Amended Resolution No. TBD 00 A resolution transmitting a ballot measure to the Pierce County Auditor to be placed on the ballot for the General Election on Tuesday, November, 0, which reads: GOVERNING BOARD OF THE TACOMA TRANSPORTATION BENEFIT DISTRICT PROPOSITION NO. The Board of the City of Tacoma Transportation Benefit District adopted Resolution No. TBD 00 concerning a sales use tax to fund street improvements. If passed, Proposition No. would authorize a sales use tax of one tenth of one percent (0.00) to be collected from all taxable retail sales within the District in accordance with RCW..0 beginning in 0 for ten years for the purpose of funding maintenance, preservation improvement for residential streets, arterials, freight access, bike pedestrian mobility projects as identified in the City s Comprehensive Transportation Improvement Program. TBD BY REQUEST OF BOARD CHAIR STRICKLAND A RESOLUTION relating to the City of Tacoma Transportation Benefit District; providing for the submission of a proposition to the electors of the City of Tacoma Transportation Benefit District, at the General Election to be held on November, 0, asking voters to approve a measure for an additional /0th of percent sales tax over a period of ten years to fund maintenance for residential arterial streets, freight access bike pedestrian mobility; setting forth the ballot proposition; authorizing the transmission of a ballot title explanatory statement to the Pierce County Auditor s Office. WHEREAS RCW provide for the establishment of a transportation benefit district by cities counties to levy impose various taxes fees to generate revenue to support transportation improvements that benefit the district are consistent with state, regional, or local transportation plans, necessitated by existing or reasonably foreseeable congestion levels, WHEREAS Ordinance No. 0, passed on November 0, 0, codified under Chapter 0. of the Tacoma Municipal Code, established the City of Tacoma Transportation Benefit District ( District ) for the purpose of acquiring, constructing, improving, providing, funding transportation improvements within the district that are consistent with existing state, regional, local transportation plans necessitated by existing or reasonably foreseeable congestion levels, WHEREAS the City of Tacoma s Six-Year Transportation Improvement Program includes a City-wide residential street rehabilitation project, non-motorized TBD/Res00 (Res-0) amend.doc-cdb/bn --

3 transportation (bike pedestrian) arterial street projects, freight access 0 0 projects, WHEREAS the corporate boundaries of the District are contiguous with the corporate boundaries of the City of Tacoma, WHEREAS adequate dedicated funding to preserve maintain City streets within the District boundaries continues to be a significant challenge for the City of Tacoma the District, WHEREAS the Tacoma City Council Council-appointed task forces have consistently identified the issue of sustainable, dedicated funding for basic maintenance of City neighborhood streets road safety upgrades, pothole repairs, repaving of streets arterials, safety improvements at intersections, sidewalks, crosswalks near schools, bridge maintenance safety repairs as a top priority, WHEREAS RCW..00 authorizes the District to impose a sales use tax in an amount not to exceed /0th of percent of the selling price or value of the article used, to be used for the above-described purposes, WHEREAS the District Governing Board deems it necessary to submit to the qualified electors a proposal for an additional /0th of percent sales tax over a period of ten years, to generate an estimated $,000,000, for the sole purpose of maintaining the City s street network within the District, including residential street rehabilitation, non-motorized transportation (bike pedestrian) arterial street projects listed in the Six-Year Transportation Improvement Program, TBD/Res00 (Res-0)amend.doc-CDB/bn --

4 WHEREAS the Governing Board of the District authorizes the submission of a 0 0 proposition to the electors of the District at the General Election to be held on November, 0, asking voters to approve a measure for an additional /0th of percent sales tax over a period of ten years to fund maintenance for residential arterial streets, freight access bike pedestrian mobility, further authorizes the transmission of a ballot title explanatory statement to the Pierce County Auditor s office, WHEREAS transparency accountability of how funds are spent, the budgets of the projects, leverage of funds achieved demonstration of progress made are critical to delivering the improvements promised to voters, WHEREAS, to ensure transparency accountability, state law requires the District to issue an annual report, indicating the status of transportation improvement costs, transportation improvement expenditures, revenues, construction schedules, to the public to newspapers of record in the District, WHEREAS, in furtherance of transparency accountability of how the newly generated funds will be spent, it is the intent of the Transportation Benefit District to establish new separate funds to segregate the revenues collected as a result of this measure, to restrict the use of these funds for the purposes set forth in this measure; Now, Therefore, BE IT RESOLVED BY THE GOVERNING BOARD OF THE TACOMA TRANSPORTATION BENEFIT DISTRICT: TBD/Res00 (Res-0)amend.doc-CDB/bn --

That the Pierce County Auditor, as ex officio supervisor of 0 0 elections in Pierce County, Washington, is hereby requested to submit to the qualified electors of the District, for their approval or rejection at the General Election to be held on November, 0, a proposition authorizing an additional /0th of percent saless tax over a period of ten years to fund maintenance for residential arterial streets, freight access, bike pedestrian mobility in the District. Section. The Tacoma Transportationn Benefit District shall submit a proposition to the electorate of the City of Tacoma in the form substantially as follows: GOVERNING BOARD OF THE TACOMA TRANSPORTATION BENEFIT DISTRICT PROPOSITION NO. The Board of the City of Tacomaa Transportation Benefit District adopted Amended Resolutionn No. TBD 00 concerning a sales use tax to fund street improvements. If passed, Proposition No. would authorize a sales use tax of one tenth of one percent (0.00) to be collected from all taxable retail sales within the District in accordance with RCW..0 beginning in 0 for tenn years for the purpose of funding maintenance, preservationn improvement for residential streets, arterials, freight access, bike pedestrian mobility projects as identified in the City s Comprehensivee Transportation Improvement Program.
