1 LOAN LIBRARY RULES FACULTY OF MATHEMATICS AND PHYSICS CHARLES UNIVERSITY I. Basic Provisions Following the Operating rules of the Faculty of Mathematics and Physics of the Charles University (hereinafter library ) these Loan Library Rules of the Faculty of Mathematics and Physics of Charles University amending specific conditions for using library services are hereby issued. II. Library and Information Services 1) Lending Services a) in-house in the library b) outside out of the library c) inter-library loans facilitation of loans from Czech and foreign libraries (provided only to faculty staff and students of the doctoral programmes) d) lending of electronic devices 2) Information services a) advisory services - information on catalogs, collections and use of the library, b) bibliographic - information services, reference and research services, c) electronic services - access to electronic information resources. 3) Reprographic services 4) Records of publishing activities of faculty staff 5) Information education III. Library Users 1) Internal users a) faculty staff b) faculty students c) users from Charles University (staff and students of other faculties) d) members of Matfyz Alumni, r.a. and Charles University Alumni Club e) interns 2) External users a) Other professional public b) Participants of Lifelong Learning programmes 3) Collective users Collective users are the juridical persons entered in the library register held by the Ministry of Culture. Registrations of such collective users with the CU Library are carried out on the basis of their first requests on the CU Library within the interlibrary loan service (hereinafter ILL ). The collective users do not employ the CU ID card. 4) User Registration a) An individual becomes a user by registering, signing the loan statement and presenting their university identity card (hereinafter ID card ). Registration is for a limited time period and must be extended before the time period expires. When registering, a user also presents their

2 national identity card (or passport, if not from the EU). b) By signing the loan statement the user accepts the terms of the Loan Library Rules and consents with the storage of the provided data in the borrower database (in accordance with the Act on Personal Data Protection No. 101/2000 Coll., as amended). Registration may be declined for serious reasons (e.g. foreigners without a residence permit or valid document, etc.). A user may receive a copy of the loan statement by request when signing the statement. c) The following may be used as an ID card: for faculty staff a Charles University staff ID card for faculty students and faculty doctoral students a Charles University student ID card (with valid faculty coupon) for Charles University Alumni Club members a Charles University Alumni Club ID card for members of Matfyz Alumni a Matfyz Alumni ID card for users from Charles University a Charles University employee ID card or student ID card (with valid faculty coupon) for interns a foreign student ID card for the professional public a personalized ID card for external users of Charles University services for participants of Lifelong Learning programmes - a personalized ID card for external users of Charles University services in exceptional cases and with the consent of the head of library, the library may accept or lend out a non-personalized card for external users of Charles University for a period of one year. d) Upon entering the library and upon request the user is obliged to show another form of identification along with the above mentioned ID card. e) The ID card is non-transferable and may be only used by the person whom was issued to. If lost the user must notify the library immediately. Repeated loss of one s ID card due to negligence may result in the user being deprived of their right to use library services. f) User registration is valid for: 6 months for interns (foreign students) 1 year for users of Charles University, the professional public, participants of Lifelong Learning programmes, Charles University Alumni Club members and members of Matfyz Alumni 3 years for faculty students 5 years for faculty staff g) University staff upon termination of employment at the university are obliged to request confirmation from the library that all borrowed documents have been returned. Confirmation is presented to the personnel department. University students before completing their studies are obliged to inform the library immediately of their expected completion of studies and settle their liabilities to the library. h) The user is obliged to notify the library immediately of any changes in personal data, address, completion or suspension of studies, termination of employment at the university). Upon failure to do so, the library may demand from the user compensation for the costs associated with the ascertainment of such data. IV. Basic Obligations and Rights of Library Users 1) Basic obligations and rights of library users are following: a) Users must comply with the Loan Library Rules and follow the instructions of library staff, b) Access to the library is permitted upon presentation of a valid ID card, c) The user is obliged to leave their outer clothing and personal belongings in locked storage lockers or in other areas designated by library staff,

3 d) Storage lockers may be used only when using the library. Users may not remove the keys to the lockers beyond library premises, e) Users have to undergo specific inspection measures necessary to maintain order and to protect property, f) Users may not smoke in the library, or bring in food or beverages in open containers. Pets in library are prohibited, g) The user has the right to use all documents in open access collection and technical resources reserved for such purpose. Users are obligated to learn the terms of use before using any library device. These terms are available on request from library staff, h) The user is obliged to report all defects and deficiencies in documents or library facilities, i) Users are required to use the library collection carefully and protect it from damage, j) It is forbidden to remove any part of the library collection outside the space bounded by the electronic security device without making a proper loan, k) Computers located in the library can be used solely for the purpose of the corresponding library function, l) Users use electronic information resources exclusively for educational, academic, or scientific purposes and personal use only and are required to comply with the requisite license conditions for the use of these resources (these conditions are available in respective resources), m) Users may make and use printed or electronic copies of documents from the library collection in accordance with applicable regulations (Copyright Act No. 121/2000 Coll., as amended), n) Users may not change the configuration of a computer or terminal and may not engage in any activity that would prevent other users from normal use of the network, o) It is forbidden to install software or copy programs, p) Users are obliged to keep quiet in the library, to maintain cleanliness and tidiness, and to behave with consideration towards other visitors, otherwise they may be expelled from the library, q) If the user fails to comply with this policy, they may be temporarily or permanently deprived of the right to use library services. This measure does not relieve the user of the obligation to pay damages or liability under applicable law. V. Loans 1) Borrowing documents a) Library users borrow documents from the library collection after presenting their ID card, which makes it possible to register the loan. The loan is concluded when it is electronically recorded by the computer, b) Registration of a loan and acceptance of the document is not accompanied by a loan form and user signature. The user confirmed the terms and conditions for borrowing by signing the loan statement for the registration period, c) In justified cases, the librarian may require the user s signature on the loan form for loan confirmation (for attachments to documents, failure of the electronic library system, etc.), d) The user may borrow only one copy of each document, e) Loaned textbooks and monographs may be taken outside the library, other documents are for in-house use only; exceptions are granted by the head of library, f) ILL users (legal entities) borrow documents from the library collection according to the legal regulations of MVS.

4 2) Types of Loans a) The loans the user is allowed to take outside the library: study loan (textbooks) regular loan (books, proceedings, etc.) short-term loans (specific documents) electronic devices (e-readers and tablets) When making a loan the user is informed about the length of time during which they may keep the document in use. b) In-house loans (only in the study area) encyclopedias and dictionaries non-circulating collection in study rooms magazines documents issued between 1801 and 1938 c) Strictly in-house loans (only in the study area and electronically recorded on users account) University theses old prints ( ) 3) Lending Arragmenets a) Respective loan periods, loan renewals, maximum number of borrowed documents and reservations are specified by the type of document and category of the user stipulated in the Rector s Provision no. 24/2016 (Library Rules of Charles University) b) Faculty staff (or holders of grants, projects, etc.) are allowed long-term loans, which terminate upon notification of the library for the document s return. Staff who make long-term loans are required to submit the borrowed documents once a year to the library for inspection. The date and form of inspection shall be announced by the library staff. c) The loan period can be extended if the borrowed document is not required by another user. An extension can be requested only before the end of the loan period. In exceptional cases the loan period may be shortened. d) Reservation/request is possible only for documents currently on loan or materials from the closed depot. These items can be requested in electronic library catalog or at library s circulation desk. After completion of the request the user is informed by library (usually by e- mail). The reserved tem can be collected only in respective library department. e) Requested document from closed depot is reserved for the user for duration of 7 days since placement of the request. If the requested document is already loaned, it will be prepared for the user after previous loan period expires. f) Documents borrowed through inter-library loan services are subject to special lending arrangements and regulations governing the inter-library loan service. For arranging loans from foreign libraries, the user is required to pay a fee, which is charged by the organization that owns the document or organization facilitating the loan. The loan period for such documents cannot be extended. 4) Returning a borrowed document a) Completion of a loan (return of a borrowed document) is done in electronic library system. The return of a borrowed document is not accompanied by the library s confirmation of return. b) The user is obliged to return borrowed items in the same condition in which they were borrowed taking into account normal wear and tear; the user is responsible for it for the entire period for which it has borrowed. The user may not lend a borrowed publication to others.

5 5) Recovery of unreturned loans a) The user is obliged to observe the lending period. If the borrowed document is not returned by the end of the loan period they are required to pay fixed late fees, including fees associated with the sending of overdue notices (see Appendix: List of Charges and Paid Services). b) The library can recover unreturned loans by legal means. Costs associated with the preparation of recovery by legal means and the actual recovery shall also be borne by the user. 6) Historical library collection a) Historical library collection consist of the old prints (i.e. materials published before 1800), selected documents published before 1938 and archival documents. All these materials are strictly for in-house study only. Study of these documents is allowed solely to registered users of the library. b) By registering the loan and signing the lending slip the user agrees to abide by the loan library rules and the conditions for handling the borrowed materials. c) Documents from historical library collection shall be accessible to the user only in designated study spaces and only after signing the lending slip. It is forbidden to remove the materials outside the study space. The user is required to present the borrowed document to library staff for control. Materials in bad physical condition shall not be accessible. d) The user is obliged: to use protective gloves while manipulating with the materials, to use only pencil with hardness 2H or HB when studying, to use only acid-free paper while bookmarking or following text (available at library s circulation desk), to follow other directions of library staff. e) It is forbidden to alter borrowed documents in any way, including writing notes or underlining, or using them instead of writing pad. The user is obliged to return borrowed items in the same condition in which they were borrowed taking into account normal wear and tear. The user is responsible for any damage inflicted during the time the items were borrowed to him and is obligated to reimburse any expenses connected to repairing the items or pay for loss or irreparable damage of the items. f) The use is allowed to make copies of the borrowed documents providing previous consultation with library staff. The copies must be used in accordance with applicable regulations (Copyright Act No. 121/2000 Coll., as amended) for personal or scientific use. While making copies usage of intense light or tripod is prohibited. Using any other aids for copying (such as paperweights or clips) must be approved by library staff. g) If the user fails to comply with this policy, the borrowed items might be taken away. h) Potential exceptions to these rules are granted by the head of library (e.g. for exhibitions, publishing, etc) i) The copy of lending slip may be issued upon user s request. VI. Losses and Compensation 1) The user is obliged to immediately inform the library of the loss, destruction or damage to a borrowed document. 2) The method of compensation shall be decided by the head of library. Damages may be claimed for: obtaining a replacement copy of the same document in the same edition and binding obtaining another edition of a lost document obtaining another document as agreed with the head of library

6 providing financial compensation. The amount of financial compensation is set by the head of library. VII. Final Provisions 1) Exceptions to the library rules and loan rules a) Exceptions to the library rules and loan rules are granted by the head of library, b) Their decision may be appealed to the dean of the faculty, whose decision is final. 2) Comments Comments, complaints and suggestions on the work of the library can be submitted orally, in writing or electronically to the head of library, the chairman of the library board or the appropriate vice-dean of the faculty. 3) Supplements to the library rules An integral part of loan library rules is: a) Supplement no. 1: List of Charges and Paid Services b) Addendum no. 1: Special conditions for indefinite access to the Department of Mathematics library for certain users c) Addendum no. 2: Lending of electronic devices d) Example of Loan contract for electronic devices e) Example of User s loan statement f) Example of Lending slip for studying historical library collections 4) Date of effect of the loan rules The loan library rules come into force upon publication on the faculty s website and take effect on 1 st January In Prague. prof. 7 Supplement No. 1 List of Charges and Paid Services This List of Charges and Service is an appendix to the Loan Library Rules of the Faculty of Mathematics and Physics, Charles University. It sets out the basic fees associated with the use of the collections and services of the library. 1) User registration a) Registration of holders of Charles University ID cards: free of charge b) Loan of non-personalized ID card to an external user of services of Charles University: 160 CZK/yr 2) Loss or damage of document s bar code 100 CZK 3) Loss or damage of loaned non-personalized ID card 160 CZK 4) Late fee per day after expiration of the borrowing time period: Regular loan 3 CZK per document Study loan 3 CZK per document Short-term loan 3 CZK per document Loan for in-house use 50 CZK per document Loan of electronic device 100 CZK per document 5) One-time fee for processing and sending of reminders 50 CZK 6) Fee for loss or damage to locker key 100 CZK 7) Compensation for loss or irreversible damage to component of electronic device: CZK per component Compensation for loss or damage to loaned electronic device: - up to the purchase price of the device 8) Copying and black-and-white printing a) Single-sided A CZK Siglesided A3 3 CZK b) Double-sided A4 4 CZK Doublesided A CZK c) Additional services CZK d) Copies of pages sent electronically via the interlibrary loan service 2 CZK 9) Copy cards for self-service copying a) 50 units 65 CZK b) 100 units 130 CZK 10) Inter-library loan service According to the current price list of service providers (e.g. National Technical Library, National Library of the Czech Republic) The price list comes into effect on 1 January 2017, simultaneously cancelling in full the price list valid up to that date. 8 Addendum No. 1 Special conditions for indefinite access to the Department of Mathematics library for certain users This addendum to the Loan Library Rules of the Faculty of Mathematics and Physics of Charles University (hereinafter the Addendum) is valid for mathematical department of the library. I. In the library s department of mathematics in Karlín, selected users can be allowed access in the absence of library staff. II. Authorization for indefinite access to the library shall be decided by the faculty vice-dean for the mathematics section. III. Unless specified otherwise in this Addendum, selected users shall be governed by the Loan Library Rules of the Faculty of Mathematics and Physics of Charles University. IV. Selected users who use the library in the absence of library staff may not remove any part of the library collection outside the space bounded by the electronic security system. Furthermore, they are not authorized to use library facilities in the rooms of the library staff. Used books and magazines are required to be left on the storage tables and not shelved back. When leaving the library the user is obliged to check whether the windows are properly closed, the lights turned off and the door is locked. V. Selected users are granted authorization to use the library in the absence of library staff only after signing a statement that they have familiarized themselves with this Addendum, and after approval by the head of library s Department of mathematics. 9 Addendum No. 2 Lending of Electronic Devices I. Electronic devices (such as e-book readers, tablets) are subject to the same rules when borrowed as printed documents, including conditions for compensation. The terms for borrowing electronic devices are governed by the Agreement on Lending Electronic Devices, the valid Loan Library Rules of the Faculty of Mathematics and Physics of Charles University and the Civil Code. By signing the contract, the user agrees to comply with the conditions of use of the loaned electronic device. II. Electronic devices can be loaned only to registered internal users of the Library of the Faculty of Mathematics and Physics of Charles University. III. The loan period of electronic devices is stipulated at 14 days. The loan of electronic device is registered in the library system. The user is obliged to return the borrowed electronic device within the stipulated period. If the borrowed device is returned after expiration of loan period the user must pay late fees in accordance with the valid list of charges. IV. Before signing the loan contract the user is obliged to inspect the electronic device. Failure to do so shall result in the user being liable for all defects discovered later. If the electronic device is lost or damaged, the user is required to pay damages up to the purchase price of the electronic device. 10 Example of Loan contract for electronic device LOAN CONTRACT FOR ELECTRONIC DEVICE concluded according to paragraph 2193 following. Of the Act No. 89/2012 between the following parties: I. Lender: Charles University, Faculty of Mathematics and Physics registered office: Ke Karlovu 3, Praha 2 ID: represented by...authorized employee and li. Borrower:... date of birth address... ID number 1. By entering into this agreement the Lender leaves to the Borrower the use of the electronic device specified below, together with the following accessories (hereinafter the "electronic device") and the Borrower is entitled to use the electronic device in compliance with the conditions and the principles of operation set out below during the specified period of use. 2. Issues not covered by this agreement shall be governed Loan Library Rules of the Faculty of Mathematics and Physics of Charles University and the Civil Code in effect on the date this agreement is signed. 3. The loan period is 14 days from the date this contract is concluded. In the case this period is exceeded the Borrower will be charged a late fee according to the Loan Library Rules of the Faculty of Mathematics and Physics. 4. The loan is free of charge. 5. The Borrower is obliged to look after the electronic device with proper care and take into account the nature of the device to avoid damage. The Borrower further undertakes to protect the electronic device against loss and theft. The Borrower agrees to use the electronic device in a way that does not violate the rights of third parties, in particular copyrights and moral rights. 6. The Borrower is obliged to return the electronic device to the library where this agreement was concluded in full working condition and charged in order to verify its functionality. If it is not possible to verify the functionality of the electronic device, the Lender will not accept its return. 7. The parties expressly agree that if the Borrower does not return the electronic device even 2 weeks after the stipulated loan period, or returns it in a condition in which it can no longer serve its purpose, the Lender is entitled to charge the Borrower a contractual fee in the amount of the purchase price of the electronic device. If the Borrower does not return an accessory of the electronic device even 2 weeks after the stipulated loan period, or returns it in a condition in which it can no longer serve its purpose, the Lender is entitled to charge the Borrower a contractual fee of 300 CZK for each unreturned or damaged accessory.
