Telephone Banking: I request authorization to use Millbury Savings Bank Telephone Banking, and understand and agree to the following terms and conditions. Funds may be transferred between statement accounts only. (Passbook Savings and Certificate of Deposit accounts are not eligible.) The bank has the right to withdraw funds from any account standing in the name of an account owner to satisfy any transaction initiated through Telephone Banking. All Telephone Banking transactions are subject to verification by the bank. The bank is not responsible for the failure or malfunction of Telephone Banking. The bank has the right to restrict Telephone Banking access due to misuse. New customers may have to wait 30 days for access. Online Banking/Online Bill Payment/Mobile Banking: I agree to abide by the terms and conditions of Millbury Savings Bank s Electronic Funds Transfer Agreement and Disclosures. In selecting Online Bill Payment, I authorize Millbury Savings Bank to post Bill Payment transactions received via the internet from the Online Bill Payment to the Bill Payment account selected. My use of Online Bill Payment signifies acceptance of all the terms and conditions detailed in the Electronic Funds Transfer Disclosure and Agreement and to the online Terms and Conditions of Online Bill Payment. I understand that: I control my account; payments may take up to 10 business days to reach a vendor; payments may be made either electronically or by check; and I am responsible for any loss or penalty due to lack of sufficient funds or other conditions that prevent transactions from being processed to/from my account. My use of Mobile Banking signifies acceptance of all the terms and conditions detailed in the Electronic Funds Transfer Disclosure and Agreement and to the online Terms and Conditions of Mobile Banking. 2 ELECTRONIC FUND TRANSFER DISCLOSURE AND AGREEMENT Millbury Savings Bank 109 Elm Street Millbury, Massachusetts (508) MillburySavings.com For purposes of this disclosure and agreement the terms "we", "us" and "our" refer to Millbury Savings Bank. The terms "you" and "your" refer to the recipient of this disclosure and agreement. The Electronic Fund Transfer Act and Regulation E require institutions to provide certain information to customers regarding electronic fund transfers (EFTs). This disclosure applies to any EFT service you receive from us related to an account established primarily for personal, family or household purposes. Examples of EFT services include direct deposits to your account, automatic regular payments made from your account to a third party and one-time electronic payments from your account using information from your check to pay for purchases or to pay bills. This disclosure also applies to the use of your ATM Card (hereinafter referred to collectively as "ATM Card") or Debit Card (hereinafter referred to collectively as "Debit Card") at automated teller machines (ATMs) and any networks described below. TERMS AND CONDITIONS. The following provisions govern the use of EFT services through accounts held by Millbury Savings Bank which are established primarily for personal, family or household purposes. If you use any EFT services provided, you agree to be bound by the applicable terms and conditions listed below. Please read this document carefully and retain it for future reference. DEFINITION OF BUSINESS DAY. Business days are Business days are Monday through Friday, excluding federal holidays. ELECTRONIC FUND TRANSFER SERVICES PROVIDED ATM CARD SERVICES. The services available through use of your ATM card are described below. ATM CARD SERVICES. You may withdraw cash from your checking account(s), money market account(s), and statement-type savings You may make deposits into your checking account(s), money market account(s), and statement-type savings You may transfer funds between your statement-type You may make balance inquiries on your checking account(s), money market account(s), and statement-type savings DEBIT CARD SERVICES. The services available through use of your debit card are described below. DEBIT CARD SERVICES. You may withdraw cash from your checking account(s), money market account(s), and statement-type savings You may make deposits into your checking account(s), money market account(s), and statement-type savings You may transfer funds between your statement-type You may make balance inquiries on your checking account(s), money market account(s), and statement-type savings You may use your card at any merchant that accepts MasterCard debit cards for the purchase of goods and services. Your card may also be used to obtain cash from your designated account at participating financial institutions when so authorized under the terms of your Account Agreement. ATM SERVICES NETWORK. Your ability to perform the transactions or access the accounts set forth above depends on the location and type of ATM you are using and the network through which the transaction is being performed. A specific ATM or network may not perform or permit all of the above transactions. You may access your ATM Card or Debit Card through the following network(s): Cirrus, NYCE, PLUS, SUM, MasterCard, Discover/Novus, AMEX, ACCEL/Exchange. ATM FEES. When you use an ATM not owned by us, you may be charged a fee by the ATM operator or any network used, and you may be charged a fee for a balance inquiry even if you do not complete a fund transfer. POINT OF SALE TRANSACTIONS. Listed below are the cards you may use to purchase goods and services from merchants that have arranged to accept your cards as a means of payment (these merchants are referred to as "Participating Merchants"). Some Participating Merchants may permit you to receive cash back as part of your purchase. Purchases made with your cards, Electronic Fund Transfer Disclosure And Agreement - DD8108 Page 1 of 9

3 including any purchase where you receive cash, are referred to as "Point of Sale" transactions and will cause your "designated account" to be debited for the amount of the purchase. We have the right to return any check or other item drawn against your account to ensure there are funds available to pay for any Point of Sale transaction. We may, but do not have to, allow transactions which exceed your available account balance or, if applicable, your available overdraft protection. If we do, you agree to pay the overdraft. The following cards and the corresponding designated account(s) may be used for Point of Sale transactions: Debit Card: Statement Accounts. ATM Card: Statement Accounts. CURRENCY CONVERSION - MasterCard. If you perform transactions with your card with the MasterCard logo in a currency other than US dollars, MasterCard International Inc. will convert the charge into a US dollar amount. At MasterCard International they use a currency conversion procedure, which is disclosed to institutions that issue MasterCard. Currently the currency conversion rate used by MasterCard International to determine the transaction amount in US dollars for such transactions is generally either a government mandated rate or wholesale rate, determined by MasterCard International for the processing cycle in which the transaction is processed, increased by an adjustment factor established from time to time by MasterCard International. The currency conversion rate used by MasterCard International on the processing date may differ from the rate that would have been used on the purchase date or the cardholder statement posting date. IMPORTANT ADDITIONAL FEE NOTICE: MasterCard charges us a Currency Conversion Fee of 0.20% of the transaction amount for performing currency conversions and a Cross-Border Fee of 0.80% of the transaction on all cross-border transactions (even those with no currency conversion). Therefore, you will be charged 1.00% of the dollar amount on all cross-border transactions - i.e., transactions processed through the "Global Clearing Management System" or the "MasterCard Debit Switch" when the country of the merchant or machine is different than your country, as cardholder. SERVICES PROVIDED THROUGH USE OF TELEPHONE BANKING. You may perform the following functions through use of Telephone Banking: You may initiate transfers of funds between your between your statement You may make balance inquiries on your statement In addition, you may perform other transactions such as: making payments on consumer loans and home mortgage loans that you have with us from your statement PREAUTHORIZED TRANSFER SERVICES You may arrange for the preauthorized automatic deposit of funds to your checking account(s), savings account(s), and money market account(s). You may arrange for the preauthorized automatic payment of bills from your checking account(s), money market account(s), and statement-type savings SERVICES PROVIDED THROUGH USE OF ONLINE BANKING, ONLINE BILL PAYMENT, AND MOBILE BANKING. Millbury Savings Bank offers its customers use of our Online Banking, Online Bill Payment, and Mobile Banking service. DEFINITIONS "Online Banking" is the Internet-based service providing access to your account(s) under the terms set forth in this Agreement. "Mobile Banking" is the mobile phone-based service providing access to your account(s) under the terms set forth in this Agreement. "Online Bill Payment" is the Internet-based service providing payments to third parties from your designated Millbury Savings Bank account(s). "Online Bill Payment Account" is the transaction account from which you are initiating an Online Bill Payment. "Password" is a series of numbers and letters that you select that establishes your connection to these Services. "Payment Initiation Date" is the date you enter into Online Banking when setting up a bill payment. "Time of day" references are to Eastern Standard Time. HOURS OF OPERATION. The Services are generally available 24 hours a day, 7 days a week, except during special maintenance and upgrade periods, which routinely are scheduled between 12:00 a.m. and 5:00 a.m. Monday mornings USE OF YOUR SECURITY PASSWORD. Access to these services requires a user ID and password. You agree not to allow anyone to gain access to these services or disclose your password used for the services to anyone. You agree to assume responsibility for all transactions initiated through these services with your access ID, up to the limits allowed and applicable by law. 4 ILLEGAL USE OF SERVICES. You agree not to use Online Banking, Online Bill Payment, or Mobile Banking Services for any illegal transactions, including internet gambling and similar activities. SERVICES PROVIDED THROUGH ONLINE BANKING. These services are available for statement accounts that you enroll in Online Banking: Check account balances; review account history to confirm deposits and checks cleared; view all ATM, debit card, and Online Banking transactions; download account information into popular money management software packages; transfer funds between your Millbury Savings Bank statement-type accounts; and make Millbury Savings Bank loan payments. ONLINE BILL PAYMENT The Online Bill Payment Service permits you to use your Internet-abled device to direct payments from your designated Online Bill Payment checking account to third parties you wish to pay and who accept bill payment services. SERVICES PROVIDED THROUGH ONLINE BILL PAYMENT. Pay bills from your designated "Payment Account" to business payees (any business, merchant, or professional that generates a bill or invoice for products or services provided to you on your behalf and that has an address we can verify) and individual payees (individuals, family, or friends for non-business purposes). You may set up the following types of bill payments: Single Payments to be made to a payee one time, or Recurring Payments of fixed amounts to a single payee in recurring intervals. All payments you make will be deducted from the account you designate as your Online Bill Payment account on the Payment Initiation Date. Any payments you wish to make through this Service must be payable in U.S. dollars to a payee located in the continental United States. We reserve the right to restrict or limit the number of transactions processed through this Service from time to time. Further, we reserve the right to check your credit history at enrollment and obtain follow-up credit history reports at a later date. You should not use the Online Bill Payment Service to make payments to settle securities purchases, payments to interest bearing accounts, tax payments, or court-ordered payments (e.g., alimony or child support payments). Payments, additional fees, fines, penalties or other losses associated with payments to these payees that are delayed or improperly addressed or credited are your sole responsibility. Funds must be available in your Online Bill Payment Account, including overdraft lines of credit, on the scheduled Payment Initiation Date. If the Payment Initiation Date falls on a non-business Day (i.e., Saturday, Sunday or holiday), funds must be available in your Online Bill Payment Account the following Business Day (i.e., Monday or the next Business Day following a holiday). After funds are withdrawn from your Online Bill Payment Account to make a payment, we may make the payment either by transferring funds electronically to the payee or by mailing the payee a check. If your Online Bill Payment Account does not have sufficient available funds to make a payment as of the Payment Initiation Date, the payment will be canceled and no further attempt will be made by Millbury Savings Bank or its agent to make the transfer or payment. The Bank or its agent will attempt to notify you by or U.S. Postal Mail, but shall have no obligation or liability if it does not complete a transfer or payment because there are insufficient available funds in your account to process a transaction. In all cases, you are responsible for either making alternate arrangements for the payment or rescheduling the payment through the Online Bill Payment Service. In the case of recurring payments, only the payment currently scheduled will be canceled. Recurring payments scheduled for future dates will not be affected. In the event you have sufficient funds to make some, but not all, of the bill payments scheduled for a particular payment date, Millbury Savings Bank or its agent may use its sole discretion in determining which payments to complete. If the session during which you schedule a payment or transfer ends by 7:00 p.m. EST, Millbury Savings Bank will be considered to have received it on that day. Otherwise, it will be considered as received the following Business Day. For all entries made using the Service, the time recorded by the Online Banking service controls. You may cancel or change a scheduled payment by using the payment screens in the Online Bill Payment Service. Payments must be changed or canceled using the Online Bill Payment Service prior to 7:00 p.m. EST on the Business Day the transaction will be initiated. If you ask us to cancel a payment after it is issued and we agree to do so, we will charge you a stop payment fee to stop the bill payment. Stop payment orders, whether oral, written, or electronic, will be in effect for a period of six months. If requested by Millbury Savings Bank, you will confirm any stop payment order in writing within 14 days. After six months, any stop payment will terminate and must be renewed to continue in effect. Millbury Savings Bank may pay any item that is presented following the lapse of any stop payment order. Note that when a stop payment order is on a consumer account EFT debit transfer, this stop payment order will remain in effect until your withdrawal of the stop payment order. 5 ONLINE BILL PAYMENT GUARANTEE. Millbury Savings Bank reserves the right to refuse any transaction if the Bank believes such refusal is necessary for security reasons, without any liability for damages or fees. However, if the Bank does not properly complete a transfer to or from your account on time or in the correct amount according to our Agreement with you, we will reimburse you for any late payment fees or penalties you are charged up to a maximum of $50.00 per scheduled payment. In order for you to be eligible for reimbursement, you must meet each of the following conditions: 1) You must properly schedule the payment to be initiated on a date at least four (4) Business Days prior to the bill's actual due date. This means that you must initiate a single payment before 7:00 p.m. Eastern Standard Time on a Business Day at least four (4) days prior to the bill's actual due date. For recurring payments, this means that you must allow additional time for months in which weekends or holidays reduce the number of Business Days between the recurring Payment Initiation Date and the bill's actual due date. 2) You must provide us with the correct Payee name, address, phone number and account information, and with the correct payment amount. 3) On the Payment Initiation Date, your checking account must contain sufficient available funds, including overdraft lines of credit, to complete the payment. 4) The late payment fee or penalty, or the method of its calculation, must be published by the payee prior to the bill's actual due date. 5) The Service will not process any payments less than $1.00 or greater than $99, ) You can schedule a Payment Due Date up to a year in advance. MOBILE BANKING By participating in the Mobile Banking Service or using the Service, you agree that the Services or Software may require the use of your handheld device's data and text messaging capabilities and that standard data and text messaging charges apply in accordance with your Service Agreement with your Mobile Services Provider. You agree that Millbury Savings Bank is not responsible for any charges you may incur while using the Services and Software as part of this agreement. SERVICES PROVIDED THROUGH MOBILE BANKING. Check account balances; review account history to confirm deposits and checks cleared; transfer funds between your designated Millbury Savings Bank statement-type accounts; make, change, or cancel payments to Online Bill Payment service third-party payees. NEW SERVICES. New services may be introduced for Online Banking, Online Bill Payment, and/or Mobile Banking from time to time. Millbury Savings Bank will notify you of these new services. By using these services when they become available, you agree to be bound by the rules that will be made available to you concerning these services. ELECTRONIC CHECK CONVERSION. You may authorize a merchant or other payee to make a one-time electronic payment from your checking account using information from your check to pay for purchases or to pay bills. LIMITATIONS ON TRANSACTIONS TRANSACTION LIMITATIONS - ATM CARD CASH WITHDRAWAL LIMITATIONS: You may withdraw up to $ through use of ATMs in any one day. There is a daily limit for all ATM withdrawal transactions. For security reasons, specific dollar limits are disclosed at the time the ATM Card is issued. Millbury Savings Bank reserves the right to change dollar amount limits at any time upon prior notification. POINT OF SALE LIMITATIONS: You may buy up to $ worth of goods or services in any one day through use of our Point of Sale service. TOTAL DAILY LIMITS: In addition to the ATM limit or Point of Sale limits disclosed above, a total daily limit is imposed on these transactions. The maximum amount of cash withdrawals and Point of Sale transactions is limited to $ in any one day. TRANSACTION LIMITATIONS - DEBIT CARD CASH WITHDRAWAL LIMITATIONS: You may withdraw up to $ through use of ATMs in any one day. There is a daily limit for all ATM withdrawal transactions. For security reasons, specific dollar limits are disclosed at the time the Debit Card is issued. Millbury Savings Bank reserves the right to change dollar amount limits at any time upon prior notification. In addition to the cash withdrawal and PIN-based Point of Sale limits disclosed above, a total daily limit is imposed on these transactions. You have the ability to lower your daily ATM/debit card withdrawal limit to $ You may purchase up to $1, worth of goods and services in any one day through use of our signature-based Point of Sale service. 6 OTHER LIMITATIONS The terms of your account(s) may limit the number of withdrawals you may make each month. Restrictions disclosed at the time you opened your account(s), or sent to you subsequently will also apply to your electronic withdrawals and electronic payments unless specified otherwise. We reserve the right to impose limitations for security purposes at any time. NOTE: Passbook accounts do not have electronic debit capabilities. LIMITS ON TRANSFERS FROM CERTAIN ACCOUNTS. Federal regulation limits the number of checks, telephone transfers, online transfers and preauthorized electronic transfers to third parties (including Point of Sale transactions) from money market and savings type You are limited to six such transactions from each money market and/or savings type account(s) you have each statement period for purposes of making a payment to a third party or by use of a telephone or computer. NOTICE OF RIGHTS AND RESPONSIBILITIES The use of any electronic fund transfer services described in this document creates certain rights and responsibilities regarding these services as described below. RIGHT TO RECEIVE DOCUMENTATION OF YOUR TRANSFERS TRANSACTION RECEIPTS. Depending on the location of an ATM, you may not be given the option to receive a receipt if your transaction is $15.00 or less. Upon completing a transaction of more than $15.00, you will receive a printed receipt documenting the transaction (unless you choose not to get a paper receipt). These receipts (or the transaction number given in place of the paper receipt) should be retained to verify that a transaction was performed. A receipt will be provided for any transaction of more than $15.00 made with your ATM Card or Debit Card at a Participating Merchant. If the transaction is $15.00 or less, the Participating Merchant is not required to provide a receipt. PERIODIC STATEMENTS. If your account is subject to receiving a monthly statement, all EFT transactions will be reported on it. If your account is subject to receiving a statement less frequently than monthly, then you will continue to receive your statement on that cycle, unless there are EFT transactions, in which case you will receive a monthly statement. In any case you will receive your statement at least quarterly. OTHER RIGHTS TO RECEIVE DOCUMENTATION OF YOUR TRANSFERS. DOCUMENTATION AS EVIDENCE OF TRANSFER. Any documentation that is provided to you which indicates that an electronic fund transfer was made shall be admissible as evidence of such transfer and shall constitute prima facie proof that such transfer was made to another person. PREAUTHORIZED DEPOSITS. If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company: you can call us at to find out whether or not the deposit has been made. PASSBOOK ACCOUNTS. If the only type of electronic fund transactions are preauthorized deposits you will not receive a statement for your Passbook account. If you bring your Passbook to us, we will record any electronic deposits that were made to your account since the last time you brought in your Passbook. You will not receive a periodic statement noting these transactions on your Passbook account. USING YOUR CARD AND PERSONAL IDENTIFICATION NUMBER ("PIN"). In order to assist us in maintaining the security of your account and the terminals, the ATM Card or Debit Card remains our property and may be revoked or canceled at any time without giving you prior notice. You agree not to use your ATM Card or Debit Card for a transaction that would cause your account balance to go below zero, or to access an account that is no longer available or lacks sufficient funds to complete the transaction, including any available line of credit. We will not be required to complete any such transaction, but if we do, we may, at our sole discretion, charge or credit the transaction to another account; you agree to pay us the amount of the improper withdrawal or transfer upon request. Your ATM Card may only be used with your PIN. Certain transactions involving your Debit Card require use of your PIN. Your PIN is used to identify you as an authorized user. Because the PIN is used for identification purposes, you agree to notify Millbury Savings Bank immediately if your ATM Card or Debit Card is lost or if the secrecy of your PIN is compromised. You also agree not to reveal your PIN to any person not authorized by you to use your ATM Card or Debit Card or to write your PIN on your ATM Card or Debit Card or on any other item kept with your ATM Card or Debit Card. We have the right to refuse a transaction on your account when your ATM Card or Debit Card or PIN has been reported lost or stolen or when we reasonably believe there is unusual activity on your account. The security of your account depends upon your maintaining possession of your ATM Card or Debit Card and the secrecy of your PIN. You may change your PIN if you feel that the secrecy of your PIN has been compromised. You may change your PIN for your ATM Card or Debit Card using our Interactive Voice Response telephone service by calling RIGHTS REGARDING PREAUTHORIZED TRANSFERS RIGHTS AND PROCEDURES TO STOP PAYMENTS. If you have instructed us to make regular preauthorized transfers out of your account, you may stop any of the payments. If you call, please have the following information ready: your account number, the date the transfer is to take place, to whom the transfer is being made and the amount of the scheduled transfer. If you call, we will require you to put your request in writing and deliver it to us within fourteen (14) days after you call. NOTICE OF VARYING AMOUNTS. If you have arranged for automatic periodic payments to be deducted from your checking or savings account and these payments vary in amount, you will be notified by the person or company you are going to pay ten days prior to the payment date of the amount to be deducted. OUR LIABILITY FOR FAILURE TO STOP PREAUTHORIZED TRANSFER PAYMENTS. If you order us to stop one of the payments and have provided us with the information we need at least three (3) business days prior to the scheduled transfer, and we do not stop the transfer, we will be liable for your losses or damages. YOUR RESPONSIBILITY TO NOTIFY US OF LOSS OR THEFT. CONSUMER LIABILITY. Tell us at once if you believe your ATM Card or Debit Card or PIN or internet banking access code has been lost or stolen or used without permission or if you believe that an electronic fund transfer has been made without your permission using information from your check. Telephoning is the best way of keeping your possible losses down. Your liability shall not exceed $50.00 for any unauthorized electronic fund transfer or a series of transfers arising from a single loss or theft of your ATM Card or Debit Card or PIN. Also, if your statement shows transfers you did not make, including those made by card, code, or other means, tell us at once. If you do not tell us within 60 days after the statement was transmitted to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods. CONSUMER LIABILITY FOR UNAUTHORIZED TRANSACTIONS INVOLVING DEBIT CARD. The limitations on your liability for unauthorized transactions described above generally apply to all electronic fund transfers. However, different limitations apply to certain transactions involving your card with the MasterCard branded card. If you promptly notify us about an unauthorized transaction involving your card and the unauthorized transaction took place on your MasterCard branded card, including any PIN-based ATM or POS transactions, zero liability will be imposed on you for the unauthorized transaction. In order to qualify for the zero liability protection, you must have exercised reasonable care in safeguarding your card from the risk of loss or theft and, upon becoming aware of such loss or theft, promptly reported the loss or theft to us. ILLEGAL USE OF DEBIT CARD. You agree not to use your Debit Card for any illegal transactions, including internet gambling and similar activities. 8 Notification should be made as soon as possible if you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. You must contact Millbury Savings Bank no later than 60 days after we sent you the first statement on which the problem or error appears. You must be prepared to provide the following information: Your name and account number. A description of the error or transaction you are unsure about along with an explanation as to why you believe it is an error or why you need more information. The dollar amount of the suspected error. If you provide oral notice, you will be required to send in your complaint or question in writing within ten (10) business days. We will determine whether an error occurred within ten (10) business days (twenty (20) business days for new accounts) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days (ninety (90) days for new accounts and foreign initiated or Point of Sale transfers) to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days (twenty (20) business days for new accounts) for the amount which you think is in error, so that you will have the use of the money during the time it takes to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account. The extended time periods for new accounts apply to all electronic fund transfers that occur within the first thirty (30) days after the first deposit to the account is made, including those for foreign initiated or Point of Sale transactions. We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation. Please see our error resolution forms and related information regarding electronic disputes provided under the Quick Links menu of our website. LIABILITY FOR FAILURE TO COMPLETE TRANSACTION. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages as provided by law. However, there are some exceptions. We will NOT be liable, for instance: If through no fault of ours, you do not have enough money in your account to make the transfer. If the transfer would result in your exceeding the credit limit on your line of credit, if you have one. If the electronic terminal was not working properly and you knew about the breakdown before you started the transfer. If circumstances beyond our control (such as fire or flood, computer or machine breakdown, or failure or interruption of communications facilities) prevent the transfer, despite reasonable precautions we have taken. If we have terminated our Agreement with you. When your ATM Card or Debit Card has been reported lost or stolen or we have reason to believe that something is wrong with a transaction. If we receive inaccurate or incomplete information needed to complete a transaction. In the case of preauthorized transfers, we will not be liable where there is a breakdown of the system which would normally handle the transfer. If the funds in the account are subject to legal action preventing a transfer to or from your account. If the electronic terminal does not have enough cash to complete the transaction. There may be other exceptions provided by applicable law. CHARGES FOR TRANSFERS OR THE RIGHT TO MAKE TRANSFERS FEES. You may be charged a fee for withdrawals of cash under certain circumstances, whether they take place at proprietary machines or through a network or are Point of Sale transfers or transfers made without the use of your ATM Card or Debit Card. The circumstances under which such charges will be assessed, as well as the amount of the charge, are included in the current fee schedule, which is hereby incorporated into this document. SCHEDULE OF FEES. The schedule of fees referred to above is being provided separately and is incorporated into this document by reference. Additional copies of the schedule may be obtained from Millbury Savings Bank upon request. PREAUTHORIZED TRANSACTIONS. There are no additional charges for your use of preauthorized electronic fund transfers except as stated in our fee schedule, which is incorporated into this document by reference. Millbury Savings Bank offers Online Banking, Online Bill Payment, and Mobile Banking services to you at no monthly charge. Any other charges may be assessed at the rates published in the bank's fee schedule These fees are subject to change. Millbury Savings Bank will notify you in writing regarding any fee changes at least thirty (30) days in advance of the effective date of these changes. 9 DISCLOSURE OF ACCOUNT INFORMATION. You agree that merchant authorization messages transmitted in connection with Point of Sale transactions are permissible disclosures of account information, and you further agree to release Millbury Savings Bank and hold it harmless from any liability arising out of the transmission of these messages. We will disclose information to third parties about your account or electronic fund transfers made to your account: 1. Where necessary to complete a transfer or to investigate and resolve errors involving the transfer(s); or 2. In order to verify the existence and condition of your account for a third party such as a credit bureau or merchant; or 3. In order to comply with government agency or court orders; or 4. If you give us your permission in a record or writing. AMENDING OR TERMINATING THE AGREEMENT. You are responsible for complying with all the terms of this Agreement and with the terms of the agreement governing the deposit accounts which you access these Services. We may terminate any of the services that have been agreed to under this Agreement for any reason and at any time without prior notice to you, or if you do not pay any fee required by this Agreement when due, or if you do not comply with the Agreement governing your deposit or loan accounts, or your accounts are not maintained in good standing. We will promptly notify you if we terminate this Agreement or your use of the Services for any other reason. Millbury Savings Bank may modify the terms and conditions applicable to any Service from time to time upon mailing or delivering a notice of the modifications to you at the address shown on our account records, and the revised terms and conditions shall be effective at the earliest date allowed by applicable law. You will be notified at least 30 days before a change will take effect if it will cause you an increase in costs or liability or it will limit your ability to make electronic fund transfers. We may send any notice to you via electronic mail and you will have been deemed to have received it three (3) days after it is sent. No notice will be given if the change is necessary for security reasons, or for inactivity of your ATM card, Debit Card, Online Banking, Mobile Banking or Online Bill Payment service as described below. If the account is a joint account, any owner of the account may terminate this Agreement, and the termination will apply to all joint owners on the account. If either you or we terminate your services under this Agreement, we will no longer have to complete any of your electronic fund transactions. For preauthorized transfers, you must terminate any agreement authorizing transfers to or from your account by notifying the person or company initiating the transfer. You will remain obligated to us under this Agreement for all of your transactions, even if they occur or are completed after this Agreement has ended. Termination of your electronic fund transfer service does not terminate your account(s) with us. Closing the account to which the service relates simultaneously terminates your electronic fund transfer service. We may convert your Online Banking and Online Bill Payment account to inactive status without additional notification if you do not sign on to the Service or have any transaction scheduled through the Service during any consecutive ninety (90) day period. If your account is considered inactive, you must contact us to have the Service re-activated before you will be able to schedule any transaction through the Service. We may close your ATM Card or Debit Card without additional notification if you do not use the card to make a transaction during any consecutive twelve (12) month period. If your card is closed, you must contact us to obtain a new card. You may terminate your right to any of the services that you have agreed to under this Agreement by giving us written notice. Your notification should include your name, address and the effective date to stop the Service(s).
