2 Scott Greenberg Sandberg Phoenix Shareholder Scott Greenberg is a veteran attorney and shareholder. His primary focus is debtor/creditor relations, bankruptcy and reorganization, banking, mortgage servicing and title insurance, as well as general corporate and real estate matters. Former chair of the firm s Strategic Plan Committee, Scott has also served as a member of the Compensation Committee and is the former Chair of the firm s Pro Bono program, which assists indigent clients and charitable organizations with free legal service. Prior to joining Sandberg Phoenix, Scott was formerly a partner and founding member of Davis, Davis, Kasnetz & Greenberg. Experience Representing Banks, Servicers and Lenders Practicing law for almost thirty years, Scott has a proven track record representing community, regional and national banks, as well as mortgage servicers and lenders. His expertise is concentrated in matters of lending, enforcing creditors rights, Bankruptcy Court and related proceedings. Recently, he successfully represented a locally owned St. Louis bank in a complex restructuring of a borrower s debt, which included the negotiation and drafting of an intercreditor agreement with another bank that had competing interests. Scott has served as counsel to numerous creditors committees, including Superior Insulating Tape Company, Juvenile Shoe Corporation, Kawin Chotin Jewelers, Sky Top Sunroofs, St. Louis Leasing, and others. In St. Louis Leasing he served as lead counsel to a committee of secured investors comprising over $50 Million in secured claims and guided the group to a successful conclusion in a complex Chapter 11 reorganization case. Corporate and Real Estate Assists clients with a variety of contractual matters, including asset purchase agreements, stock agreements, licensing agreements and non-competes, as well as a variety of real estate related matters and closings, including a recent $20 Million sale of an apartment complex. He has also successfully litigated or negotiated a host of title insurance claims and related matters. 3 Mortgage Services Sandberg Phoenix handles a wide variety of mortgage servicing related matters offering "cradle-tograve" service to its mortgage servicing clients. Our practice includes judicial and non-judicial foreclosures, deeds in lieu of foreclosure, title claims and title litigation, forbearance agreements, unlawful detainers (evictions), REO closings and mortgage related litigation. Bankruptcy services include motions for relief from stay, objections to confirmation, proofs of claims and adversary proceedings. 4 Successes The following are a few of many recent successes Scott Greenberg has had at Sandberg Phoenix: Rouse v. Beneficial Result was a summary judgment on behalf of a mortgage lender that was sued by a Chapter 7 Bankruptcy Trustee alleging the lender s deed of trust was invalid and constituted a preferential transfer. Scott was able to distinguish controlling Eighth Circuit law to win the case. Bi-State Medical Successfully represented a purchaser in a contested Section 363 sale of substantially all the assets of the company. Recently selected for inclusion in Best Lawyers in America, Named a Missouri & Kansas Super Lawyer in the area of Bankruptcy & Creditor/Debtor Rights.
