Permanent working copy (PWC): A publication that can be borrowed by NHL Stenden staff for a maximum period of one year. Reminder: An warning for late return of a borrowed publication Director of O&S: Director of Educational Logistics & Student Support of NHL Stenden University of Applied Sciences Article 2 Applicability These regulations apply to all users and all services and facilities of the NHL Stenden library. Article 3 Access to and use of library 1 The library is open to the public during its opening hours. NHL Stenden is authorised to deny access to the library to a person or group of persons if it sees reasons to do so. 2 All publications and all related facilities can be consulted or used by everyone, unless stipulated otherwise. 3 A user must follow the instructions given by or on behalf of NHL Stenden or library staff. 4 A user may not cause nuisance for other users and library staff.

2 Article 4 Borrowing: Borrowers 1 A person can borrow publications present in the library for that purpose using a valid NHL Stenden pass or, after registration with the library with a valid pass of HG, VHL, or Tresoar. 2 A person other than referred to in paragraph 1 of this article may borrow publications present in the library for that purpose after registration, using an NHL Stenden borrowing pass. The NHL Stenden borrowing pass can be obtained against cash payment of 25 and presentation of a valid proof of identity and proof of address. The NHL Stenden borrowing pass will be valid for one year and remains the property of NHL Stenden. 3 Without prejudice to the provisions in paragraph 2, a person other than referred to in paragraph 1 of this article may, after registration and upon presentation of a valid proof of identity and proof of address, borrow the publications present in the library for that purpose against payment of 2.50 per publication. 4 Institutions may conclude a borrowing agreement with NHL Stenden on conditions yet to be determined. 5 Messages from the library sent to the address of a borrower as it is known to the library will be considered to have reached the borrower. 6 A borrower will immediately report loss or theft of their pass to the library in writing or electronically. Every use of a pass prior to this notification will be at the borrower's expense and risk. Article 5 Change of address 1 Students and employees of NHL Stenden are obliged to inform the student administration office as soon as possible of any change of address. 2 Other borrowers are obliged to report a change of address or address to the library as soon as possible, either in writing or electronically, upon presentation of valid proof of identity and address. 3 Any consequences of late notifications of changes of address will be at the person's own expense and risk. Article 6 Borrowing: Borrowing 1 Publications can be borrowed at the counter of the library or via the library self-service facility. 2 Publications with a yellow label can only be borrowed in: a. Leeuwarden; by students attending a Master s programme b. Meppel; by students of the ITEPS study programme. 3 Permanent working copies (PWC) can be borrowed by NHL Stenden staff. 4 Publications with a red label are intended for inspection and may not be borrowed. 5 Borrowed publications may not be made available to third parties. Article 7 Borrowing: Borrowing term 1 The library uses 4 different borrowing terms: a. Publications with a white label: Three weeks b. Publications with a purple label: One week c. Publications with a blue label: Return the same day d. A permanent working copy (PWC): Up to one year. 2 A borrower may borrow up to twelve publications at the same time. In deviation of this, NHL Stenden employees may borrow up to fifty publications at the same time. 3 A borrower may find out what the borrowing term is by means of at least the online catalogue.

3 4 One day before the end of the borrowing term, a borrower will receive an electronic message that the borrowing term ends the next day. Article 8 Borrowing: Returning 1 A borrower must return a publication to the library by the last day of the borrowing term at the latest and during opening hours of the library. Upon request, the borrower may be given a receipt for return of the publication. 2 Publications can be returned to the counter, by means of the self-service facility, or by sending it to the library by post, properly packaged and with sufficient postage. 3 Outside of library opening hours, publications can be returned to the library locations Leeuwarden and Terschelling by means of the self-collection device. 4 The addresses of the library locations of NHL Stenden library are as follow: Rengerslaan 8 / DD Leeuwarden (Rengerslaan 8) (Rengerslaan 10) Zeemanstraat BZ Assen Van Schaikweg KL Emmen Phebensstraat BL Groningen Van der Duijn van Maasdamstraat AT Meppel Dellewal EG West-Terschelling Article 9 Borrowing: Extending

4 1 A borrower may extend the borrowing term up to five times by the term referred to in Article 7, paragraph 1, unless: a b The publication has been booked The borrower owes the library a fee. 2 A borrower may extend the borrowing term via the online catalogue, the self-service facility, the counter, or by telephone. 3 Permanent working copies can be extended by one year. Permanent working copies can only be extended at the counter. Article 10 Borrowing: Booking 1 A borrower may book a publication that is currently not available via the online catalogue, the counter, or by telephone. 2 The borrower will be informed as soon as the publication is available. If a borrower has not collected the publication within seven days after the date of the notification, the booking will lapse. Article 11 Borrowing: Reminder and fee 1 The library will send a borrower the following reminders: a b c d A first reminder one day after the borrowing term has ended A second reminder one week after the borrowing term has ended A third reminder two weeks after the borrowing term has ended A fourth reminder three weeks after the borrowing term has ended. 2 A borrower will owe a fee if the publication has not been returned by the last day of the borrowing term at the latest. This fee will total: a. for publications with a white label: 0.20 per day b. for publications with a purple label: 0.20 per day and c. for publications with a blue label: 5.00 per day, in all three cases with a maximum of If the fee owed totals more than 10 or if the fourth reminder has been sent to the borrower, a borrower may not borrow any publications from the library until the fine owed has been paid or the publication has been returned. 4 The times for payment of the fee as referred to in this article are firm dates. 5 In case of non-payment or late payment, a borrower will owe, in addition to the principal sum and interest, collection costs as referred to in Section 6:96 subsection 1 under c of the Dutch Civil Code. These costs amount to 15% on the first 2,500 of the principal sum and 10% on the next 2,500 of the principal sum, with a minimum of 40. Article 12 Borrowing: Failure to return, damage and fee 1 In case of loss of or failure to return a publication, the borrower must pay the replacement value of the publication, with a minimum of 10 per publication, as well as a fee under Article 11, paragraph 2, equalling an amount of The invoice for the replacement value and fee owed as referred to in the first paragraph will be sent to the borrower from two months after the end of the borrowing term as referred to in Article 7. The invoiced amount must be paid within two weeks after the date of the invoice. 3 If the borrower returns the publication within one week of the invoice, the replacement costs as referred to in the first paragraph will lapse. 4 In case of irreparable damage to publications, the borrower must pay the replacement value of the

5 publication, with a minimum amount of 10 per publication. In case of repairable damage to a publication, the damage amount will be determined by the library's information specialist. 5 The invoice for the replacement value or damage amount owed as referred to in the fourth paragraph will be sent to the borrower from two months after the end of the borrowing term as referred to in Article 7. The invoiced amount must be paid within two weeks after the date of the invoice. Article 13 Borrowing: Interlibrary borrowing 1 In principle, a borrower may, against payment, request a publication present in a different library in the Netherlands. The interlibrary conditions are available from the library. 2 Interlibrary borrowing is subject to these regulations in so far as not indicated otherwise by the library. Article 14 Duty of care and liability 1 A user will have the duty of care for the publications borrowed. 2 Without prejudice to the provisions in paragraph 1 of this article, a borrower will handle the publications, equipment and other library assets with due care and will be liable for damage incurred to these through their acts or omissions. 3 NHL Stenden will not be liable, for any legal ground whatsoever, for damage incurred by a user, directly or indirectly, as a result of the use of the services and facilities of the library, except in so far as this damage is the result of gross negligence or intention of NHL Stenden. NHL Stenden will never be liable for consequential damage, including loss of income, lost turnover and profits, immaterial damage, damage as a result of loss of data, and damage due to delay. 4 The information on the NHL Stenden internet and/or intranet is only intended to provide information on the services and facilities of the NHL Stenden library. NHL Stenden does not guarantee and is not liable for the completeness, correctness and suitability of the information. 5 The internet and/or intranet contains hyperlinks to websites operated by others than NHL Stenden. Access to and use of these websites by third parties may be subject to conditions. NHL Stenden is not responsible for the content of these websites or for the information, software, products, and services offered on these websites. The inclusion on the intranet of hyperlinks to third-party websites in no way implies approval by NHL Stenden of the content of these websites, nor any relation or connection with the parties operating these websites. Article 15 Reproduction of publications 1 Users may only reproduce a publication in whole or in part if this is allowed under the law. In general, a few copies may be made for individual exercise, study or use. 2 Users will indemnify NHL Stenden from any claim in respect of violation by them of an intellectual property right to a borrowed and used publication. Article 16 Privacy statement 1 The library processes the personal data of a borrower for its borrowing records, delivery of publications, and communication with borrowers about activities, publications, and services and facilities of the library. 2 The library is responsible for protection of personal data of its borrowers, in accordance with the conditions set out in the European General Data Protection Regulation. 3 Borrowers have the right to access, rectify, supplement or delete the data included about them. 4 The library does not use the personal data for purposes that are irreconcilable with this and will not

6 disclose them to third parties. An exception may be made to this rule based on the legal authority of the police and judiciary to requisition identifying and/or user data to prevent, investigate and prosecute offences. Article 17 Complaints Complaints about the library can be filed via A complaint will be answered in writing within two weeks after reception. Article 18 Unforeseen situations The Director of O&S of NHL Stenden will decide on cases not provided for in these regulations. Article 19 Applicable law and disputes 1 The use of library services and facilities is governed exclusively by Dutch law, unless the law of another country applies based on a mandatory provision. 2 All disputes ensuing from or related to the use of the library services and facilities will only be brought before the competent court in Leeuwarden, unless a mandatory provision dictates otherwise. A user who does not act in the course of a profession or business may, within one month after NHL Stenden has invoked this provision in writing, declare that they opt for settlement of the dispute by a court authorised by law. In that case, the latter court will have jurisdiction. NHL Stenden will at all times be entitled to bring the dispute before a court authorised by law. Article 20 Commencement and citation reference 1 These regulations are effective as of 1 September These regulations shall be cited as: Library Regulations.
