1 GOVERNMENT RESOLUTION OF MONGOLIA 28 March 2001 Resolution No. 67 City of Ulaanbaatar Approval of the Procedures on National Immunization Based on Paragraph 1, Article 19 and Paragraph 2, Article 12 of the Immunization Law, the Government of Mongolia approves: 1. To establish the Immunization fund, and adopt the procedure of the immunization fund operation by Annex 1, adopt the chart of Fund Council by Annex To obligate P.Nyamdavaa, the Minister of Health, Ch.Ulaan, the Minister of Finance and Economics, to exercise control and oversight on the implementation of this Procedure. 2 Annex 1 of the Resolution 67/2001 of the Government of Mongolia PROCEDURE OF IMMUNIZATION FUND OPERATION ONE. GENERAL PROVISIONS 1. This procedure shall regulate relations pertaining to the Immunization special fund /hereafter the fund / including collecting and expending of the fund. 2. The primary goal of the fund is to establish a common fund for all immunization related activities from different sources. The fund shall be expended on purchase and transportation of preventive vaccination and financial support for preventive vaccination and immunization, supply of medicines, syringes and needles. 3. The fund is a independent legal entity and may use the official logo. 4. As stated in Article 5, the Budget Law of Mongolia, The Ministry of Health shall act as an authorized fund governor, the National Center for Communicable Disease /hereafter NCCD / under direct supervision of Ministry of Finance and Economics shall act as implementing agent for the fund. 5. The Government shall be responsible for establishing the fund, making changes in operations, and dissolution of the fund. TWO. FINANCING OF THE FUND 6. The Immunization Fund shall be financed from the following sources: a/ State and local budget; b/ Support and aid from all types of legal entities and citizens; c/ Support and aid from a foreign country, international and non-government organizations; d/ income from voluntary immunization fees e/ other sources
3 7. Based on the Ministry of Health proposal, Ministry of Finance and Economics shall determine the budget for allocations from the central budget for the in a given fiscal year. 8. The Ministry of Finance and Economics shall disburse the fund from the central budget based on the request from the fund governor, and shall monitor expenditures and performance of the fund. 9. Unused funds shall be reported to and approved by the Ministry of Finance and Economics at the end of the fiscal year, and shall be used for the next year activities. THREE. SPENDING OF THE FUND 10. The NCCD shall expend the fund for purchase, transportation and disbursement of preventive vaccination and immunization, supply of medicines, syringes and needles, as approved by the Fund Council. 11. Based on Article 10 of this regulation, NCCD shall implement the following activities: a/ Submit the estimation of the nationwide required vaccination, supply of medicines, syringes and needles to the Fund Council no less than twice during the particular fiscal year. b/ Have a prior approval from the Fund Council and Ministry of Health on the purchase contract for vaccination, supply of medicines, syringes and needles. Particular focus shall be given on the amount, transportation, and supply conditions from vendors. c/ Cooperate with city and aimag health authorities on procurement, storage, transportation, stocking, and distribution of the vaccination and biomedicine. d/ Ensure the supply of vaccination and biomedicine meets state standards, and its transportation and storage meet necessary conditions and hygienic requirements. e/ Make the payment only in the form of a bank transfer for vaccinations, medicines, syringes and needles, cold chains and transportation to vendors based on vendor invoices and performance report.
4 f/ Prepare the financial statement of the fund on a quarterly and annual basis and submit to the Fund Council. FOUR. VOLUNTARY VACCINATION AND PREVENTIVE MEDICINE FEE REGULATIONS 12. Based on Section d, Article 6 of this regulation voluntary vaccination and preventive medicine /hereafter preventive vaccination / fee shall be deposited in the fund. 13. Business entities and organizations in the businesses with required preventive vaccination shall submit a list of employees for each type of preventive vaccination before January 25 of each year. 14. Preventive vaccination for epidemiological grounds shall be financed from the Fund. 15. Business entities and organizations in the services and businesses that require preventive vaccination shall be responsible for the preventive vaccination fee. Selfemployed citizens in the services and businesses that require preventive vaccination, shall be responsible for the preventive vaccination fee. FIVE. MONITORING AND EVALUATION 16. The State Health Inspection Authority and other related organizations shall have control over the quality, effectiveness, storage, and transportation of the vaccination, medicines, syringes and needles, and cold chains purchased by the Fund financing. 17. Expenditures on purposes not stipulated by the regulation are prohibited. 18. If the provisions of this regulation are violated and/or if expenditures from the Fund for purposes not stipulated by the regulation have occurred, sanctions in accordance to the related law of Mongolia shall be imposed on the guilty official.
5 Annex 2 of the Resolution 67/2001 of the Government of Mongolia IMMUNIZATION FUND COUNCIL CHART ONE. GENERAL PROVISIONS 1. This chart shall regulate operations of the non-staff fund council /hereafter the council / to utilize the Fund resources. 2. The council shall operate in accordance with the Immunization law of Mongolia and National Immunization Program. The council shall be responsible for developing guidelines for immunization planning, organizing and implementing immunization activities, and collecting the income for the Fund from different resources, allocating them and monitoring Fund expenditures. The fund shall be expensed for the purposes of prevention, reduction and eradication of communicable diseases. 3. The council members shall be supervised by the Vice Minister of Health, and approved by a joint order of the Minister of Health and Minister of Finance and Economics. 4. The council shall meet on a quarterly basis. The meeting agenda shall be discussed by the Council members before the meeting. The council shall meet for non-routine meetings if necessary. 5. The NCCD shall be responsible for the administrative work of the council. 6. The council shall make decisions based on majority votes. The council meeting shall produce resolution, guidelines, and manuals. 7. The council shall discuss the fund quarterly, semi-annual, annual financial statements, and shall make decisions on the fund allocation, immunization policy, planning, and implementation issues.
6 TWO. RIGHTS AND RESPONSIBILITIES OF THE COUNCIL 8. The council shall have the following responsibilities: a/ Collect money for the fund and make decisions on fund allocation; b/ Cooperate with Ministry of Health and Ministry of Finance and Economics on planning allocations from the state budget to the Immunization fund for each fiscal year. c/ Monitor the Fund income and expenditures and discuss any issue with the Ministry of Finance if necessary. d/ Increase citizens and legal entities involvement in raising the fund. e/ Provide technical support to improve Fund operations. f/ Request an audit from the state audit office in fund utilization and spending. If any violations have occurred, the council shall take actions for removing the damage and preventive measures. g/ Provide proposals on vaccine and transportation costs that shall be financed by the Fund to the Ministry of Health. 9. The council shall have the following rights: a/ Request financial and operational reports of the Fund, immunization information, and research from the related government organization by a certain time frame. b/ Request information on quality, supply condition, and cost for vaccines and preventive medicines selected by government tender. c/ Monitor the fund utilization. Request to establish a working group to improve the Fund operation, and resource utilization. Provide guidelines and suggestions for improvement.
7 d/ Propose sanctions and/or penalties to be imposed on the legal entity and /or any citizen who has expended on the Fund for purposes not stipulated by the regulation.
