1 TUSC Terms of Use 1. The Teesside University Smart Card (TUSC) Staff will normally be issued with a TUSC as part of their induction and students by their School as part of the enrolment process. The TUSC is an important tool for staff and students of the University as it facilitates many activities within the University. You will a need a TUSC to: Get in to some buildings and rooms on both the main campus and Darlington campus; Borrow items from the Library; Print and copy documents using the MyPrint system (available across the campus) Access a range of University facilities including car parking (subject to charges) and sports facilities ; Identify yourself in academic examinations; Utilise cashless payment facilities at catering outlets within the University. Some of these TUSC services are not enabled by default: a) The ability to cancel lost cards by telephone b) Making cashless payments at catering outlets c) Chargeable printing & copying (MyPrint) d) Self-service Library loans and returns e) Car Parking All of these services apart from e) require you to provide security information before they can be activated. You are strongly encouraged to register this security information, as this will enable you to reset your own computer password should it be forgotten and provides you with the simplest route to cancel a lost or stolen TUSC. You can manage your security information and activate your TUSC for MyPrint and Cashless vending here. This document sets out the terms and conditions of use of the TUSC. 2. Terms of Use Teesside University Smart Card (TUSC) Terms of Use. V1.1 1 of 13
2 The University requires that staff and students exercise due care and attention over their user-id and password and take all reasonable precautions to ensure there is no unauthorised access or fraudulent use of the same. Staff and students are each advised to: 2.1 Carry your TUSC with you at all times while attending the University. 2.2 Report any lost or stolen TUSC to the University immediately. This will enable the University to disable the card to prevent improper use. You can report a lost TUSC in one of the following ways: a) Online via the web here. b) In person at any IT Service desk. To use this facility you will need to provide proof of identity (see 2.4). c) By telephone (Weekday) or (Evening and Weekends). To use this facility you must have pre-registered some security information (See 2.4 below). Any TUSCs that are subsequently found can be manually re-enabled provided no replacement card has been issued. 2.3 Replacement TUSCs can be provided by visiting the Library customer services desk (Middlesbrough or Darlington). If your TUSC is damaged or needs replacing due to a change of personal information (name etc.), then it will replaced free of charge provided you bring the old TUSC in exchange. If you have lost your TUSC, and cannot evidence how this occurred outside your control, then a charge will be made for issuing a replacement. This payment is made online here. For your protection the reissue process incorporates security checks (see below). 2.4 To cancel or have a TUSC replaced in-person your identity will be checked against the photo-id stored in the TUSC system (the same image as printed on the TUSC itself). You will also be required to provide proof of identity, which should be some form of state-issued photo-id. E.g. A driving licence or passport. In addition students are also required to provide documentation showing their home address. 2.5 Some of the services listed above have specific terms and conditions or regulations relating to their use. These are shown in Appendix A and are additional to these wider terms of use. 3. Ownership Teesside University Smart Card (TUSC) Terms of Use. V1.1 2 of 13
3 3.1 The Head of Learning Environment has responsibility for maintaining this document. Any changes are to be approved by the Card Development Subcommittee. APPENDIX A: Terms and Conditions for specific TUSC based services. A1. CASHLESS PAYMENTS SERVICE ( The Service ) A1.1 Money added to your TUSC and the use of your TUSC for cashless payment for products and services within the University is subject to these Terms and Conditions. These Terms and Conditions are between Teesside University (otherwise "we" "us", "our" or "TU" as the context permits) and the User (otherwise You or Your as the context permits). A1.2 It is your responsibility to familiarise yourself with these T&Cs. If you do not accept these T&Cs, you must not put credit on your Cashless account. A1.3 The service operates by you crediting funds Top-Ups (via the University s online payments system here) into a Cashless account, which is linked to your TUSC. You can then use your TUSC instead of cash to buy items from University catering outlets provided you have a sufficient credit. A1.4 Each Top-Up credit transaction must be at least 5 and no more than 250. There is no limit to the number of Top-Up transactions. A1.5 You will receive an confirmation of the Top-Up. Your Cashless account will normally be updated within 5 minutes of making the payment. If your account has not been updated by this time or you suspect any problems, please contact: onlinepayments@tees.ac.uk or the University Cash Office, in the Middlesbrough Tower, during normal Office hours. A1.6 Money added to a Cashless account can only be used for that purpose. I.e. it cannot be used for Printing (which uses a separate account), nor can it be refunded until your account is closed. Staff accounts are closed upon termination of employment and student accounts on completion of studies. Refunds amounts are confirmed by contacting the university finance office staff at onlinepayments@tees.ac.uk If the refund is within 3 months of the original payment a refund will be made to the credit/debit card used to make payment After 3 months Any value up to 25 can be reclaimed through petty cash at the finance office (opening times for petty cash refunds can be found here ) Teesside University Smart Card (TUSC) Terms of Use. 4 If specifically requested and for any balance over 25 a refund will be made direct to bank within 4 weeks, staff and students are responsible for providing (via to onlinepayments@tees.ac.uk) the bank details for the account they wish the money to be paid back to A1.7 Cashless transactions only require the TUSC itself there is no PIN number or other electronic validation of card use. You should protect the TUSC in the same way you would cash or credit/debit cards. For your safety, there is a daily spend (debit) limit of 30 per day. The University does not accept any liability for transactions made using your TUSC up until it is reported as lost or stolen. A1.8 Please see section 2.2 in the TUSC Terms of Use for information on how to report a lost or stolen TUSC. A1.9 The balance on your Cashless account can be displayed at catering outlets (without a purchase) and is also printed on till receipts. It is also possible to view detailed transactions against your account online. Details of how to do this will be ed to you when you activate your TUSC for Cashless. A1.10 Your TUSC has to be activated for Cashless payments (See Section 1), but cannot be used until you add a credit balance to your Cashless account. A1.11 Changes or suspension of Service: Teesside University reserves the right to suspend, restrict, withdraw, or terminate operation of the cashless system and the use of your TUSC to make purchases at any time and will use all reasonable endeavours to provide prior notification to you of such events. A1.12 The University will process Top-Ups to your TUSC using reasonable care and skill. A1.13 The University is not responsible for any loss suffered as a result of you losing your TUSC or the theft of it. Teesside University is only liable to you for losses, which you suffer as a result of a direct breach of these Terms by the University. A1.14 The University is not responsible to you for any losses which you may incur, if you and the University could not have contemplated those losses before or when you used the Cashless system. Teesside University s liability to you shall not in any circumstance include any business losses that you may incur, including but not limited to lost data, lost profits or business interruption. A1.15 Nothing in these terms attempts to exclude Teesside University s liability (if any) to you for: Personal injury or death resulting from the University s negligence Fraud Any matter which it would be illegal for the University to exclude or to attempt to exclude the University s liability Teesside University Smart Card (TUSC) Terms of Use. 5 A2. CHARGEABLE PRINT AND COPY (MYPRINT) SERVICE ( The Service ) A2.1 Money added to your TUSC and the use of your TUSC for MyPrint Print and Copy services is subject to these Terms and Conditions. These Terms and Conditions are between Teesside University (otherwise "we" "us", "our" or "TU" as the context permits) and the User (otherwise You or Your as the context permits). A2.2 It is your responsibility to familiarise yourself with these T&Cs. If you do not accept these T&Cs, you must not put credit on your MyPrint account. A2.3 The service operates by you crediting funds Top-Ups to your MyPrint account, linked to your TUSC, in one of three ways: via the University s Online payments system here via wall mounted or free standing money loaders. or as a last resort, in cash at the Library customer services desk. You can then use your TUSC to print and copy documents at MyPrint stations located across the campus. A2.4 Should there be a fault in the print\copy process whereby the printed copy is malformed or of poor quality, due to a fault with the device, then please take the affected pages to the Library izone where a refund will be credited to your MyPrint account. A2.5 Each Top-Up credit transaction must be at least 5 and no more than 250. There is no limit to the number of Top-Up transactions. A2.6 You will receive an confirmation of the Top-Up for online transactions and obtain a receipt for money loader and cash transactions. 7 A3. CAR PARKING SERVICE TERMS AND CONDITIONS The following has been paraphrased from the Campus Facilities Car Parking Policy: Eligibility for a parking permit: 1. The issue of permits is restricted to: a. All categories of staff on the payroll of the University. b. Honorary Professors, Readers and Lecturers on the staff/associate roll of the University. c. Associates designated by the University as visiting members of staff. Additionally certain regular service providers not on direct contract to Schools/Services may be included. d. University vehicles. e. Members of the Board of Governors and its Committees and Sub Committees. f. Certain tenants of property owned by the University. g. University staff that a hold joint permanent University/NHS appointments h. Retired staff subject to annual confirmation from the appropriate Dean of the School that continue to make a regular contribution to the work of the School and for this purpose require access to the University s car parks. i. Resident Students living in University Accommodation. j. Post graduate students, subject to parking restrictions. k. Non-resident students. Note: Students who live locally and within Post Code areas TS1, (inclusive of Teesside House and Linthorpe Halls), TS2, TS3 and TS4 will not be granted a permit or access rights to any of the University Carparks. For this purpose, locally is defined as having a termtime address within a radius of approx 3 miles of Teesside University. They may however use the Dartmouth carpark on a Pay & Display basis. 1.1 Further restrictions on the legibility of each of the above categories of persons apply in that a. All Staff are restricted to parking in: Main Site Staff Car Parks. The Dartmouth all day Pay & Display Car Park. Cannon Park Way (Park & Ride Scheme) Car Park. 8 Disabled Parking: Unless otherwise directed to do so by University Security or Car Park Attendants. b. All Resident Students are restricted to Parking in: Parkside West. Parkside East Unless otherwise directed to do so by University Security or Car Park Attendants. c. All Non Resident Students are Restricted to parking in: Student Union & Middletown short stay Pay & Display Car Parks. Dartmouth, Penn and Parkside East all day Pay & Display Car Parks. Cannon Park Way (Park & Ride Scheme) Car Park. Darlington Pay and Display Car Park Unless otherwise directed to do so by University Security or Car Park Attendants. 2 Staff or students who have a national disability parking permit or those others who subject to the provision of satisfactory documentary (including where appropriate, medical) evidence, are eligible to receive a blue University parking permit. Upon issue of such permit, appropriate access rights will be granted to all carparks that have disability parking bays. Obtaining a Vehicle parking Permit: The parking year runs from the 1 st of September through to the 31 st of August. 3 All drivers of motor vehicles must apply to Campus facilities to register for parking by completing an appropriate form, or by online renewal before parking a vehicle on University property. Permits/access rights are granted at the discretion of the Head of University Services or in his absence the Security Manager. Permit/access rights will not be granted unless the person registering is in possession of a full driving licence and staff/associate/student TUSC Car Parking Permit application forms are issued and processed by Campus Facilities at room M2.08 as follows: Staff/Associates: a. Initial issues in person at room M2.08. b. Renewals online via Unity September/October each year. Students: a. Initial issues in person at room M2.08. b. Resident Students in person at M2.08. c. 9 Note: a. Permits must be prominently displayed and visible through the windscreen of the vehicle whilst parked within a University carpark. b. Security and support services staff (Car Park Attendants) are authorised to direct traffic on University property, regulate entry to car parks, exercise control over parking and ensure compliance with the University s Parking Regulations. c. The University reserves the right to affix a Warning Notice to vehicles that are in breach of these regulations or are not displaying a valid parking permit/pay & Display ticket. A warning will be affixed to the vehicle and the details will be retained for a period of twelve months. Additional Penalties are listed in the full car park policy. d. It is an offence to give incorrect or misleading information when applying for a permit, either in person at room M2.08 or on line via Unity (for Staff) or E Vision (for Students) The full policy governing car parking can be obtained from Campus Facilities Room M2.08. 10 A4. LIBRARY TERMS AND CONDITIONS Regulations governing the use of Library facilities can be found here The following has been paraphrased from the document: 3. MEMBERSHIP The act of registering as a student or signing a contract of employment with the University constitutes an undertaking to accept all L&IS Regulations. All other members undertake to accept all L&IS Regulations by signing a membership application form. The TUSC is required for the issue of all loanable items. It is the responsibility of the user and is not transferable. Any PIN issued to a user is confidential. 5. USE OF UNIVERSITY RESOURCES University resources are authorised for the user s own individual academic use; they must not be given or loaned to anyone else. The use of resources must be restricted to projects concerned only with the user s own studies, research and teaching and other University purposes, for which no remuneration other than from funds administered by the University is received by the user whether directly or indirectly. 7. BORROWING REGULATIONS This section relates only to members who are registered as Borrowers. 7.1 All items are loaned at the discretion of the Director. The lending of certain categories of items is not permitted, as specified in L&IS factsheets. 7.2 A valid TUSC must be produced before any item will be issued or PIN used if renewed via the web. 7.3 Any item, other than equipment, may be returned by post, but the borrowed item remains the responsibility of the recorded borrower until it arrives in the Library and is discharged from the borrower s account. 7.4 All loaned items are the responsibility of the borrower who must keep them in good condition and from whom they are not transferable. 11 7.5 All borrowers must comply with the conditions of borrowing as outlined in this document and in L&IS webpages. 7.6 All borrowers must return all items by dates and times specified. Reminder notices are a courtesy, not entitlement. 7.7 The late return/renewal of an item will result in a penalty being charged for the item. 7.8 All L&IS items, issued to the borrower, which are lost or damaged, must be paid for at a rate sufficient to cover replacement, the precise amount to be determined in each case by the Director. 7.9 The Director, in exceptional circumstances, reserves the right to recall any item that is on loan, prior to the due date. 10. SECURITY 10.1 Users must comply with any request made to them by L&IS staff or University Security staff in connection with the enforcement of these Regulations Users must show some form of identification (ID) when requested by L&IS staff or University Security staff at any time. Anyone without adequate ID, or unwilling to show ID, may be asked to leave the Library immediately The Library Management reserves the right to restrict or change the use of certain areas of the Library. Users must not enter the designated administrative areas of the Library, without permission from a member of L&IS staff or University Security staff Users must respect agreed times for access to the Library and they must comply with requests from L&IS staff to leave the Library, or any part of it, if requested to do so by a member of L&IS staff or University Security staff CONDUCT AND PENALTIES 11.1 Instances of misconduct will result in the application of University disciplinary procedures in accordance with the University Code of Student Discipline established by the Board of Governors The Vice-Chancellor determines the level of penalties and charges, after taking advice from the Academic Board and Charges Sub-Committee Penalties will be imposed for the non-return and late return/renewal of L&IS items. 12 11.4 Any persons whose conduct, in the opinion of the Director or the senior member of L&IS staff present, is interfering with the proper use of L&IS facilities may be suspended from access to the Library and its services. They will be given a written statement of the procedures and further details In all cases of Library suspension the Director of L&IS, (copied where appropriate to School Directors) and the University Secretary will be informed in writing of the suspension from the Library, and the reason. A5. ONLINE PAYMENTS TERMS AND CONDITIONS Terms and Conditions Online Payments Please read these terms and conditions carefully before using the online payment facility. Your use of the online payment facility on this website indicates your acceptance of the terms and conditions. Terms and Conditions All payments are subject to the following terms and conditions. 1. Payments will normally reach the University account to which you are making a payment on the following working day. However, up to three working days should be allowed for transactions to be processed. 2. Refunds, if applicable, will only be made to the credit/debit card used for the original transaction. 3. Teesside University cannot accept liability for a payment not reaching the correct University account due to you quoting or inputting an incorrect account number or incorrect personal details. 4. Teesside University cannot accept liability if payment is refused or declined by the credit/debit card supplier. If payment is declined, the University is under no obligation to bring that fact to your attention. You should check with your bank/payment provider that payment has been deducted from your account. 5. In no event will Teesside University be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, or the materials or information contained on this site. 6. The payment of any sums via this facility does not in itself indicate the existence of a contract between the University and a student. 7. All payments made through this online facility must be made in pounds sterling. Any currency conversion costs or other charges incurred in making the payment or processing a refund shall be borne by the payee and shall not be deductible from the fees due to the University. 13 The payment details that you provide via this online payment facility are automatically encrypted when you enter them. This site is secured using a Thawte SSL Web Server Certificate to offer secure communications by encrypting all data. Data Protection The data that you provide during this transaction will only be used for the purpose of recording and processing your payment. Teesside University is registered as a Data Controller under the Data Protection Act 1998, and all personal data is handled in accordance with the safeguards and requirements of the Data Protection Act.
