1 Oregon VOTING RECORD YOUR S VOTING RECORD ON SMALL BUSINESS ISSUES 2018 EDITION The voting record is only one measure of a legislator s performance. A vote tally does not indicate which legislators represented small business interests in committee or behind the scenes. However, the record does indicate their positions when asked to vote on key issues on the floor of the House or Senate. Please thank those legislators who supported legislation important to small business. 1. HEALTH INSURANCE PREMIUM TAX (HB 2391). Imposes a 1.5 percent assessment on commercial health insurance premiums and premium equivalents for managed care organizations and Public Employees Benefit Board health benefit plans. This is the health insurance tax upheld by Oregon voters with the passage of Ballot Measure 101 (2018). A No vote supports the NFIB position. Passed in the House Passed in the Senate Signed into law by the governor. 2. HEALTHCARE COST SHIFT (SB 1067). Modifies the methodology for reimbursement of hospital services and supplies provided to enrollees in health benefit plans offered by Public Employees Benefit Board and Oregon Educators Benefit Board. The bill ties rates to a percentage of Medicare rates for most hospitals, shifting costs to the commercial health insurance market in the form of higher premiums. A No vote supports the NFIB position. Passed in the House Passed by the Senate Signed into law by the governor. 3. SMALL EMPLOYER GROUP HEALTH PLANS (SB 271). Modifies the definition of small employer for purposes of group health benefit plans as an employer with at least one employee, but not more than 50. The bill takes away state agencies authority to change the definition by rule. A Yes vote supports the NFIB position. Passed in the House Passed in the Senate Signed into law by the governor. 4. BUSINESS PERSONAL PROPERTY TAX REPORTING (HB 2573). Eliminates annual filing requirement for business personal property tax so long as the total value of which is less than $16,500 for the property tax year, indexed to inflation. The bill still allows, but does not require, county assessors to annually provide a notice to each taxpayer whose business personal property tax liability is under the threshold to attest that the value of the property remains under the threshold. A Yes vote supports the NFIB position. Passed in the House Passed in the Senate Signed into law by the governor. 5. PASS-THROUGH BUSINESS INCOME DEDUCTION DISCONNECT (SB 1528). Disconnects Oregon from the new 20 percent federal deduction on qualifying pass-through business income. The bill raises over $1 billion in revenue for the state over six years by denying Oregon small business owners the right to claim the deduction on their Oregon income tax filings. A No vote supports the NFIB position. Passed in the House Passed in the Senate Signed into law by the governor. 6. SMALL BUSINESS AGENCY RULEMAKING (HB 4052). Establishes a Small Business Rules Advisory Committee to serve as a standing advisory committee for agencies adopting new administrative rules and to review effectiveness of existing administrative rules. A Yes vote supports the NFIB position. Passed in the House Passed in the Senate Signed into law by the governor. 7. LIMITING CIVIL PENALTIES FOR FIRST-TIME PAPER- WORK ERRORS (SB 664). Prohibits state agencies from imposing civil penalties on a small business for a first violation of paperwork requirements if the violation does not pose an unreasonable risk of harm to either the employees of the business or to the general public, and if the business is otherwise in compliance with all other applicable laws. A Yes vote supports the NFIB position. Passed in the Senate In House Business & Labor Committee upon adjournment. 8. WAGE CLAIM DISCLOSURE (SB 279). Requires that a notice of nonpayment of wages or compensation (wage claim), from an employee to an employer,
2 includes a statement that if the payment of unpaid wages or compensation to the employee occurs within 12 days, the penalty may not exceed the actual amount of the unpaid wages or compensation owed to employee. A Yes vote supports the NFIB position. Passed in the Senate In House Rules Committee upon adjournment. 9. SMALL BUSINESS TAX INCREASE (HB 2060). Limits eligibility for the Oregon pass-through entity tax rates by increasing the employment requirement from one employee to 10 employees. The bill also limits eligibility to businesses operating in one of the following seven economic sectors: agriculture, mining, manufacturing, wholesale trade, transportation and warehousing, information, or accommodation and food services. Estimated tax increase on Oregon small businesses: $100 million per year. A No vote supports the NFIB position. Passed in the House At Senate president s desk upon adjournment. 10. WAGE CLAIM LIABILITY (HB 4154). Makes a contractor liable for the unpaid wages, including other benefits, of the employee of a subcontractor after the employee files wage claim and the Bureau of Labor and Industries determines that the claim is valid but cannot be enforced against the subcontractor. A No vote supports the NFIB position. Passed in the House In Senate Rules Committee upon adjournment.
