2 Credit Card Terms and Conditions IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens a new account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. INITIAL DISCLOSURE STATEMENT This Initial Disclosure Statement (Statement) controls the use of your credit card account (Account) until it is replaced by the full Credit Card Agreement (Agreement) that we will send with your credit card (Card). Please read and keep this Initial Disclosure Statement for your reference. It explains some key terms of your Account. The Agreement contains additional terms and conditions not inconsistent with the terms and conditions in this Initial Disclosure Statement. 1. DEFINITIONS; YOUR PROMISE TO US. CFNA, we, us and our mean Credit First National Association, a national banking association located at 6275 Eastland Road, Brook Park, Ohio You and your mean each person who signs the 1 attached application (Application) for an Account with us. Credit Card or Card means each credit card we issue to you or a person any of you authorize to use the Account (Authorized User). Billing Cycle means the days between the closing date shown on the last monthly billing statement (Statement) we sent you and the closing date on your current Statement. Other capitalized terms are defined in the Agreement. You agree to the terms of this Initial Disclosure Statement and, when you receive it, the Agreement. You promise to do everything this Initial Disclosure Statement and/or the Agreement requires of you. You agree to pay for all transactions charged to the Account by any of you and any Authorized User. You will be bound by APPLICANT: Detach from application and retain for your records.

3 this Initial Disclosure Statement when you sign or submit an Application that is approved by us in Ohio or otherwise request an Account from us, sign a sales slip using the Account or use or permit someone else to use credit provided through the Card or Account. You will be bound by the Agreement as provided therein. You will use the Card only for personal, family or household purposes, and not for business, commercial or agricultural purposes. 2. CREDIT PLANS. A. Regular Credit Plan. You may use your Account for transactions that are not subject to Promotional Credit Plan Terms. Such transactions are subject to the regular terms of this Agreement ( Regular Credit Plan Terms ). Any balance of transactions subject to Regular Credit Plan Terms is your Revolving Balance. B. Promotional Credit Plans. You may use your Account for transactions that are subject to Promotional Credit Plan Terms, such as the Three Month Payment Plan (see below). Promotional Credit Plan Terms temporarily modify certain terms of this Agreement for qualifying purchases; all other terms of this Agreement remain unchanged. C. Three Month Payment Plan. Specified purchases will qualify as Three Month Payment Purchases under the Three Month Payment Plan. You will not owe us Interest Charges that accumulate on Three Month Payment Purchases during the Three Month Payment Plan Delay Period if we receive (a) the required Minimum Payment Due by its Payment Due Date for each Billing Cycle during the Delay Period and (b) the full amount of your Three Month Payment Purchases by the Three Month Payment Plan Due Date. The Delay Period begins on the later of (a) the date you make a Three Month Payment Purchase or (b) the first day of the Billing Cycle in which the transaction posts to your Account. The Delay Period ends on the third Statement Closing Date after a Three Month Payment Purchase posts to your Account. The Delay Period can end as early as the first or second Statement Closing Date if we do not receive a Minimum Payment Due by its Payment Due Date within two consecutive Billing Cycles. Any balance of Three Month Payment Purchases remaining unpaid at the end of the Delay Period (Unpaid Three Month Payment Purchases) is added to the Revolving Balance as a Current Due Three Month Payment transaction in the Billing Cycle that begins immediately after the Delay Period ends. The Due Date for the Three Month Payment Plan is at least 23 days after a Current Due Three Month Payment transaction is added to the Revolving Balance of the Account. If we do not receive a Minimum Payment Due by its Payment Due Date within two consecutive Billing Cycles, you will owe us Interest Charges that have accumulated at the Interest Rate on all Unpaid Three Month Payment Purchases during their respective Delay Periods. If we do not receive the full amount of a Current Due Three Month Payment transaction by its Due Date, you will owe us Interest Charges that have accumulated (a) on such Unpaid Three Month Payment Purchase(s) during its Delay Period and (b) on the Current Due Three Month Payment Purchases in the prior Billing Cycle. You can lose benefits of the Three Month Payment Plan early if you make late payments. Any Unpaid Three Month Payment Purchases can be added to the Revolving Balance early if we do not receive at least the required Minimum Payment Due on your Account by the Payment Due Date within two consecutive Billing Cycles. 3. INTEREST CHARGES. We will calculate periodic Interest Charges on your Account for each Billing Cycle by multiplying a monthly periodic rate ( Periodic Interest Rate ) by the Average Daily Balance (including new transactions) on your Account. 2 A Periodic Interest Rate is one-twelfth of its corresponding ANNUAL PERCENTAGE RATE ( APR ). We will charge you a minimum INTEREST CHARGE of $1 for any Billing Cycle in which an Interest Charge of less than $1 would otherwise be imposed. A. Periodic Interest Rate; Interest Rate. The Periodic Interest Rate that applies to your Revolving Balance is 1.9% (corresponding APR 22.8%) ( Interest Rate ). The Interest Rate also applies to your Unpaid Three Month Payment Purchases at the end of each Billing Cycle during the Delay Period. B. How We Calculate Average Daily Balance Subject to Periodic Interest Charges. We calculate the Average Daily Balance on your Account separately for (1) your Revolving Balance and (2) your Unpaid Three Month Payment Purchases for each Billing Cycle during the Delay Period. Revolving Balance - To get the Average Daily Balance for your Revolving Balance, we first must determine the daily balance for your Revolving Balance. To get the daily balance, we take the beginning Revolving Balance of your Account each day. Then we subtract any payments or credits applied to your Revolving Balance, and any unpaid Interest Charges. We add to that amount any new Regular Credit Plan transactions, Current Due Three Month Payment transactions, Late Payment Fees, credit insurance, debt cancellation charges and other Account fees and administrative charges. Unpaid Three Month Payment Purchases - To get the Average Daily Balance for your Unpaid Three Month Payment Purchases during the Delay Period, we first must determine the daily balance for your Unpaid Three Month Payment Purchases. To get the daily balance, we take the remaining balance of your Three Month Payment Purchases each day. Then we subtract any payments or credits applied to your Unpaid Three Month Payment Purchases. We separately add up all the daily balances for each. We then divide each total by the number of days in the Billing Cycle. This gives us the Average Daily Balance for your Revolving Balance and the Average Daily Balance for your Unpaid Three Month Payment Purchases. C. When Interest Charges Begin to Accumulate. Interest Charges accumulate on each purchase (including Three Month Payment Purchases) from the later of (a) the date of the transaction or (b) the first day of the Billing Cycle in which the transaction posts to your Account. You will not owe us an Interest Charge for any Billing Cycle in which your Account has no previous Balance or during which payments and credits posted to your Account by the Payment Due Date (at least 23 days after the Statement Closing Date shown on your last Statement) equal or exceed the previous Revolving Balance. We do not charge Interest Charges on unpaid Interest Charges, that is, we do not compound Interest Charges. 4. FEES. A. Late Payment Fee. If we do not receive at least the Minimum Payment Due by each Payment Due Date (including Minimum Payments Due during the Delay Period for Three Month Payment Purchases and other Promotional Credit Plan transactions), we may add to your Account a Late Payment Fee of $15 for New Balances up to $100, $28 for New Balances of $100 or more up to $300 and $38 for New Balances of $300 or more. B. Returned Payment Fee. If your payment check or other instrument is dishonored by your bank or must be returned for any reason, we will add a Returned Payment Fee of $35 to the Revolving Balance of your Account.

4 C. ACH Service Fee. Each time you ask a customer service representative to assist you in making an expedited automated payment from your bank account (i.e. an automated clearinghouse or ACH transaction), we may add a service fee to the Revolving Balance of your Account. 5. YOUR ADDRESS. We will consider your current address and state of residence to be the same as the billing address we maintain in our records. You agree to notify us of any change in your name, residence, or billing address by writing to us at the address shown on your Statement. 6. GOVERNING LAW. This Initial Disclosure Statement, the Agreement and your Account are governed by federal law applicable to a national bank and, to the extent not preempted by federal law, the laws of Ohio, without regard to its conflicts of law provisions. 7. WAIVER. We may, at our discretion from time to time without notice, waive any of our rights under this Agreement in certain circumstances. We can waive our rights without affecting our other rights. If we waive any right, we do not waive the same right in other circumstances or at other times. 8. DEBT CANCELLATION. Your purchase of any debt cancellation product that we offer is optional. Whether or not you purchase this product does not affect our decisions about your credit. NOTICES: California Residents: If you are married, you may apply for a separate account. New York Residents: Upon your request, you will be informed of whether or not a credit report was ordered, and if it was, you will be given the name and address of the consumer reporting agency that furnished the report. Ohio Residents: The Ohio laws against discrimination require that all creditors make credit equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio civil rights commission administers compliance with this law. Married Wisconsin Residents: No provision of any marital property agreement, unilateral statement under Section of the Wisconsin statutes or court order under Section adversely affects the interest of CFNA, unless CFNA, prior to the time credit is granted is furnished a copy of the agreement, statement or decree or has actual knowledge of the adverse provision when the obligation to CFNA is incurred. YOUR BILLING RIGHTS KEEP THIS NOTICE FOR FUTURE USE. This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act. Notify Us In Case of Errors or Questions About Your Bill. If you think your bill is wrong, or if you need more information about a transaction on your bill, write us on a separate sheet at CFNA, BK-11/Customer Service, P.O. Box 81315, Cleveland, Ohio Write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information: Your name and account number. The dollar amount of the suspected error. Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about. I f you have authorized us to pay your credit card bill automatically from your checking account, you can stop the payment on any amount you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur. Your Rights and Our Responsibility After We Receive Your Written Notice. We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as past due. We can continue to bill you for the amount you question, including Interest Charges, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your bill that are not in question. If we find we made a mistake on your bill, you will not have to pay any Interest Charges related to any questioned amount. If we didn t make a mistake, you may have to pay Interest Charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as past due. However, if our explanation does not satisfy you and you write to us within 10 days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your bill. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it finally is. If we don t follow these rules we can t collect the first $50 of the questioned amount, even if your bill was correct. Special Rule for Credit Card Purchases. If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right: a. You must have made the purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and b. The purchase price must have been more than $50. These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services. An Important Notice Concerning the Privacy of Your Information. CREDIT FIRST NATIONAL ASSOCIATION PRIVACY POLICY Credit First National Association ( CFNA, we, us, and our below) is committed to protecting your privacy. As a financial institution, we know that your trust in us is of central importance. We collect information about you to accurately identify you, protect and administer your account and records, help us design or improve our products and services, understand your financial needs, offer you quality products and services and comply with certain laws and regulations. 5 on the relationship we share with you. Therefore, we work hard to safeguard information about that relationship. This Privacy Policy describes how we protect and use the information we collect about current and former customers and other consumers who may apply to us for credit ( you and your below). This Policy also describes how you can limit certain information about you that we share within our affiliated family of companies, that is, any company that controls, is controlled by or is under common control with us ( affiliates ), and with third parties that are not affiliated with us ( nonaffiliated third parties ). Our affiliates are the Bridgestone Firestone family of companies and the following company owned retail tire and service stores: Firestone Complete Auto Care, Tires Plus, Wheel Works, Expert Tire and Hibdon Tire. Independently owned retail tire and service stores, and other independently owned retailers, are nonaffiliated third parties. If you choose to limit information sharing, you may not learn about all the opportunities that could be important to you. This Policy takes the place of any other Privacy Policy we may have given you. Please read this policy and keep it for your records. 1. Information We Collect. We may collect nonpublic personal information about you from the following sources: Information we receive from you on applications or other forms, such as your name, address and social security number; Information about your transactions with us, our affiliates, or others, such as your account balance, payment history and credit card use; Information we receive from a consumer reporting agency, such as your creditworthiness and credit history; Information we receive from third parties about their relationships with you, such as your employment or credit history; and Information we receive from dealers from whom you purchase goods and services using a credit card issued by us, such as your purchasing patterns. 2. Information We Share. We may share all of the information we collect as described above ( nonpublic personal information ) unless your billing address is in California or Vermont. We may disclose nonpublic personal information about you to the following types of third parties: Financial service providers, such as insurance providers; and Non-financial companies, such as direct marketers and merchandise vendors. We also may disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law, even if your billing address is in California or Vermont. We may disclose all of the information we collect as described above to companies that perform marketing services on our behalf or to other financial institutions that have joint marketing agreements with CFNA. 3. Your Option to Limit Disclosure of Information About You. A. External Sharing - Nonaffiliated Third Parties. If you prefer that we not disclose nonpublic personal information about you to nonaffiliated third parties, and your billing address is not in California or Vermont, you may opt out of those disclosures, that is, you may direct us not to make those disclosures (other than disclosures permitted by law) as provided in D below. If your billing address is in California or Vermont, disclosures are limited to those permitted by law. B. Internal Sharing - Affiliates. Under the federal Fair 4 Credit Reporting Act, we are permitted to share identification information with our affiliates, as well as information related to the transactions and experiences we have with you. If you prefer that we not share any other information with our affiliates, including information from consumer reporting agencies such as your credit score, and your billing address is not in Vermont, you may opt out, that is, you may direct us not to share other information among our affiliates as provided in D below. If your billing address is in Vermont, we will share other information among affiliates only with your consent or as permitted by law. C. Affiliate Sharing for Marketing. Federal law gives you the right to limit some but not all marketing from our affiliates. Federal law also requires us to give you this notice to tell you about your choice to limit marketing from our affiliates. You also may limit our affiliates from marketing their products or services to you based on your personal information that we collect and share with them. This information includes your account history with us, and your credit score. Your choice to limit marketing offers from our affiliates will apply until you tell us to change your choice. An opt-out direction by one of you will apply to all others on your account with us. If you have already made a choice to limit marketing offers from our affiliates, you do not need to act again. To limit marketing offers, see D below. D. How to Opt Out of Information Sharing. If you wish to opt out of any of the information sharing described above, you may do so at any time. To do so, please call or write us at CFNA, BK-11/Customer Service, P.O. Box 81315, Cleveland, Ohio When you call or write, please provide the account number for which you wish the opt out to apply. If you opt out, you will be deemed to have opted out of the External Sharing, Internal Sharing and Affiliate Sharing for Marketing as described above. If you have a joint account, an opt-out request by one individual will apply to all individuals on the account. It is important to understand that an election to opt out of information sharing does not prohibit us from contacting you about additional products or services. 4. Information Safeguards. We restrict access to your nonpublic personal information about you to those employees who need to know that information in order to provide products or services to you. We maintain physical, electronic and procedural safeguards that comply with federal standards to guard your information. 5. Changes to This Notice. We may amend this policy at any time and we will inform you of any changes as required by law. 6. Former Customers. If you end your relationship with us, we will adhere to the information sharing practices described in this policy, as well as your opt-out election with regard to information we have collected about you.
