F K: he applicant is requesting an after-the-fact epartment of the rmy permit authorization to clear, grade, excavate, place and maintain fill material for the construction of an approximate 56-lot residential subdivision (llis states), near enham prings, ouisiana, within ivingston Parish. he proposed development would include residential homesites, 4 detention ponds, utility and drainage infrastructure and appurtenances, green space areas, and ingress/egress. pproximately 46,58 cubic yards of native material would be excavated as a result of pond construction and placed as fill in jurisdictional areas during project construction. pproximately 0.66 acre of jurisdictional wetlands have been impacted prior to the applicant obtaining a epartment of the rmy permit. pproximately 4. acres of jurisdictional forested wetlands (including after-the-fact portion) would be directly impacted as a result of project implementation. pproximately.5 acres of jurisdictional ther

Individuals or parties may request an extension of time in which to comment on the proposed work by writing or ing the orps of ngineers Project Manager listed above. ny request must be specific and substantively supportive of the requested extension, and received by this office prior to the end of the initial comment period. he ection hief will review the request and the requestor will be promptly notified of the decision to grant or deny the request. If granted, the time extension will be continuous to the initial comment period and, inclusive of the initial comment period, will not exceed a total of calendar days. he application for this proposed project is on file with the ouisiana epartment of nvironmental Quality and may be examined during weekdays between 8:00 a.m. and 4: p.m. opies may be obtained upon payment of costs of reproduction. orps of ngineers Permit riteria he decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts of the proposed activity on the public interest. hat decision will reflect the national concern for both protection and utilization of important resources. he benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. ll factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. he U rmy orps of ngineers is soliciting comments from the public, federal, state, and local agencies and officials, Indian ribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. ny comments received will be considered by the U rmy orps of ngineers to determine whether to make, modify, condition, or deny a permit for this proposal. o make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and other public interest factors listed above. omments are used in the preparation of an nvironmental ssessment and/or an nvironmental Impact tatement pursuant to the ational nvironmental Policy ct. omments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.

Fish and ildlife ervice, cological ervices ffice, the orps has determined that the proposed activity would have no effect on any listed species. his notice initiates the ssential Fish abitat (F) consultation requirements of the Magnuson-tevens Fishery onservation and Management ct. he applicants proposal would result in the destruction or alteration of 0 acres of F utilized by various life stages of red drum and penaeid shrimp. ur initial determination is that the proposed action would not have a substantial adverse impact on F or federally managed fisheries in the Gulf of Mexico. ur final determination relative to project impacts and the need for mitigation measures is subject to review by and coordination with the ational Marine Fisheries ervice.
