1 CITY OF MONTROSE PLANNING COMMISSION AGENDA City Council Chambers, 107 S Cascade Ave., Montrose, Colorado 5:00 p.m., November 14, 2018 The 11:00 rule will be enforced. All public hearings scheduled and noticed to be heard today must begin prior to 11:00 p.m. or they will be rescheduled. If the Planning Commission is discussing an agenda item, but has not voted on the item before 11:00 p.m., the Planning Commission may take a vote to decide whether to vote on the agenda item or to continue the item to the next meeting. The Planning Commission may also vote to consider discussion and action on additional agenda items that require action in a specified time period due to legal requirements. All remaining agenda items, not heard due to time constraints, will be placed first on the next Planning Commission Agenda. 1. Approval of the minutes dated October 24, Additions or Deletions. 3. 2 The Montrose City Planning Commission held a meeting on October 24, 2018, at 5:00 p.m. in City Hall Council Chambers. The meeting agenda was posted in accordance with the Colorado Open Meetings Act (C.R.S , et.seq.). PRESENT Karen Vacca, Gary Seitz, Vince Fandel, Anthony Russo and City staff Garry Baker, Sharon Dunning, Christine Aslakson and Ryan Cushenan were present. ABSENT None GUESTS None CALL TO ORDER Chairperson Gary Seitz called the meeting to order at 5:07 p.m. APPROVAL OF MINUTES Vince Fandel moved to approve the minutes of the September 26, 2018 meeting as submitted. Karen Vacca seconded and the motion carried unanimously. ADDITIONS OR DELETIONS Garry Baker stated there will need to be two motions on the agenda item. VARIANCE S 1 ST STREET. This is a request for a variance from setbacks and landscaping. Probuild is the applicant. Garry Baker introduced this item. All public requirements have been fulfilled and the official files and exhibits were entered into the record. Pro-Build has applied for a variance from corner setback requirements to place a 26-foot by 150- foot three-sided storage building 5 feet from the property line on Grand Avenue frontage. The property is currently used as a lumber/storage yard for Pro-Build and this building would contribute to that existing use. The property is located in the B-3 zone which has a corner

3 Planning Commission October 24, 2018 Page 2 setback requirement of 25 feet. The request is for a 20-foot variance from that requirement to place the building 5 feet from the property line. The construction of this building is triggering the site development review process by the City. Pro-Build is also requesting a variance from the landscaping requirements of site development. Site development requires that 8% of the property not covered by buildings be landscaped. If enforced, site development would require the applicant to landscape approximately 2,134 square feet of the lot plus 3 trees and 9 shrubs. In summary this building proposal triggers two variances, one for setback and the other is from landscaping. Some sidewalk and city landscaping have improved the look of the area, balancing the impact from the lumber yard. The nature of the area and an accessory building are good arguments for not requiring additional landscaping. Staff feels that all the criteria have been met and recommends approval of the request. Vince Fandel asked if the building will go where the lumber is now, and asked what variance to landscaping is being requested. Garry Baker replied the building would go where the lumber is now, and the request is for a total landscaping variance. Planning Commissioners discussed the variance requests and were concerned about the request for no landscaping. Garry Baker responded the cost of landscaping could be pretty significant relative to the cost of the building. Anthony Russo asked if the Planning Commission could enforce landscaping on the front end only. He is thinking about the long term and making it more attractive at least from the front. Andrew Boyko responded it is up to the Planning Commission if it wants to approve a reduced amount of landscaping. The applicant was not present. Garry Baker suggested to continue the discussion to the next meeting. The public testimony portion of the hearing was closed. Vince Fandel moved to approve Variance for Lot 1, Old Mill Subdivision known as 10 S 1 st Street, a variance from setbacks requirements. Anthony Russo seconded and the motion passed unanimously. Anthony Russo moved to table Variance for Lot 1, Old Mill Subdivision, known as 10 S 1 st Street, a variance from landscaping requirements, to the November 14, 2018 meeting. Karen Vacca seconded and the motion passed unanimously. OTHER BUSINESS Anthony Russo announced there will be an Opportunity Zone meeting on November 8, 2018 at 10:00 a.m., tentatively in the Centennial Room at City Hall.

Pro-Build is also requesting a variance from the landscaping requirements of site development. Site development requires that 8% of the property not covered by buildings be landscaped. If enforced, site development would require the applicant to landscape approximately 2,134 square feet of the lot plus 3 trees and 9 shrubs.

6 The landscaping variance criteria are as follows: City Code, Section (H) (1) Variances by the Planning Commission may be granted from the requirements of Subsection (B)(1) above if it determines following the review procedure of Section of City Zoning Regulations that all the criteria of this Subsection (H) are met: (a) (b) (c) (d) (e) (f) The variance is requested for an addition to an existing building or construction of a purely accessory structure. The variance will not adversely affect the public health, safety or welfare. The addition or structure will have a de minimus effect on traffic, parking and drainage. The variance requested is the minimum variance that will afford relief. The variance will not result in development incompatible with other property or buildings in the area and will not affect or impair the value, use or development of other property. Strict compliance is technically infeasible or the cost of the required site improvements is substantially more than the cost of the addition or structure or the scope of the addition or structure is insignificant with respect to the structures already on the premises. Staff Recommendation: Staff feels that all the criteria have been met and recommends approval of the request. Approval Motion Recommendation: "I hereby make a motion to approve the variance. The variance meets the Code criteria based on the testimony presented at this hearing and in the staff report." Denial Motion Recommendation: "I hereby make a motion to deny the variance. First Street, Pro Build Site Development Project This letter is to serve as a request for a variance for both property line set-back requirements as well as landscape requirements for the subject property located within B-3 zoning. The property is located at 10 S. First Street and is currently being used as a lumber/material storage yard for Pro-Build and will continue to be used for lumber/material storage. The project will be adding a 26'x150' three-sided storage building and associated loading dock and ramp. The size of the building triggers the City Site Development process. The developer is specifically requesting a variance to the Zoning Regulations, Section regarding set-back requirements. The property is located on a comer lot which would require a 25' set-back along the Grand Avenue frontage. Utilizing a 25' set-back would result in a large majority of the property being unusable for a building given the triangle-like shape of the property. It is proposed to place the new building approximately 5' off of the existing fence which would match the nearby properties located on Grand Avenue that currently have buildings at a O' set-back. The developer is requesting the set-back requirement be reduced to 5'. The developer is also requesting a variance from all landscaping requirements set-forth by the Site Development Process. The property is located along Grand Avenue which was recently redone by the City and the project incorporated landscaping along the entire length of the property. Landscaping would also greatly reduce the amount of the site that is usable for the proposed project. The variances requested will not adversely affect the public health, safety and welfare. The project's intended use is defined in and a set-back and landscape requirement would make it unfeasible to develop the property for the purpose intended. The variance requested is the minimum variance that will afford relief and allow for the reasonable use of the property. The variance will not result in development incompatible with other property or buildings in the area, and will not affect or impair the value or use or development of other property.
