2 Introduction The Commission services presented a draft work programme for RSC in 2010 at the RSC#30 meeting (see document RSCOM09-71). During the debate at the meeting, RSC members generally supported the draft and were asked to provide their comments in writing. The Commission received comments from Denmark, France, Germany, Ireland, Latvia, Malta, the Netherlands, Portugal and Sweden which were taken into account during the elaboration of a stable work programme for RSC#31. In light of a number of comments on the suggestion for a draft mandate to CEPT on the preparation of WRC-12, this proposal has been withdrawn and replaced with the more general text from last year's work programme referring to initiatives in relation to WRC- 12. It must be nevertheless emphasised that appropriate flexibility is required in the implementation of the work programme. Its establishment should not lead to the exclusion of issues where a need for analysis and action only becomes apparent during the course of the year. The RSC work programme will therefore be updated periodically according to circumstances. Due account will also have to be taken this year of the introduction of the draft Radio Spectrum Policy Programme, although it is not expected that this will have a direct impact on the RSC work programming for

ON-GOING HARMONISATION MEASURES Update of Decision on Short Range Devices (SRD) The annual update of the technical annex of the Decision for Short Range Devices (2006/771/EC). The 2009 amendment should be finalised in Q Work on the 2010 amendment of the SRD Decision is foreseen to start in Q The RSC should discuss the time frame for future amendments of the SRD Decision. Mobile Communication services on Vessels (MCV) A Regulatory Opinion on the draft Commission Decision on MCV is foreseen in Q Commission Decision on the harmonisation of the MHz band for terrestrial ECS A Regulatory Opinion on the draft Commission Decision on the technical harmonisation of the MHz band is foreseen in Q Final CEPT Reports in response to the 2 nd EC Mandate on the digital dividend were received on 4 November FOLLOW-UP ACTIVITIES ON CURRENT RSC ISSUES Spectrum implications of the switchover to digital broadcasting and the digital dividend The recent adoption by the Commission of a set of proposals for a common roadmap to the digital dividend (Communication and Recommendation) includes some forward-looking elements which will require preparatory technical work. It is expected that this activity will include: a possible EC Mandate on the relocation (or other alternatives) of some categories of wireless microphone services (PMSE), further technical assessment related to the potential use of white spaces by cognitive devices, discussion group with the aim of having an exchange on interference immunity of DTT equipment and cable TV equipment and possibly some prospective technical work on the improvement of spectrum efficiency in transmission networks. The strategic elements of the EU Roadmap will be part of the Radio Spectrum Policy Programme (RSPP) to be endorsed by the European Parliament and Council. ITS - deployment and operation of safety-related infrastructure-based cooperative applications and systems in the 5.9 GHz band Discussion on the experiences in the Member States related to the implementation of the ITS Decision 2008/671/EC in the context of infrastructurebased ITS communications. It was agreed at the 25 th RSC meeting that the re-introduction of this topic on the RSC agenda should take place once more experience has been gained, so that possible best practices and/or information on the implementation could be exchanged between the Member

4 States. In particular, the issue of how and by whom infrastructure-based ITS systems will be implemented, operated and financed as well as the issue related to whether there is a need for a specific licensing framework for such systems. WAPECS Gradual implementation of the WAPECS concept. The final CEPT report in response to EC Mandates on the 900/1800 MHz and 2 GHz bands should be made available for RSC#32 in Q Issues: adding the LTE and WiMAX technologies to the list of systems able of coexisting with GSM in the annex to the draft Decision on 900/1800 MHz, addressing the 2 GHz bands currently used only for UMTS. 3. POSSIBLE NEW RSC ISSUES Spectrum requirements for emergency communications RSC could consider a follow-up to the RSPG Opinion on public sector use of spectrum, the EC Study on "Optimising the use of spectrum by public sectors" and CEPT activities. Studies on PPDR spectrum requirements undertaken by national administrations could be presented. Preparation for ITU WRC-12 Conference Initiatives within the frame of the Radio Spectrum Decision 676/2002/EC to take into account EU objectives linked to the WRC-12 agenda, in line with RSPG contribution to the preparatory process for WRC-12 and the Commission's political guidance. Future spectrum requirements identified by EU RTD activities Links between the EU IST programme and spectrum regulation policy could be considered in 2010, e.g. e-inclusion, e-health. Issues under observation, where further action would depend on a motivated request from RSC member(s) Spectrum for broadband direct air-to-ground communications There might be a future demand for spectrum capable of providing broadband access to planes within Europe. Such a system would be realised based on a terrestrial infrastructure in frequency bands below 6 GHz. A similar system is already in operation in the USA. Spectrum requirements for railway applications GSM-R requirements were discussed at RSC#23. Further action depends on RSC members' requests. Femtocells At RSC#24 it was agreed to keep this topic under observation. 4

5 4. MAINTENANCE AND IMPLEMENTATION OF EXISTING DECISIONS National implementation of Decisions Verification of progress of implementation of harmonisation Decisions and publication of results. Commission Decision 2008/477/EC on the GHz band Guidance document on the effective implementation could be finalised in Q following comments received from stakeholders and MS. The aim is to achieve an effective coordination in the bands used by satellite and terrestrial industries. Annual monitoring of 24 GHz Short Range Radars (SRR) and fundamental review of the Decision itself Annual monitoring of penetration of vehicles equipped with 24 GHz SRR, according to the SRR Decision (2005/50 EC). Following CEPT input, the fundamental review of the Decision is under way. Final CEPT report on Part 1 of the Mandate on SRR was made available to RSC#29 in Q Final CEPT report on Part 2 of the Mandate on SRR will be made available to RSC#31 in Q Assessment of the need for updating or abrogating Decisions. To be presented in annual reports from the Commission on radio spectrum policy in the Community. May also arise on an ad hoc basis if there is clear evidence that the implementation of a Decision is causing serious difficulties or where other factors are interfering with the effective implementation of a Decision. 5
