This Price List specifies the descriptions, rates and regulations for the provision of interstate communications services by the Issuing Carriers between one or more stations in different states on the mainland United States, including the District of Columbia, Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam and the Commonwealth of the Northern Mariana Islands (CNMI). This Price List is provided in accordance with The Policy and Rules Concerning the Interstate, Interexchange Marketplace, Implementation of Section 245(g) of the Communications Act of 1934, CC Docket 96-61, Second Report and Order, 11 FCC Rcd (1996).

8 Original Page 7 ABBREVIATIONS ANI ICB IBL Automatic Number Identification. The codes transmitted between carriers that indicate the telephone number of the originating line. Individual Case Basis. Each installation is individually priced and negotiated with the Customer. Integrated Business Line LATA Local Access and Transport Area. A geographic area established by the US District Court for the District of Columbia in Civil Action No , within which a Local Exchange Company provides communications services. LEC Local Exchange Company.

9 Original Page 8 SECTION 1 - DEFINITIONS The following definitions are applicable to this Price List: Access Code - Denotes a uniform code assigned by the Company to an individual Customer. Access Line - An arrangement which connects the Customer's location to a tw telecom switching center or point of presence. Account - The Customer who has agreed, verbally or by signature, to honor the terms of service established by the Company. An account may have more than one access code billed to the same Customer address. Answer Supervision - The transmission of the switch trunk equipment supervisory signal (off-hook or on-hook) to the Customer's point of termination as an indication that the called party has answered or disconnected. Authorized User - A person, firm, corporation, or any other entity authorized by the Customer to communicate utilizing the Company s service. Business Line Termination - For use with inbound service only. Incoming calls are routed directly to the Customer's existing local exchange line. No dedicated access terminations are required. Call - A Customer attempt for which the complete address code is provided to the service end office. Commission - The Federal Communications Commission.

10 Original Page 9 SECTION 1 DEFINITIONS, (CONT D.) Company or Carrier - One or more of the Issuing Carriers otherwise clearly indicated by the context. Customer - The person, firm, corporation or other entity which orders, cancels, amends or uses service and is responsible for payment of charges and compliance with the Company's Terms and Conditions and Price List(s). See also Subscriber. Dedicated Access - See Special Access. Dedicated Long Distance - The direct dial service of the Company s digital network via a DS1 connection between the Company s switch and the carrier s nearest hub. End User - Any person, firm, corporation, partnership or other entity which uses the services of the Carrier under the provisions and regulations specified herein. The End User is responsible for payment unless the charges for the services utilized are accepted and paid by another Customer. Equal Access - The ability of the Carrier to serve End Users on a pre-subscribed basis rather than through the use of dial access codes. Integrated Business Line (IBL) - Service offered by the Company that allows the grouping of rate components to meet a Customer s business needs. Interstate - For the purposes of this Price List, the term Interstate applies to the regulatory jurisdiction of services used for communications between locations located in different states within the United States or between one or more locations in the United States and one or more international locations. LATA - Local Access and Transport Area. A geographic area established by the US District Court for the District of Columbia in Civil Action No , within which a local exchange company provides communications services. Message - A Message is a Call as defined above.

Special Access Origination/Termination - Where originating or terminating access between the Customer and the interexchange carrier is provided on dedicated circuits. The cost of these dedicated circuits is billed by the access provider directly to the Customer. Special Construction - Service configurations specifically designed and constructed at a Customer's request. Subscriber - The person, firm, Customer, corporation or other entity that arranges for the Carrier to provide, discontinue or rearrange telecommunications services on behalf of itself or others under the provisions of the Company s Terms and Conditions and applicable Price List(s). Switched Access Origination/Termination - Where originating or terminating access between the Customer and the interexchange carrier is provided on local exchange company Feature Group circuits. The cost of switched Feature Group access is billed to the interexchange carrier. Switched Services - Services provided to Customers that utilize the Company s switching equipment or Access Service for the origination of interstate, interlata toll calls. Switchless Services - Services provided to Customers that utilize another carrier s switching equipment or Access Service for the origination of interstate, interlata toll calls. tw telecom Any Issuing Carrier of this Price List. United States - The contiguous United States, Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, Guam and the Commonwealth of the Northern Mariana Islands (CNMI). VersiPak Service offered by the Company that allows the grouping of rate components to meet a Customer s business needs.

12 Original Page Generally SECTION 2 APPLICATION OF PRICE LIST This Price List contains the service descriptions and rates for interstate communications service provided by the Company. Service is provided subject to the Company s Interstate Services Terms and Conditions. The Company s Interstate Services Terms and Conditions are available for inspection on the Company s Internet website at and at its usual places of business. Rates and charges are subject to change.

13 1 st Revised Page 12 Cancels Original Page InterLATA Calling Service Description SECTION 3 SERVICE DESCRIPTION AND RATES Effective: December 1, 2011 InterLATA Calling Service is an interlata long distance service and is billed at a minimum charge of $0.01 (one cent) per call. After the one cent minimum is met, usage is billed in 6 second increments. Partial increments are rounded up to the next full increment on a per call basis. Fractional cents will be rounded to the next higher cent. Service is available only in conjunction with the Customer s subscription to the Company s local exchange services at a minimum of one location. For those Customers, InterLATA Calling Service is available on a switchless basis or provisioned on a dedicated long distance facility. If the Customer discontinues services with the Company such that the only remaining service is switchless and/or dedicated long distance services, the Company reserves the right to discontinue those services upon providing the Customer a 30-day advance notice of disconnection. The Company may waive the local exchange service requirement for dedicated long distance facility on an individual case basis. Customers who purchase local exchange services in a minimum of one location may also purchase services at locations where they do not subscribe to the Company s local exchange services and/or subscribe to a dedicated on-net direct dial service over the Company s carrier s digital network utilizing a DS1 connection between the Company s switch and the carrier s nearest hub. To the extent facilities are available, services offered under this Price List are provided by the Company on an on-net basis. Unless otherwise noted, pricing for services offered under this Price List reflect the on-net price for such services. Where service is provided on an off-net basis, additional charges may apply. Timing of Calls Effective: July 23, 2012 Unless otherwise indicated in this Price List, long distance charges are based on actual usage. Chargeable time begins when a connection is established between the calling station and the called station. Chargeable time ends when either party hangs up thereby releasing the network connection. If the called station hangs up, but the calling station does not, chargeable time ends when the network connection is released by automatic timing equipment in the network. Chargeable time does not include time lost because of faults or defects in the connection. (T) The minimum call duration and rounding of calls for measurement and billing purposes is six seconds, except as otherwise specified in this Price List. The duration of each call will be rounded to the nearest higher increment for billing purposes. Fractional cents will be rounded to the next higher cent Terms of Service The rates for InterLATA Calling Service may be based on the Customer s estimated usage and established one (1) year, two (2) year, or three (3) year term contracts for the Company s business Customers. The rates are further segregated between switched and switchless type service. Switchless service may be offered in a package with other services or by itself at a rate or discount offered on a contractual basis. Rates will be offered to the Customer in writing and on a non-discriminatory basis. (T) Upon expiration of a term contract, the service term will automatically renew at the same terms and conditions for successive one (1) year terms unless either party notifies the other thirty (30) days prior to the expiration of the then current term that it wishes to terminate the service.

21 Original Page Calling Card Service Description SECTION 3 - SERVICE DESCRIPTION AND RATES, (CONT D.) Calling Card Service is offered to Customers for use when away from their established locations. The Company will issue to Customers Company Calling Cards which will allow Customers to place telephone calls and to re-originate calls, a feature which allows a Customer to place a new call without hanging-up and re-dialing the 8XX access number. Access to the service is gained by dialing a Company-designated toll free access number (i.e. 8XX-NXX-XXXX) and then entering a Company-provided personal identification number (PIN) and the called telephone number, including the area code. The Company, by written notice to the Customer, may discontinue service to a Company Calling Card PIN if that PIN has not been used for a period of 120 days Call Timing Calling Card Service is usage sensitive. Calls are billed in an initial eighteen second increment followed by six (6) second increments. The duration of each call will be rounded off to the nearest higher increment for billing purposes. Additional fractional cents will be rounded off to the nearest higher cent. Unless otherwise specified in this Price List, the duration of each call for bill purposes will be rounded off to the nearest higher increment.
